SC To Pronounce Judgement On Pleas Challenging Abrogation Of Article 370 Today

The Constitution bench of the Supreme Court will pronounce its verdict on a batch of petitions challenging the abrogation of Article 370 and bifurcation of the erstwhile state of Jammu and Kashmir into two Union territories on Monday (December 11).

Five-judge constitution bench comprising Chief Justice of India DY Chandrachud, Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant will pass the judgement today.

On September 5, the apex court reserved the judgement after hearing the arguments for 16 days.

The central government had defended its decision to abrogate Article 370, saying there was no “constitutional fraud” in repealing the provision that accorded special status to the erstwhile state of Jammu and Kashmir.

Attorney General R Venkataramani and Solicitor General Tushar Mehta appeared for Centre.

The Centre had told the bench that Jammu and Kashmir was not the only state whose accession to India was through instruments of accession, but many other princely states that too had joined India post-independence in 1947, with conditionalities and after their merger, their sovereignty was subsumed in the sovereignty of India.

At the time of independence in 1947, the majority of the 565 princely states were in Gujarat and many had conditions relating to taxes, land acquisition and other issues, the central government told the bench.

The Centre had also submitted that the status of Jammu and Kashmir as a Union Territory is only temporary and it will be restored to statehood; however, Ladakh would remain a Union Territory.

Senior advocate Kapil Sibal, appearing on behalf of the petitioners, had opened the arguments, saying Article 370 was no longer a “temporary provision” and had assumed permanence post the dissolution of the Constituent Assembly of Jammu and Kashmir.

He had contended that the Parliament could not have declared itself to be the legislature of J-K to facilitate the abrogation of Article 370, as Article 354 of the Constitution does not authorise such an exercise of power.

Highlighting that the express terms of clause 3 of Article 370 show that a recommendation from the Constituent Assembly was essential to removing Article 370, Sibal had argued that in the wake of the dissolution of the Constituent Assembly, whose recommendation was required to abrogate Article 370, the provision could not be revoked.

The Jammu and Kashmir High Court Bar Association had told the Supreme Court that while acceding to India, the Maharaja of Jammu and Kashmir acceded to his sovereignty over the territory of the state but not his sovereign power to rule and govern the state.

The accession of Jammu and Kashmir to India was territorial and except for defence, external affairs and communication, all the powers were retained with the state to make laws and govern, said senior advocate ZA Zafar, appearing for the J-K High Court Bar Association.

The Central government had defended its decision to abolish Article 370 in Jammu and Kashmir, saying that after the changes, street violence, which was engineered and orchestrated by terrorists and secessionist networks, has now become a thing of the past.

Since 2019, when Article 370 was abrogated, the entire region has witnessed an “unprecedented era of peace, progress and prosperity,” the Centre said.

After the abrogation of Article 370 in Jammu and Kashmir, life has returned to normalcy there after three decades of turmoil, the Centre, in its affidavit, told the Supreme Court.

The Constitution Bench was hearing a batch of petitions challenging the abrogation of Article 370 of the Constitution and bifurcating the state into two Union Territories.

Several petitions were filed in the top court, including those of private individuals, lawyers, activists, politicians and political parties challenging the Jammu and Kashmir Reorganisation Act, 2019, which splits Jammu and Kashmir into two Union Territories: Jammu and Kashmir and Ladakh.

On August 5, 2019, the Central government announced the revocation of the special status of Jammu and Kashmir granted under Article 370 and split the region into two union territories. (ANI)

ASI To File Gyanvapi Survey Report In Court Today

The report of the scientific survey of the Gyanvapi mosque conducted by the Archaeological Survey of India (ASI) is likely to be presented in the Varanasi court on Monday.

On the previous date, the court had given the ASI 10 days’ time on November 30 and ordered it to file the report within the “provided time.”

The Court had earlier asked it to submit its survey report by November 17. Later, ASI was granted time until November 28 to file its report.

The survey has been held for 100 days, during which the ASI has asked for several extensions. The survey had concluded almost a month ago and the ASI had sought extra time to file its report.

The last extension was on November 18, when the ASI asked for another 15 days. The court had allowed it 10 days. The ASI had been conducting the survey since August 4 on the mosque premises. It leaves out the Wuzukhana area, which has been sealed by the orders of the Supreme Court.

