SC Rejects Bail Plea Of Jain In Money Laundering Case

The Supreme Court on Monday rejected the bail plea of former Delhi Minister Satyendar Jain in the money laundering case, asking him to surrender forthwith.

A bench of Justice Bela M Trivedi and Justice Pankaj Mithal dismissed the appeal filed by Jain.

The court also rejected the bail plea of the other two co-accused Ankush and Vaibhav Jain.

On May 26, Satyendar Jain was granted interim bail for six weeks on medical grounds and later it was extended from time to time.

Additional Solicitor General SV Raju, appearing for the Enforcement Directorate (ED), had taken court through concurrent findings of the trial court and high court and other details related to the case.

Countering the ED submission, Senior Advocate Abhishek Manu Singhvi, appearing for Jain, had said that his client had been incarcerated for a year. He also remarked that probe agencies are trying to convert an income tax case into a money laundering matter.

The Senior Advocate urged the top court to grant bail to Jain saying that he is not a flight risk and threat to witness. The senior advocate also said that this is a matter of life and liberty for Jain.

The Enforcement Directorate has opposed the bail plea of former Delhi Minister Satyendar Jain and had submitted before the top court that whenever he wants to be out of jail he moves bail on medical grounds and, stays in hospital. Whenever there is an argument on the bail in the court, he falls down, which is a strange coincidence. However, Jain’s counsel called the submission baseless.

Meanwhile, the hearing on Jain’s bail witnessed many twists and turns in December 2023, as Chief Justice of India DY Chandrachud explained why the matter was listed before a different combination of bench as there was a matter relating to the extension of bail.

CJI also mentioned the communication received from Justice AS Bopanna to take up part heard matter from him because he would not be able to hear the matter due to medical reasons.

Earlier, Jain’s bail plea was partly heard by a bench of Justices AS Bopanna and Bela M. Trivedi. Later, the matter was listed before a bench of Justice Trivedi and Justice Satish Chandra Sharma.

Jain underwent surgery on July 21 last year. The interim bail given to Jain on medical grounds was extended from time to time.

The ED case is based on a Central Bureau of Investigation (CBI) complaint registered on the allegation that Satyendar Jain had acquired movable properties in the name of various persons from February 14, 2015, to May 31, 2017, which he could not satisfactorily account for. (ANI)

SC Extends Satyendar’s Interim Bail Till Nov 24

The Supreme Court on Monday extended the interim bail granted to AAP leader Satyendar Jain till November 24 in a money laundering case.

A bench comprising Justice A.S. Bopanna and Justice Bela M. Trivedi extended the interim relief granted to Jain while adjourning the hearing of the bail plea till the next date of hearing.

Meanwhile, Jain’s counsel, Senior Advocate AM Singhvi, pressed for his bail. Jain underwent surgery on July 21. The interim bail given to Jain on medical grounds is extended from time to time.

During arguments in the High Court, Additional Solicitor General SV Raju appearing for the Enforcement Directorate, contented that money laundering is crystal clear against Jain and other co-accused. In his bail plea, Jain stated, “I appeared before the ED on seven occasions. I have cooperated and participated in the investigation. I was arrested five years down the line in 2022.”

On November 17, 2022, the trial court dismissed the bail petition of Satyendar Jain. He was arrested on May 30, 2022, under sections of the Prevention of Money Laundering Act (PMLA) by the Enforcement Directorate.

SC Grants Interim Bail To Jain On Medical Grounds

The Supreme Court on Friday granted interim bail to former Delhi minister and Aam Aadmi Party (AAP) leader Satyendar Jain for six weeks in a money laundering case.

The court also imposed various conditions including neither talking with the media nor leaving Delhi without permission.
A bench of Justices JK Maheshwari and PS Narasimha granted interim bail to Jain till July 11 and directed him not to influence witnesses in the matter.

The SC directed that all relevant papers of treatment be produced before this court. The top court said that the order will remain in operation till July 11 and listed the matter for July 10 for further hearing.

The top court also gave Jain to choose any hospital of his choice for his medical treatment. The top court made it clear that interim bail is considered on medical conditions.

Senior Advocate AM Singhvi, appearing for Jain, said that they are seeking bail due to health reasons.

