SC Closes Contempt Cases Pertaining To Babri Mosque Demolition

The Supreme Court on Tuesday closed contempt petitions filed against some BJP leaders, the Uttar Pradesh government, and its officials arising out of the demolition of Babri Masjid in Ayodhya.

A three-judge bench of Justices Sanjay Kishan Kaul, Abhay S Oka and Vikram Nath said that in view of the passage of time and the 2019 apex court’s judgement on the Ram Janmbhoomi-Babri Masjid land dispute case in Ayodhya, the contempt cases don’t survive.
The contempt petition was filed by one Mohammed Aslam Bhure in 1992 against the Uttar Pradesh government for violation of the undertaking given to the court regarding the maintenance of law and order in the area.

The contempt case proceedings were initiated against Uma Bharti, Murli Manohar Joshi, Sadhvi Ritambara, Vinay Katiyar and others.

Noting that the contempt petitioner Bhure had passed away in 2010, the bench said that in this backdrop, nothing survives in the matter. (ANI)

Ghulam Nabi To Hold Public Meeting In Jammu On Sept 4

Former Union Minister Ghulam Nabi Azad, who quit the Congress last week and has decided to float a political party, will hold a public meeting on September 4 at Sainik Colony in Jammu.

This will be his first meeting since he snapped his nearly 50-year-long association with Congress. The public meeting is scheduled for 11 am.

Azad has said that he will launch a new party soon and the first unit will be formed in Jammu and Kashmir in view of impending assembly polls. Azad was Chief Minister of Jammu and Kashmir from 2005 to 2008.

With Azad signalling that he will float a new party, several leaders have resigned from the Congress in Jammu and Kashmir.

Former Jammu and Kashmir Deputy Chief Minister Tara Chand is among 64 leaders who have resigned from the Congress.

In an indication of his political stock even as he has resigned from Congress, three party leaders who are members of Group of 23 met him at his residence in the national capital on Tuesday. Azad was also a member of G-23.

The leaders who met Azad were former Haryana Chief Minister Bhupinder Hooda, former Maharashtra CM Prithviraj Chavan and former union minister Anand Sharma.

In his resignation letter to Sonia Gandhi, Azad had targeted party leadership, particularly Rahul Gandhi, over the way the party has been run in the past nearly nine years.

In the hard-hitting five-page letter, Azad had claimed that a coterie runs the party while Sonia Gandhi was just “a nominal head” and all the major decisions were taken by “Rahul Gandhi or rather worse his security guards and PAs”.

Azad had said he was submitting his resignation with “great regret and an extremely leaden heart” and severing his about 50-year association with the Congress. He was earlier Leader of Opposition in Rajya Sabha.

Recounting his long association with the Congress, Azad had said the situation in the party has reached a point of “no return.”

“Unfortunately, the situation in the Congress party has reached such a point of no return that now ‘proxies’ are being propped up to take over the leadership of the Party. This experiment is doomed to fail because the Party has been so comprehensively destroyed that situation has become irretrievable. Moreover, the `chosen one’ would be nothing more than a puppet on a string,” he said.

While Azad took potshots at Sonia Gandhi in the letter, his sharpest attack was on Rahul Gandhi and he described the Wayand MP as “non-serious individual” and “immature”. (ANI)

After boycotting some of the Bollywood biggies ‘Laal Singh Chaddha’, ‘Raksha Bandhan’, ‘Dobaaraa’ and recently Vijay Deverakonda’s ‘Liger’, netizens are now eyeing a boycott of Ranbir Kapoor and Alia Bhatt’s upcoming sci-fi thriller film ‘Brahmastra: Part 1 – Shiva’.

Trollers are currently trending #BoycottBrahmastra on Twitter, asking the people not to watch the film.
Apparently, some netizens went through the archives and dug up actors Ranbir, Alia and Amitabh Bachchan’s previous portrayals in different films which have deeply affected their religious sentiments.

Talking about Ranbir, he made a guest appearance in Aamir Khan’s ‘PK’ as an alien, in which Aamir placed stickers of Hindu Gods on Ranbir’s cheeks for self-defence.

Along with this a clip from the ‘Saawariya’ actor’s film ‘Rockstar’ also surfaced on the internet in which he could be seen mocking a Hindu mantra, along with a decade-old clip from an interview where Ranbir stated that he loves to eat beef.

Meanwhile, Alia’s controversial advertisement for a clothing brand came into highlight once again during the #BoycottBrahmastra trend, in which, as per netizens, the ritual of Kanyadaan was portrayed as an oppressive practice.

Apart from that, Alia, in an interview, said that “if you don’t like me, don’t watch me”, which has triggered anger amongst netizens. The clip has gone viral on social media, with many Twitter users saying that they will boycott her upcoming film ‘Brahmastra’.

