Manipur Situation

Manipur Violence: SC Seeks Fresh Status Report On Security Measures

The Supreme Court on Wednesday directed the State of Manipur to file a fresh status report on all the security, relief and rehabilitation efforts made for the people affected by the violence between Meitei and Kuki communities.

A bench of Chief Justice of India (CJI) DY Chandrachud and Justices PS Narasimha and JB Pardiwala that maintaining law and order is a State subject and as the Supreme Court, it will ensure that the political executive does not turn a blind eye to the matter.
“We can’t say who is responsible for this… law and order is a State subject. We as the apex court can ensure they don’t turn a blind eye. We must as a court also understand that some matters are entrusted to the political arm,” said the CJI.

Centre and the State government told the top court that a status report has been filed and the situation had improved in the State.

In its status report, the government said a total of 318 relief camps have been opened where more than 47,914 persons have been given relief. A total of 626 FIRs have been registered so far.

“The provision for ration, food, water and medical care & medicines are being arranged by the District Magistrates with Sub-Divisional Magistrates, Executive Magistrates and District level Officers of concerned line Departments by deputing responsible Officers.

The state government had also sanctioned a contingent fund of Rs. 3 crore for meeting exigencies in providing relief measures, it added. The State government had taken the decision to earmark 25 per cent of the MLA Local Area Development Fund for relief measures in respective Assembly Constituencies, the affidavit further stated.

The affidavit said, “State Home Department had issued instructions to DGP and all District SSP to register FIRS of all reported cases irrespective of jurisdiction and also to take up action on suo motu basis for incidents within its jurisdiction. A total of 626 FIRs have been registered so far. The administration has also taken away fire arms from a large number of persons 1,070 arms, 27,110 ammunition and further recovered a large number of firearms 456 arms, 6,819 ammunition.”

The bench also said it will not deal with the legal issues arising out of the Manipur High Court’s decision, directing the State government to recommend to the Centre the inclusion of the Meitei community in the Scheduled Tribe list, as the pleas challenging the order were pending in the larger division bench there.

The top court took into account the security apprehensions of Meitei and Kuki communities and ordered that the Chief Secretary and his Security Advisor will assess and take steps to ensure “peace and tranquillity” in the State.

It said that tribals could move the division bench of the Manipur High Court with their grievances on the quota issue.

The bench further questioned Manipur High Court for its order asking the State government to recommend to the Centre the inclusion of Meitei in the ST list.

The CJI remarked, “We have to stay the order of the Manipur High Court. It is completely factually wrong and we gave time to Justice Muralidharan to remedy his error and he did not. We have to take a strong view against it now. It is clear if the High Court judges do not follow Constitution bench judgments then what should we do… it is very clear.”

The bench did not impose any stay and took into note that an appeal has been filed before the division bench of the High Court against the judgment of the single judge and the next date of hearing is June 6 there. It said aggrieved parties can present their case before the division bench.

Solicitor General Tushar Mehta appearing for the Centre and Manipur government said an application was filed before the single judge to grant an extension of time and the judge has granted time for considering a direction to send a recommendation by one year.

He said considering the position on the ground, the government chose not to seek a stay of the order and only seek an extension, because it would have an impact on the situation on the ground.

“In all fairness, it was the decision of the government to only ask for extension, because it’s one tribe versus another,” Solicitor General added.

Senior advocate Ranjit Kumar appearing for one of the petitioners for the Meitei community said the illegal immigrants are coming from Myanmar and they are wanting to settle in Manipur.

They are involved in poppy cultivation and that is how these militant camps are growing therein. This is the larger problem leading to the situation and militant camps are coming out of Myanmar, he added.

Solicitor General agreed with Kumar and said “concern about illegal immigrants from Myanmar is correct”.

The bench now posted the matter for hearing in July first week.

Earlier, the top court expressed concern over the loss of lives and properties in Manipur during the violence between the Meitei and Kuki communities and stressed taking adequate measures to restore normalcy there.

The apex court was hearing a batch of pleas relating to the violence in Manipur.

On March 27, the High Court directed the State to consider the inclusion of the Meitei community in the Scheduled Tribes list.

The violence in Manipur between the Hindu Meiteis and the tribal Kuki, who are Christians, erupted after a rally by the All Tribal Students Union of Manipur (ATSUM) on May 3.