ASG SV Raju, appearing for the Enforcement Directorate (ED) sought Jain to be examined by a panel of doctors either by AIIMS or Ram Manohar Lohia Hospital. He also informed the SC that he was the Health Minister and that government hospitals were under him.

Last week, the top court asked ED to file a reply on Satyendar Jain’s plea seeking bail in a money laundering case and also granted liberty to Jain to move vacation bench of the top court for an early hearing on his plea challenging Delhi High Court order dismissing his bail plea in the money laundering case against him.

Jain Hospitalised After Falling In Tihar Jail Bathroom

Former Delhi Minister Satyendar Jain has been hospitalised after he slipped and fell in the bathroom at Delhi’s Tihar Jail, officials said on Thursday.

Jain, who has been detained in Tihar Jail since last year, has been admitted to the Deen Dayal Upadhyay Hospital with minor injuries.
“This morning around 6 am, under trial prisoner (UTP) Dr Satendra Jain slipped and fell in the bathroom of the Medical Inspection (MI) room of the hospital of Central Jail (CJ-7), where he was kept under observation for general weakness,” as per an official statement from the prison officials.

According to officials, Jain was examined by doctors and his vital organs were found to be normal.

“He was further referred to DDU Hospital as he complained about back, left leg and shoulder pain,” said an official statement from prison officials.

On Monday, the former AAP minister Jain was taken to Safdarjung Hospital after he complained of health issues.

AAP has claimed that Jain suffers from acute lumbar pain, causing vertigo and chronic lower back pain due to a slipped disc. The pain radiates throughout his lower limbs, leaving him with a constant tingling sensation and decreased mobility, the party said.

A recent MRI conducted on May 3 demonstrates degeneration in all intervertebral discs of Satyendar Jain leading the doctors to advise urgent spinal/vertebral surgery and proper post-operative care, read the AAP statement.

However, the AAP said, Jain has been placed as No 416 on a waiting list by Jail authorities and is expected to be able to undergo the surgery only after a further five months.

Earlier this month, on May 15, Jain had moved a plea in the Supreme Court, seeking bail in the alleged money laundering case against him. He has challenged the Delhi High Court’s order dismissing his bail plea in the alleged case.

Jain was arrested on May 30, 2022, under sections of the Prevention of Money Laundering Act (PMLA) by Enforcement Directorate and is presently in Judicial Custody in the case.

Tihar Jail SP Gets Notice After 2 Inmates Shifted To Jain’s Cell On Ex-Minister’s Request

The jail administration has issued a show-cause notice to the superintendent of Tihar jail no. 7 for shifting two men to the cell of former Delhi minister and Aam Aadmi Party’s jailed leader Satyendar Jain on the latter’s request.

This comes after Jain had written an application from inside the Tihar Jail, requesting the prison administration to lodge him with two more inmates in the cell.
Citing the depression and loneliness, he is suffering from, the Jain on May 11, requested the superintendent of Tihar jail no. 7 to lodge two more persons with him, an official of Tihar Jail said.

“Jain in his application said he is feeling depressed and low because of loneliness. A psychiatrist suggested him for more social interactions and he requested to lodge him with at least two more persons. He also provided two persons’ names, from the same ward no. 5,” the official said, adding that immediately his request was accepted and two persons were moved to his cell.

However, the jail administration along with the show-cause notice sent the AAP leader’s fellow inmates back to their cell.

According to the jail administration, the superintendent took this decision without informing the administration, whereas, as per the procedure, no inmate can be moved and transferred to another cell without informing the administration and taking permission.

Jain has been lodged inside Tihar Jail since June, last year.

Earlier in November, last year, a CCTV footage went viral and the AAP leader was seen having a full-body massage from inside the prison.

The Enforcement Directorate (ED) had initiated a money-laundering investigation on the basis of the First Information Report registered by the Central Bureau of Investigation (CBI) on August 24, 2017, under several sections of the Prevention of Corruption Act, 1988 against Satyendar Jain, Poonam Jain, Ajit Prasad Jain, Sunil Kumar Jain, Vaibhav Jain and Ankush Jain.

The CBI filed a chargesheet on December 3, 2018, against Satyendar Kumar Jain, Poonam Jain, Ajit Prasad Jain, Sunil Kumar Jain, Vaibhav Jain and Ankush Jain.

