Kejriwal Moves Delhi HC Against Arrest

The Delhi Chief Minister, Arvind Kejriwal, on Saturday moved to the Delhi High Court, challenging his arrest and the order of remand passed by the trial court on March 22.

CM Kejriwal was arrested on March 21 by the Directorate of Enforcement (ED) in connection with the now-scrapped excise policy case.

His legal team said that his plea in Delhi HC stated that both the arrest and the remand order are ‘illegal’ and he is entitled to be released from custody immediately.

An immediate hearing has been sought from the Acting Chief Justice, preferably on Sunday, March 24.

The ED, which was given the custody of Delhi CM till March 28 by the court, has alleged that the Aam Adami Party (AAP) is the major beneficiary of the proceeds of crime generated in the alleged liquor scam.

The Rouse Avenue Court on Friday remanded Kejriwal to six days of ED custody in the money laundering case related to the alleged liquor policy scam case till March 28.

Special CBI judge Kaveri Baweja of the Rouse Avenue Courts passed the order after Kejriwal was produced today following his arrest last night by the central probe agency. The ED sought 10 days remand of Kejriwal in its custody.

Senior Advocates Abhishek Manu Singhvi, Vikram Chaudhari, and Ramesh Gupta, along with Advocates Rajat Bharadwaj, Mudit Jain and Mohd Irshad, appeared for the Delhi CM Kejriwal.

ASG SV Raju and Special Counsel Zoheb Hossain appeared for the probe agency. “Part of the proceeds of crime to the tune of cash of Rs 45 cr approx. has been utilised in the election campaign of AAP in Goa Assembly elections 2022,” the ED alleged.

The agency further claimed that Kejriwal was directly involved in the formation of the excise policy.

“Arvind Kejriwal has also been intrinsically involved in the entire conspiracy of the Delhi liquor Scam wherein the policy was drafted and implemented in a manner wherein certain private persons were favoured and benefitted in a quid pro quo of receiving kickbacks,” the federal agency said in its remand.

It also claimed that due to the actions of Arvind Kejriwal involving excise policy formulation, hatching the conspiracy of kickbacks with the South Group members, and eventually using part of the proceeds of crime generated out of this scheduled offence in the election campaign of AAP for Goa Assembly elections, it is clear it all these activities were not only done with his knowledge but also his active collusion.

Kejriwal was arrested by the central agency late Thursday night on charges of corruption in relation to the case. It is the first time in independent India that a serving Chief Minister has been arrested. The move came after Kejriwal skipped multiple summons by the investigation agency, nine in total, calling them “illegal”.

The case pertains to alleged irregularities and money laundering in framing and implementing the Delhi Excise Policy 2022, which was later scrapped.

While Kejriwal was not named in the FIRs registered by the ED or the Central Bureau of Investigation in the Delhi excise policy case, his name first found a mention in the ED’s chargesheet, wherein the agency claimed that he allegedly spoke to one of the main accused, Sameer Mahendru, in a video call and asked him to continue working with co-accused and AAP communications-in-charge Vijay Nair.

Nair was among the first people to be arrested by the CBI in the case, in 2022. Subsequently, former deputy chief minister Manish Sisodia and Rajya Sabha MP Sanjay Singh were arrested in connection with the case. (ANI)

Kejriwal’s Arrest Is Because Of His Own Deeds: Anna Hazare

Following the arrest of Delhi Chief Minister Arvind Kejriwal, social activist Anna Hazare on Friday said that the arrest of the AAP chief was because of his own “deeds.”

“I am very upset that Arvind Kejriwal, who used to work with me, raise his voice against liquor, is now making liquor policies. His arrest is because of his own deeds,” Hazare said on Friday.

The Enforcement Directorate arrested Delhi Chief Minister Arvind Kejriwal in connection with the Delhi excise policy case on Thursday night, in which two senior AAP leaders are already in judicial custody.

Arvind Kejriwal had joined the Anna movement in 2011 against the then Congress government’s alleged corruption. He rode on to fame, floated his own political party in 2012, and contested for the chief minister’s office.

In another development, the Delhi Chief Minister earlier withdrew his plea from the Supreme Court against his arrest by the Enforcement Directorate in connection with an excise policy-linked money laundering case as it was clashing with his remand.

