So what was the crime of Julian Assange? Why did he rot in prison, trapped, condemned, depressed, without sunlight and hope, for so many years? How come the ‘free democracies’ of the West chose to punish a young man who did nothing but restore the faith of society in the freedom of expression? And why did Chelsea Manning, an American army officer, as young, got equally condemned in solitary confinement in an American prison, for merely listening to his free conscience, and, thereby, giving away all the secret documents he could score on shady American operations in the Middle-East, especially in Iraq and Afghanistan, as much as elsewhere, as in the death-camps of Guantanamo Bay?

Perhaps in only one of the few acts of redemption, former US president, Barack Obama, did one ‘yes we can’ with Manning. In one of his last noble acts before remitting office, he allowed Manning to be free. For a man who let a predator-like Hillary Clinton, his secretary of state, to unleash mindless wars in Syria and Libya, a woman who laughed like a blood-thirsty hyena when Muammar Gaddafi was murdered by a mob on the streets, this was truly an act of solitary redemption.

Even till this day, he has remained mum on the genocide in Gaza, with his buddy, ‘Genocide Joe’, directly arming the bombing and maiming of over 40,000 civilians, including over 15,000 children. Some things just refuse to change when it comes to American foreign policy, and it does not really matter who is at the helm – the democrats, or, the republicans.

While there is an international hue and cry that Benjamin Netanyahu should be tried in an international court as a war criminal, there was an eerie silence when it came to the mass murders unleashed by former US president George Bush. Tens of thousands of Iraqis were murdered, first by NATO strikes, then in a bloody civil war which ravaged the country, in what was an endorsement of the fraudulent theory of ‘clash of civilizations’ hatched by Samuel Huntington.

This is exactly where Assange comes in and marks a rupture. Once a cyberpunk who professed total freedom on internet, the original dream-sequence of this new cyberspace, which has since then been usurped by sundry predator capitalists like Mark Zuckerberg, Assange is an anarchist-journalist. He believed that all anti-establishment information which a journalist gathers through his sources should be disseminated far and wide, without any checks and balances. Wisely, he also believed that he and the organization he had founded, WikiLeaks, should ally with mainstream media outfits, to spread this exclusive public interest information.

That all sourced information should be released without an editorial filter — that is perhaps one of the doctrines which found objections from certain editors of media organisations who became his partners in this project, such as ‘The Guardian’ of London. Among other things, this was also what landed him in trouble with the western authorities, especially the US.

When he founded WikiLeaks he believed that the State apparatus in a democracy should be accountable, that it cannot be secretive in its dealings with its citizens. He also believed that if the State is doing compulsive and all-round surveillance on its unsuspecting citizens, then it has no right to exist. It must go.

This is the same doctrine which propelled another young whistle-blower, now in exile in Russia, to thoroughly expose the democracy in America by proving, with evidence, that citizens in this country were under the surveillance of the ‘Deep State’, and they just cannot do anything about it. Edward Snowden, in alliance with journalist Glen Greenwald, released this explosive evidence in the web-edition of the ‘Guardian’. The entire American establishment found itself in a soup.

Snowden had to pay a heavy price, a phenomenon similar to independent journalists in India under the current Neo-Nazi regime in Delhi – though nothing comparable to what he or Assange did — happened in contemporary India. He escaped to Hong Kong. And, then, spent several years hiding in transit, in an airport in Moscow.

So, what was the crime of Assange?

He effectively exposed that the war in Iraq, unleashed by Bush, Dick Cheney, Donald Rumsfeld, Condoleezza Rice and Colin Powel, had nothing to do with resurrecting the seeds of a democracy in a totalitarian regime. It was clearly a ‘blood for oil’ war, with Cheney and Bush, reportedly, having direct interests in multinational oil companies like Bechtel and Halliburton. And, thereby, began the ravaging of Iraq, the hanging of Saddam Hussain, and the mass murder of millions across the ancient rives of Euphrates and Tigris.

Did they find any ‘Weapon of Mass Destruction’? Did they find chemical or biological weapons? Did they find any war planes ready to unleash a flood of bombs? So, what did they find?

Nothing!

That is why the phenomenon of ‘embedded journalism’ was hatched by the West, whereby not one drop of news could be wired without it being censored by the military establishment in the war zone. That is, all journalists had to be embedded with the military so as to report from the ground. Almost all western media outfits succumbed – including the likes of BBC. No wonder, Al Jazeera, though headquartered in Qatar, had to face the brunt of choosing to stay independent.

Grave adversity and crisis, inevitably, creates its parallel cinema. Hence arrived the box office star of Salam Pax. Probably a young girl, she reported from the heart of Baghdad, amidst the rubble and the ruins, the dead and the dying, the bombs and the fires of hell! She reported, nevertheless, without hope, but undying objectivity and resilience, unafraid, fearless. She reported! Every day. Without fail.

When almost the entire big media had sold its soul in the West, like in India these days, it is this parallel stream of consciousness which became the scaffolding of the alternative media. The National Public Radio (NPR) and Democracy Now run by Amy Goodman in America, became the new anchors of authentic, impartial news. Run by public money, independent of political or corporate links, they reported as authentically as they could, given the circumstances. The American establishment hated them.

