1984 Anti-Sikh Riots: Grounds To Presume Accused Instigated Unlawful Assembly

The Rouse Avenue court on Friday directed to frame charges against Congress leader Jagdish Tytler in the Pul Bangash Sikh Killings case.

The court said that there is sufficient grounds to presume that he abetted the killing of three Sikhs by instigating the mob that attacked Gurudwara Pul Bangash, and some of them set it on fire.

Special CBI Judge Rakesh Syal said, “There appears to be sufficient grounds to presume that the accused has committed offences punishable under Sections 143, 147, 188 and 153 A IPC, Sections 295, 436, 451, 380 read with Section 149 IPC, and Section 302 r/w Section 109 IPC.”

The court also said that it is considered that there is not sufficient ground for proceeding against the accused under Section 148 IPC.

“Let the charges be framed accordingly against the accused,” Special Judge Rakesh Syal ordered on August 30.

The court said that the accused has, by instigating the members of the unlawful assembly to kill Sikhs, abetted the murder of the three persons.

On the basis of statements of witnesses, the court stated that, “The accused, Jagdish Tytler, along with other unknown persons, was a member of an unlawful assembly, he instigated members of the assembly to attack Gurudwara Pul Bangash and some members of the assembly, destroyed/damaged/defiled Gurudwara Pul Bangash, a place of worship with the intention of thereby insulting the religion of Sikhs.”

Further, some members of the unlawful assembly, of which the accused was a member, committed mischief by setting Gurudwara Pul Bangash on fire intending to cause destruction.

The court further said that the material on record reveals that when the members of unlawful assembly were attacking Gurudwara Pul Bangash and looting the properties of the Sikhs, the accused instigated them to kill Sikhs by saying, “maro maro” and “Pahle maro phir luto”.

Thereupon, some members of the aforesaid unlawful assembly had committed the murders of Badal Singh, Thakur Singh and Gurcharan Singh, by stabbing/burning them, the court said.

It is alleged that Harpal Kaur, after going back to her house, saw their bodies being thrown.

As per the prosecution case and the Site Plan, the accused was present near Gurudwara Pul Bangash and has left from there, whereas the dead bodies of the deceased persons were thrown from the house near the house of Harpal Kaur, which is situated on a road perpendicular to the road, where Gurudwara Pul Bangash and shop of Amarjeet Singh Bedi are located.

The court further said, “From the statement of witnesses examined by the CBI, it also appears that on 01.11.1984, at around 09:00 A.M., thousands of people had gathered in front of Gurudwara Pul Bangash and they were shouting, “kill Sikhs because they have killed our Prime Minister”. They were looting the shop of Amarjeet Singh Bedi, creating a ruckus in front of the Gurudwara and throwing fire bottles in the Gurudwara.”

The court noted citing the material on record, “It appears that on 01.11.1984, a mob of thousands of persons, armed with “lathis”, iron rods, sharp-edged weapons, hammers, sticks, petrol etc. had gathered at Gurudwara Pul Bangash, Azad Market with the common object to destroy/damage Gurudwara Pul Bangash, kill Sikh persons and loot their properties.”

“Thus, they constituted an unlawful assembly. They had set Gurudwara Pul Bangash on fire, killed Badal Singh, Thakur Singh and Gurcharan Singh, criminally trespassed into the shops and house of Sikhs and also looted properties of Sikhs, including shop of Amarjit Singh Bedi,” the cover noted.

It has also come on record that the accused, who was a well-known person, led the mob

and instigated/incited the mob to kill Sikhs and loot their properties.

In view of the legal position, even if other accused persons are unknown or can not be traced, the accused can still be charged, along with such unknown persons under sections 149 IPC, the court held.

It can be seen that there is nothing on record to show that during the incident in question, the accused (Jagdish Tytler) was armed with a deadly weapon or with anything used as a weapon of offence was likely to cause death, the court said.

The court said that from the material brought on record, it appears that on 01.11.1984, at or about 11:00 A.M., Near Gurudwara Pul Bangash, falling within the jurisdiction of PS Bara Hindu Rao, accused Jagdish Tytler, along with other unknown persons, has intentionally joined and was a member of an assembly of thousands of persons and the common object of the said assembly was to cause destruction/damage to Gurudwara Pul Bangash, kill Sikh persons and loot their properties.

The court also noted that it has also come on record that some members of the unlawful assembly, of which the accused was a member, committed house trespass in the shop of Amarjeet Singh Bedi, situated in front of Gurudwara Pul Bangash and committed theft of TV sets, VCRs, telephones etc. in the said shop.