The charge sheet mentions that Satyendar Jain while holding the office as a Minister in the Government of Delhi, during the period February 14, 2015, to May 31, 2017, had acquired assets which are disproportionate to his known sources of income.

The CBI has accused Satyendar Kumar Jain and others for the commission of offences under the Prevention of Corruption Act, 1988.

Jain was arrested after the ED in April this year attached immovable properties worth Rs 4.81 crore owned by companies named Akinchan Developers Pvt. Ltd, Indo Metal Impex Pvt Ltd, and others under the Prevention of Money Laundering Act, 2002 in connection with the disproportionate asset and money laundering case registered Jain, his wife Poonam Jain, and others. Jain’s Jail Luxury Continues: House-keeping service In His Cell

The latest video that has emerged in a series of purported CCTV footage of Delhi Minister Satyendar Jain inside the Tihar jail, shows house-keeping services being provided to the jail cell of the Aam Aadmi Party leader.

The purported footage that emerged according to the sources on Sunday morning was dated September 13, 15 and October 1 in which the visuals show men sweeping the floor of the jail cell and also arranging the Minister’s bed. In the visuals dated September 12, Jain was seen interacting with other people inside his jail cell.
This is ostensibly the fourth CCTV footage that has emerged relating to the jail Delhi Minister. The first purported visuals, which appeared on November 19, showed the Minister getting a full body massage. The second purported footage surfaced on November 23, a day after Jain’s counsel claimed inside the trial court that the Minister had lost 28 kg of weight during his custody. In the footage, Jain was seen having an elaborate and extensive meal. Interestingly, sources had said that the Minister had gained 8 kg weight instead.

In the third purported footage that came out on November 26, the Minister was seen having a conversation with some people, including currently suspended Jail superintendent Ajit Kumar.

Earlier on Saturday, Bharatiya Janata Party (BJP) national spokesperson Shehzad Poonawalla slammed AAP over the November 26 video of Jain and termed it as “AAP ka darbar of Bhrashtachar”.

Shehzad said this was the third video in the series — first AAP made a ‘spa’ in Tihar where Delhi’s health minister Satyendra Jain got a ‘maalish’ from a child rapist and AAP labelled it as physiotherapy.

Then he was served 5-course meal but he claimed he was being starved.

Now a video shows how he was allowed to hold a “darbar” inside jail, he added.

Slamming Delhi chief minister and AAP supremo Arvind Kejriwal, Poonawalla asked whether Jain was kept as a minister despite getting no relief from courts so that he could do “Vasooli” and can also get VIP maalish?

The BJP leader demanded that Satyendra Jain be sacked and Kejriwal should apologise to the entire nation for defending a child rapist as a therapist and insulting physiotherapy.

Earlier on November 22, Shehzad Poonawalla alleged that Arvind Kejriwal and Delhi’s Deputy CM Manish Sisodia were aware of Satyendar Jain getting a massage in jail after a video of the minister had surfaced.

“The whole matter was in the knowledge of Arvind Kejriwal and Manish Sisodia, but they are trying to fool the people that this was physiotherapy being done by a rapist,” Shehzad Poonawalla had said while talking to ANI.

Poonawalla had said that the person whom Kejriwal and Sisodia were passing off as a physiotherapist was actually a potential rapist and that too a rapist of young children who is involved in cases and the section 376 of IPC under the POCSO Act.

Poonawalla had said that this shows that Arvind Kejriwal and Manish Sisodia were not just passing off physiotherapy but actually defending “corruption therapy”. (ANI)

Tihar Jail Supt Among Others Seen Interacting With Jain

Fresh CCTV footage of jailed Delhi minister Satyendar Jain has emerged from Tihar Jail in which the Aam Aadmi Party leader is seen in conversation with some people, including the Jail superintendent Ajit Kumar who is currently under suspension.

In the purported videos sourced from Tihar Jail, Jain can be seen lying on his bed and Ajit Kumar is seated on a chair nearby while the pair apparently seem to be having a conversation. Kumar was suspended as Tihar Jail Superintendant on November 14 for allegedly providing special treatment to the Delhi minister.
At the beginning of the footage from earlier this September, the Delhi minister is seen interacting with several people who leave before Ajit Kumar enters Jain’s cell.

