Nitish Reiterates Call For Oppn Unity Ahead Of 2024 LS Polls

Bihar Chief Minister Nitish Kumar on Wednesday reiterated his call for Opposition unity ahead of the 2024 Lok Sabha elections.

The Chief Minister, in his address in the Assembly ahead of the trust vote of the new Mahagathbandhan government in the state, alleged that the BJP “creates trouble” in society and the Opposition will visit every nook and corner of the country and make people and society aware of the wrong policies implemented by the government including the discrimination on the basis of religion.
“We (RJD and JDU) have taken the pledge to work together for the development of Bihar. Leaders from across the country called me and congratulated me on this decision and I urged all of them to fight together in the 2024 elections. Is there any work being done by Delhi (Centre)? Only advertisement is being done,” Kumar said.

Questioning the BJP’s role in the freedom struggle of the country, the Bihar CM alleged that they will “finish even Bapu” (Mahatma Gandhi).

“You were saying things about the 75th year of Independence. Where were you in the freedom struggle? In the end, they will finish even Bapu (Mahatma Gandhi). We have come together. We will put forward everything in front of every village and every section of society. Their only work is to create trouble in society. When everybody will come together, nobody will ask about them,” he said.

During the session, some Bihar BJP MLAs walked out of the State Legislative Assembly. Reacting to this, the Chief Minister said that they “must have got orders from your superior bosses” to say things against him.

“You (BJP MLAs) are all running away? You will only get a position in your party if you say things against me. You all must have got orders from your superior bosses,” he said.

Earlier, Bharatiya Janta Party’s Vijay Kumar Sinha today resigned as the Speaker of the Bihar Assembly ahead of a floor test to prove the majority of the ‘Mahagathbandhan’ alliance government led by chief minister Nitish Kumar.

Deputy Speaker of the Bihar Legislative Assembly, Maheshwar Hazari chaired the Assembly after the resignation of Speaker Vijay Sinha earlier today. The election for Bihar Assembly Speaker will take place on August 26.

Sinha’s resignation came after a no-confidence motion against him was moved by the MLAs of the ruling coalition.

Sinha had earlier said the notice for the motion, received at the Vidhan Sabha secretariat was unclear and did not follow the rules and regulations.

“I would like to tell you that your no-confidence motion is unclear. Eight of the nine letters, which were received were not as per rule,” said Sinha. (ANI)

Army Foils 3rd Infiltration Attempt At LoC In 72 Hours

The Indian Army on Wednesday foiled a third infiltration bid by terrorists on the Line of Control (LoC) in the Pallanwala area of Jammu and Kashmir’s Akhnoor sector on Tuesday night.

“An infiltration bid was foiled by the Indian Army at LOC in Pallanwala in Akhnoor sector on the night of August 23. This is the third such failed infiltration attempt in the last 72 hours at LoC,” Army officials said on Wednesday.

Earlier in the day, the Indian Army recovered the bodies of two Pakistan-based terrorists who were killed in an earlier infiltration attempt after they stepped on a minefield that activated a series of mines.

This activated series of mines eventually killed the two terrorists on the spot, while the Army suspected that the third terrorist was hiding injured.

“Infiltration attempt by two terrorists from Pakistan-based terror organization foiled after they stepped on a minefield, activating series of mines killing 2 terrorists on spot. The third one, possibly injured, is hiding there or has escaped. Bodies were recovered today,” Brigadier Kapil Rana said.

Army sources informed that on Monday, the suspicious movement of two terrorists from Pakistan-based terror organizations, approximately 150 metres on the Indian side of the Line of Control (LoC) was detected, after which a blast was observed.

“It was later assessed that they (terrorists) stepped on a minefield,” Army sources said.

On the first incident, the Defence Ministry said in a statement, “On 21 August 2022, in the morning hours, alert soldiers deployed in Jhangar sector of Naushera spotted movement of two to three terrorists on own side of Line of Control. One terrorist came close to the Indian post and tried cutting the fence when he was challenged by alert sentries.”

“The terrorist tried to flee, however, was brought down by the effective fire, incapacitating him. Two terrorists who were hiding behind fled the area by taking cover of dense jungle and broken ground. The injured Pakistani terrorist was captured alive and provided with immediate medical aid and lifesaving surgery was carried out,” the statement said.

