SC To Hear Uddhav’s Plea Against Maha Speaker’s Decision On March 7

The Supreme Court on Friday agreed to hear petition filed by Uddhav Thackeray faction of Shiv Sena challenging the order of Maharashtra Speaker Rahul Narwekar on the dismissal of disqualification pleas against Chief Minister Eknath Shinde faction MLAs on March 7.

A bench of Chief Justice of India DY Chandrachud, Justices JB Pardiwala and Manoj Misra posted the matter for hearing on March 7 after senior advocate Kapil Sibal, appearing for the Thackeray faction, mentioned it for an early hearing. Sibal urged the bench to list it on March 7.

“We will list it for hearing on March 7,” said the bench. It said several matters, which were to be listed on March 1, could not be accommodated in the list as the bench has to rise early.

The Thackeray faction’s plea was to be listed for hearing today.

In January, the Supreme Court issued notice to Shinde and 38 MLAs of his group on Sunil Prabhu’s (Thackeray faction) plea challenging the Speaker’s order.

The Shinde group had approached the Bombay High Court, challenging the refusal of the Speaker to disqualify the Uddhav Thackeray group and the High Court issued notice on the Shinde group’s petition.

In the apex court, along with the Maharashtra Speaker’s decision to not disqualify Shinde and his group, the Thackeray faction also challenged the order of the Speaker to recognise the Shinde faction as the ‘real Shiv Sena’ after its split in June 2022.

The Speaker’s decision came on January 10, nearly two years after Thackeray’s camp moved disqualification petitions against Shinde and his supporting legislators under the Tenth Schedule (anti-defection law) of the Constitution.

Approaching the apex court against Maharashtra Speaker Narwekar’s decision dismissing the disqualification petitions against Shinde and 38 “rebel” Shiv Sena legislators, the Thackeray faction said the decision was a “colourable” exercise of power based on “extraneous and irrelevant” considerations.

Earlier, the top court had asked the Speaker to expeditiously decide the disqualification petitions pending before him.

The disqualification petitions against the rebel MLAs were filed by Sunil Prabhu, the Shiv Sena party whip appointed by Uddhav Thackeray, on June 23, 2022, after the MLAs revolted against Thackeray.

In May last year, a five-judge constitutional bench held that it could not disqualify the Eknath Shinde-led Maharashtra government and reinstate Uddhav Thackeray as Chief Minister because the latter had chosen to resign instead of facing a test of strength in the Assembly.

In August 2022, the top court’s three-judge bench referred to a five-judge Constitution bench the issues involved in the petition filed by rival groups of Shiv Sena in relation to the Maharashtra political crisis.

On June 29, 2022, the top court gave a go ahead to the floor test in the Maharashtra Assembly on June 30. It had refused to stay the Maharashtra Governor’s direction to the then Chief Minister Uddhav Thackeray to prove his majority support on the floor of the House on June 30.

After the apex court’s order, Uddhav Thackeray announced his resignation as the Chief Minister and Eknath Shinde was later sworn-in as the Chief Minister. (ANI)

Bharat Ratna for Ch Charan Singh Will Help BJP

‘Bharat Ratna for Ch Charan Singh Will Help BJP Electorally’

Vishwas Chaudhary, an affluent farmer of the Jat Community in Western UP, says the move was long overdue and it will help BJP consolidate its position in the sugar belt. His views:

The Bharat Ratna award was a much awaited and genuine honour to the most popular farmers’ leader of the Jatland and a long pending demand of the people, particularly the agrarian community, in Uttar Pradesh. Though it should not be linked to any kind of vote bank politics, the decision is definitely going to further enhance the prospects of the ruling BJP in the upcoming Lok Sabha elections in this sugarcane belt.

However, in any case, if a voter changes his/her preference of voting in lieu of any kind of freebies or a demand (that is just), it is wrong. There is a wrong perception among political parties that by declaring or offering just ahead of elections, they could win over the hearts of the people and the voters to get the desired result.