CM Soren, UPA MLAs Arrive At Ranchi Airport

The UPA MLAs on Friday arrived at Ranchi airport along with Jharkhand Chief Minister Hemant Soren.

Earlier CM Soren was seen spending quality time with his MLAs at the Latratu dam in the Khunti district of the state on Saturday.
This came soon after the meeting of Jharkhand’s ruling UPA coalition members, amidst speculation about Hemant Soren’s possible disqualification as an MLA in the state assembly for allegedly violating poll norms by extending a mining lease to himself. (ANI)

Chinese Mining Company Accused Of Killing Dozens, Stealing Gold By Trespassing

Dozens of local men are alleged to have died in mines run by a Chinese mining company in West Africa, which is accused of digging under a neighbouring concession to steal a huge amount of gold, media reports said.

According to a year-long investigation by the Sydney Morning Herald, Shaanxi Mining Company Ghana Ltd has also a bitter dispute with an Australian mining company that claims the state-linked Chinese firm seeking gold on an adjacent block dug long tunnels under their concession area to ‘steal’ gold valued at tens of millions of dollars.
Separated by 2.5 kilometres of rock, rubble and poverty above ground, the mines stand opposite each other. One is an Australian exploration mine run by Cassius Mining Limited. The other is a Chinese state-linked mine run by the Shaanxi Mining Company.

Both came here to make their fortune by tapping into the rich veins of gold that run through this ancient terrain but competition soon turned to suspicion and hostility. Now, they are involved in a bitter dispute over claims of trespass, theft and the deaths of more than a dozen miners.

Cassius suspected Shaanxi’s shafts ran as deep as 500 metres underground and had horizontal tunnels running into the Australian concession. A subterranean laser probe confirmed that Shaanxi’s tunnels were far more extensive than they had publicly revealed.

The Chinese miners had laid explosives at the entrance to their shafts. Shaanxi staff tried to forcibly block Cassius from entering sensitive areas. Fuelled by suspicion and language barriers, scuffles broke out between the Chinese and Australian camps.

Australian mining manager Andrew Head is still traumatised by the deaths of dozens of miners inside a Chinese state-linked mine in Africa, as per the media portal.

“One day as we were going into one area, the Chinese started running off, they had laid explosives nearby to show us we weren’t supposed to be in the mine,” says one member of Head’s team who asked not to be identified because of fears for their safety.

“It was very, very harrowing.”

A report commissioned by Cassius and seen by The Sydney Morning Herald and The Age found there was “a strong probability” that Shaanxi was trespassing on five levels of the Cassius concession, right along its eastern and northern borders.

“Clear evidence of trespass has been gathered which indicates that Shaanxi are mining and exploring into Cassius’s licence, to the north and east,” the report found. “Given the known geology and assumed grades of veins in the area, the amount of gold removed is probably significant.” (ANI)

It is outrageous, both in law and morally. Procedurally, the question of remission should have gone to the Maharashtra State, where the trial happened. The Supreme Court in 2016 had established it in the union of India vs V. Sriharan, which the Gujarat High Court had relied upon, when one of the convicted, Lala Vakil, in the ‘Bilkis Bano gang rape and murder of her family case’, had moved court for premature release.

The SC, in its May order too, had not pronounced the remission — it had only asked the Gujarat government to consider it. The constitution of the committee, with the non-official members being BJP leaders, including elected representatives, further establishes that at every step, the stage was set for the release of the convicted. Also, the permission of the presiding judge, who convicted the accused, was not sought. That should ideally have been the Mumbai trial court which sentenced the 11 accused in 2013.

Since the CBI had investigated the case, it is also clear in law that the Gujarat government should have consulted the central government in Delhi, since its opinion would be mandatory in the remission. Did the Gujarat government seek its opinion? It is time the Union Ministry of Home Affairs clarified this position.

Being a crime against humanity, there was no way that remission should have been granted. The revised guidelines of remission as listed in 2014 are clear on this, but the Gujarat government, again making it easy for the convicts, decided to use the 1992 guidelines.

This aspect is what is chilling; that the survivor of rape and a witness of the murder of 14 people of her family, including three children, including her own 3-year-old daughter, is expected to live everyday with the killers and rapists (confirmed by court) living close by. Did the committee not see this aspect while upholding the remission?

It is not that the women’s movement does not believe in the remission of those convicted against acts of violence against women. But this is unprecedented as there is no such example for remission for such a heinous crime. If the convicted were medically not well, or facing debilitating illnesses, or, simply could not take care of themselves, as was the case of Father Stan Swamy, there was still a cause for consideration. Father Stan was 83 and an under trial; he was not granted bail and denied even a sipper.

Or consider the case of 93-year-old Dr Habib, arrested on charges of terrorism, who could not even clean himself. The jail manual is clear that if the physical strength of the prisoner is reduced to half of what it was at the time of committing the crime, his case should be considered.