On November 2, the ASI told the court it had “completed” the survey but would need some more time to compile the report, along with the details of the equipment used in the survey.

The court had granted additional time till November 17 for submitting the document. The survey was ordered by a Varanasi court on July 21, following a petition by four women who sought permission to pray at the Shringar Gauri Shrine which is behind the western wall of the temple.

Earlier, in August this year, the Allahabad High Court allowed the Archaeological Survey of India to conduct a survey of the Gyanvapi mosque complex in Varanasi. (ANI)

Vishnu Deo Sai Selected As Chhattisgarh New Chief Minister

Tribal leader and former Union Minister Vishnu Deo Sai is the Bharatiya Janata Party’s (BJP) pick as the new Chief Minister of Chhattisgarh.

BJP leader and Union Minister Renuka Singh Saruta said, “I am very happy that Vishnu Deo Sai will be the Chief Minister of Chhattisgarh. This is the first time a party worker from the tribal community belonging to a farmer’s family has been elected as the CM…”

Sai won the recently concluded assembly polls from Kunkuri in north Chhattisgarh, a region the BJP has swept.

Sai is a prominent figure in the BJP and has held various positions, including being the former state chief and former union minister.

Sai hails from the influential Sahu (Teli) community which has a sizable presence in the Durg, Raipur and Bilaspur divisions.

He served as State President of the party for Chhattisgarh from 2020 until 2022. He was the Union Minister of State for Mines, Steel in the first PM Modi cabinet. He is highly regarded among tribal voters.

Earlier, BJP central observers Sarbananda Sonowal and Arjun Munda held a meeting in Raipur.

The polling in the state was held in two phases, with the first on November 7 featuring 223 candidates and the second seeing 958 candidates put their electoral fates to the test on November 17.

Of the 90 assembly constituencies in Chhattisgarh, the BJP bagged 54 while the Congress won 35. (ANI)

Telangana CM Revanth Reddy Meets KCR In Hospital

Telangana Chief Minister Revanth Reddy on Sunday met former CM and Bharat Rashtra Samithi Chief K Chandrashekar Rao at Yashoda hospital.

KCR underwent total left hip replacement surgery after he fell in his farmhouse in Erravalli, on December 7.

Earlier, Yashoda Hospital, where Telangana former Chief Minister K Chandrashekar Rao is hospitalised has said that the latter has a left hip fracture and would require left hip replacement that may take 6-8 weeks to recover.

“Kalvakuntla Chandrashekhar Rao Garu had a slip and fall in his Bathroom at his Residence and was subsequently brought to Yashoda Hospital for further care. On evaluation, including CT scans he was found to have a left Hip fracture (Extracapsular Neck of femur fracture). He would require left hip replacement for the same and the usual course of recovery for such cases is expected to be six to eight weeks,” the hospital said in a statement.

“He is being constantly monitored by a multi-disciplinary team including Orthopaedic, Anaesthesia, General Medicine, and Pain Medicine. His general condition is stable. The hospital will update his health status periodically,” it added.

Meanwhile, on the direction of Telangana CM Revanth Reddy, Secretary of Health Medical and Family Welfare visited Yashoda Hospital to inquire about the health of former CM K Chandrashekar Rao.

Prime Minister Narendra Modi prayed for his recovery while his daughter K Kavitha had said that the former Telangana CM sustained a minor injury.

“Distressed to know that former Telangana CM KCR Garu has suffered an injury. I pray for his speedy recovery and good health,” PM Modi said in a post on X.

K Kavitha also had posted on X and said that former Telangana CM KCR sustained a minor injury and is currently under expert care.

“BRS supremo KCR Garu sustained a minor injury and is currently under expert care in the hospital. With the support and well wishes pouring in, Dad will be absolutely fine soon. Grateful for all the love,” K Kavitha posted on X. (ANI)

After the Bahujan Samaj Party (BSP) supremo and former chief minister Mayawati named her nephew, Akash Anand, as her successor going into the Lok Sabha elections next year, party leader Chaudhary Sheeshpal Singh on Sunday said ‘Behenji’ has shifted focus to the crucial poll battle in 2024 and the move is a step in that direction.