It added that the captured terrorist revealed his identity as Tabarak Hussain, resident of Sabzkot village, district Kotli of Pakistan-occupied Kashmir.

“On further interrogation, the terrorist confessed about their plan to attack the Indian Army post. Tabarak Hussain stated that he was sent by a Colonel of Pakistan intelligence agency named Col Yunus Chaudhry who had paid him 30,000 Pakistani rupees. Tabarak also revealed that he along with other terrorists had carried two to three close recces of Indian forward posts with an aim to target them at an opportune time,” the statement said.

It added that the go-ahead to target the Indian post was given by Col Yunus Chaudhry on August 21. (ANI)

Centre Should Call All-Party Meet To Decide Freebies Issue: SC

The Supreme Court on Wednesday asked the Centre why it cannot call an all-party meeting to determine issues relating to the promise of freebies during election campaigns.

Chief Justice of India NV Ramana’s remark came after Solicitor General of India Tushar Mehta, appearing for the Centre, said that there are parties, who may not be in power, were rolling out promises to influence the voters unduly.
“For example, someone says, for all of you I will not charge electricity. People can be lured. I don’t even know from where the money will come. Electricity is one example. Would the voter have an atmosphere where he can take informed decision. Can you promise the moon to get elected?” SG said.

To this, the CJI asked the Solicitor General, “Why doesn’t the government of India call for an all-party meeting?”

The Solicitor General replied that political parties have already moved the court and opposed any intervention on freebies, hence, an all-party meeting may not be productive. He added, “There are some political parties who think it is their fundamental right to offer freebies and have come to power by only offering freebies.”

Mehta further told the bench that a Constitutional body should head the committee to deliberate the issue.

“Why doesn’t the Government of India form a committee to study this issue?” asked CJI from Mehta.

Solicitor General said that the Central government is assisting the court in every way and that the committee can submit a report on the issue in two-three months.

Yesterday, the apex court while acknowledging the complex nature of the issue, had said that the intention of the court was to initiate a wider public debate on the issue, and it is for that purpose the constitution of an expert body was mooted.

While hearing the case today, the CJI on the issue of who will head the committee, said, “That Biggest problem is, who will head the committee? Ultimately it is the political parties which make promises and contest elections, not individuals. Suppose if I contest I won’t even get 10 votes because individuals do not have much importance. That is how our democracy is.”

Senior advocate Vikas Singh, appearing for the petitioner, told the bench that a committee to look into the issue of freebies should be headed by a retired Supreme Court judge.

To this, the Chief Justice said that a person who retires or is going to retire from his professional life has no value in India.

“I was suggesting a retired Supreme Court judge to head the committee like Justice (RM) Lodha,” Singh said.

CJI Ramana replied, “The person who retires or is going to retire has no value in this country.” CJI Ramana is retiring on August 26.

During the previous hearing, the apex court said that the issue concerning freebies is complex and there is a need to draw a distinction between welfare schemes and other promises that are made by political parties before elections.

The top court was hearing a batch of pleas seeking direction to seize election symbols and deregister political parties that promised to distribute irrational freebies from public funds.

The apex court had earlier said that there is a need for a commission consisting of Niti Aayog, Finance Commission, ruling and opposition parties, Reserve Bank of India, and other stakeholders to make suggestions on how to control freebies by political parties.

Senior advocate Kapil Sibal, assisting the apex court on the issue, had said that a “non-political body” like Finance Commission may look into the issue and make recommendations.

On the last date of the hearing, the apex court said that it cannot prevent political parties from making promises during the election campaigns but the question is what constitutes right promises and what is the right way of spending public money.

Political parties like Aam Aadmi Party, Congress and Dravida Munnetra Kazhagam (DMK) have sought to intervene in the matter and opposed the plea.

AAP had filed an application stating that electoral promises such as free water, free electricity, and free transport are not ‘freebies’ but these schemes are absolutely essential in an unequal society.

Earlier, the Supreme Court had said that promising and distributing freebies by political parties during elections is a “serious issue” and an amount has to be spent on infrastructure etc. It had said that the economy losing money and the welfare of people, both have to be balanced.

The Election Commission had pointed out that it was the Supreme Court in its 2013 judgment which had held that promises made by political parties and candidates in their manifestos could neither be construed as a corrupt practice under the Representation of the People Act nor the violation of level playing field (Article 14).