In Lucknow, Uttar Pradesh Deputy Chief Minister KP Maurya lashed out at the Congress, an AAP partner in INDIA bloc, for coming out in support of Arvind Kejriwal, said, “Congress is the mother of corruption… The language that their leader Rahul Gandhi is using will be decided in the Lok Sabha polls… People took it as their right to indulge in corruption.”

“They keep accusing the central agencies as if they are working at the orders of the PMO or the HMO. The agencies are working neutrally. Arvind Kejriwal was issued 9 summonses but he is has the pride of power. If the ED is wrong, then he should have gone to court…,” the BJP leader said.

Arvind Kejriwal’s arrest came days after the ED arrested K Kavitha, Bharat Rashta Samithi (BRS) leader and daughter of former Telangana chief minister K Chandrasekhar Rao, in connection with its investigation into money laundering charges linked to the now-scrapped excise policy.

Earlier Manish Sisodia, who was the then Delhi Deputy Chief Minister, was arrested by the CBI on February 26 following several rounds of questioning. On October 5, ED arrested Sanjay Singh, who is a Rajya Sabha member.

Kejriwal’s arrest also comes ahead of the Lok Sabha elections, which will be held from April 19 to June 1, as per the schedule announced by the Election Commission earlier in the month. (ANI)

Kejriwal Arrested By ED In Excise Policy Case

Delhi Chief Minister and AAP national convenor Arvind Kejriwal has been arrested by the Enforcement Directorate (ED) in the excise policy case, sources said.

AAP leader and Delhi Minister Atishi said they had moved the Supreme Court for quashing Kejriwal’s arrest and have sought an urgent hearing.

“We have moved the Supreme Court for quashing the arrest of Delhi CM @ArvindKejriwal by ED. We have asked for an urgent hearing by the Supreme Court tonight itself,” Atishi said in a post on X.

She had earlier said that Kejriwal will run the government from jail.

“We have received news that ED has arrested Arvind Kejriwal… We have always said that Arvind Kejriwal will run the govt from jail. He will remain the CM of Delhi. We have filed a case in the Supreme Court. Our lawyers are reaching SC. We will demand SC have an urgent hearing tonight,” she said.

An Enforcement Directorate team arrived at Kejriwal’s residence on Thursday for questioning in connection with the liquor policy case. The team conducted a search operation at his residence, the sources said.

The Enforcement Directorate team reached his residence for questioning hours after the Delhi High Court refused interim protection to Kejriwal from coercive action in connection with the excise policy case.

AAP workers also staged a protest outside the residence of Delhi CM Arvind Kejriwal.

Denying him interim protection from arrest in the liquor policy case, the Delhi HC ruled that, in this state, it was not inclined to do so.

The court passed down the directive during the hearing on a plea by the AAP supremo, urging coercive action against him in connection with the excise policy case.

Aam Aadmi Party (AAP) leader Raghav Chadha called the ED’s move a conspiracy to arrest the Delhi Chief Minister just before the Lok Sabha elections.

“Just before the Lok Sabha elections, a big conspiracy is going on to arrest Arvind Kejriwal ji. Kejriwal ji has the blessings of crores of people. The wonderful works done in Delhi and Punjab are being discussed all over the world today. You can arrest Kejriwal’s body but cannot put Kejriwal’s ideology behind bars,” Chadha said in a post on X.

Punjab Chief Minister Bhagwant Mann said BJP’s political team (ED) cannot put Kejriwal’s ideology behind bars. “It is only the Aam Aadmi Party (AAP) that can stop the BJP. Thoughts and ideas can never be suppressed,” he said.

Delhi Minister Imran Hussain said, “It’s very unfortunate. It’s a conspiracy to stop the AAP and Arvind Kejriwal. People of Delhi love Arvind Kejriwal and they’ll respond to the BJP.”

Delhi HC Refuses To Grant Kejriwal Interim Protection

The Delhi High Court on Thursday refused interim protection from coercive action to Delhi Chief Minister Arvind Kejriwal and said at this stage it is not inclined to grant interim relief.

The court was hearing a plea by Kejriwal seeking protection from coercive action in connection with the excise policy case.

The bench of Justice Suresh Kumar Kait and Justice Manoj Jain passed an interim order on his petition with the main matter listed for July 22, 2024.

