Uttar Pradesh Public Service Commission (UPPSC)

Delhi Waqf Board: AAP MLA Moves Delhi HC For Anticipatory Bail

Aam Aadmi Party, (AAP) MLA Amanat Ullah Khan approached Delhi High Court for a anticipatory bail in a money laundering case registered against him in connection with alleged irregularities by Delhi Waqf Board in the recruitment of staff and leasing of properties.

On Friday, the trial court denied him bail in Delhi Waqf Board Money Launderig case. He was earlier summoned by the ED in this case.

Senior advocate Menaka Guruswamy along with advocate Rajat Bhardwaj had argued on the bail application on behalf of Amanat Ullah Khan. It was argued by the Senior advocate Menaka Guruswamy that this case of Enforcement Directorate (ED) has registered this ECIR after 8 years (7 years 7 months) of CBI’S FIR lodged in 2016.

It has been alleged that Rs. 100 crore Waqf Properties were given on lease illegally. It is also alleged that 32 contractual employees were appointed in Delhi Waqf Board during chairmanship of Amanat Ullah Khan flouting the rules.

Senior advocate argued that the CBI concluded in its charge sheet that leasing out properties was administrative irregularities. There were no proceeds of crime, no undue advantage and loss to government exchequer.

It was also argued that the amount is Rs. 100 crore as similar to the CBI case. They still have to prove a scheduled offence. He was granted bail in CBI case on March 2023, Guruswamy said.

It was also argued that Salaries were paid to the workers for the work done by those employees. No undue advantage by the applicant. No recovery effected from the applicant. It was also submitted that on 28 September 2022, the accused was granted bail in ACB FIR.

It was held in the order, 32 contractual employees were paid Rs. 3 crores salaries through banking channel. No employee repaid the salary to the applicant. It means there is no undue advantage.

“I don’t know how I am (Amanat) involved in this case of sale id property. Till date there is no recovery of any sort. Rs. 27 crore is a big amount. Where is this amount and how this proceeds of crime. I am not even accused in this case,” the counsel argued.

Senior advocate further argued that there is no scheduled offence, no proceeds of crime, therefore there is no money laundering. There is no proceed of crime, no undue advantage, no loss to exchequer, there is no money laundering

” You (ED) can not lodge a new FIR on receipt of any new information. You can not have two FIR for the same cause,” Guruswamy argued

Special public prosecutors (SPP) Manish Jain and Simon Benjamin alongwith Advocate Snehal Sharda appeared for ED.

SPP Manish Jain rebutted the submission made by the senior advocate for Amanat Ullah Khan. He submitted that this entire case banked upon the role of Amanat Ullah Khan.

“At the nucleus of the entire controversy is A K. His name appears 83 times in the bail dismissal order of three accused persons. Order speaks itself,” Jain argued. Money laundering is layering. It is deep rooted conspiracy, he added.

He further argued that the summons issued to the applicant was challenged before the High Court and Prosecution Complaint (Charge Sheet) was also annexed with the petition.

This charge sheet was given to other accused on January 19, after cognizance of the same taken by the court.

The petition was withdrawn as not pressed. No liberty was sought or granted. You are giving up your rights, the SPP submitted.

This fact has been was concealed in this bail application. This is called malicious concealment, Manish Jain submitted.

Senior advocate Guruswamy objected to the submissions of the SPP Manish Jain. We have concealed nothing. Prosecutor can’t use this kind of language. No accused gives up his right of bail. And I am not even accused in this case.

Thereafter the SPP Jain referred to bail orders of three accused.

He submitted that Misappropriated worth Rs.100 crore property. ACB is investigating. Zeeshan and Daud Nasir acted on behest of applicant in connivance with Javed Imam Siddiqui and Qausar Imam Siddiqui, he added.

He again reiterated that at the nucleus of the case is Amanat Ullah Khan. There were 22 cases registered against him

He was declared bad character (BC) of the area and a history sheet was opened. It was challenged before the Delhi high court. The plea was dismissed. Special Leave Petition (SLP) is pending before the Supreme court.

Concluding his arguements Jain said that rigourous provision of twin conditions under section 45 of PMLA applies to the applicant. There is a flight risk. There is great apprehension of influencing the witnesses.