One of the pleas filed by advocate Ashwini Upadhyay claimed that political parties arbitrarily promise or irrational freebies for wrongful gain and to lure voters in their favour is analogous to bribery and undue influences.

It claimed that promise or distribution of irrational freebies from public funds before elections could unduly influence the voters, shake the roots of a free and fair election, and disturb the level playing field, besides violating the purity of the election process. (ANI)

“The proceedings of Enforcement Directorate (ED) and Central Bureau of Investigation (CBI) are being discussed everywhere. Even today, they will watch the programme to know who all were present in the event,” he added taking a jibe at the Union government.

Many people are being raided, he added.

Captured Terrorist Confesses Pakistan Army’s Role In Terrorism: J&K

A terrorist captured by the Indian security forces at the Line of Control near the Jammu region has brought in focus the role of a serving Pakistani Army colonel in sponsoring terror attacks within the Indian territory.

The captured terrorist, Tabarak Hussain, resident of Sabzkot village, district Kotli of Pakistan occupied Kashmir, is presently undergoing treatment at an Army medical facility. Hussain was in an extremely critical condition before Army doctors saved his life.
As he recovers, Hussain told ANI on Wednesday that he had been sent along with three to four other terrorists were paid money by a Pakistani Colonel Yunus Choudhary to carry out a ‘fidayeen’ attack on Indian soldiers after crossing the LoC. Hussain received a bullet wound while his accomplices escaped.

“We were four-five people. We had come to die. We were sent by Pak Army’s Colonel Choudhary Yunus. He gave us money to attack Indian posts,” said Hussain responding to questions. He said that the group had four to five guns with them.

“We were asked to attack the Indian Army. I had come in 2016. This time we could not attack. The others ran away…After I was hit by a bullet, the Indian Army saved me,” he added.

Army doctor Rajeev Nair said that when Hussain was brought his condition was quite critical. His life is saved but he will take several weeks to recover from his wounds, he said.

Asked if he did not find it ironical that a terrorist who had come to kill was being saved, the doctor said for them everyone who comes is a patient.

“Whoever comes to us is a patient and our job is only to save their life. We have made the same effort to save him that we would have made for soldiers or others. This is the valour of Indian soldiers that they even donated blood to save him. He had come to shed their blood and our soldiers donated their blood to save him,” said Nair.

He added that Hussain is bed-ridden and it is Indian soldiers who are now feeding him.

In an official statement, Defence authorities said that in the last 48 hours, two major infiltration bids have been eliminated by alert troops deployed along the Line of Control in Naushera Sector of Rajouri district.

“On 21 August 2022, in the morning hours, alert soldiers deployed in Jhangar sector of Naushera spotted movement of two to three terrorists on own side of Line of Control. One terrorist came close to the Indian post and tried cutting the fence, when he was challenged by alert sentries.

“The terrorist tried to flee, however, was brought down by effective fire, incapacitating him. Two terrorists who were hiding behind, fled the area by taking cover of dense jungle and broken ground. The injured Pakistani terrorist was captured alive and provided with immediate medical aid and lifesaving surgery was carried out,” the statement said.

It added that the captured terrorist revealed his identity as Tabarak Hussain, resident of Sabzkot village, district Kotli of Pakistan occupied Kashmir.

Tabarak Hussain stated that, he was sent by a Colonel of Pakistan Intelligence Agency named Col Yunus Chaudhry who had paid him 30,000 Pakistani Rupees. Tabarak also revealed that he along with other terrorists had carried two to three close recces of Indian forward posts with an aim to target them at an opportune time,” the statement said.

It added that the go-ahead to target the Indian post was given by Col Yunus Chaudhry on 21 Aug 2022.

“Incidentally, the individual was earlier captured by Indian Army from the same sector in 2016 along with his brother Haroon Ali, and was repatriated on humanitarian grounds in November 2017,” it added.

In the second operation, on the night of 22/ 23 August 2022, a group of two to three terrorists tried to infiltrate in Lam sector of Naushera(J&K). Our alert troops were able to observe the terrorists as they crossed the Line of Control and continuously monitored this movement. As they moved ahead into our minefields a series of mines got activated and two terrorists got eliminated on the spot, the Army statement said. (ANI)