Violence has gripped the entire state for several days and the Central government had to deploy paramilitary forces to bring the situation under control. (ANI)

3-Month Extension To SEBI To Conduct Probe Into Hindenburg Report Against Adani

The Supreme Court on Wednesday granted an extension of time for three months to the Securities and Exchange Board of India (SEBI) to conduct a probe into the Hindenburg report against Adani Group.

A bench led by the Chief Justice of India (CJI) DY Chandrachud and also comprising Justices PS Narsimha and JB Pardiwala granted an extension of time for three months to SEBI.
The court said that SEBI is granted time till 14th August 2023 to conduct the probe.

The court also said that the matter will be listed in July and requested the expert committee to continue to assist the court.

The court also said that the expert committee may hold further deliberations in the meantime.

The court also said that the copies of the report of the expert committee shall be made available to the parties and their counsels to assist the court.

Solicitor General Tushar Mehta has informed SC, SEBI is seeking an extension of time for conducting the probe and needs six months to reach any conclusion.

In a rejoinder filed recently, The Securities and Exchange Board of India apprised the Supreme Court on Monday that the market regulator is already investigating Adani Group companies since 2016 is factually baseless.

SEBI has filed a rejoinder affidavit in response to a petition relating to Hindenburg Research’s report on Adani Group.

SEBI had sought an extension to conclude the investigation in the report by US short-seller Hindenburg Research by a period of six months. The top court on Friday orally remarked that they will extend the time for the probe to SEBI, but not for six months and they can extend the time for the probe by three months.

SEBI told the SC that the investigation done earlier by SEBI pertains to the issuance of Global Depository Receipts (“GDRs”) by 51 Indian listed companies, in respect of which investigation was conducted. SEBI submitted before the Supreme Court that no listed company of Adani Group was part of those 51 companies it was investigating.

“Pursuant to completion of investigation, appropriate enforcement actions were taken in this matter. Hence, the allegation that Securities and Exchange Board of India (“SEBI”) is investigating Adani since 2016 is factually baseless. I, therefore, say and submit that reliance sought to be placed on the investigation pertaining to GDRs is wholly misplaced,” SEBI said in a rejoinder affidavit.

SEBI submitted before Supreme Court that in the context of investigation into Minimum Public Shareholding (“MPS”) norms, SEBI has already approached eleven overseas Regulators under the Multilateral Memorandum of Understanding (“MMOU”) with International Organization of Securities Commissions (“IOSCO”). Various requests for information were made to these Regulators. The first request to overseas Regulators was made as early as on October 6, 2020, SEBI apprised the court.

SEBI submitted before the Supreme Court that the application for extension of time filed by SEBI is meant to ensure carriage of justice keeping in mind the interest of investors and the securities market since any incorrect or premature conclusion of the case arrived at without full facts material on record would not serve the ends of justice and hence would be legally untenable.

SEBI has informed Supreme Court that in respect of the investigation and examination relating to 12 transactions referred to in the Hindenburg Report, prima facie it is noted that these transactions are highly complex and have many sub transactions across numerous jurisdictions and a rigorous investigation of these transactions would require collation of data/information from various sources including bank statements from multiple domestic as well as international banks, financial statements of onshore and offshore entities involved in the transactions and contracts and agreements, if any, entered between the entities along with other supporting documents.

On March 2, the apex court directed the capital market regulator SEBI to investigate any violations of securities law by the Adani Group in the wake of the Hindenburg report, which led to a massive wipeout of more than USD140 billion of the Adani Group’s market value.

Supreme Court, on March 2, set up an expert committee on the issue arising from the Hindenburg Research report on Adani Group companies. The committee will consist of six members, headed by former apex court judge Justice AM Sapre.

The top court had then asked SEBI to file a status report within two months.

The apex court was then hearing petitions pertaining to the Hindenburg report, including on the constitution of a committee relating to regulatory mechanisms to protect investors’ interests.

The January 24 Hindenburg report alleged stock manipulation and fraud by the conglomerate.

