SC: Shinde Govt Gets Relief; Court Can’t Restore MVA As Uddhav Resigned

The Supreme Court on Thursday said that it cannot disqualify the Eknath Shinde-led Maharashtra government and rejected the submission to reinstate Uddhav Thackeray as chief minister because the latter had chosen to resign instead of facing a test of strength in the assembly.

After the verdict, Uddhav Thackeray said that people who had left his party had no right to ask him questions, and if Eknath Shinde has any morality he should submit his resignation.
A five-member Constitution bench led by the Chief Justice of India, which had been hearing a batch of petitions filed by both the groups of the Shiv Sena from February this year, today ruled that the exercise of discretion by the then Maharashtra Governor BS Koshyari to conduct a Floor Test was not in accordance with the Constitution of India. The bench also said that the Speaker’s decision to appoint Bharat Gogawale a whip of the Eknath Shinde group was wrong.

The whip has to be appointed by a political party, the court observed.

The Supreme Court referred its 2016 judgment in the Nabam Rebia case to a larger bench for judgment in the case of the defection of 16 MLAs in June 2022 from the then Uddhav Thackeray-led Shiv Sena.

The Thackeray faction had sought disqualification of the MLAs under the anti-defection law of the country.

The apex court said that the Speaker must decide on disqualification petitions within a reasonable time.

The top court said there were no communications relied on by the Governor indicating that the dissatisfied MLAs wanted to withdraw support to the government. The Governor erred in relying on the resolution of a faction of MLAs of Shiv Sena to conclude that Uddhav Thackeray had lost the support of the majority of MLAs.

It stated that the status quo cannot be restored as Uddhav Thackeray did not face the Floor Test and tendered his resignation. Hence, the Governor was justified in administering the oath to Eknath Shinde with the support of the largest party BJP.

The Supreme Court said that a Floor Test cannot be used as a medium to settle inter and intra-party disputes.

The Nabam Rebia judgment had held that Speakers cannot issue disqualification notices when a notice seeking their removal is pending.

The Supreme Court also said the Speaker if he finds that the motion for his removal is not as per procedure, then he could proceed with the petitions seeking disqualification of the MLAs.

The apex court held that the Speaker’s decision to appoint Bharat Gogawale (Eknath Shinde) as the whip of the Shiv Sena party was illegal. The top court said that the Speaker should recognize only the whip appointed by the political party.

The judgment was delivered by a five-judge bench of Chief Justice DY Chandrachud and Justices MR Shah, Justice Krishna Murari, Justice Hima Kohli, and PS Narasimha.

The five-judge bench delivered the judgment on a batch of cross-petitions filed by Uddhav Thackeray and chief minister M Eknath Shinde factions on the Maharashtra political crisis.

The then-governor Bhagat Singh Koshyari’s decision to invite Shinde to form the government along with the Bharatiya Janata Party after Thackeray chose to resign.

The court had earlier reserved the order after all the parties concluded their arguments. (ANI)

Sharad, Nitish Plan Joint Oppo Fight Against BJP

Nationalist Congress Party (NCP) national president Sharad Pawar on Thursday met with Bihar chief minister Nitish Kumar in Mumbai and the two leaders stressed on the need for opposition parties to work together in the interest of the nation.

Addressing a joint press conference with Kumar the veteran NCP leader said, “In the wake of the situation in the country, to save democracy, it is important to work together. After looking at the condition of the country, it seems that if we work together, there will be support for the alternative that the country needs.
“Yesterday, there were polls in Karnataka. As per my information, people there will oust BJP and elect a secular government”, Pawar said.

Addressing the joint press conference, the Bihar chief minister lashed out at the BJP.

“What the BJP is doing, is not in the country’s interest. So, the more the number of Opposition parties comes together, the better it is in the interest of the nation. We have spoken with several political parties. We will sit together and take further decisions,” Kumar said.

