Ex-Haryana CM Chautala Moves Delhi HC Challenging Conviction, Sentencing By Trial Court

Former Haryana Chief Minister Om Prakash Chautala has moved to the Delhi High Court challenging the order of a trial court which sent him to four years of imprisonment in a disproportionate assets (DA) case.

Advocate Harsh Sharma on Tuesday confirmed that the appeal has been moved to the High Court challenging a trial court order of conviction and order of sentence against Chautala.
On May 27, 2022, the Rouse Avenue Court of Delhi ordered four years of imprisonment to Chautala. The Court had also ordered to confiscate four properties of him and also imposed a fine of Rs 50 lakh.

While passing the order, CBI Judge Vikas Dhull had also ordered to send Chautala in the custody of Tihar Jail.

During the argument, Chautala physically appeared and remained present in the courtroom. Appearing for Chautala, Advocate Harsh Sharma cited medical grounds for less punishment and submitted that “I, (OP Chautala), have been infected with polio since birth and I am partially disabled.”

CBI’s Special Public Prosecutor Ajay Gupta had opposed the submissions of Chautala’s lawyer for a grant of concession on the grounds of ill-health and age.

CBI had urged the court that “maximum punishment shall be given as it would send a message to the society.” “The person, in this case, is a public figure and giving minimum punishment would send a wrong message. He is not having clean antecedents. It is the second case, in which he has been convicted,” CBI said.

Special Judge (PC Act) Vikas Dhull on May 21, convicted Chautala and said the accused had failed to satisfactorily account for such dis-proportionality by proving his source of income or means by way of which, he acquired assets during this period.

“Hence, accused Om Prakash Chautala is convicted for the offence under Section 13(1)(e) read with 13(2) of the Prevention of Corruption Act, 1988. Put up May 26, 2022 at 10.00 AM for arguments on the point of sentence,” said the court.

According to the CBI’s FIR, accused Chautala, while functioning as Chief Minister of Haryana during the period from July 24, 1999, to March 5, 2005, in collusion with his family members and others, accumulated assets, immovable and movable, disproportionate to his known lawful sources of income, in his name, in the names of his family members and others to the extent of Rs.1,467 crores.

The FIR further stated that the accused accumulated enormous wealth and invested the same throughout the country in the shape of thousands of acres of land, multi complexes, palatial residential houses, hotels, farmhouses, business agencies, petrol pumps and other investments apart from investments in foreign countries.

The FIR also stated that 43 immovable properties in all, apart from cash and jewellery were accumulated. Apart from 43 alleged properties listed in the FIR, additional properties were also suspected to be of the accused family.

An investigation with regard to additional properties was also conducted for ascertaining the link of the accused family with the said properties.

The chargesheet filed in the matter after the conclusion of the investigation stated that accused OP Chautala had acquired assets, both immovable and movable, which were disproportionate to his known source of income.

The disproportionate assets were calculated to be Rs 6,09,79,026 only and the percentage of disproportionate assets was 189.11 per cent of his known sources of income.

Accordingly, CBI had chargesheeted the accused for the offence under Section 13(1)(e) read with 13(2) of the Prevention of Corruption Act.

Apart from the charge sheet filed against the accused OP Chautala, the CBI had filed two more charge sheets arising out of the present FIR, against the sons of the accused i.e. Abhay Singh Chautala and Ajay Singh Chautala and others, which are being tried separately. (ANI)

Lanka’s PM Challenges Dissanayake To Revive Economy In 6 Months

Sri Lanka’s Prime Minister Ranil Wickremesinghe on Tuesday challenged Janatha Vimukthi Peramuna (JVP) leader MP Anura Kumara Dissanayake to revive the country’s economy in six months.

Addressing the Parliament, PM Wickremesinghe said that he is ready to step down if Dissanayake can revive Sri Lanka’s economy in 6 months.
Earlier, Dissanayake had boasted that he is capable of restoring Sri Lanka’s economy in six months.