As per FIR No. 316/84 dated 01.11.1984, PS Bara Hindu Rao, Delhi on 01.11.1984, Sub Inspector (SI) Ranveer Singh was on patrol duty along with Police constables Chandra Kishore and Nawab Singh at Azad Market, near Pul Mithai, when information was received by them that some people had gathered in front of Gurudwara, Azad Market and were setting it on fire.

SI Ranveer Singh, along with the police officials, reached Gurudwara, Azad Market, where ASI Swaran Singh and Police Constable Raghunath Singh were present.

He found that a mob of thousands of people were shouting slogans that Gurudwara, Azad Market would be completely burnt and that no Sikh person will be allowed to escape alive from there. The fire was raging inside and outside the Gurudwara. Some rioters were throwing tyres into the fire due to which the fire was getting worse.

SI Ranveer Singh, along with other police officials, tried to pacify the mob by stating that Section 144 of Cr.P.C. was in force and, thus, people could not gather there. Some people left the spot while others continued to stay and got into heated exchanges with the police officials. ASI Swaran Singh arrested 31 persons under section 107/151 Cr.P.C. for disturbing law order.

Later, when the crime scene was inspected, two human bodies, which had been burnt using tyres, were found. It was also noticed that amongst other shops, one shop named Bedi Electricals was looted by the mob.

Accordingly, FIR No. 316/84, under Sections 147, 148, 149, 302, 457, 380, 436, 188 and 295 IPC, was registered at PS Bara Hindu Rao, Delhi.

During the investigation, it was revealed that three persons, namely, Badal Singh, Thakur Singh and Gurcharan Singh, were killed by the accused persons on 01.11.1984 by burning them.

However, only two burnt-dead bodies could be recovered from the crime scene. The third dead body was completely burnt and no remains of the same could be recovered. (ANI)

US Rapper Fatman Scoop Dies After Collapsing On Stage

Rapper Fatman Scoop is no more.

As per The Hollywood Reporter, Scoop, Isaac Freeman III, died after collapsing onstage this weekend. He was 53.

The mishap happened on Friday while he was performing at Town Center Park in Hamden, Connecticut. His family announced his death on Saturday morning, but gave no cause.

In their statement, the family referred to Freeman as “a radiant soul, a beacon of light on the stage and in life” who, of being a “world class performer” was also “a father, brother, uncle and a friend.”

“He was the laughter in our lives, a constant source of support, unwavering strength and courage,” they continued. “FatMan Scoop was known to the world as the undisputed voice of the club. His music made us dance and embrace life with positivity. His joy was infectious and the generosity he extended to all will be deeply missed but never forgotten.”

Freeman is survived by his son, daughter and brother. (ANI)

It’s A Hard-Working Industry Don’t Destroy It: Mohanlal On Hema Committee Report

In his first address after resigning as the President of the Association of Malayalam Movie Artists (AMMA) amid the #MeToo storm in Mollywood, actor Mohanlal on Saturday, urged people not to “destroy” the Malayalam industry.

The actor welcomed the Hema Committee report and asserted that the guilty will be punished and they will cooperate in the investigation. He also informed that elections for the new positions in AMMA will be held soon.

A redacted version of the Justice Hema Committee report on harassment faced by women in the Malayalam cinema industry was made public, earlier this month. The report containing shocking accounts of harassment, exploitation, and ill-treatment of women professionals has taken the whole industry by storm.

“When such incidents happen, which might lead to the destruction of the entire industry, we do not know what else to do. We request you not to put the entire focus on AMMA. The investigation is going on, and all the statements are out in the public,” the veteran actor told reporters on Saturday.

“There are disagreements in the association as well, so we will take appropriate action. There will be an election soon. This is not any kind of escape. Please don’t put unnecessary blame on the association. We welcome the Hema Committee report. It was the correct decision by the government to release that report. We welcome that. I was AMMA president for the last two terms. The entire Malayalam cinema is answerable for the resignation of the executive members,” he added.

Earlier this week, Mohanlal, along with other AMMA leaders, resigned from their positions following serious allegations of sexual abuse made by several female actors against prominent figures in Malayalam cinema, including director Ranjith and actors Siddique and Mukesh.

