Sanjay Singh Allowed To Visit Parliament Again To Take Oath

The Rouse Avenue Court of Delhi on Tuesday permitted Aam Aadmi Party (AAP) leader Sanjay Singh for the second time to go to Parliament in police custody and take oath as a Rajya Sabha MP. The court has allowed Singh to go to Parliament on February 8 or February 9.

Special Judge MK Nagpal while allowing Sanjay Singh’s application stated that on February 3, 2024, this court had directed the jail authorities to take the accused to Rajya Sabha under judicial custody for administration of oath as a member.

However, it has been submitted that though he was taken to the Rajya Sabha the oath could not be administered to him due to certain reasons and hence he is directed to be taken again to the Rajya Sabha on February 8 and February 9, 2024, said the Court.

The court further directed that the applicant shall be taken to Rajyasabha from judicial custody and under appropriate security for administration of oath on either of the above dates on which he may be required to visit for the above purpose. In this regard, the Jail superintendent is being directed to communicate with the Rajya Sabha Secretariat.

The Court has allowed Singh’s Lawyer to visit Tihar Jail to meet Sanjay Singh to take his signatures on relevant documents.

Advocates Rajat Bharadwaj and Mohd Irshad appeared for Singh in the matter and Special Public Prosecutor Naveen Kumar Matta appeared for the Enforcement Directorate.

It was submitted by the counsels for Singh that certain documents are required to be signed by the accused and these have to be submitted in the concerned office of Rajya Sabha so that the applicant can be called for administration of oath and the date will then be finalised by said office only.

On February 5, 2024, Sanjay Singh was not sworn in as Rajya Sabha MP as Rajya Sabha Chairman Jagdeep Dhankhar refused to allow him to take the oath and stated that proceedings of the Upper House are regulated by the listed business which is notified in the bulletin. Oath taking of Sanjay Singh wasn’t listed in the business of the House and no communication from Rajya Sabha on this matter ever came for consideration.

Singh was arrested by the Enforcement Directorate in a money laundering case linked to the now-scrapped Delhi excise policy.

Last week, the Delhi High Court kept the order reserved on a regular bail plea moved by Singh in Delhi’s Excise policy case. He was arrested by the Enforcement Directorate on October 4, 2023, in the case.

In its reply filed by ED in the bail matter, the probe agency has opposed the bail petition of Aam Aadmi Party leader Sanjay Singh and alleged that he was involved in creating a special purpose vehicle to launder the proceeds of crime that would have been generated from the business arising out the policy changes as conspired by him and his co-conspirators.

Sanjay Singh was then involved in acquiring, possessing, concealing, dissipating and using proceeds of crime generated from the Delhi Liquor Scam pertaining to the policy period of 2021-22, said ED. (ANI)

My Facebook Account Has Been Hacked: Sibal

Rajya Sabha MP Kapil Sibal said on Sunday that his Facebook account has been hacked for the last 10 days.

“My Facebook account has been hacked for the last 10 days,” Sibal said in a post on ‘X’.

Earlier in November, the Rajya Sabha MP hit out at the central government after Opposition party leaders received an ‘Apple warning message’ claiming a privacy breach attempt on their devices.

“The government itself has people who are compulsive wrongdoers. Why talk of the opposition? Everything that this government has done since it came to power has been contrary to the Constitution. Actually, they have subverted every provision of the Constitution. People belonging to the BJP, against whom serious cases are pending, are out on bail. This is a complete misuse of the system,” Kapil Sibal told ANI.

Several political leaders also reported receiving alerts from Apple in November. Congress national president Mallikarjun Kharge and party’s General Secretary organisation KC Venugopal, Congress’ Pawan Khera, Shashi Tharoor, Shiv Sena MP Priyanka Chaturvedi, Trinamool MP Mahua Moitra, BRS working president KT Rama Rao and AAP MP Raghav Chaddha are among others who reported receiving alert messages from Apple.

The leaders of the opposition parties have alleged that the government was behind the attempt to breach their devices. The leaders also shared screenshots of the warning received on their devices.

After a major controversy erupted between the ruling party and the opposition leaders over the alleged hacking of their phones, Apple officially announced that it does not attribute the threat notifications to any specific state-sponsored attacker.