Recently the court has also dismissed the bail application of three arrested accused namely Zeeshan Haider, Daud Nasir and Jawed Imam Siddiqui. Fourth arrested Qausar Imam Siddiqui has not moved bail yet. (ANI)

ICMR Study Shows, COVID Vaccine Not Responsible For Heart Attacks: Mandaviya

Union Health Minister Mansukh Mandaviya has said ICMR has done a detailed study which shows that COVID-19 vaccine is not responsible for heart attacks, and an individual’s lifestyle and factors such as binge drinking could be among underlying causes.

Speaking at ‘ANI Dialogues – Navigating India’s health sector’ here on Saturday, the Union Health Minister said that the Modi government is working with a holistic approach so that people get affordable health care.

The Union Health Minister talked of  India’s efforts to supply COVID-19 vaccines to around 150 countries in the world and said that it has generated enormous goodwill in those countries.

Answering a query,  Mandaviya said there had been attempts to create misconceptions about COVID-19 vaccines.

“If someone has a stroke today, some people think it is because of the COVID vaccine. ICMR has done a detailed study on this. (COVID) vaccine is not responsible for heart attacks. There are multiple reasons for heart attacks, like our lifestyle, tobacco and excess liquor consumption… Sometimes, misinformation goes among the people and a perception is formed for some time. But whatever decision we make, it should be data-based and scientific research-based,” the minister said.

According to a peer-reviewed ICMR study that came out in November last year, vaccines administered for COVID-19 did not increase the risk of sudden death among young adults in India but it was the post-Covid hospitalisation, family history of sudden death, and certain lifestyle behaviours that are likely the underlying causes.

The study by Indian Council of Medical Research(ICMR) was conducted through the participation of 47 tertiary care hospitals across India. Cases were apparently healthy individuals aged 18-45 years without any known co-morbidity, who suddenly died of unexplained causes between October 2021-March 2023.

Interviews were recorded to collect data on COVID-19 vaccination, infection and post-COVID-19 conditions, family history of sudden death, smoking, recreational drug use, alcohol frequency and binge drinking and vigorous-intensity physical activity two days before death.

“Lifestyle factors such as current smoking status, alcohol use frequency, recent binge drinking, recreational drug/substance use and vigorous-intensity activity were positively associated with unexplained sudden death. As compared to never users, the more the frequency of alcohol use, the higher was the odds for unexplained sudden death,” the study said.

The study was done in view of some anecdotal reports of sudden unexplained deaths in India’s, apparently healthy young adults during the once-in-a-century pandemic.

Mandaviya said at the ANI Dialogues that the government took decisions concerning vaccination based on advice of experts and scientific evidence.

“When the vaccine was given, an attempt was made at that time to create a misperception that this vaccine is not good. Then political questions were raised that if it (vaccine) was good then why PM Modi is not taking it?…PM Modi falls under the category of 60 years without comorbidities and he took the vaccine in the third category,” he said

“Mansukh Mandaviya is minister not scientist. So my decision should be scientific. You should have seen that during COVID, empowered groups were created. And technical teams made the decisions and I approved. But decision was theirs, not mine,” he added.

The Union Health Minister talked of the speed at which COVID-19 vaccine was rolled out in India due to determination of the government led by Prime Minister Narendra Modi.  He said PM Modi told scientists that resources will not be constraint in the developing the vaccine.

He said PM Modi conveyed that India should also send vaccines to other countries after meeting its needs.

“During COVID-19, I conveyed the message of PM Modi to companies that it’s time to cooperate with the world and it would be better if we won’t hike the prices. Indian companies have supplied medicines to 150 countries but haven’t hiked the price. None of the countries have ever complained, we have supplied quality and affordable medicine to the world. When the price of the vaccine was at USD 20-30, we supplied it either for free under the Vaccine Maitri initiative or at the minimal cost of USD 2 to 3. Now the world thinks that India is such a country that gives priority to human service and stands firm as a friend when needed,”  Mandaviya said.

The union minister also referred to his meeting with Microsoft co-founder Bill Gates who lauded India’s COVID-19 management and vaccination.