Asked if Sharad Pawar will be the main face of an Opposition alliance, the Bihar CM said, “There will be nothing more delightful than that…I have told him that he has to work strongly not only for his party but the entire country.”

Nitish Kumar who is also the JD(U) leader accompanied by Bihar deputy chief minster and RJD leader Tejashwi Yadav also met with Uddhav Thackeray at ‘Matoshree’ in Mumbai.

The JD(U) leader has been meeting Opposition leaders to strengthen the bloc against the BJP ahead of the 2024 Lok Sabha polls.

Kumar had caught the national imagination with his pitch for a “united opposition” which, he believes, can take on and defeat the BJP in next year’s Lok Sabha polls. The JD(U) supreme leader, who stunned the BJP last year when he snapped ties will visit Nationalist Congress Party Chief Sharad Pawar later in the day.

In his joint presser with Uddhav Thackeray today the Bihar chief minister speaking on a United Opposition candidate said, “This exercise is not done to advance their personal advance but for the good of the country and to give the people of India a good alternative to the present government.”

Kumar said that a decision on the candidate will be decided after the formation of the United Front and not before that.

“Those who are at the Centre are not working for the country…All political parties in the country need to unite to work together,” the Bihar chief minister said. (ANI)

Wrestlers’ Protest: Minor Wrestler Records Statement Before Magistrate

The minor female wrestler, who along with some other wrestlers has made sexual harassment allegations against Wrestling Federation of India chief Brijbhushan Sharan Singh, has recorded her statement before the magistrate.

Delhi Police said that the statement was recorded under CrPC 164 on Wednesday.
Delhi Police is conducting a probe into the sexual harassment allegations by wrestlers protesting at Jantar Mantar against Brijbhushan Sharan Singh, a BJP MP.

Two FIRs have been registered following a complaint by the wrestlers. Wrestlers have been on a protest at Jantar Mantar since April 23.

In their complaint to the police, the wrestlers alleged that seven female wrestlers, including a minor, were harassed by Brij Bhushan Sharan Singh.

Rio Olympic bronze medallist wrestler Sakshi Malik had on Wednesday asked Brij Bhushan Sharan Singh to undergo a lie detector narco test if he is confident of his integrity.

“I challenge the WFI president to take a Narco Test. We are also willing to take the test. Let the truth come out in the open, who is the culprit and who is not,” Malik said at a press conference at Jantar Mantar.

Olympic medallist Bajrang Punia said they want all competitions to take place under the ad hoc panel of IOA. “If the WFI chief is involved in any way, we will oppose it,” he said. (ANI)

Animal Rights Body Denies ‘Disrupting’ Parallel Event On Stray Menace

The India Unites For Animal Rights, an animal welfare group, has denied reports and video clips circulated on social media platforms, that insinuate that the group’s members gate-crashed an event on stray dogs menace organized on Wednesday at the Constitution Club of India.

The matter came to light when two parallel events were orgnised in the Constitution Club, one on ‘Peaceful Co-Existence: As Simple As ABC’ by India Unites For Animal Rights and the other addressed by former BJP Member of Parliament on menace of stray dogs.

The animal rights group session was addressed by eminent jurist Justice JR Midha and senior legal luminaries and attended by an audience of some 200 lawyers, teachers, actors, professionals and social activists including Mrs Romi Dev.

Several clips circulated on social media allegedly showed a clash between the organisers of the two events with some unruly scenes. India Unites For Animal Rights organisers, in a press statement, expressed their “shock” at the “allegations that our attendees gate crashed into an adjoining event” and called it a “completely false allegation”.

“Our entire event was filmed from beginning to end and no such thing took place,” the statement said. “We are told that the adjoining event organised by one Shri Vijay Goel was billed as a discussion forum to which all were invited. In that case there can be no ‘ gate crashing’.

An open discussion by its very nature invites all points of view and provides a platform for differing opinions where there is always the chance of friction.:

The rights group said, “By contrast, our session on the newly notified Animal Birth Control (ABC) Rules 2023 was peaceful, disciplined, positive and productive.”