This has raised a new question for the women’s movement; that first we have to struggle for justice at every step, from the lodging of the FIR, fair investigation, filing of a proper charge sheet, and ensuring that good lawyers are available to fight it out in the trial court. The protracted trial itself becomes difficult when the woman has to speak her testimony in front of her own rapists. In the current circumstances, it is a signal that if at all the judgement does come in favour of the woman, it can be done away with a stroke by the executive if it wants to reverse it through remission.

The remission policy was a humanitarian dimension in our Constitution and criminal law, but to convert it for the sake of one party wanting to show that it has met the aspirations of the people by granting remission to Brahmins, as they are ‘sanskaris’, as stated by the MLA of the remission committee, shows that this dimension too can be abused. It adds to a terribly frightening scenario for Muslim women in particular, who are vulnerable to sexual violence in the present majoritarian and xenophobic times, even while the issue of hijab is still unsettled. Indeed, this is a big blow for Muslim women in India.

This example is clear — that in the contemporary, majoritarian times of the re-establishment of the chaturvarna system, through Brahminism, which is integral to the ideology of Hindutva, Muslims, Dalits, adivasis, and all women, will be affected. The Manu law will be re-established. All women will consequently face attacks and women’s rights will be violated encompassing all women across the spectrum.

Savarkar clearly said that the ‘othering’ of the women of the ‘enemy’ – read, the minorities, Muslims, Christians, communists, etc, – is acceptable and part of the struggle to make Bharat a Hindu Rashtra. Well, we are almost there. Indeed, historically, the contestation between communities always happens over women’s bodies! Surely, this is another kind of organised violence.

Bhagwant Opens Khedan Watan Punjab Dian Event, Tries Hand At Volleyball

Punjab Chief Minister Bhagwant Mann inaugurated a sporting event named ‘Khedan Watan Punjab Dian’ at Guru Gobind Singh stadium in Jalandhar on Monday.

CM Mann also tried his hand at playing volleyball with players.

“I love playing sports, I have come here to participate. Chief Minister also played with us, he talked about sportsmanship and motivated us to play for Punjab and for the country,” a player participating in the tournament told ANI.

“It was great to have our Chief Minister playing with us, it was a very good experience,” another participant said.

Sisodia, Wife At Bank As CBI Searches Locker

Delhi Deputy Chief Minister Manish Sisodia on Tuesday reached a Punjab National Bank (PNB) branch in Ghaziabad on Tuesday for the Central Bureau of Investigation’s (CBI) search of his locker in connection with its probe into alleged irregularities in the capital’s now-withdrawn excise policy.

Sisodia was accompanied by his wife.
CBI officials will search his locker in connection with the ongoing probe into the alleged scam in the recently withdrawn excise policy of the Aam Aadmi Party government.

Last week, several raids were conducted at 21 places in Delhi and National Capital Region including the residence of Manish Sisodia and the premises of four public servants, according to a CBI official. The official said that raids were conducted in locations across 7 states.

Sisodia had then tweeted: “We are honest, building a future for lakhs of children. Unfortunate that in this country, whoever does good work is hassled just like this, that is why our country is still not number-1.”

The probe into Sisodia was done after taking into account a report forwarded by the Chief Secretary to Delhi’s Lieutenant Governor VK Saxena recommending a CBI investigation into the matter.

The LG office said that Sisodia also extended financial favours to liquor licensees much after the tenders had been awarded and thus caused considerable losses to the exchequer.

The excise policy was passed in Chief Minister Arvind Kejriwal-led Delhi Cabinet in the middle of the deadly Delta Covid-19 pandemic in 2021. The Delhi government’s version is that the policy was formulated to ensure the generation of optimum revenue, and eradicate the sale of spurious liquor or non-duty paid liquor in Delhi, besides improving user experience.

Following LG’s recommendation, the office of the Assistant Commissioner of Delhi Police’s Economic Offence Wing (EOW)issued a notice to Delhi’s Excise Commissioner asking him to provide all documents relating to the award of liquor licenses under the new excise policy. (ANI)

With a total net worth of USD 137.4 billion, 60-year-old Adani has surpassed the wealth of Louis Vuitton chairman Arnault and is now just behind business magnate Elon Musk and Jeff Bezos in the ranking.
In the latest Bloomberg Billionaires Index, Reliance chief Mukesh Ambani is at number 11 with a total USD 91.9 billion worth.

This is the first time an Asian person has broken into the top three of the Bloomberg Billionaires Index.

The index is a daily ranking of the world’s richest people. Details about the calculations are provided in the net worth analysis on each billionaire’s profile page. The figures are updated at the close of every trading day in New York.

The net worth of Elon Musk and Jeff Bezos are currently at USD 251 billion and USD 153 billion, respectively.