“Bill Gates is in India, and when he speaks it turns into a perception all over the world. At the World Economic Forum, I had a meeting with him, when we shook hands, he said, congratulations India, you have done good COVID management and vaccination drive,” the minister said.

According to the Economic Survey 2022-23, tabled by government in Parliament,  India had administered more than 220 crore Covid vaccine doses across the country as on January 6, 2023.

He said India was never short of brain power and manpower but will power and PM Modi has fulfilled this gap.

The minister also talked of the need to take inspiration from advancements in medicine in India’s ancient past.

“If you go to medical universities all over the world, you’ll see the statue of Sushruta, the entire world takes inspiration from him. We haven’t built his statue, this was a mistake. But don’t we have the right to correct this mistake? National Medical Commission had a Greek god in its logo, I don’t have an issue with that, but shouldn’t we respect our God and heritage. I said that I want the new generation to take inspiration from the scientists that we had, and hence I have changed the logo…Every person should work with commitment and dedication towards the nation. India is an able nation, it never has short of brain power and manpower but will power, PM Modi has fulfilled this,” he said.

The Union Minister said that health sector will play a vital role in India becoming a developed country. (ANI)

Bangladesh Al Qaeda Case

Nizamabad PFI Case: NIA Nabs Absconding Accused

The National Investigation Agency (NIA) has apprehended an absconding chargesheeted accused carrying a cash reward of Rs 2 lakh for his arrest in the Nizamabad Popular Front of India (PFI) case involving an anti-India conspiracy by the banned outfit to carry out acts of terror and violence.

Abdul Saleem, the State Secretary for the PFI Telangana North, is the 15th accused to be arrested in the case, originally registered by the State Police at Nizamabad Police Station in July 2022 and taken over by the NIA in August the same year.

Saleem has been on the run since the case came to light and NIA had subsequently declared the reward for his arrest. He was nabbed from Mydukur in Kadappa district of Andhra Pradesh based in an intelligence-led operation.

NIA investigations in the case have revealed that Saleem was involved in radicalisation and recruitment of impressionable Muslim youth into the PFI. He was also sending them to terror training camps for weapons training to equip them to further the organisation’s nefarious anti-India agenda.

The NIA had earlier chargesheeted 11 accused, including Abdul Saleem, in December 2022, followed by supplementary chargesheets against five in March and one in December last year.

“An integral part of the conspiracy of the PFI and its cadres was to make India into an Islamic nation by 2047,” said the NIA.(ANI)

Family Business Season 2 in Pakistan

Live Streaming In Pakistan – Family Business Season 2

Forget corruption charges and delivering poor governance – two families in Pakistan have worked their way back to power. They can thumb their noses at critics, at home and in the Western world who call “dynastic rule” undemocratic. For now, the two rival ‘dynasties’ have buried their differences to keep out their third rival Imran Khan, a “non-dynast”.

In a power-sharing deal, Shehbaz Sharif – notwithstanding his disastrous 18-month rule during 2022-23 – is poised to be the prime minister again. Maryam, his niece and elder brother Nawaz Sharif’s political heir is now Pakistan’s first woman chief minister, and that too, of Punjab, the most populous and powerful province. As Sharifs keep the two big jobs, above them all, Asif Ali Zardari is poised to be the country’s President, again, facilitated by the all-powerful army-led military and civil ‘establishment’.

The ‘establishment’ retains all the aces in domestic and external relations. It has ditched Khan, its ‘proxy’ of the 2018 vintage. Convicted in numerous cases, he is in jail even though his hundred-plus supporters were elected in a House of 264, making the entire exercise controversial.

That is because the ‘establishment’s’ calculations failed. Although tipped for a fourth term as the prime minister, Nawaz fell short of the numbers and had to make way for his younger brother. The deal with the Bhutto-Zardaris who came third in the electoral race, gets Punjab for the Sharifs but also keeps alive ambitions within their clan.

Khan has lost despite his proven mass popularity. In hindsight, his position became untenable when General Asim Munir and Justice Faez Isa whom he had targeted as the prime minister reached their respective top offices. Besides, he alleged an American ‘conspiracy’ for his ouster. Now, he and his supporters will struggle and protest in and out of the jail, courts and the legislature. In Pakistan, it is business as usual for now, until the cyclical process, driven by political wrangling, public disenchantment and monitored by the men in khaki, ends where it began.

