Delhi Chief Minister Arvind Kejriwal, who met Nationalist Congress Party chief Sharad Pawar on Thursday to seek the party’s support in Rajya Sabha against the Centre’s ordinance on control of administrative services in the national capital, said that the defeat of the Bill in the Upper House will be the testimony of opposition unity.

Kejriwal said that if the Bharatiya Janata Party fails to pass the Bill in Rajya Sabha, it will imply that the “Narendra Modi government will not be able to return to power at the Centre after the 2024 Lok Sabha polls.”
“Sharad Pawar ji has assured us that NCP will support us in defeating the Bill in Rajya Sabha. We are trying to gather support from all non-BJP parties against the Centre’s ordinance on control of administrative services in the national capital,” Kejriwal said at a joint press conference with Pawar.

He thanked Pawar for his assurance to support the AAP in the Upper House and said that it is a fight for the “federal structure” of the country.

“I thank Sharad Pawar that he has assured his support that when the Bill comes to Rajya Sabha, they will not let the Bill pass in the House. If all non-BJP parties come together in Rajya Sabha, this Bill can be failed. This is not a fight for Delhi, it is a fight for the federal structure,” he said.

“If the BJP is not able to pass the Bill in Rajya Sabha, then one should consider it a semi-final of 2024. The message will be that the Modi government is not returning in 2024,” the Delhi Chief Minister added.

When asked if he will meet Congress leadership in connection with the matter to seek their support, Kejriwal said that he will seek time from Congress President Mallikarjun Kharge and Rahul Gandhi to meet them on the issue.

Sharad Pawar assured his party’s support to AAP on the matter and said that talks will be held with other leaders to support Delhi Chief Minister in his effort.

“There is a crisis in the country and it’s not an issue limited to Delhi. NCP and the people of Maharashtra will support Kejriwal. We will also talk to other leaders to support Kejriwal. We must focus on bringing all non-BJP parties together,” Pawar said.

The Delhi Chief Minister on Tuesday embarked on a nationwide tour to seek support from the Opposition parties against the ordinance brought by the central government on the transfers and postings of bureaucrats in the national capital.

The Aam Aadmi Party (AAP) national convenor accused the Centre of “taking away the rights” of the people of Delhi and said that the ordinance “should not” be allowed to pass in Rajya Sabha.

This comes after the Union Government on May 19 brought an ordinance to notify rules for the Government of National Capital Territory of Delhi (GNCTD) regarding the ‘transfer posting, vigilance and other incidental matters’.

The ordinance was brought to amend the Government of National Capital Territory of Delhi Act, 1991 and it circumvents the Supreme Court judgement in the Centre vs Delhi case.

Earlier, CM Kejriwal met West Bengal Chief Minister Mamata Banerjee in Kolkata on Tuesday and sought her support against the ordinance. (ANI)

Delhi Chief Minister Arvind Kejriwal on Thursday launched an attack on Lieutenant Governor Vinai Kumar Saxena and urged him to permit teachers and academic staff from Delhi government schools to travel abroad for training citing the example of the Punjab Government.

Thirty-six government principals of the Punjab Government are going to Singapore for five days of teacher training from February 6-10, 2023, Delhi Chief Minister Arvind Kejriwal said in a press conference.
Kejriwal addressed the press conference and questioned Delhi’s LG regarding the non-clearance of the Finland file so far with respect to the proposal to send teachers abroad for training.

“The Delhi government has already provided training to more than 1000 principals/teachers from abroad and further wants to continue it,” he added.

Kejriwal reiterated that Delhi LG is now stopping the teachers of Delhi’s government schools.

“The Constitution Bench of the Supreme Court had ruled in July 2018 that no file will go to the L-G, but the Centre passed a law directing that they will; we have challenged this because it is unconstitutional. I hope that the L-G will allow teachers to go abroad till this decision is announced,” he further added. (ANI)

Murmu Delegates Fresh Powers To Delhi LG Amid Stalemate With Kejriwal

President Droupadi Murmu has delegated two fresh powers to Delhi Lieutenant Governor Vinai Kumar Saxena under the Industrial Relations Code, 2020 and the Occupational Safety, Health and Working Conditions Code, 2020 to formulate the rules only in the areas of the Union territory of the National Capital Territory of Delhi where it is required.

It is directed that the Delhi LG will exercise the powers and discharge the functions of the appropriate government or state government under these rules until further order, mentions two separate notifications issued by the Ministry of Home Affairs (MHA) on January 16.

As per the notifications, administrators and the Lieutenant Governors of five other Union Territories, including Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry and Lakshadweep, were also delegated similar powers by the President.

“In pursuance of clause (1) of article 239 of the Constitution, the President hereby directs that

the administrator or Lieutenant Governor of the National Capital Territory of Delhi, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry and Lakshadweep shall, subject to the control of the President and until further order, exercise the powers and discharge the functions of the appropriate Government or State Government under the Industrial Relations Code, 2020 (35 of 2020), to formulate the rules only in the areas where the Union territory of the National Capital Territory of Delhi, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry and Lakshadweep are required to formulate rules either as appropriate Government or State Government,” states one of the notifications.

Under Industrial Relations Code, 2020, the appropriate government may exempt any new industrial establishment or class of establishments from the provisions of the Code in the public interest.

Another notification mentions regarding delegation of powers of state government and appropriate government under the Occupational Safety, Health and Working Conditions Code, 2020 to the administrator and Lieutenant Governor of these six UTs.

“In pursuance of clause (1) of article 239 of the Constitution, the President hereby directs that the administrator or Lieutenant Governor of the National Capital Territory of Delhi, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry and Lakshadweep shall, subject to the control of the President and until further order, exercise the powers and discharge the functions of the appropriate Government or State Government under the Occupational Safety, Health and Working Conditions Code, 2020 (37 of 2020), to formulate the rules only in the areas where the Union territory of the National Capital Territory of Delhi, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, Chandigarh, Puducherry and Lakshadweep are required to formulate rules either as appropriate Government or State Government,” said the notification.

The delegation of two fresh powers to Delhi LG is significant amid his stalemate with Delhi Chief Minister Arvind Kejriwal.

The recent flashpoint between Delhi Chief Minister Arvind Kejriwal and Lieutenant Governor Vinai Kumar Saxena has triggered ahead of the January 23 election of the Mayor and Deputy Mayor of the Municipal Corporation of Delhi (MCD). AAP has accused the LG of issuing orders on “practically everything” and bypassing the elected government. (ANI)