BJP spokesperson Shehzad Poonawalla tweeted the footage and posted on his Twitter account, “Yet another video of Tihar put out by the media. This time the Satyendar ka darbaar has a Jail superintendent who has now been suspended.”

“After maalish by child rapist & Nawabi meal now this! This is corruption therapy of AAP but Kejriwal ji defends this! Will he sack SJ now?,” Shehzad Jai Hind’s Twitter handle tweeted.

The new CCTV footage came after the Tihar Jail Superintendent was suspended for allegedly providing special treatment to jailed Jain.

Meanwhile, earlier on November 23, Jain had filed an application in a Delhi court seeking direction to restrain all media organizations from airing, broadcasting, or publishing any CCTV clip related to him.

The plea stated that all the national media are regularly running CCTV footage of Satyendar Jain. A parallel media trial is going against him, despite the present matter being examined by this court, argued senior advocate Rahul Mehra who appeared for Jain.

Two days back, a video emerged showing Jain having an elaborate meal inside. Jain was seen having food including fruits and dry fruits.

The video of having a meal came out just a day after footage of the minister receiving an oil massage inside his jail cell trigged an uproar.

Tihar Jail sources also said that the Delhi minister gained 8 kg weight during his time in jail, contrary to his lawyer’s claims of him having lost 28 kgs.

The new footage surfaced a day after Jain submitted before the trial court that he has not been getting privileges like proper food and medical check-up in Tihar Jail. He had also claimed that he lost 28 kg while being locked up in jail.

On Tuesday, the minister’s counsel Senior Advocate Rahul Mehra had alleged that Enforcement Directorate was leaking sensitive information to the media despite the order of the Court and undertaking given in this court.

Rahul Mehra also denied ED allegations of getting privileged treatment in Tihar Jail. He asked, “What privilege are they talking about?”

“I have lost 28 kg in jail. Is this what a privileged person in jail gets? I’m not even getting proper food. What privilege are they talking about? No prison rules are violated if an undertrial is pressing his hand or feet,” Jain said.

However, appearing for ED, advocate Zohaib Hossain denied the allegations made by Satyendar Jain’s lawyer and said that there is not a single leak from the Enforcement Directorate.

Purported videos of the minister getting a massage inside his cell in Tihar went viral on social media. The Aam Aadmi Party however asserted that Jain was receiving physiotherapy.

Sources reported on Tuesday that the person administering massage to Jain was not a physiotherapist, furthermore, he has been identified as a rape accused too.

Jailed Delhi Minister was being given a massage by an accused in a rape case, the official sources claimed on Tuesday.

The Tihar Jail official sources claimed that the prisoner, identified as Rinku, was “not a physiotherapist” and has been charged under the Protection of Children from Sexual Offences (POCSO) Act, 2012.

“The masseur providing massage to jailed Delhi min Satyendar Jain is a prisoner Rinku. He’s a prisoner in a rape case, charged u/s 6 of the POCSO Act and 376, 506 & 509 of IPC. He’s not a physiotherapist,” the sources claimed.

The purported CCTV footage dated September 13 shows the minister lying on his bed while a man seated next to him is seen massaging his foot.

Jain has been in jail since June. A Delhi court denied his bail application on November 16. (ANI)

Not Getting Proper Food, Medical, Have Lost 28 Kgs: Satyendar

Jailed Minister Satyendar Jain on Tuesday submitted before the trial court that he has not been getting privileges like proper food and medical check-up in Tihar Jail and has lost around 28 kg weight in custody.

Satyendar Jain’s counsel Senior Advocate Rahul Mehra alleged that Enforcement Directorate is leaking sensitive information to the media despite the order of this Court and undertaking given in this court.
“I am defamed every single minute by their act,” he said.

Rahul Mehra also denied ED allegations of getting privileged treatment in Tihar Jail. He asked, “What privilege are they talking about?”

“I have lost 28 kg in jail. Is this what a privileged person in jail gets? I’m not even getting proper food. What privilege are they talking about? No prison rules are violated if an undertrial is pressing his hand or feet,” said Satyendar Jain.

However, appearing for ED, Advocate Zohaib Hossain denied the allegations made by Satyendar Jain’s lawyer and said that there is not a single leak from the Enforcement Directorate.