“We are appalled that anyone should make false allegations against a well-intentioned citizens gathering to try and gain attention and misplaced sympathy and expect an apology,” it read.

Nitish Kumar is also planning a big meeting of all Opposition Leaders in Delhi on May 18.

Earlier yesterday, Nitish Kumar met with his Jharkhand counterpart Hemant Soren in Ranchi. After the meeting, both held a joint press conference at the Jharkhand Chief Minister’s residence.

Addressing a press conference, Bihar CM Nitish Kumar said that discussions on various issues were held with Jharkhand CM Hemant Soren.

“Discussed various issues with Chief Minister Hemant Soren today and agreed that we will work unitedly for the benefit of the country,” said Kumar.

Battle Against Ideologies In PoK, Gilgit-Baltistan

An ‘Age of Revolution’ is how the period between late 18th to mid-19th centuries is described by sociologists and political scientists as well as political economists. It was a period in modern history when revolutions took place in the Americas and Europe.

It was during this period in history that absolute monarchies were brought down or their powers curtailed in favour of public representative governments and in some cases a written constitution was adopted. This was undoubtedly a period in history that gave birth to the modern concept of nation and nation-state.
The industrial revolution in England, the Atlantic revolutions, Latin American revolutions resulted in the abolition of feudalism and the birth of the absolute hierarchy of trade and finance capital over the affairs of the state.

Consensus among historians, social scientists and philosophers exist that all these revolutions began after a certain section of social strata got inspired by the new ideas that formed the political narrative known as Enlightenment.

Enlightenment was a cultural/ideological rebellion against the decay of feudal socioeconomic production relations that paved the wave for industrial society.

Similarly, Industrial society gave birth to a new cultural/ ideological representation among forces of production and was based on the theory that society was divided into two antagonist classes: the capitalist and the working classes. This led to the formation and crystallization of the ideology of Marxism.

In Europe, Enlightenment gave rise to a social contract between the monarchy and the parliament as well as between the state and its subjects. The manifestation of this was western democracy.

Marxism, on the other hand gave rise to horrific dictatorships in Russia and the central Asian states and in China and later in Eastern Europe and Cuba.

The economic models of western democracy and the Marxist states were respectively two poles of economic extremes. One being based on free market and the other based on centralised and nationalized economies.

Both have failed as they try to grapple with the cycle of economic crisis that is caused due to the unbridled pursuit of profit or in case of Marxist economies the strangulation of free enterprise.

In Pakistan-occupied Kashmir including occupied Gilgit-Baltistan (PoK-GB), people have never had the freedom to flourish under either of the systems since both territories lacked big landlords or rich industrialists.

The main economic activity in both territories to this day have been government employment or economic migration to the Middle East, Europe, West Asia or North America.

The people of PoK-GB have never been in control of their destiny. They have depended on the ‘good will’ of the state of Pakistan and the occupying army for economic handouts. Therefore, psychologically they are more inclined toward the concept of fate and trust in Allah.

This makes the majority of the population vulnerable to fall prey to ideologies of various kinds. The most dangerous ideology that my people have fallen victim to is radical jihadi Islam.

During the 1960s, the upper intellectual strata of PoK was influenced by the Marxist ideology and a brief romance with the Chinese revolution and the idealism of guerrilla war as a legitimate tactic to gain freedom from Pakistan occupation became an obsession.

The Marxist tradition simply refused to recognise the national question in PoK and made the cause of independence subservient to class struggle that was Pakistan-centric.

However, during the early 1980s, when Pakistan started the Afghan-Jihad, things changed for the worst. Now the ideology of radical Islam was touted in PoK as a means to salvation and linked to Ghazwa-e-Hind. Again making the struggle for freedom from the colonial oppression of Pakistan subservient to the requirements of global Islamic jihad.