During the hearing, Senior Advocate Abhishek Manu Singhvi, who appeared for Kejriwal, submitted that the summons issued under Section 50 do not even reveal whether the person summoned is a witness, suspect or accused.

Singhvi referred to Karnataka Deputy Chief Minister DK Shivkumar’s case order to argue for no-coercive action.

He said his client has apprehension that he would be arrested “for political purposes”.

“What prevented you from arresting him, and why are you issuing summonses back-to-back?” the court asked ED during arguments.

Additional Solicitor General SV Raju replied that the agency never said that they are going to arrest. “The power is there. You come to join the investigation, we may or may not arrest you.”

Raju opposed the plea on maintainability grounds and submitted that the petition is seeking to quash and set aside all proceedings qua the petitioner in the capacity of his being national convener of a political party.

“But here, AAP has not been made an accused yet and the fact that he’s challenged means that his figment of imagination can’t lead to a grant of relief. A person or entity that has not been made an accused can’t seek to strike down a provision,” Raju said.

On Wednesday, during the hearing in the related matter before the Delhi High Court, Kejriwal’s lawyers stated that they have apprehension that the ED will arrest him and that he is ready to appear if he is given protection.

The Delhi High Court had sought response of the ED on a plea filed by Kejriwal challenging the summons issued to him in connection with the Delhi excise policy case.

During the hearing, the bench asked the Kejriwal lawyers, Why don’t you appear before the Enforcement Directorate? In the reply, Singhvi said that AAP leaders Manish Sisodia and Sanjay Singh were also arrested by the agency. “We have an apprehension that ED will arrest him; he is ready to appear if he is given protection.”

Kejriwal, through his plea, has sought, the declaration of Section (2) (s) OF PMLA to be ultravires, unconstitutional and arbitrary insofar it is construed to include a political party within its ambit and sweep.

Kejriwal’s plea stated that the present petition is being filed in extremely urgent and emergent circumstances where such arbitrary procedure under PMLA is sought to be employed “to create a non-level playing field for the impending general elections scheduled to be held from April 19, 2024, and to skew the electoral process in the favour of the ruling party at the Centre that controls the ED through the Ministry of Finance”.

The plea said action is being taken in view of the petitioner’s role as a vocal critic of the ruling party and his role as an opposition leader and partner of the INDIA alliance contesting the general election, stated the plea.

“By using such provisions of PMLA for investigation/arrest or threat thereof, E.D., being in control of the Central Government, has been weaponized as a tool to coerce a change in the political landscape of the country in favour of the ruling dispensation,” Kejriwal alleged.

The plea further stated that it is the case of the petitioner that the said impugned summons dated February 26, 2024 and March 16, 2024, were sent to the petitioner with an oblique motive to arrest the petitioner (Kejriwal).

“The investigation in the present matter has been going on since August 22, 2022, i.e., the last one-and-a-half years and after the investigation, as many as six prosecution complaints with thousands of documents have been filed. All necessary documents/ information are already in possession of respondent and summoning the petitioner “in person” is therefore a ploy to illegally arrest him and the present matter is a clear case of malice,” the petition said.

It said since elaborate complaints with thousands of documents are filed by the respondent, it is clear that all relevant material and information is already in the possession of the Directorate of Enforcement.

Last week, the Additional Chief Metropolitan Magistrate of Rouse Avenue Court granted bail to Arvind Kejriwal on two complaints filed by ED for non-compliance with summons issued by the agency. During the hearing, Kejriwal appeared physically before the court.

According to the ED, the agency wants to record Kejriwal’s statement in the case on issues like the formulation of policy, meetings held before it was finalized, and allegations of bribery.

In its sixth charge sheet filed in the case on December 2, 2023, naming AAP leader Sanjay Singh and his aide Sarvesh Mishra, the ED claimed that the AAP used kickbacks worth Rs 45 crore generated via the policy as part of its assembly elections campaign in Goa in 2022.

The now-scrapped excise policy was aimed “at revitalizing the city’s flagging liquor business” and replacing a sales-volume-based regime with a licence fee for traders.