“So if there is such a plan, I am ready to resign and let him take up this position. I am ready to give up my position and support that program. Because the positions I hold are not new to me. At a time when the country has become anarchic and no one has taken responsibility, I have not accepted this position out of the desire for the chair,” he added.

“It would be great if he has a plan to restore the country’s economy within six months. With such a plan, we will be able to restore the economy in a short period of time. Not only that, but it also sets a good precedent for the world,” said the Sri Lankan Prime Minister.

PM Wickremesinghe said that taking a country whose economic growth has fallen to negative ratings to a positive economic growth rate in six months is an action that has never happened in any country in the world.

Taking a jibe at JVP leader, Wickremesinghe further advised Dissanayake to lay out the plan of the country’s economic revival to President Gotabaya Rajapaksa or to the Sri Lankan Parliament as that plan would win him the Nobel Prize in Economics.

“That is why I am asking MP Anura Kumara Dissanayake to submit this plan to the President. If you don’t want to go to the President, present it to this Parliament. Let us discuss it in this Parliament. If that plan is better and more effective than the plan we are implementing now, we will implement it. Such a plan would be brilliant enough to win the Nobel Prize in Economics,” said Wickremesinghe.

He further stated “if there is a more effective plan than the one we have presented, if there is a faster plan, then present it. We can discuss it. Run it the most effective path to recovery.”

Wickremesinghe said that the island country is participating in negotiations with the International Monetary Fund (IMF) as a bankrupt country.

“Our country has held talks with the IMF on many occasions before. But this time the situation is different from all those previous occasions,” he said in Lankan Parliament.

“We are now participating in the negotiations as a bankrupt country. Therefore, we have to face a more difficult and complicated situation than previous negotiations,” Wickremesinghe said.

The Prime Minister further in the speech said that once a staff-level agreement is reached, it will be submitted to the IMF Board of Directors for approval.

Sri Lanka has been facing the worst economic crisis since independence in 1948, leading to an acute shortage of essential items like food, medicine, cooking gas and fuel across the island nation.

The country, with an acute foreign currency crisis that resulted in foreign debt default, had announced in April that it is suspending nearly USD 7 billion foreign debt repayment due for this year out of about USD 25 billion due through 2026. Sri Lanka’s total foreign debt stands at USD 51 billion.

The economic crisis has particularly impacted food security, agriculture, livelihoods, and access to health services. Food production in the last harvest season was 40 – 50 per cent lower than last year, and the current agricultural season is at risk, with seeds, fertilizers, fuel and credit shortages.

Sri Lanka is one of the few nations named by the Food and Agriculture Organization (FAO) which is expected to go without food due to the global food shortage expected this year. (ANI)

Several Attempts Made On Moose Wala’s Life During Poll: Father

Several attempts were made to attack Sidhu Moose Wala during the Punjab assembly elections in April and the Aam Aadmi Party-led state “government too left no stone unturned” to curtail his security and “publicized” the withdrawal of his security, said Balkaur Singh, father of the Punjabi singer-politician.

“Sixty to eighty people were after him (Sidhu Moose Wala) to kill him. Efforts were made at least eight more times during the elections to kill him. The government too left no stone unturned, withdrew his security and publicized it,” Balkaur Singh said on Monday.

Moosewala, the 28-year-old singer, was gunned down near his village in Mansa on May 29, a day after his security was scaled down by the newly formed Bhagwant Mann government.

“Gangsters are running a parallel government (in Punjab). Young men are dying. Vicky Middukhera’s revenge was taken, tomorrow someone will do it for Sidhu. But it is our houses being destroyed,” Singh said while speaking at the inauguration ceremony of a road in Mansa district’s Burj Dalwa village.

The murder of Moosewala saw several arrests. Gangster Lawrence Bishnoi, the mastermind in the case, is under police remand till July 6.

A special cell of the Delhi Police recently apprehended two most wanted criminals of the Lawrence Bishnoi-Goldy Brar Gang.