If you recall, the previous UPA government, under Manmohan Singh, towards its last days, declared reservations for the Jat community in 2014 under Ch Ajit Singh’s pressure. However, it hardly made any impact on the results (of the 2014 elections) and the BJP overthrew it with a thumping and record breaking majority.

As far as the Rashtriya Lok Dal chief Jayant Chaudhary’s swing of loyalty from Samajwadi Party to the BJP is concerned, it is a welcome move as it will benefit both the saffron group and the RLD. As a matter of fact, the golden days of the RLD were in 2009 when it contested the Lok Sabha election in alliance with the BJP and won five seats which is still a record for its electoral history.

Despite the fact that the SP had offered seven Lok Sabha seats to the RLD in these elections, it had started playing mischief since the last (2022) Vidhan Sabha elections. This new collaboration is definitely going to be a booster for the RLD as its alliance with the SP was in turmoil after the 2022 elections where the party did win nine seats but three of these were on the symbol of the Samajwadi and the RLD had little say in the process of selection and choice (of seats) for 2024.

In my opinion, The BJP-RLD combine will win with a landslide in two seats (Baghpat and Bijnore) plus a Rajya Sabha seat. The decision is definitely going to have a deep socio-political impact in the western UP as Jat voters dominated about 30 out of the 130-140 Assembly segments of the western UP and the combination will boost the political prospects of both parties in the region.

This new alliance could also be termed as more respectable and reliable (for the RLD and its voters) as there is no doubt that the NDA, led by the BJP, is going to form the third consecutive government at the Centre and the voter also tends to give the power in the hand of those who have the authority.

ABVP, Left-Backed Groups Clash At JNU Over Poll Committee Selection

A clash broke out between ABVP and Left-backed student groups at Jawaharlal Nehru University (JNU) over the selection of election committee members at the School of Languages on Thursday night, leaving some students injured.

The Akhil Bharatiya Vidyarthi Parishad JNU blamed the attack on students on the Left unions and said that they would stand for the rights of students.

“ABVP JNU condemns this brutal attack on students and will always stand for rights of students. Common Students who came to attend SL School GBM at School of Languages were brutally attacked with sharp objects by LEFTIST GOONS. Just because they were asking for a fair chance to participate and vote in the school GBM. Some students faced severe injuries,” ABVP JNU posted on X.

“Atleast six people have been injured. The fight was started by them (AISA) and we have filed the complaint. The selective video have been released. These communist attacked us from the back and at that time were not able to record the video when we were attacked. They were all hitting us. In the self defence we attacked them as security people were not coming to help us. The issue started after questioning the process of EC process,” Umesh Chandra, ABVP President told reporters on Friday.

While the Left-wing students accused the ABVP student wing of creating a ruckus and allegedly disrupting the selection process for the election committee.

“The last day of the GBM at the School of Languages witnessed another round of violence by ABVP goons. Initially attempting to disrupt the selection process for the election committee, the ABVP resorted to physical violence against students when thwarted by JNU students. The ABVP goons were seen wielding rods and targeting and beating common students indiscriminately,” the AISA stated.

“The entire day these lumpens kept on disrupting the process of the GBM. They singled out the muslim students and they opposed whenever any muslim student propose their names for upcoming election committee. They also vitiated the atmosphere of school GBM premises by threatening students, by sexist and casteist slurs,” AISA further stated.

The Left-wing students further alleged that two senior students of Ph.D. scholars and a senior AISA activist were chased and beaten up by the goons of ABVP.

“This is not the first incident of violence that occurred yesterday. Another lumpen who abused students for singing the national anthem, also misbehaved with security officials at the GBM premises, as multiple videos clearly depict his misconduct,” they alleged.

The student union said that the JNU community must stand up and rise against this violence and the politics of intimidation.

“The VC office must acknowledge this act of vandalism and violence by the ABVP goons, whose faces are clearly visible and are seen in the videos circulating online. These perpetrators must be punished; they should be booked under relevant sections for unleashing such unprecedented violence,” they said.

Meanwhile, the Delhi Police said they have received a formal complaint on the matter from both sides.

“We have received complaints from both sides. We are examining the complaints. The Police have come to know about three injured,” the Delhi Police stated. (ANI)