Further urging the media and the public not to paint the entire industry in a negative light, the actor emphasised it is a very ‘hard-working’ industry. He added that the

“AMMA cannot answer all the questions. Everybody should be asked these questions. This is a very hard-working industry. A lot of people are involved in this, but not everyone is to be blamed. The responsible ones will be punished. The investigation is underway. We cannot change the law for anyone; those involved will be punished. Don’t destroy the industry.”

“The investigation will definitely happen. We cannot suddenly come up with a solution. Problems faced by junior artists are also being looked at. Suddenly, there is an explosion of names coming out. Haryana Police Arrests 7 For Murder Of Migrant Labourer

Haryana police have arrested seven people, including two minors, in connection with the murder of a migrant labourer in Haryana’s Charkhi Dadri district, police said.

The deceased has been identified as Sabir Malik. The arrested persons have been identified as Abhishek, Ravinder, Mohit, Kamaljeet and Sahil, according to Haryana police.

Deputy Superintendent of Police (DSP) Dheeraj Kumar said that the police have registered a case under Bharatiya Nyaya Sanhita (BNS) and are actively investigating the matter. The accused have been taken into police remand and are being questioned.

“A migrant labourer was beaten to death by some people. A case has been registered under BNS and 7 people, including 2 juveniles, have been arrested. Police is working on the case actively and the accused have been taken on police remand and are being questioned,” DSP Kumar said.

Further investigation into the case is underway, police said.

Haryana Chief Minister Nayab Singh Saini termed the murder of a migrant in Haryana’s Charkhi Dadri district an “unfortunate” incident and said that such incidents should not happen.

“It is not right to say things like mob lynching, because a strict law has been made in the Assembly for cow protection and there is no compromise on it…I want to say that such incidents should not happen and these incidents are unfortunate,” Haryana CM said. (ANI)

Bihar: Man Tries To Attack Giriraj During Begusarai Event

One person has been arrested for allegedly attempting to attack Union Minister Giriraj Singh by breaking the security cordon during an event in Bihar’s Begusarai, the police said.

The incident happened during Singh’s ‘Janta Darbaar’ in Begusarai on Saturday.

As the Union Minister was leaving the venue following his address, a group of miscreants allegedly tried to attack him and raised “Muradabad” slogans.

Following this, one person was detained by the officials.

Begusarai Superintendent of Police, Manish confirmed the accused person has been arrested for “behaving indecently” during the event and tried to break the security cordon.

The accused has been identified as Shahzad alias Saifi.

“One person has been arrested. The Union Minister (Giriraj Singh) had a program in the Ballia subdivision this afternoon, during which a person behaved indecently. The policemen present in the security cordon caught him and further action is underway,” the SP said.

“The person’s name is Shahzad alias Saifi, he was caught behaving indecently and trying to break the security cordon… He is a resident of Ballia and is said to be a ward councillor,” he added.

Giriraj Singh, who is the Minister of Textiles and also BJP MP from Begusarai, strongly condemned the incident and said he won’t get ‘scared’ of these attacks.

“I am Giriraj and I will always speak and fight for the interests of the society. I am not going to be scared by these attacks. Those who pamper and caress them on seeing their beard and cap should see today how land jihad, love jihad and communal tension is being created in the entire country including Begusarai, Bihar,” Giriraj Singh stated in a post on X.

The Union Minister alleged that if the miscreant had a revolver in his hand, he would have killed him. He also reiterated Uttar Pradesh Chief Minister Yogi Adityanath’s “Batenge to Katenge” remark.

Speaking to ANI, Singh said, “In this election, the attitude of Muslims towards me in Begusarai and the results that came, Yogi Adityanath rightly said that, “Batenge to Katenge”. If this man had a revolver in his hand, he would have killed me the way he attacked me. However, his attack failed. He used very abusive language.”

“I will not get afraid and will continue my work. No matter how many terror mongers come, it will not affect me…Muslims in my area protested so much, the result of which was that they got so much courage that when I was in the janta darbar, despite the presence of many SDOs, DSPs, he behaved so rudely,” he added. Shreya on Saturday, took to her social media account to announce the decision.

In a statement that she shared on her Instagram account, the singer revealed that she is deeply affected by the gruesome incident.

“I am deeply affected by the gruesome and heinous incident that recently took place in Kolkata. Being a woman myself the very thought of sheer brutality that she must have gone through is unthinkable and sends shivers down my spine,” read her statement.

