It is outrageous, both in law and morally. Procedurally, the question of remission should have gone to the Maharashtra State, where the trial happened. The Supreme Court in 2016 had established it in the union of India vs V. Sriharan, which the Gujarat High Court had relied upon, when one of the convicted, Lala Vakil, in the ‘Bilkis Bano gang rape and murder of her family case’, had moved court for premature release.

The SC, in its May order too, had not pronounced the remission — it had only asked the Gujarat government to consider it. The constitution of the committee, with the non-official members being BJP leaders, including elected representatives, further establishes that at every step, the stage was set for the release of the convicted. Also, the permission of the presiding judge, who convicted the accused, was not sought. That should ideally have been the Mumbai trial court which sentenced the 11 accused in 2013.

Since the CBI had investigated the case, it is also clear in law that the Gujarat government should have consulted the central government in Delhi, since its opinion would be mandatory in the remission. Did the Gujarat government seek its opinion? It is time the Union Ministry of Home Affairs clarified this position.

Being a crime against humanity, there was no way that remission should have been granted. The revised guidelines of remission as listed in 2014 are clear on this, but the Gujarat government, again making it easy for the convicts, decided to use the 1992 guidelines.

This aspect is what is chilling; that the survivor of rape and a witness of the murder of 14 people of her family, including three children, including her own 3-year-old daughter, is expected to live everyday with the killers and rapists (confirmed by court) living close by. Did the committee not see this aspect while upholding the remission?

It is not that the women’s movement does not believe in the remission of those convicted against acts of violence against women. But this is unprecedented as there is no such example for remission for such a heinous crime. If the convicted were medically not well, or facing debilitating illnesses, or, simply could not take care of themselves, as was the case of Father Stan Swamy, there was still a cause for consideration. Father Stan was 83 and an under trial; he was not granted bail and denied even a sipper.

Or consider the case of 93-year-old Dr Habib, arrested on charges of terrorism, who could not even clean himself. The jail manual is clear that if the physical strength of the prisoner is reduced to half of what it was at the time of committing the crime, his case should be considered.

This has raised a new question for the women’s movement; that first we have to struggle for justice at every step, from the lodging of the FIR, fair investigation, filing of a proper charge sheet, and ensuring that good lawyers are available to fight it out in the trial court. The protracted trial itself becomes difficult when the woman has to speak her testimony in front of her own rapists. In the current circumstances, it is a signal that if at all the judgement does come in favour of the woman, it can be done away with a stroke by the executive if it wants to reverse it through remission.

The remission policy was a humanitarian dimension in our Constitution and criminal law, but to convert it for the sake of one party wanting to show that it has met the aspirations of the people by granting remission to Brahmins, as they are ‘sanskaris’, as stated by the MLA of the remission committee, shows that this dimension too can be abused. It adds to a terribly frightening scenario for Muslim women in particular, who are vulnerable to sexual violence in the present majoritarian and xenophobic times, even while the issue of hijab is still unsettled. Indeed, this is a big blow for Muslim women in India.

This example is clear — that in the contemporary, majoritarian times of the re-establishment of the chaturvarna system, through Brahminism, which is integral to the ideology of Hindutva, Muslims, Dalits, adivasis, and all women, will be affected. The Manu law will be re-established. All women will consequently face attacks and women’s rights will be violated encompassing all women across the spectrum.

Savarkar clearly said that the ‘othering’ of the women of the ‘enemy’ – read, the minorities, Muslims, Christians, communists, etc, – is acceptable and part of the struggle to make Bharat a Hindu Rashtra. Well, we are almost there. Indeed, historically, the contestation between communities always happens over women’s bodies! Surely, this is another kind of organised violence.

Bhagwant Opens Khedan Watan Punjab Dian Event, Tries Hand At Volleyball

Punjab Chief Minister Bhagwant Mann inaugurated a sporting event named ‘Khedan Watan Punjab Dian’ at Guru Gobind Singh stadium in Jalandhar on Monday.

CM Mann also tried his hand at playing volleyball with players.

“I love playing sports, I have come here to participate. Chief Minister also played with us, he talked about sportsmanship and motivated us to play for Punjab and for the country,” a player participating in the tournament told ANI.

“It was great to have our Chief Minister playing with us, it was a very good experience,” another participant said.

Under an initiative to promote sports in the state, the Department of Sports and Youth Services, Punjab is organising “Khedan Watan Punjab Diyan-2022” from September 1st to October 21st.