Speaking to ANI on Sunday, Singh weighed in on the big takeaway from the BSP meet chaired by Mayawati saying, “At the meeting, she (Mayawati) said Akash Anand is her only successor, as the leaders whom she entrusted with key responsibilities failed to deliver the goods. I think he (Akash) will prove to be a great leader going forward. As of now, he has been assigned to lift the morale of our cadre in states where we are on a weaker footing. Following in the same path that took us to a win in 2007, Behenji asked us to unite every member of the Bahujan community and fight the Lok Sabha elections with full strength. It was also decided at the meeting that the party will observe Bejenji’s birthday, henceforth, as Public Welfare Day.”

Another BSP leader, Udayveer Singh, said Mayawati’s successor will direct his efforts in states other than Uttar Pradesh and Uttarakhand.

“With Akash Anand being declared as her successor, we will now strive to project Behenji as a Prime Ministerial face. He (Akash) will be assigned responsibilities in states where we are not on a strong footing. He will not be working in Uttar Pradesh and Uttarakhand but elsewhere where our cadre need a morale boost. He will take care of party affairs when Behenji is away. At the meeting, she asked us to plunge headlong into the preparations for the next Lok Sabha elections. Everyone will have to take responsibility,” he said.

The BSP supremo chaired the party meeting at its Lucknow office on Sunday, with an eye on the next Lok Sabha elections.

The meeting came a day after the BSP chief suspended Lok Sabha MP Danish Ali for ‘anti-party activities’.

However, Ali had denied the allegations, stating that he never indulged in anti-party activities.

The party, earlier, on Saturday, wrote to the MP informing him of his suspension for 6 years.

One Arrested In Rajput Karni Sena Chief Murder Case

Jaipur Police have arrested Ramveer Singh, a resident of Mahendragarh, Haryana, in connection with the murder of Rashtriya Rajput Karni Sena chief Sukhdev Singh Gogamedi.

Jaipur Police Commissioner Biju George Joseph said that one of the accused, Ramveer (23), a resident of Sureti Pilaniyan in Sattanali district of Haryana’s Mahendragarh, was among the conspirators of the Sukhdev Singh Gogamedi murder case. He was arrested on Saturday (December 9).

On December 5, Sukhdev Singh Gogamedi was murdered by two shooters, Nitin Fauji and Rohit Rathod, in an indiscriminate firing at his residence in Shyam Nagar and arrangements were facilitated for Nitin Fauji by the accused Ramveer Singh in Jaipur, said the Jaipur Police Commissioner in an official statement.

Additional Police Commissioner Kailash Chandra Bishnoi said, “Accused Ramveer is a close friend of shooter Nitin Fauji. Ramveer and Nitin Fauji lived in neighbouring villages and both studied together in class 12th in a school in Mahendragarh. After passing 12th, Nitin Fauji joined the army in the year 2019-20. Whereas Ramveer has studied B.Sc. from Wilfred College, Mansarovar Jaipur in the year 2017 to 2020 and M.Sc. (Mathematics) from Vivek PG College, Kalwad Road, Jaipur in the year 2021 to 2023. Ramveer went to the village after giving the final paper of his MSc in April 2023. Nitin had come on military leave.”

He further said that on November 9, Nitin Fauji and his associates fired on the police of Mahendragarh Police Station Sadar and absconded. During this period, Nitin Fauji sent his friend Ramveer to Jaipur on November 19.

Bishnoi further said, “Ramveer arranged a hotel for Nitin Fauji in Jaipur and after the incident took Nitin Fauji and Rohit Rathore on a motorcycle from Ajmer Road and escorted them in a Rajasthan Roadways bus from Nagaur depot ahead of Bagru toll plaza. Accused Ramveer has been arrested from his house after interrogation.”

Ramsingh Shekhawat Additional Deputy Commissioner of Police (West), Shyam Sundar Singh ACP Sodala, Chandra Prakash Police Station incharge Cyber Crime, Arvind Charan PN Police Station incharge Shyam Nagar, Rakesh Jhajharian (Constable) Cyber Cell Commissionerate and the team are investigating the accused Ramveer Singh and other suspected accused.