Both, the ideology of Marxism and the ideology of radical Islam and jihad, have been instrumental in holding back our struggle for freedom from Pakistan and re-join with mother India.

It has taken a long time for the young generation to come to terms with the fact that their relation with Pakistan is not that of equals but of master and subject. Over the past 4 years, social unrest and economic crisis has deepened their understanding of the colonial nature of their relation with Pakistan.

Social media revolution has helped the young generation to explore the world wide web and look for answers to their miseries. They have realised that it is Pakistan which attacked their state and divided and occupied their lands.

This realisation has brought a new life into the struggle for their salvation. Anti-Pakistan slogans have become the norm of any political or economic rights protest in PoK-GB. More and more young people want to join India and the union territories of Jammu and Kashmir and Ladakh.

It is under the threat of this new wave of radicalization that Pakistan has relaunched the Jamiat e Tuleba e Islam, a youth fascist organisation, in almost every college in the PoK.

A conference to stress the finality of the prophet of Islam, Muhammed, was held on April 30 in Jhelum valley, another seminar under the title ‘Nizam e Mustafa’ is being planned for Mirpur city. Pakistan military officers are regularly giving lectures to high school students on the tenants of Islam and Jihad and a new jihadi organisation, Janbaz Force, has recently been launch.

The purpose of the recent endeavour of raising the jihadi sentiment among the youth in PoK is to ‘re-educate’ them in the narrative of Jinnah’s two-nation theory and Islamic religious fascism.

Islam as an ideological weapon is being presented to the youth of PoK as a way of salvation from the decaying socio-economic conditions of PoK. The truth of the matter is that occupation, plunder and loot of our natural resources is the root cause of our backward socio-economic condition.

The way out of our misery is not hidden in the tenants of Islam but by rebelling against the occupation and becoming masters of our own natural resources. For this to happen a battle, not between ideologies but, against ideologies must be fought.

Acts Of Force Will Only Exacerbate Situation: Rijiju

Union Law Minister Kiren Rijiju on Thursday, appealed to people in Manipur to abstain from any form of violence and said efforts are on to work towards restoration of peace and order in the north-eastern State, which has been gripped by violence since May 3.

In an open letter written on behalf of the North East Member of Parliament Forum, Rijiju, who is also chairman of the body extended condolences to families of those who have lost their loved ones in the incidents in the State recently.
“The pain caused by the loss of lives and properties is irreplaceable, and our hearts go out to those who have been affected by these tragic events. We understand that emotions are running high at this moment, and people may be induced to violence. However, we appeal to every member of the community to abstain from the use of force or any kind of violence. Such acts will only exacerbate the situation and cause more harm to innocent people,” the Union minister wrote.

“We believe that every life is precious, and we are committed to working towards the restoration of peace and order in the affected areas. We are aware that our efforts will be incomplete without the cooperation of the public. Hence, we appeal to all members of the society to kindly help us in our endeavours to restore peace and order,” he elaborated.

A curfew was imposed on May 3 after violence broke out in the State. The State government also clamped down on the use of the Internet and mobile phones to ensure the spread of panic and false information could be curtailed.

Throughout this period, Manipur Chief Minister Biren Singh had multiple meetings via video conferencing with Union Home Minister Amit Shah and top officials of the Home Ministry to assess the situation and centre sending paramilitary forces to the state.

As per the official figures close to 60 people lost their lives while more than 230 were injured and close to 1700 houses were burnt down during the violence that erupted on May 3.

We urge all members of the community to come together during these difficult times and work towards restoring peace and harmony in our society, the Cabinet Minister appealed.

Members of Parliament from northeastern states cutting across political parties are part of the North East MPs Forum to further the cause of the northeastern region, especially development.

The forum was formed under the guidance of former Lok Sabha Speaker, P A Sangma. His son Meghalaya CM Conrad Sangma is also part of this forum. The President of the forum is Kiren Rijiju whereas the secretary is Congress MP Vincent Pala. (ANI)
