Adani-Hindenburg Row: SC To Hear SEBI’s Plea For Extension On Monday

The Supreme Court on Friday listed to hear on May 15 (Monday) the Securities and Exchange Board of India’s (SEBI) plea seeking to extend the time to conclude the investigation in the report by US short-seller Hindenburg Research by a period of six months.

The bench, led by the Chief Justice of India (CJI) DY Chadrachud, and also comprising Justices PS Narsimha and JB Pardiwala, adjourned the matter till May 15.
Meanwhile, the court orally remarked that they will extend the time for the probe to SEBI, but not for six months and they can extend the time for the probe by three months.

Solicitor General Tushar Mehta insisted on an extension, citing the involvement of bank statements from multiple domestic and international banks.

SEBI application seeking an extension of time has been opposed by the petitioner, Vishal Tiwari.

In an application moved before the Supreme Court, SEBI submitted that keeping in view the forgoing circumstances, it would take further time to arrive at verified findings and conclude the investigation.

SEBI, in the application, also submitted that for ascertaining possible violations, it would take at least 15 months for completion of the investigation of these transactions, but is making all reasonable endeavours to conclude the same within six months.

On March 2, the apex court directed the capital market regulator SEBI to investigate any violations of securities law by the Adani Group in the wake of the Hindenburg report, which led to a massive wipeout of more than USD140 billion of the Adani Group’s market value.

Supreme Court, on March 2, set up an expert committee on the issue arising from the Hindenburg Research report on Adani Group companies. The committee will consist of six members, headed by former apex court judge Justice AM Sapre.

The top court had then asked SEBI to file a status report within two months.

The apex court was then hearing petitions pertaining to the Hindenburg report, including on the constitution of a committee relating to regulatory mechanisms to protect investors’ interests.

There was a loss of investors’ wealth in the securities market after the Hindenburg report because of a steep decline in the share price of the Adani Group of companies.

The January 24 Hindenburg report alleged stock manipulation and fraud by the conglomerate.

The Adani Group has attacked Hindenburg as “an unethical short seller”, stating that the report by the New York-based entity was “nothing but a lie”. A short-seller in the securities market books gains from the subsequent reduction in the prices of shares. (ANI)

Jaishankar Bilawal

Indo-Pak Relations to Remain Strained

Coming soon after the recent Shanghai Cooperation Council’s (SCO) Defence Ministers’ Summit in New Delhi, India last week hosted the Foreign Ministers of the SCO at Goa. The common thread between these two summits was the tough posturing by India against its two neighbours Pakistan and China.

At the Goa meeting, India’s External Affairs Minister, S Jaishankar, revealed that India had twice called out China and Pakistan at the summit for violating India’s sovereignty through their connectivity projects. The statement was made in response to a question on the China-Pakistan Economic Corridor (CPEC), which runs through Indian territory currently under Pakistan’s illegal occupation.

Earlier, India had sort of reprimanded the Chinese Defence Minister at the New Delhi meeting, on the issue of the stalled talks over the Line of Actual Control (LAC).

India’s critique of Pakistan

Pakistan’s Foreign Minister Bilawal Bhutto Zardari was in Goa to represent Pakistan at the SCO-CFM. A visit, which happened after a 12 years gap. The last Pakistani foreign minister to visit India was Hina Rabbani Khar, when she met her Indian counterpart SM Krishna in Delhi in 2011.

However, what soured the atmosphere this time in Goa, was references made by Zardari over Kashmir and Pakistan being a victim of terrorism itself. Though he also called for reviving the stalled talks.

India, in a strongly worded response to Pakistan’s overtures for talks, said victims of terrorism do not sit together with perpetrators of terrorism to discuss terror.

Rebutting each of the points made by Zardari, EAM S Jaishankar said he (Zardari) was “a promoter, justifier and spokesperson for a terrorism industry which is the mainstay of Pakistan. The tough Indian response came after the news of death of five Indian Army soldiers in a terrorist attack near the Line of Control (LoC) on Friday, Jaishankar said Bilawal’s suggestion to sit together and talk was “hypocritical” and said India was feeling “outraged” by the incident.

India’s stand on China

Jaishankar had a similar position on China whose readout on the bilateral between him and its Foreign Minister described the situation on the boundary as stable. Jaishankar said that, there is an abnormal position in the border areas. We have to take the disengagement process forward. I have made it very clear. India-China relations will not be normal if peace and tranquillity in the border areas is disturbed. This message was on the same lines as delivered by the Indian defence minister to his Chinese counterpart, a fortnight ago.

Responding to Zardari’s diatribe, Jaishankar said Bilawal’s opposition to a G-20 meeting to be held in Kashmir had no basis since Pakistan was not even a member of that grouping. On Bilawal’s opening address at the SCO conference where he said the issue of terrorism should not be used to score diplomatic points, the minister said: “We are not scoring diplomatic points. We are exposing Pakistan. As a victim of terrorism, we are authorised to do so. We have put up with it. It speaks so much about the mindset of that country.”

He asked Pakistan to “smell the coffee” regarding its grouse about the abrogation of Article 370 as a violation of international agreements. “370 is history. Sooner the people realise it, the better.” Jaishankar said.

Indian response to CPEC

EAM Jaishankar also took an exception at the mention of China-Pakistan Economic Corridor (CPEC) at the SCO meeting, both by Pakistan and China. And rightly so, as SCO is a multilateral forum, not a bilateral one and further India’s adversarial stand on the CPEC has been very clear from the beginning, as it passed through the PoK. India has consistently opposed the Belt and Road Initiative and CPEC, as these projects violate India’s territorial integrity and sovereignty.