Lieutenant Governor Vinai Kumar Saxena had ordered a probe into alleged irregularities in the policy. AAP has accused Saxena’s predecessor, Anil Baijal, of sabotaging the move with a few last-minute changes that resulted in lower-than-expected revenues.

World Air Quality Report 2023 Raises Red Flag Over Delhi’s Air Quality: L-G Saxena

After the release of the World Air Quality Report 2023, Delhi L-G VK Saxena on Wednesday wrote to Delhi Chief Minister and Aam Aadmi Party convenor Arvind Kejriwal drawing his attention to the report “painting a grim picture” of the air quality in the national capital.

“It raises a red flag over the abnormally high PM 2.5 levels, two-fifths of which is attributable to vehicular emission. I am sure that you are aware that prolonged exposure to particulate matter of this dimension leads to premature deaths in people, triggers lung disease, leads to a host of respiratory diseases,” the Delhi L-G pointed out.

L-G Saxena further highlighted in his letter that there are regular reports of increased admissions in the city hospitals with children and the elderly suffering the most from respiratory ailments.

Calling it a “public health emergency”, the L-G emphasised that this contravenes the very basic natural and fundamental right of the people of Delhi.

The L-G further said that Chief Minister Kejriwal must take responsibility and take definitive steps and bold measures.

“Your ministers obfuscate the issue by engaging in a farcical exercise of emergency measures, lip service and media byte,” he lashed out.

Citing global examples the L-G said, “The Great Smog of London and the grey skies of Beijing got cleaned up with the determined leadership.”

Addressing the same issue, Delhi’s Environment Minister Gopal Rai said, “The pollution levels in the national capital have been decreasing consistently. From 2015 till 2023, there has been a decrease in levels of PM 10 and PM 2.5. After 2015, last year we had 206 days of better air quality.”

Meanwhile, the initiative of sprinkling water was taken in the national capital as a measure to curb air pollution. (ANI)

Kejriwal Gets Bail In ED Summon Case

Delhi Chief Minister Arvind Kejriwal on Saturday appeared before the Rouse Avenue Court the national capital in the Enforcement Directorate summons case.

The Rouse Avenue Court later granted him bail in both the complaints of the Enforcement Directorate.

Additional Chief Metropolitan Magistrate (ACMM) Divya Malhotra granted bail to the Delhi CM.

The bail was granted on a bail bond of Rs 15,000 and a surety of Rs 1 lakh.

Kejriwal appeared before the court following a summons issued to him by the court based on two ED complaints in connection with the Delhi Excise Policy case.

The Rouse Avenue Court on Friday reserved an order on the stay of summons issued to Kejriwal on complaints filed by the ED.

Kejriwal had challenged the summons issued by the court after taking cognizance of two complaints filed by the ED for avoidance of the summons issued to him.

According to the ED, the agency wants to record Kejriwal’s statement in the case on issues like the formulation of policy, meetings held before it was finalized, and allegations of bribery. (ANI)

Who Will Employ Them?: Kejriwal Takes On Centre On CAA

Delhi Chief Minister Arvind Kejriwal on Wednesday joined his INDIA bloc partners to take on the centre over the Citizenship Amendment Act (CAA). Kejriwal termed the government decision as “very dangerous” and said that the government money which should be spent on the development of family and country will now be spent on allowing Pakistanis to settle in India.

“After ruling the country for 10 years and just before the elections, they have to talk about the Citizenship Amendment Act. If you had done some work in these 10 years, perhaps you would have asked for votes on your work instead of on CAA. It means that a large number of minorities from Pakistan, Afghanistan and Bangladesh will be brought to our country, and they will be employed and settled here. The youth of the country are not being given employment by the BJP government. Many people of India do not have houses but BJP wants to bring people from Pakistan and give them houses here,” he said.

The Delhi CM also questioned the government claiming that the influx of refugees could lead to a huge financial burden.

“There are approximately three crore minorities in these three countries. As soon as our doors open, huge crowds from these countries will come here. Even if 1.5 crore people come here, who will employ them? Where will they be settled? Why is BJP doing this?” CM Kejriwal said.

Further, he added that if the BJP wants to bring back anyone, then it should bring 11 lakh big industrialists and businessmen who have left India.