“State-sponsored attackers are very well-funded and sophisticated, and their attacks evolve over time. Detecting such attacks relies on threat intelligence signals that are often imperfect and incomplete. It’s possible that some Apple threat notifications may be false alarms or that some attacks are not detected,” Apple said in a statement. (ANI)

RS Suspends 45 MPs In A Day

In the biggest ever action in the history of Parliamemt in a day, the Rajya Sabha on Monday suspended 45 Opposition MPs for their “misconduct” during proceedings of the House.

Of the 45 suspended MPs, 34 have been suspended for the remainder of the Winter Session, which concludes on December 22, while 11 have been suspended until the reports of the Rajya Sabha’s Committee of Privileges is not received.

As per Rajya Sabha Secretariat sources, “this is the biggest ever suspension in the history of Rajya Sabha, when 45 legislators were suspended in a day.”

Those suspended for the remainder of the Winter Session are Congress’s Pramod Tiwari, Jairam Ramesh, Amee Yajnik, Naranbhai J. Rathwa, Syed Nasir Hussain, Phulo Devi Netam, Shaktisinh Gohil, KC Venugopal, Rajani Ashokrao Patil, Ranjeet Ranjan, Imran Pratapgarhi and Randeep Singh Surjewala; TMC’s Sukhendu Sekhar Ray, Mohammed Nadimul Haque, Abir Ranjan Biswas, Santanu Sen, Mausam Noor, Prakash Chik Baraik and Samirul Islam; DMK’s M Shanmugam N R Elango, Kanimozhi NVN Somu and R Girirajan; Rashtriya Janata Dal’s Manoj Kumar Jha and Faiyaz Ahmad; CPI (M’s) V Sivadasan; JDU’s Ram Nath Thakur and Aneel Prasad Hegde; NCP’s Vandana Chavan; Samajwadi Party’s Ram Gopal Yadav, Javed Ali Khan; Jharkhand Mukti Morcha’s Mahua Maji; Kerala Congress (M) MP Jose K Mani; and Independent legislator Ajit Kumar Bhuyan.

Besides, those 11 MPs suspended and their names sent to the Rajya Sabha Committee of Privileges are Congrrss’s Jebi Mather Hisham, L Hanumanthaiah, Neeraj Dangi, Rajmani Patel, Kumar Ketkar and G C Chandrashekhar; CPI’s Binoy Viswam, Sandosh Kumar P; DMK’s M Mohamed Abdulla; and CPI (M) legislators John Brittas and AA Rahim.

So far, a total of 46 MPs from Rajya Sabha have been suspended in this Winter Session of the Parliament. TMC’s Derek O’Brien was suspended last week and his name was also sent to the Committee of Privileges.

Those names referred to the Privileges Committee, which has been asked to give its report in three months, will be suspended until the report is submitted by the panel to the House.

The fresh action of the Rajya Sabha came hours after 33 members were suspended from the Lok Sabha for “misconduct” for the remainder of the monsoon session.

After the motion for suspension was adopted by the House, the Chairman asked the suspended members to leave the precincts.

He then adjourned the House for the day.

The motion for the suspension of MPs was moved by Rajya Sabha leader of the House, Piyush Goyal.

The suspension was announced soon after the Rajya Sabha assembled at 4.30 pm following various other adjournments since morning as the MPs trooped into the well of the House and kept on sloganeering, which led to disruption of proceedings. (ANI)

BJP MP Meena Introduces UCC Bill In RS

Bharatiya Janata Party (BJP) Rajya Sabha MP Kirodi Lal Meena on Friday introduced the ‘Uniform Civil Code in India Bill, 2020’ in the Upper House.

BJP Rajya Sabha MP presented the highly discussed Bill during private members’ business, while Vice President Jagdeep Dhankhar was ex-officio chairman, with an aim to carry forward the BJP’s promise to implement the Uniform Civil Code in the country.
The Uniform Civil Code is a proposal in India to formulate and implement personal laws of citizens which apply to all citizens equally regardless of their religion, sex, gender, and sexual orientation.

Currently, the personal laws of various communities are governed by their religious scriptures.

The code comes under Article 44 of the Constitution which lays down that the state shall endeavour to secure a Uniform Civil Code for the citizens throughout the territory of India.

Notably, in BJP’s 2019 Lok Sabha election manifesto, the party promised the implementation of UCC if it came to power.

The Winter Session of the Parliament began on December 7 and will have 17 working days.

The government plans to introduce a total of 16 new Bills during the session according to the notified schedules. (ANI)