The Adani Group has attacked Hindenburg as “an unethical short seller”, stating that the report by the New York-based entity was “nothing but a lie”. A short-seller in the securities market books gains from the subsequent reduction in the prices of shares. (ANI)

Jaishankar on Veiled Attack On Pakistan

Look At EU Council Regulations…: Jaishankar On Import Of Russian oil

Responding to Josep Borrell, EU Foreign policy chief’s remarks calling for action against Indian refined products from Russian crude, External Affairs Minister S Jaishankar on Tuesday (local time) advised him to look at EU Council regulations.

“Look at EU Council regulations, Russian crude is substantially transformed in the third country and not treated as Russian anymore. I would urge you to look at Council’s Regulation 833/2014,” said Jaishankar.
This comes after the bloc’s chief diplomat earlier said that the EU should crack down on India reselling Russian oil as refined fuels including diesel into Europe as Western nations move to tighten sanctions on Moscow’s energy sector.

“India buys Russian oil, it’s normal… ” said EU’s Foreign policy chief Borrell but wants the bloc to act on refined products coming from India-made Russian crude in an interview with Financial Times.

While Borrell met with Jaishankar at the trade technology talks in Brussels, he was not present at the press conference that followed.

In his place, EU Executive Vice President on Competition, Margrethe Vestager said that there was “no doubt about the legal basis of the sanctions”, and that the EU and India would have the discussion as “friends… with an extended hand and of course, not a pointed finger.”

Along with Jaishankar, Commerce Minister Piyush Goyal, and Union Minister of State for Entrepreneurship, Skill Development, Electronics and Technology Rajeev Chandrasekhar was also in the meeting.

Jaishankar on Monday arrived in Brussels for the last leg of his three-nation visit covering Bangladesh, Sweden and Belgium.

Earlier also Jaishankar had defended India’s imports from Russia while indirectly criticising the West for pressurising New Delhi to minimise its trade with Russia in view of its military action in Ukraine.

He wondered how Europe could make choices to prioritise its own energy needs and at the same time ask India to do something else.

“Our trade with Russia is at a very small level- USD 12-13 billion, in comparison to European countries. We’ve also given the Russians a set of products… I don’t think people should read more into it other than the legitimate expectations of any trading country to increase its trade,” the EAM said earlier in December while addressing a joint press conference with his German counterpart Annalena Baerbock.

“I would urge you to look at these figures. There is a website called ‘Russia Fossil Fuel Tracker’ that would give you country-by-country data of who is really importing what and I suspect that might be very very helpful,” he added. (ANI)

US Report On Religious Freedom Based On Flawed Understanding: India

India rejected the US State Department report on international religious freedom and said it was based on “misinformation and flawed understanding.”

According to a statement released by the Ministry of External Affairs, spokesperson Arindam Bagchi said, “We are aware of the release of the US State Department 2022 Report on International Religious Freedom. Regrettably, such reports continue to be based on misinformation and flawed understanding.”
He further stated that the report is motivated and biased commentary by some US officials which only serves to undermine further the credibility of these reports.

“We value our partnership with the US and will continue to have frank exchanges on issues of concern to us,” the spokesperson said.

This statement came in response to the US State Department 2022 Report on International Religious Freedom where it alleged high handedness against minorities especially Muslims by various state governments in India.

“There were numerous reports during the year of violence by law enforcement authorities against members of religious minorities in multiple states, including plainclothes police in Gujarat publicly flogging four Muslim men accused of injuring Hindu worshippers during a festival in October, and the Madhya Pradesh State government bulldozing Muslim-owned homes and shops following communal violence in Khargone in April,” US report read.

“In June, UN special rapporteurs on adequate housing, minority issues, and freedom of religion and belief wrote the government to express their “serious concerns” about the “punitive” demolitions in Khargone, which they stated were “ordered by local governments arbitrarily to punish Muslim minorities and low-income communities.” In October, a report drafted by a citizens committee stated there were “multiple instances of apparent police complicity” in violent actions against protestors, who were mostly Muslim, in the Delhi riots in 2020,” it added.

After the release of the report, State Secretary Antony Blinken said that in India, legal advocates and faith leaders from across the country’s diverse religious communities condemned a case of extreme hate speech against Muslims in the city of Haridwar, calling for the country to uphold its historical traditions of pluralism and tolerance.

Meanwhile, answering a media query over the International Religious Freedom Report on India, a senior US State Department official said that the official has been saddened to see New Delhi’s name and to see what is outlined in today’s report. (ANI)