Maryam at 50 marks a generational change. Bilawal Bhutto Zardari joining the Shehbaz government would have reinforced that. He had pleaded in the previous National Assembly that the old guard makes way for the young.  He did not succeed. How a complete debutante Maryam and Bilawal’s experience limited to foreign affairs — though not an unusual thing in South Asia — would have fared in tackling the country’s myriad problems is a different story.

There indeed was some talk of Bilawal as the prime minister, Pakistan’s youngest at 33. But the deal went the way his father Asif Ali — the real (civilian) king-maker this time around – possibly wanted, to secure the presidency and the power in Sindh for his clan.

He had earned the sobriquet “Mr Ten Percent” by allegedly taking the cut in business transactions, when his wife Benazir was the prime minister twice, adding to her woes and a collapse in governance. Her 2007 assassination and the sympathy it generated led him to the president’s house. Although he had the Constitution amended to limit the president’s powers, during 2008-13, the country was run from his office.

ALSO READ: Maryam To Be Pakistan’s First Woman CM

Not for nothing he is called the “wheeler-dealer”, ‘Machiavelli II’ and more. Pakistan’s most astute politician is also a great survivor. As feudal in politics do, he was involved in family feuds, including the killing of Benazir’s brother Murtaza. He has a lengthy record and the length of time spent behind bars, without ever being convicted.

They say that “the only thing certain in life is death and taxes”; in Pakistan, it might as well be “death, taxes, and Mr Zardari’s political relevance”….. Yet, he is also the first democratically elected president to serve out a five-year tenure, and likely to become the only person to have held that office twice,” Zain Siddiqi writes in Dawn (February 23, 2024).

Besides being in and out of jail and being in exile, Zardari has some things in common with Maryam Nawaz: controversies over educational qualifications. Zardari’s claims cover degrees in England and France, while Maryam, who had to change schools when young, could not complete her studies in medicine when her admission was challenged, but has supposedly done her M.A., and Ph.D. Another is both remained out of the government but active politically. Indeed, Maryam joined only a decade back to counter Imran Khan’s growing charisma among the youth.

Maryam is the fourth Sharif family member to become Punjab’s chief minister. The province accounts for 53 per cent of Pakistan’s 241 million population and 60 per cent of its $350 billion GDP. Her problems are more daunting than those her father and uncle tackled, with arguable results.

At the top of her problems is her being a woman politician in a deeply conservative Pakistan. Only around a dozen women were elected to the National Assembly in last month’s elections. Most women enter parliament in seats reserved for women and religious minorities.

For Maryam, a mother of three and a grandmother, it could be familial, like Benazir who had a husband (Zardari) to deal with, at home, in public and in her government. Maryam too has a husband Mohammed Safdar Awan, a former army captain and a lawmaker.

A fiery orator like Benazir, Maryam will have to guard against all that Bhutto faced — from the hardliners among the clergy who cite scriptures to disapprove of a woman holding public office. Patriarchy at all levels dominates Pakistani society. The most daunting could be the militants who took Benazir’s life. Indeed, Tehreek-e-Taliban Pakistan (TTP), with affiliates of the Islamic State Khorasan Province (ISKP), has dug deep roots in Punjab.

Coming from a business family, Maryam has done well to keep her focus on economic issues that not just Punjab but the whole of Pakistan need to tackle. Women activists are enthused by the symbolic boost for women and that she has touched on women and the young, on education and health in her inaugural speech.

But all these need money and the initial pronouncements carry little by way of reforms – less ostentatious spending and more taxation – that the foreign donors, especially the International Monetary Fund (IMF) have been demanding.

Reports link Maryam to her maternal great-grandfather, Gama (Ghulam Mohammed) Pehelwan, undivided India’s champion wrestler and “Rustam-e-Hind” who migrated to Pakistan. He was never defeated.  Gama remains a known name in India. She could work on this legacy and her father Nawaz’s readiness to do business with India.

It will be interesting to watch if Maryam, on a possible India visit sometime in future, will create as much public frenzy, and goodwill for Pakistan, as Benazir did in 1972 at the Simla Summit and while meeting Rajiv Gandhi, her Indian counterpart in the 1980s.