Block-level tournaments will be held from September 1st to 7th followed by district-level tournaments from September 12 to 22nd. The final state-level tournaments will be organised from October 10 to 21. (ANI)

Sisodia, Wife At Bank As CBI Searches Locker

Delhi Deputy Chief Minister Manish Sisodia on Tuesday reached a Punjab National Bank (PNB) branch in Ghaziabad on Tuesday for the Central Bureau of Investigation’s (CBI) search of his locker in connection with its probe into alleged irregularities in the capital’s now-withdrawn excise policy.

Sisodia was accompanied by his wife.
CBI officials will search his locker in connection with the ongoing probe into the alleged scam in the recently withdrawn excise policy of the Aam Aadmi Party government.

Last week, several raids were conducted at 21 places in Delhi and National Capital Region including the residence of Manish Sisodia and the premises of four public servants, according to a CBI official. The official said that raids were conducted in locations across 7 states.

Sisodia had then tweeted: “We are honest, building a future for lakhs of children. Unfortunate that in this country, whoever does good work is hassled just like this, that is why our country is still not number-1.”

The probe into Sisodia was done after taking into account a report forwarded by the Chief Secretary to Delhi’s Lieutenant Governor VK Saxena recommending a CBI investigation into the matter.

The LG office said that Sisodia also extended financial favours to liquor licensees much after the tenders had been awarded and thus caused considerable losses to the exchequer.

The excise policy was passed in Chief Minister Arvind Kejriwal-led Delhi Cabinet in the middle of the deadly Delta Covid-19 pandemic in 2021. The Delhi government’s version is that the policy was formulated to ensure the generation of optimum revenue, and eradicate the sale of spurious liquor or non-duty paid liquor in Delhi, besides improving user experience.

Following LG’s recommendation, the office of the Assistant Commissioner of Delhi Police’s Economic Offence Wing (EOW)issued a notice to Delhi’s Excise Commissioner asking him to provide all documents relating to the award of liquor licenses under the new excise policy. (ANI)

With a total net worth of USD 137.4 billion, 60-year-old Adani has surpassed the wealth of Louis Vuitton chairman Arnault and is now just behind business magnate Elon Musk and Jeff Bezos in the ranking.
In the latest Bloomberg Billionaires Index, Reliance chief Mukesh Ambani is at number 11 with a total USD 91.9 billion worth.

This is the first time an Asian person has broken into the top three of the Bloomberg Billionaires Index.

The index is a daily ranking of the world’s richest people. Details about the calculations are provided in the net worth analysis on each billionaire’s profile page. The figures are updated at the close of every trading day in New York.

The net worth of Elon Musk and Jeff Bezos are currently at USD 251 billion and USD 153 billion, respectively.

Adani is a first-generation entrepreneur and the Adani Group comprises of 7 publicly listed entities with businesses spanning energy, ports and logistics, mining and resources, gas, defence and aerospace and airports. KRK Arrested At Mumbai Airport: 2020 FIR Alleging Hate

Actor Kamal R Khan, also known as KRK was arrested by Malad Police on Tuesday morning.

According to the police, KRK was arrested over FIR against his controversial social media posts back in 2020.
The FIR was lodged on the basis of a complaint by Yuva Sena leader Rahul Kanal on April 30, 2020, where he alleged that KRK’s tweets on the late Irrfan Khan and Rishi Kapoor allegedly spread “hatred”.

Rahul had said in the FIR that a person named Kamal R Khan is regularly spreading hatred on social media.

“He came into Bollywood with a movie named ‘Deshdrohi’ and is really acting like one. Even when the world is going through a pandemic, I can’t understand his inhumane behaviour and spreading hatred in all spheres of life.

The complainant said KRK was making hateful comments against late actors Irrfan Khan and Rishi Kapoor.

“After Irrfan Khan, who is India’s pride, passed away, he was making poor claims and statements on him. He was also talking crap about senior actor late Rishi Kapoor also,” he said in the complaint.

He also said that KRK is not in the country and requested PM Modi to file a case against him.

“This person is surely not in our country. I would like to urge our prime minister to kindly register a case against him under sections:- 505, 504, 501, 188, 117, 121 and 153 (A) of the Indian Penal Code (IPC), thereby setting an example for everyone to follow,” the complainant Rahul said in the complaint.

As per the information, Khan on Tuesday landed at the Mumbai airport after which he was apprehended.

Khan will be presented in Mumbai’s Borivali court today. (ANI)

Agenda Of India Out Campaign Is Hate: Maldives FM

Maldives Foreign Minister Abdulla Shahid has hit out at those fuelling the ‘India out campaign’ in the island nation.
Talking to ANI in New Delhi, Abdulla said it is a campaign launched by a group of people who have nothing to offer.

“They have no political, social, economic, development agenda. Their agenda is hate. This is what they are promising to the people of Maldives and we’ll not buy into hate,” he said.