“In the last 10 years, more than 11 lakh big industrialists and businessmen have left India. These people used to run industries in India, do business and provide jobs and employment to lakhs of people. These people left India due to BJP’s wrong policy and atrocities. If BJP wants to bring them back, then it should bring these people back. If these people come to India, they will invest in India and our children will get employment,” he added.

Arvind Kejriwal urged the people to vote against the BJP if they do not agree to take back the law.

On March 11, the Union Home Ministry notified the rules of the Citizenship Amendment Act (CAA), days ahead of the announcement of the Lok Sabha election schedule.

The CAA rules, introduced by the Narendra Modi government and passed by Parliament in 2019, aim to confer Indian citizenship to persecuted non-Muslim migrants–including Hindus, Sikhs, Jains, Buddhists, Parsis, and Christians–who migrated from Bangladesh, Pakistan, and Afghanistan and arrived in India before December 31, 2014. Kejriwal Agrees To Appear Before ED Virtually

In response to the eighth summons of the Directorate of Enforcement (ED) which asked Delhi Chief Minister Arvind Kejriwal to appear before ED on March 4, the Aam Aadmi Party leader has written a reply to the Directorate of Enforcement stating the ED’s summon as “illegal”, however he has agreed to appear before the agency virtually on any date after March 12.

Earlier on February 27, The Directorate of Enforcement (ED) issued an eighth summons to Delhi Chief Minister and Aam Aadmi Party (AAP) supremo Arvind Kejriwal in a money laundering probe related to irregularities in the Delhi Excise Policy 2021-22 case, asking him to join the investigation on March 4.

The fresh summons to the Delhi Chief Minister followed the seventh summons which he had skipped on February 26.

Kejriwal has so far skipped seven previous summons issued by the ED on February 26, February 19, February 2, January 18, January 3, November 2 and December 22, calling them “illegal and politically motivated”.

The ED wants to record Kejriwal’s statement in the case on issues like the formulation of policy, meetings held before it was finalised, and allegations of bribery.

While skipping the seventh summons issued by the ED, AAP, in a statement, termed it “illegal”, saying that the ED should stop sending summonses and wait for the court’s decision as the probe agency has already approached the court on the matter.

A day after Kejriwal skipped the fifth summons issued by the Enforcement Directorate, the agency on February 3 approached a Delhi court against him for “non-compliance with the summons”.

The case is based on a First Information Report (FIR) alleging multiple irregularities in the formation and implementation of the Delhi excise policy (2021-22) by the Central Bureau of Investigation. The policy was withdrawn after allegations of corruption.

Kejriwal Apologises In SC For Retweeting Defamatory Clip Of YouTuber

Delhi Chief Minister Arvind Kejriwal on Monday submitted before the Supreme Court that retweeting the video which was allegedly defamatory and was circulated by YouTuber Dhruv Rathee in 2018, was a “mistake”.

A bench of Justices Sanjiv Khanna and Dipankar Datta directed the trial court not to proceed with the defamation case against him for the time being.

The Aam Aadmi Party (AAP) chief has approached the apex court, challenging the February 5 order of the Delhi High Court refusing to quash the summons issued against him. The High Court had said that reposting alleged libellous content would attract defamation law.

The summon was issued in a defamation complaint lodged against him for retweeting a video of a YouTuber on the social media platform ‘X’.

During the hearing, senior advocate Abhishek Manu Singhvi, appearing for Kejriwal, told the apex court, “There is no problem in admitting that this was a mistake if he had known that these would be the consequences.”

Singhvi requested an adjournment before the trial court, saying that they were prosecuting Kejriwal swiftly.

“They are prosecuting him very fast. They are hotfooting it. We will request an adjournment before the trial court,” he said.

Justice Khanna said that Kejriwal need not appear in court for now, given the office he occupied.

The bench then asked the complainant in the case to take instructions on whether the case could be closed based on Kejriwal’s admitting to the mistake. The complainant’s advocate said he would take instructions from his client, and thereafter, the bench posted the matter for hearing on March 11.

“Relist on Monday, March 11. In the meantime, the matter will not be taken up by the trial court,” the bench stated in its order.

A defamation complaint was filed against Kejriwal for retweeting a video by a YouTuber in 2018 accusing the founder and operator of a Twitter page called ‘I Support Narendra Modi’ of behaving like ‘BJP IT CELL Part-II’.