“With an aching heart and with deep sorrow, my promoters (Ishq FM) and I wish to reschedule our concert “Shreya Ghoshal Live, All Hearts Tour lshq FM Grand Concert” which was originally scheduled for the 14th of September 2024, to a new date in October 2024. This concert was highly anticipated by all of us, but it is absolutely imperative for me to take a stand and join you all in solidarity. 47 Indian nationals who were trapped in cyber-scam centres within the Golden Triangle Special Economic Zone (SEZ)

Indian Embassy In Laos Rescues 47 Nationals From Cyber-Scam Centres In Golden Triangle SEZ

In a significant rescue operation, the Indian Embassy in Laos has successfully secured the release of 47 Indian nationals who were trapped in cyber-scam centres within the Golden Triangle Special Economic Zone (SEZ) in Bokeo Province, Laos, an official press release by the Embassy stated.

This mission, which underscores the Embassy’s commitment to the safety and well-being of Indian citizens abroad, was executed in close coordination with local authorities in Laos.

The situation came to light when Lao authorities, during their crackdown on illegal activities in the Golden Triangle SEZ, handed over 29 Indians to the Embassy. The remaining 18 individuals had independently approached the Embassy, expressing distress and seeking assistance to escape their predicament.

The Golden Triangle SEZ, located near the borders of Thailand, Laos, and Myanmar, has gained notoriety as a hub for illegal activities, including cyber scams that target unsuspecting individuals.

To facilitate the rescue, Embassy officials travelled from Vientiane to Bokeo, engaging directly with local authorities to ensure the safe release of these individuals. The Embassy arranged transportation for the rescued nationals from Bokeo to Vientiane, and upon their arrival, provided them with accommodation and food.

The swift and coordinated response highlights the Embassy’s proactive approach in addressing such emergencies.

Upon the group’s arrival in Vientiane, they were met by Prashant Agrawal, the Ambassador of India to Laos. Ambassador Agrawal personally interacted with the rescued individuals, discussing the challenges they faced and advising them on the next steps.

His involvement underscores the high priority placed on the safety of Indian nationals in foreign countries.

The Embassy has already completed all necessary procedural requirements with Lao authorities to facilitate the repatriation of these individuals to India.

Out of the 47 rescued, 30 have already returned safely or are in the process of returning, while the remaining 17 are awaiting final travel arrangements and are expected to leave Laos shortly.

Ambassador Agrawal emphasized the Embassy’s unwavering commitment to the safety of Indian citizens, stating, “Ensuring the safety and well-being of Indians is a matter of top priority for the Embassy. Any request for help received from those in distress is taken up urgently and promptly, with all due assistance extended.”

This latest operation is part of a broader effort by the Indian Embassy in Laos, which has successfully rescued 635 Indian nationals from similar situations in the past. The Embassy expressed its gratitude to the Lao authorities for their cooperation in these rescue efforts and has urged them to take action against the unscrupulous elements responsible for such activities.

The matter has also been raised at the highest levels to prevent future occurrences.

The Embassy has issued a strong advisory to Indian nationals considering job offers in Laos, urging them to exercise caution and conduct thorough due diligence to avoid being deceived.

Jaishankar Calls China A ‘Unique Problem’

Calling China a ‘unique problem’, External Affairs Minister S Jaishankar said that India is not the only country in the world that is having a debate about that country.

Addressing the ET World Leaders Forum on Saturday, Jaishankar said everyone chose to consciously overlook the nature of Chinese production decades ago, and are now complaining.

“China is a unique problem because it has a unique polity and economy. It’s not just an Indian problem. If today people are complaining about trade deficits with China, it is because decades ago, we all consciously chose to overlook the nature of Chinese production and the advantages that they enjoyed in a system where they got a level playing field with all the advantages that they brought to bear,” Jaishankar said.

“There is a general China problem. We are not the only country in the world which is having a debate about China,” he strongly asserted.

Citing an example of Europe and the US, the EAM said, “Go to Europe and ask them, what is today among your major economic or national security debates? It’s about China. Look at the United States, it’s obsessed with China, and rightly so in many ways.”

Notably, in 2020, the Indian and Chinese troops clashed at Galwan, the same year the pandemic started.

Since May 2020, when the Chinese troops tried to aggressively change the status quo on LAC in eastern Ladakh, both sides have been deployed in forward positions near Patrolling Point 15, which emerged as a friction point in the wake of the Galwan clash.

Meanwhile, Jaishankar further asked, “What happens when you have multiple neighbours?”

And then, making a thinly-veiled reference to neighbouring nations of Bangladesh and Pakistan, Jaishankar termed neighbouring countries as ‘democratic polities’, saying that the change in government will always give rise to political debates in the country.