Since then, it has been a long and hard journey. Very, very hard. It seemed impossible that Assange would ever see the sun or the moon. At the Ecuadorian embassy in London, where a Left government in Ecuador had given him shelter, he did not see sunlight for months. In the prison, he seemed to be trapped in eternal darkness.

However, human will and resilience too is infinite. His wife led the international campaign – Free Assange! Writers, actors, journalists, students, women’s groups – people joined in what was an eternal ‘virtual march’ for Julian on social media. Celebrities came out in support. The American and British regimes came under great pubic pressure. Australian Prime Minister Anthony Albanese, once again, renewed unwavering support for the freedom of ‘Citizen Assange’.

More than 100 journalists dead, while reporting and clicking pictures in Gaza. More journalists have now dared to enter the vast graveyards through Rafah, doing what they should be doing. Thousands of students are up in arms in America and Europe against the Israeli war machine, the sinister Jewish lobby, and ‘Genocide Joe’ – tottering, doddering, faltering.

In countries like India, the independent media and other institutions are under siege, dissenters are in prison, including brilliant Muslim students, crony-capitalists call the shots, and corruption rules supreme as in a banana republic. On top of it presides a fake non-biological prophet, wallowing in megalomania, despite having lost the mandate!

Hence, the freedom for Julian is more than a freedom of expression. It is a crack in the cracked mirror. It is a trickle of light amidst the dense darkness at noon. It is the belief, that if you are right, and resilient, on the side of truth, you shall overcome– come what may!

Coming down heavily on the Trinamool Congress-led government in West Bengal over a “horrific” video of a man assaulting a woman in Chopra in West Bengal’s Uttar Dinajpur, Bharatiya Janata Party President JP Nadda said on Monday that Chief Minister Mamata Banerjee’ state is “unsafe for women.”

“A horrific video has come to light from West Bengal, reminding of the brutalities that exist only in theocracies. To make matters worse, the TMC cadre and MLAs are justifying the act. Be it Sandeshkhali, Uttar Dinajpur or many other places, Didi’s West Bengal is UNSAFE for women,” Nadda posted on X.

The West Bengal police on Sunday filed a suo motu case and arrested one person in connection with the video in which a person is seen beating a woman at Chopra in the Islampur area of Uttar Dinajpur district.

“Police have arrested one person who had publicly assaulted a woman. Suo motu case filed. Victim has been provided police security. Investigation proceeds,” a tweet from Islampur police district read.

According to the police, the arrested accused, identified as Tajmul Haque alias JCB, will be produced before the ACJM court in Islampur today.

Islampur Police District further said on X that “Efforts are being made from certain quarters to spread misinformation about an incident in Chopra PS under Islampur PD. The fact is, police has promptly identified and arrested one person who had publicly assaulted a lady.”

“Suo moto case started by the police. Victim has been provided police security. Investigation proceeds,” the tweet read.

In the purported video a man is seen beating a woman and another man with bamboo sticks and the incident that took place is being witnessed by a crowd of onlookers.

Meanwhile, BJP leader Rajeev Chandrasekhar slammed the “appeasement politics” of the INDIA bloc.

“Just because INDI alliance politics is built on appeasement, that mean no laws or constitutional rights to life & liberty do not apply? Appeasement politics of INDI alliance are causing them to cross every line and every law that guarantees rights to citizens All over the country, including West Bengal. Lie about protecting the constitution but do exactly the opposite?,” the BJP leader posted on X.

Earlier on June 29, BJP MLA Agnimitra Paul said that the Bharatiya Janata Party (BJP) has demanded an inquiry by the Central Bureau of Investigation (CBI) into the alleged incident of assault on a Minority Morcha leader of the BJP in Cooch Behar.

Union Minister Union Minister and West Bengal BJP President Sukanta Majumdar on June 28 formed a seven-member team to investigate the alleged assault on the BJP Minority Morcha leader in Cooch Behar.

The seven-member team includes BJP MLA Agnimitra Paul, MLA Sikha Chatterjee, Phalguni Patra, Shashi Agnihotri, MLA Malati Rava Roy, Mafuja Khatun and MP Jayanta Roy.

The West Bengal Police said that that a case has been registered regarding the alleged incident, and three suspects have been arrested. (ANI)

Oppn MPs Protest In Parliament Premises Against Centre’s Misuse Of ED, CBI

Members of the opposition parties staged a protest on the Parliament premises on Monday against the central government’s “misuse” of central agencies including the Directorate of Enforcement (ED) and the Central Bureau of Investigation (CBI).

Opposition MPs including Leader of Opposition in Lok Sabha Rahul Gandhi, Congress’ Shashi Tharoor, KC Venugopal, Manish Tewari, K Suresh, Varsha Gaikwad, Benny Behnan, Anto Antony, Kerala Congress (M)’s Jose K Mani, Aam Aadmi Party’s Sanjay Singh, Raghav Chadha, TMC MP Sagarika Ghosh, Shiv Sena (UBT) MP Priyanka Chaturvedi and CPI(M)’s John Brittas among others participated in the protest.