“We will see that guilty are brought to justice,” the advocate said.

Advocate Zohaib submitted that they (Satyendar Jain and his advocates) were advised physiotherapy so he was taking it. Many officials of Tihar have been suspended so far. The LG has also initiated an inquiry. Transfers of some top officers also took place.

Zoheb Hossain further submitted that presuming a leak on our behalf is preposterous. There has been no leak and there will be no leak. The allegation of leaking information is already in the public domain.

Senior Advocate Rahul Mehra also submitted that they (agencies) have already put him on the gallows. “Even Ajmal Kasab got a free and fair trial,” he said.

“I am surely not worse than that. All I seek is a fair and free trial. Please look at the kind of media reports that are running against him and that is in their interest,” Mehra submitted to the Court.

Rahul Mehra also showed some screenshots of several prominent channels running reply copy content in this case. Mehra says the matter is already pending before this court but it’s again leaked.

Special Judge Vikas Dhull was hearing arguments on Satyendar Jain contempt plea against ED over the alleged leakage of footage from inside his jail cell to the media. The court after hearing the arguments listed the matter for November 28, 2022, for detailed arguments.

Court noted that Additional Solicitor General (ASG) SV Raju is leading the matter for ED, who is not present for personal reasons.

It was also informed to the court that multiple agencies are investigating how Tihar Jail was compromised for benefiting Satyendar Jain. The footage was also given to the counsel of Satyendar Jain. The primary source of footage was Tihar Jail, said the ED.

On Saturday, Satyendar Jain moved the special court with an application seeking contempt action against Enforcement Directorate. Jain’s legal team alleged that ED has leaked the CCTV video despite the undertaking given in the court. (ANI)

Bhagat Singh’s Relative Slams Kejriwal For comparing Sisodia With Freedom Fighter

Slamming Arvind Kejriwal for comparing his deputy Manish Sisodia and minister Satyendar Jain with Bhagat Singh, a close relative of the freedom fighter, Harbhajan Singh Dhath, on Monday asked the Delhi Chief Minister to “fight his fights politically”.

Dhath also asked Kejriwal to refrain from “equating” criminals with freedom fighters and suggested that he “concentrate” on the “miserable” condition of Punjab, where the Aam Aadmi Party was voted to power earlier this year with a thumping majority.
Kejriwal on Sunday had equated Sisodia who is facing a probe in the alleged excise policy case, and jailed minister Jain, with Bhagat Singh. “Jail bars and hanging noose could not deter Bhagat Singh’s resolute intentions. This is the second fight for freedom. Manish and Satyendar are today’s, Bhagat Singh. After 75 years, the country got an education minister who gave good education to the poor and gave hope for a bright future,” he had tweeted.

Speaking to ANI, the relative of the freedom fighter lambasted the Delhi Chief Minister and asked “what political mileage did he want from it?”

“Why are criminals caught in corruption cases being compared with martyrs? What political mileage did he want from it? Whatever your fight, fight it politically. Do not equate them with the martyrs. It is not only about Bhagat Singh but also do not equate anybody with other freedom fighters,” Dhath said.

“It was never his (Bhagat Singh’s) mission to be elected to power or else he could have survived and would not have been hanged… They should concentrate on the condition Punjab is in today,” he added.

The freedom fighter’s relative asked Kejriwal to follow Bhagat Singh’s vision but not “equate anybody” with him.

“There could not be a more shameful thing than comparing Satyendar Jain with Bhagat Singh. He is lodged in jail for months and the court is denying him bail. And you compare him with Bhagat Singh. We do not have any problem if you follow his vision, but do not equate anybody with Bhagat Singh,” Dhath said.

Calling the condition of Punjab “miserable”, he said that the people who voted them to power can also remove them from the top position.

“People have brought you to power (in Punjab), but if they can bring you to power, they also know how to remove you. The condition of Punjab is miserable. It was unimaginable to think that you would do such a thing to Punjab after coming to power,” he said.

“We have seen it earlier also that they took his name before the elections. I want to ask Kejriwal why did you need it? People know Bhagat Singh, he does not need recognition from the political parties. People respect him across the country and consider him an idol,” Dhath added.