Earlier, Rajasthan Police on Wednesday identified two shooters who they said were involved in the killing. The two assailants were identified as Rohit Rathore Makrana and Nitin Fauji, the state police informed, adding that the latter is a resident of Mahendragarh in Haryana.

The third assailant, Naveen Shekhawat, was killed at Gogamedi’s residence during the exchange of fire with the police. One of Gogamedi’s security guards was injured in the crossfire, police informed.

On Wednesday, two police personnel, including the station house officer (SHO), were suspended following the brazen murder in Jaipur. (ANI)

BSP Suspends Danish Ali For Anti-Party Activities

The Bahujan Samaj Party (BSP) suspended MP Danish Ali on Saturday for engaging in anti-party activities.

The party, earlier in the day, wrote a letter to MP Danish Ali.

“You have been told several times not to comment or act, which goes against the policies, ideologies, and discipline of the party. Despite this, you have been acting against the party,” the letter read.

“It is important to remind you that till 2018, you were working as a member of Dewe Gowdaji’s Janata Party and actively participated in the Karnataka assembly polls, which were fought by the BSP and the Janata Party together in an alliance. After the results of the Karnataka assembly polls, you were given the ticket as a BSP candidate from the Amroha assembly constituency at the request of Dewe Gowdaji. Before this, Dewe Gowdaji had assured that you would follow all the policies and directions given by the party and act in tune with the interests of the party. You also repeated the same,” it added.

“However, having forgotten the assurance, you are swamped with anti-party activities. Hence, you are suspended from the membership of the party in the interest of it, with an immediate effect”, it further said.

Ali is a Lok Sabha MP from Uttar Pradesh’s Amroha.

Earlier, BJP MP Ramesh Bidhuri’s derogatory remarks against Danish Ali in the Lok Sabha triggered a huge political firestorm with the BSP member threatening to quit Parliament if action was not taken against Bidhuri.

The entire opposition also extended its support to Ali as some called the comments “hate speech”.

Several opposition MPs condemned Bidhuri’s statement, calling it ‘shameful’ and ‘derogatory’. BSP Chief Mayawati also came out in support of her party MP.

A few BJP members had also accused Danish Ali of making a running commentary during his speech. BJP MP Nishikant Dubey had accused the BSP MP of instigating Bidhuri and making “derogatory remarks” against Prime Minister Narendra Modi.

Meanwhile, BJP MP Ramesh Bidhuri and BSP’s Danish Ali presented their arguments on Thursday before the Privileges Committee of the Lok Sabha, which is looking into complaints of “abusive” and inappropriate remarks during a discussion in the special session of Parliament. (ANI)

Jaishankar Speaks To Palestine PM, Reiterates India Position

External Affairs Minister S. Jaishankar held talks with Palestinian Prime Minister Mohammad Shtayyeh on Saturday. Jaishankar reiterated India’s long-standing position on Palestine.

During the telephonic conversation, Mohammad Shtayyeh expressed deep concern on the situation in Gaza and the West Bank. The two leaders agreed to remain in touch.

Taking to X, Jaishankar stated, “Spoke to Palestinian Prime Minister Mohammad Shtayyeh this evening. He expressed deep concern on the situation in both Gaza and the West Bank. Reiterated India’s long-standing position on Palestine. Agreed to remain in touch.”

India’s position regarding the Palestine issue has been “longstanding and consistent,” Ministry of External Affairs Arindam Bagchi said in a press briefing on October 12.

Arindam Bagchi said, “India has always advocated the resumption of direct negotiations towards establishing a sovereign, independent and viable state of Palestine living within secure and recognised borders side by side at peace with Israel. That position remains the same.”

Earlier in October, Prime Minister Narendra Modi spoke to the President of the Palestinian Authority, Mahmoud Abbas and expressed his condolences over the loss of lives at Al Ahli Hospital in Gaza.

PM Modi also reaffirmed India’s commitment to provide the Palestinian people with humanitarian assistance while reiterating India’s long-standing principled position on the Israel-Palestine issue.