“You know, by definition, relationships with neighbours are very complicated. They are all democratic polities. Governments will change, and there will be political debates in their country. Often, we will be the centre of those debates. It’s natural as we are a big country. We have to expect, plan and build into our policy, making an expectation that there will be changes, some more organic and some more disruptive in our neighbourhood,” the minister went on to say.

Jaishankar on Friday said that India has to find a ground of mutual interest with Bangladesh and India would deal with ‘the government of the day’.

Speaking at the release of Ambassador Rajiv Sikri’s new book, “Strategic Conundrums: Reshaping India’s Foreign Policy”, the External Affairs minister said that the political changes in Bangladesh can be ‘disruptive’.

“Since Bangladesh’s independence, our relationship has gone up and down, and it is natural that we will deal with the government of the day. But we also have to recognise that there are political changes, and they can be disruptive. And clearly here we have to look for mutuality of interest,” he said.

The minister also did some plain speaking about India’s relationship with its neighbour Pakistan.

“I think the era of uninterrupted dialogue with Pakistan is over. Actions have consequences. And insofar as Jammu and Kashmir is concerned, I think Article 370 is done. So the, the issue today is what kind of relationship can we possibly contemplate with Pakistan?…Whether events take a positive or a negative direction, either way, we will react to it,” Jaishankar said. Many Strict Laws Made For Safety Of Women: Mod

Amid the growing outrage over the alleged murder and sexual assault of a female trainee doctor in Kolkata, Prime Minister Narendra Modi reiterated that many strict laws have been made in the country for the safety of women.

He said half the population (women) will get maximum security when swift action is taken in cases related to atrocities of women.

“Today, atrocities against women, safety of children… are serious concerns of the society. Many strict laws have been made in the country for the safety of women, but we need to make it more active. The faster the decisions are taken in cases related to atrocities against women, the greater assurance of safety half the population will get.”

Prime Minister Narendra Modi was addressing the inaugural event of the 2-day National Conference of District Judiciary, at Bharat Mandapam on Friday.

His remarks came after West Bengal Chief Minister Banerjee on Friday wrote to PM Modi, reiterating her request for stringent central legislation and exemplary punishment on heinous crimes like rape and murder.

In his address, PM Modi said, “In the Amritkaal of Independence, 140 crore countrymen have only one dream – Developed India, New India. New India, that is – a modern India in thinking and determination. Our judiciary is a strong pillar of this vision.”

Prime Minister Modi said that significant efforts had been made to eliminate delays in justice.

“In the past decade, significant efforts have been made at various levels to eliminate delays in justice. In the last 10 years, the country has spent an amount worth around Rs8,000 crore on the development of judicial infrastructure. Interestingly, 75% of the total amount spent on judicial infrastructure in the last 25 years has been spent in just the last 10 years alone,” the PM said.

“We have got new Indian judicial law in the form of Indian Judicial Code. The spirit of these laws is – ‘Citizen First, Dignity First and Justice First’. Our criminal laws are free from the colonial mindset of rulers and slaves,” he added.

PM Modi also praised the Apex Court and said that the judiciary is the protector of the Constitution.

“In our democracy, the judiciary is considered the protector of the Constitution. This is a huge responsibility in itself. We can say with satisfaction that the Supreme Court has made an excellent effort to fulfill this responsibility,” PM Modi said.

“The people of India have never distrusted the Supreme Court, our judiciary. The 75 years of the Supreme Court, as the ‘mother of democracy’, further enhance India’s pride. This also strengthens our cultural ethos, which say, ‘Satyamev Jayate-Nanritam’,” the PM added.

Before his address, PM Modi inaugurated the two-day National Conference of District Judiciary and unveiled the stamp and coin commemorating 75 years of the establishment of the Supreme Court of India. Chief Justice of India DY Chandrachud presented a memento to Prime Minister Narendra Modi at the event.

The Supreme Court is organising a two-day national conference of the district Judiciary beginning August 31 and September 1.

The two-day Conference, organised by the Supreme Court of India, will host five working sessions that will deliberate and discuss on the issues related to district judiciary such as infrastructure and human resources, inclusive courtrooms for all, judicial security and judicial wellness, case management and judicial training.

Union Minister Arjun Ram Meghwal, Chief Justice of India DY Chandrachud and President of the Supreme Court Bar Association, Kapil Sibal, were also present at the event. (ANI)