Ministry of External Affairs has said that the ‘India out’ campaign was based on misinformation and false propaganda and does not reflect the views of the people of Maldives.

The campaign is led by the Maldives opposition led by former pro-China Maldives President Abdulla Yameen.

The economic crisis has hit small island nations like Sri Lanka, a neighbour of Maldives. Sri Lanka recently witnessed massive protests and ousting of leadership over the economic crisis. The inability to pay fuel bills and huge debt was also an issue faced by Lanka. Asked whether the Maldives is vulnerable and can slip into a similar economic crisis owing to huge debts, Shahid said, “so far we have been able to pay all our debts even in this difficult period (COVID-19 pandemic) with the G-20 debt suspension initiative”.

“Many countries have been able to go through it and I hope we will survive,” he said.

He also referred to the travel bubble between Maldives and India during the COVID-19 pandemic.

“When the rest of the world shuts down, our tourism industry is shut down but it is also a fact that at the height of the pandemic, we were able to reach understanding with India on the travel bubble between Maldives and India, providing for Indian tourists’ visit to the Maldives in 2020. For example, at the height of the pandemic, we were able to receive over half a million tourists which kept our industry moving and since then the economy is recovering. The pace of recovery is good and our economy is stable,” Shahid said.

“We live in an interconnected world, war in Europe has badly affected Maldives as many other countries. Food crisis, fuel crisis, everything affects everyone…during pandemic from a middle-income country, we went to lower-income country overnight,” he added. (ANI)

Madarsa Linked To Terror Activity Demolished: Assam’s Barpeta

The Assam government on Monday demolished a Madarsa alleged to be involved in anti-national activities, after it was found to be on government land in the Barpeta area.

The Additional Deputy Commissioner said that the place is involved in anti-national activities and Jihadi outfits.
“This institution is involved in anti-national activities, Jihadi outfits. We immediately came to the spot, verified the property, and found it to be on government land and did not find the owner. So we decided to demolish it immediately,” Lachit Kumar Das, Additional Deputy Commissioner said.

While addressing the issue, Chief Minister Himanta Biswa Sarma said that the Madarsa management were not running the institution but were running a terrorist hub.

“This is the second Madrasa we evicted as they were not running as an institution but were running as a terrorist hub. I don’t want to generalise, but we investigate and take appropriate action when a complaint of fundamentalism comes,” Sarma said.

Assam Police have also arrested two more persons linked with Al-Qaeda Indian Subcontinent (AQIS) and Ansarullah Bangla Team (ABT) in the Barpeta district on Monday morning.

37 persons have been arrested so far in connection with AQIS-ABT in Assam. (ANI)

CBI Will Look Into My Locker Tomorrow: Sisodia

Delhi Deputy Chief Minister Manish Sisodia on Monday claimed that the “Central Bureau of Investigation (CBI) is going to come to see his bank locker tomorrow” adding that nothing will be found in the locker like nothing was found in the 14-hour raid at his residence on August 19.

He further said that he and his family would fully cooperate in the investigation.
“Tomorrow, CBI is coming to see our bank locker. Nothing was found in the 14-hour raid at my house on 19th August. Nothing will be found in the locker either. Welcome CBI. My family and I will fully cooperate in the investigation,” Sisodia said in a tweet in Hindi.

On August 19, the CBI had conducted a 14-hour-long raid at the residence of Sisodia in the Excise police case.

Searches were conducted in seven States and a Union Territory, including the premises of former Delhi Excise Commissioner Arava Gopi Krishna.

Sisodia was among 15 persons booked in the FIR filed by CBI. Excise officials, liquor company executives, dealers along with unknown public servants and private persons have too been booked in the case.

The CBI had filed a case against over alleged corruption in the 2021-22 excise policy. The excise policy was subsequently withdrawn by the AAP government.

The FIR said that “facts in the matter prima facie disclose the commission of offences” punishable under section 120-B, 477A IPC and section 7 of the Prevention of Corruption Act 1988″ against the accused.

The premises of the then Excise Commissioner Arava Gopi Krishna and Anand Tiwari were among those searched.

CBI had earlier issued a Look Out Circular (LOC) against eight accused – all private persons – in connection with the CBI case for alleged irregularities in the excise policy.

It was alleged that irregularities were committed including modifications in the Excise Policy and undue favours were extended to the license holders including waiver or reduction in licence fee, an extension of L-1 license without approval etc.

It was further alleged that illegal gains on the count of these acts were diverted to concerned public servants by private parties and making false entries in their books of accounts.

The raids have led to a political slugfest with BJP leaders including Union Minister Anurag Thakur hitting out at Kejriwal and Sisodia over alleged “liquor corruption”. AAP has termed the allegations as politically motivated. (ANI)