“Spoke to the President of the Palestinian Authority H.E. Mahmoud Abbas. Conveyed my condolences at the loss of civilian lives at the Al Ahli Hospital in Gaza. We will continue to send humanitarian assistance for the Palestinian people,” posted PM Modi on X.

Notably, the fighting between Israel and Hamas in Gaza continues, as the Israel Defence Forces said its 98th Division continues to fight with Hamas in Gaza’s Khan Younis. The Israeli Air Force carried out strikes on the sites of the terror group, The Times of Israel reported.

According to the IDF, troops of the Golani Infantry Brigade’s 12th Battalion raided a mosque in the Khan Younis area, where Hamas operatives were present, according to The Times of Israel report. The IDF said an explosive device was detonated near the forces and soldiers directed an attack helicopter to carry out a strike against Hamas operatives on the roof of the mosque.

The IDF said that an IAF fighter jet destroyed the mosque along with the tunnel infrastructure under it. Meanwhile, the elite Maglan unit identified three Hamas operatives coming out of a tunnel shaft in central Khan Younis and firing RPGs at the troops, according to IDF.

The IDF said Maglan troops also conducted drone strikes on additional Hamas operatives and tunnel shafts in the area. The IDF said that the elite Duvdevan unit found a Hamas command room, which was used by terrorists to attack soldiers, according to The Times of Israel report.

According to IDF, the Duvdevan soldiers conducted an assault on the building, and an IAF fighter jet conducted strikes on another Hamas cell in the area. The IDF said troops of the Givati Infantry Brigade killed a number of Hamas operatives and found numerous tunnel shafts in southern Gaza. (ANI)

Biden’s Approval Ratings Hit New Low In Hypothetical Polls

In the run-up to the US presidential polls, a new national Wall Street Journal poll has placed former President Donald Trump ‘narrowly ahead’ of President Je Biden in a hypothetical 2024 rematch, CNN reported.

It is pertinent that Biden’s approval currently stands only at 37 per cent among registered voters, according to the poll.

In a choice between Trump and Biden, 47 per cent of registered voters in the US currently say that they would be supporting Trump while 43 per cent say that they would be backing Biden, while a tenth (around 10 per cent) still remain undecided.

As per the new polls, Biden has been weighed down by relatively soft support among “disaffected Democrats.”

Registered voters’ presidential preference differs across several other scenarios included in the survey, highlighting the degree to which voters’ intentions remain fluid at this very early stage of the race, according to CNN.

The results are similar to other recent national polls, which have largely either found a close race with no leader or have given Trump a narrow advantage.

The Wall Street Journal poll finds Biden maintaining only 87 per cent of his 2020 supporters, compared with the 94 per cent of 2020 Trump voters who say they would back the Republican now, CNN reported.

“Voters who are undecided on the presidential race lean Democratic in other survey questions, suggesting that they could be persuaded to back Biden nearly a year from now,” the Journal noted.

Notably, when voters are prompted to think of a hypothetical scenario in which Trump is convicted of a felony in “either the classified documents or January 6th federal trials” prior to the election, they split almost evenly between the two candidates, with 46 per cent saying they would back Biden under those circumstances, and 45 per cent pushing their weight behind Trump.

Also, when potential third-party or independent candidates are included, Trump’s edge over Biden widens slightly.

In hypothetical matchups with two other potential Republican nominees, Biden ties with Florida Governor Ron DeSantis (45 per cent DeSantis, 45 per cent Biden) but runs well behind former UN ambassador Nikki Haley (51 per cent Haley, 34 per cent Biden), according to CNN.

Meanwhile, the views of the national environment remain “unquestionably bleak”. Only 26 per cent of registered voters say the US has moved in the right direction on inflation over the past year. But, this number is up from 20 per cent who said the same in August.

The Wall Street Journal also looked at the upcoming GOP primary, finding Trump at 59 per cent among potential Republican primary voters nationally, with Haley and DeSantis effectively tied for a distant second place, at 15 per cent and 14 per cent respectively.

This is similar to other recent polling on the Republican primary, with most surveys giving Trump majority support among the potential GOP electorate nationally.

The poll was conducted on November 29 and December 4 among a random national sample of 1,500 registered voters. Results for the full sample of adults have a margin of sampling error of plus or minus 2.5 points, according to CNN. (ANI)