Jaishankar very clearly stated that connectivity is good for progress, but connectivity cannot violate the sovereignty and territorial integrity of nations.

Bilawal’s overture

On his part Bilawal Bhutto Zardari blamed India’s Kashmir policy for the “frozen peace” between India and Pakistan. The India-Pakistan relationship soured significantly after India announced the withdrawal of special powers from Jammu and Kashmir and the division of the state into two union territories in August 2019.

India has always maintained that it wants regular neighbourly ties with Pakistan while emphasising that the onus is on Islamabad to create a safe environment for such an engagement.

The tough Indian response to both Pakistan and China, mainly stems from its exhaustion with its neighbours, who in spite of several Indian initiatives to better relations, prefer to stick with their age-old stands on the contentious issues, preferring not to respond positively to any Indian efforts in this regard.

The SCO meet also showed yet again that body language speaks volumes in geopolitics and diplomacy. The distance between the two foreign ministers while posing for photographs was noticeably gaping. However, the cold Indian demeanour, a departure from customary diplomatic niceties, and continuing with its old parroting by the Pakistani minister were more targeted at their respective domestic audiences.

The Indian leadership in view of the forthcoming elections in Karnataka wanted to be seen as acting tough, while the Pakistani minister wanted to showcase his ability to rake-up old issues in the backdrop of the economic woes of Pakistan. But overall this posturing does not augurs well for friendly relations between the neighbours in the foreseeable future.

BJP Fantasy Story Liquor Scam

Court Reserves Order On Sisodia’s Bail Plea

The Delhi High Court on Thursday reserved the order on the regular and interim bail pleas of former Delhi Deputy Chief Minister Manish Sisodia arrested in the liquor policy case.

He sought an interim bail on the ground of the illness of his wife.
Justice Dinesh Kumar Sharma reserved the order after hearing the arguments by the counsels for Sisodia and the Central Bureau of Investigation (CBI).

Meanwhile, the HC bench directed the concerned jail superintendent to connect Sisodia to his wife through video conferencing for one hour between 3 to 4 PM on every alternate day.

The bench has listed the bail matter in The Enforcement Directorate case on May 24 in view that the federal agency filed its reply on Thursday morning.

It was submitted by senior advocate Mohit Mathur that the condition of Sisodia’s wife is not good. She is suffering from of spine ailment and was taken to the hospital.

On the other hand, it was submitted by the senior advocate Dayan Krishnan that it was not correct that the profit margin was increased from 5 per cent to 12 per cent. 5 per cent was the minimum and 12 per cent was the maximum.

It was also submitted by the senior counsel that the decision was valid.

High Court on May 3 issued notice to the CBI on an interim bail plea. He is presently in judicial custody and was arrested by the CBI on March 26, 2023.

Earlier, the wife of Manish Sisodia was admitted to a private hospital in Delhi after her health deteriorated.

The High Court already examined the regular bail application.

Justice Sharma noted the submissions of senior advocate Siddharth Aggarwal, who appeared for Sisodia and informed the court that Sisodia’s wife has been suffering from multiple sclerosis and had been recently hospitalised due to the ailment.

Earlier, the Rouse Avenue Court while dismissing the bail plea of the former Deputy Chief Minister of Delhi, said, “The court is not inclined to release him on bail at this stage of investigation of the case as his release may adversely affect the ongoing investigation and will also seriously hamper the progress.”

Special Judge MK Nagpal dismissed the bail plea and said, in the opinion of this court, the allegations made against Sisodia were serious in nature and at this stage of the case, he did not deserve to be released on bail as he has been arrested in this case only on February 26 and investigation even qua his role has still not been completed.

According to the CBI, Sisodia had played the most important and vital role in the criminal conspiracy and had been deeply involved in the formulation and implementation of the said policy to ensure the achievement of the objectives of the said conspiracy.

Further, though even the medical condition of Sisodia’s wife has been sought to be made a ground for a grant of bail to him, it was observed that though the neurological or mental illness of the wife of the applicant is claimed to be around 20 years old, the documents filed on record in support thereof are found to be of the years 2022-2023 only, said the trial court. Pakistan: SC Orders Imran’s Immediate Release After Calling His Arrest Illegal

The Supreme Court of Pakistan on Thursday declared Pakistan Tehreek-e-Insaf chief Imran Khan’s arrest “illegal,” and also directed for his immediate release, reported ARY News.

The major relief for the former prime minister came shortly after he was presented in court.
Khan, who was removed from office as prime minister last year in April, was ordered by the SC to present himself at 4:30 pm, but he was produced at around 5:40 pm, more than an hour later.

He was carried in a 15-vehicle convoy.

Khan was ordered to appear in court after Chief Justice of Pakistan (CJP) Umar Ata Bandial described the PTI leader’s detention from the Islamabad High Court (IHC) premises as a mighty disgrace to the country’s legal system, as per ARY News.

The CJP made the comment while presiding over a three-person bench debating the PTI’s appeal challenging Khan’s arrest. The bench also contains Justices Muhammad Ali Mazhar and Athal Minallah in addition to the Chief Justice of Pakistan.

A petition was filed in the Supreme Court by PTI, a day earlier challenging the Islamabad High Court’s (IHC) decision calling Khan’s arrest by the National Accountability Bureau (NAB) “legal,” according to ARY News.

Khan was arrested on Tuesday inside the premises of Islamabad High Court when he appeared before the court in two cases.

Ever since Khan’s arrest, Pakistan has been witnessing a situation of unrest. Several protests have broken out across the country as PTI has urged its supporters to come out in support of Imran Khan.

On the other hand, the PTI has asked its supporters to stay away from the top court, ARY News reported. (ANI)