The leaders were seen carrying placards and posters that read ‘Respect Opposition, Stop Intimidation!, Stop misusing agencies to silence opposition, End the rein of fear, stop ED, IT, CBI misuse, Bhaajpa mei jaao bhrashtachar ka licence pao…”

The parties of the opposition have been targeting the central government alleging misuse of the central agencies “to silence” the opposition. The arrests of Delhi Chief Minister Arvind Kejriwal, Delhi Ministers, former Jharkhand CM Hemant Soren, and TMC Ministers by ED and CBI in various cases invited criticism from many sectors.

Hemant Soren, who was arrested by ED in connection with an alleged land scam was released on bail on June 29 after 149 days of custody.

Arvind Kejriwal was denied bail by the Delhi High Court earlier this month and is currently in judicial custody in connection with an investigation into the alleged liquor policy scam.

With both Houses meeting today after two days, heated discussions on several issues including NEET row and new criminal laws are expected to take place. (ANI)

Over 45,000 Officers Trained: Delhi Police Set To Adapt New Criminal Laws

As the new criminal laws came into force on Monday, Chhaya Sharma, Delhi Police Special CP (Training), stated that over 45,000 officers in the force have been trained for the change.

The Special CP mentioned that special booklets have been prepared to ease the implementation process.

The three new criminal laws, namely Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita, and Bharatiya Sakshya Sanhita replaced the Indian Penal Code (IPC), 1860; the Code of Criminal Procedure (CrPC), 1973; and the Indian Evidence Act, 1872, which came into effect from Monday.

“FIRs will be registered under these sections from today. Our training for this began on February 5. We prepared booklets that helped us easily train our officers so they can be prepared for the coming changes,” the Special CP said.

“The pocket booklet, divided into four parts, contains the transition from IPC to BNS, new sections added to BNS, categories that now come under seven years of punishment, and a table containing sections needed for everyday policing,” she said.

CP Sharma stated that the first round of training was provided to the IOs in all stations and also to potential IOs who might be posted in major stations in the future.

“Now, at least 45,000 officers in the Delhi Police are trained and ready for the changes introduced by the new criminal laws. We have also established a team to assist officers with any questions regarding the implementation of these laws. This team serves as an FAQ resource, providing support and clarification as needed during the implementation process,” CP Sharma said.

She also highlighted that the best part of the new system is that it focuses on ‘justice’ rather than ‘punishment’ with a victim-centric approach.

“For the first time, great emphasis has been given to digital evidence. Now, the evidence will be recorded digitally. The role of forensic experts has been enhanced,” she added.

She further said that old cases registered under the IPC, CrPC, and Indian Evidence Act will be tried under the same old laws until final disposal.

“Law doesn’t function on a retrospective basis. So, the law is that the old cases (registered earlier) will be dealt with under IPC and CrPC. But when new cases are registered from today, July 1, sections of BNS (Bharatiya Nyaya Sanhita) will be invoked. Similarly, the process of investigation that begins today will follow Bharatiya Nagarik Suraksha Sanhita (BNSS), and not CrPC. Old cases will be dealt with under old sections – CrPC and IPC. New cases will be dealt with sections of Bharatiya Nyaya Sanhita (BNS) and Bharatiya Nagarik Suraksha Sanhita (BNSS),” she said.

The first FIR under Bharatiya Nyaya Sanhita, 2023, was registered at Kamla Market Police Station in the national capital on Monday.

The case has been registered against a street vendor under Section 285 of Bharatiya Nyaya Sanhita for obstruction on the footbridge of New Delhi Railway Station and making sales.

The three new laws that came into effect today received Parliament’s nod on December 21, 2023. President Droupadi Murmu gave her assent on December 25, 2023, and it was published in the official gazette on the same day.

Bharatiya Nyaya Sanhita will have 358 sections (instead of 511 sections in the IPC). A total of 20 new crimes have been added to the bill, and the imprisonment sentence has been increased for 33 of them. The amount of the fine has been increased in 83 crimes, and mandatory minimum punishment has been introduced in 23 crimes. The penalty of community service has been introduced for six crimes, and 19 sections have been repealed or removed from the bill.

Bharatiya Nagarik Suraksha Sanhita will have 531 sections (in place of 484 sections of CrPC). A total of 177 provisions have been changed in the bill, and nine new sections as well as 39 new sub-sections have been added. The draft act has added 44 new provisions and clarifications. Timelines have been added to 35 sections, and audio-video provisions have been added at 35 places. A total of 14 sections have been repealed and removed in the Sanhita.

Bharatiya Sakshya Adhiniyam will have 170 provisions (instead of the original 167 provisions), and a total of 24 provisions have been changed. Two new provisions and six sub-provisions have been added, and six provisions have been repealed or deleted in the Adhiniyam.

The complete implementation of new criminal laws will ensure an end to the ‘tareekh pe tareekh’ era, and justice will be given in three years, as earlier informed in the Parliament by Union Home Minister Amit Shah. (ANI)
