Opposition Is Behaving As An Obstructionist, Destructive: Goyal

Union Minister Piyush Goyal on Monday said that the Opposition was behaving like an “obstructionist” who does not believe in the rules and regulations in the functioning of the Parliament.

Addressing a press conference here in the national capital, Piyush Goyal said: “Today in the Rajya Sabha, we witnessed the frustration and the complete absence of decorum from the Opposition parties. Their frustration reached a level where they don’t even believe in any rules and regulations in the functioning of Parliament.”
“They are even denying the rulings and observations of the Chair. Unfortunately, the Opposition is behaving as an obstructionist and destructive,” Goyal said.

The Union Minister also said that the Opposition’s recent walkout from the Rajya Sabha shows their “lack of faith” in the Army.

“It shows their complete lack of faith in the Army which is demoralizing the armed force. It is in the best interest of the country that the Opposition allows smooth functioning of Parliament in the sensitive matters of security and to uphold the democratic values,” he said.

He further expressed his expectations from the Opposition, particularly Congress to respect the Army and jawans at the border. He said that the Defence minister has already made a detailed statement in Rajya Sabha, after which, we would have expected the Opposition, particularly Congress to respect our Army, jawans at the border, and their commitment towards the nation, but Rahul Gandhi continues to cast aspersions on the Army,” Goyal said.

Speaking in the Lok Sabha on December 13, Defence Minister Rajnath Singh said that the Indian Army bravely stopped the Chinese PLA troops from encroaching on Indian territory, and forced them to withdraw to their posts. However, on Saturday, he said that whether it is Galway or Tawang, India’s defense forces have always shown courage and displayed their valor on every occasion.

Goyal’s remarks came after the Joint Opposition comprising Congress, the Aam Aadmi Party (AAP), the Rashtriya Janata Dal (RJD), the Rashtriya Lok Dal (RLD), Communist Party of India (Marxist), Communist Party of India (CPI), the Trinamool Congress, Dravida Munnetra Kazhagam (DMK), Samajwadi Party (SP), Nationalist Congress Party (NCP), Shiv Sena and the Kerala Congress staged a walkout from the Rajya Sabha as their demand to hold a debate over the recent clashes along the Line of Actual Control (LAC) between the Indian and Chinese forces at the Tawang sector in Arunachal Pradesh was disallowed.

The walkout was staged during the Zero Hour session in the Upper House.

The opposition sought to raise the issue with Leader of Opposition (LoP) Mallikarjun Kharge saying nothing is bigger than the nation and sought a detailed debate on December 9 clashes along the LAC between the neighboring countries.

“They (China) are encroaching on our land. If we don’t discuss this issue then what else should we discuss? We are ready for discussion on this issue in the House,” said the LoP in Rajya Sabha.

Kharge said the Rajya Sabha Chairman has residuary powers on rules for admitting adjournment notices submitted by several MPs to hold discussions on the India-China border situation issue.

Rajya Sabha Chairman Jagdeep Dhankhar, however, asked the opposition MPs to not convert it into a classroom and rejected the demand of the Opposition.

Dhankar said he can’t give attention to notices that fail to follow rules, and reprimanded MPs of Rajya Sabha for “more than 100 minutes of disruptions” of proceedings in the House. (ANI)

Oppn Leaders Meet At Kharge Office Ahead Of Parl Session

Ahead of the beginning of the day’s proceedings in Parliament, Leader of Opposition in Rajya Sabha Mallikarjun Kharge on Wednesday convened a meeting with floor leaders of opposition parties to discuss the December 9 faceoff between Indian and Chinese troops along the Line of Actual Control (LAC) in Arunachal’s Tawang sector.

On Tuesday, both Lok Sabha and Rajya Sabha were rocked by the issue with the Opposition staging a walkout after Defence Minister Rajnath Singh made a statement in both Lok Sabha and Rajya Sabha on the Tawang clash.
“A total of 17 parties attended today’s meeting and decided to raise the issue for discussion if not allowed it has been decided that parties will walk out from the house,” a leader who participated in the meeting told ANI.

The Opposition, the participant said, has also decided that if a discussion is not allowed, they will boycott the House.

The meeting was held in Congress chief Mallikarjun Kharge’s chambers to plan the Opposition strategy on India -China tussle and other issues in the House.

Kharge on Tuesday said that the opposition staged the walkout as Singh did not give a clarification on his statement in Parliament on the reports of clashes between the Indian Army and Chinese troops.

Speaking in both Houses separately, the Defence Minister informed that the “Indian Army bravely stopped the Chinese People’s Liberation Army (PLA) PLA troops from encroaching on Indian territory, and forced them to withdraw to their posts”.

Meanwhile, the Bharatiya Janata Party (BJP) parliamentary meeting also took place in the Parliament Library building today in the presence of Prime Minister Narendra Modi and Union Home Minister Amit Shah.

Singh and National BJP president JP Nadda were also present at the meeting.

The BJP MPs gave a rousing reception to PM Modi and also congratulated the BJP state president of Gujarat CR Paatil for the historic win in the western state.

The Winter Session of the Parliament began on December 7 and will have 17 working days. (ANI)

Indian Wildlife Act Amended

Rajya Sabha Amends Wildlife Act, Adds More Species

The Rajya Sabha on Thursday passed the Wild Life (Protection) Amendment Bill, 2022 which is intended to amend the Wild Life (Protection) Act, 1972 to incorporate more species protected under the law.

The Lok Sabha passed the Bill during the Monsoon session earlier this year. The Bill seeks to implement India’s obligations under the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES), which requires countries to regulate the trade of all listed specimens through permits.

Replying to the discussion on the Bill, Union Environment Minister Bhupender Yadav said that the Bill was brought because CITES requires an independent framework for the protection of wildlife.

After being passed, the Bill will allow the transfer or transport of a captive elephant for religious and other purposes by a person with a valid ownership certificate.

The winter session of the Parliament began on Wednesday. The session will have a total of 17 working days.

RS Chairman Dhankhar Slams NJAC verdict

Noting that the Supreme Court striking down the NJAC Act in 2015 was an unparalleled development in democratic history where a duly legitimized constitutional prescription was “judicially undone” and is “a glaring instance of severe compromise of parliamentary sovereignty and disregard of the mandate of the people”, Rajya Sabha Chairman Jagdeep Dhankar said on Wednesday that “this House, in concert with the Lok Sabha, is duty bound to address the issue”.

In his maiden speech in Rajya Sabha on the first day of the winter session of Parliament, the Vice President said democracy blossoms and flourishes when its three facets – the legislature, the judiciary, and the executive scrupulously adhere to their respective domains.
The Vice President talked of the need to catalyze a wholesome environment to promote the synergic functioning of Constitutional Institutions and emphasized the need to respect “Laxman Rekha”.

He said the Parliament in a much-needed historic step passed the 99th Constitutional Amendment Bill paving way for the National Judicial Appointment Commission (NJAC).

Dhankar said there was unprecedented support for the legislation and the two Houses passed it almost unanimously in August 2014.

“Rarely in Parliamentary democracy, there has been a such massive support to Constitutional legislation. This process fructified into a Constitutional prescription, after 16 State Assemblies out of 29 States ratified the Central Legislation; the President of India in terms of Article 111 accorded his consent on December 31, 2014,” he said.

Dhankar said the historic parliamentary mandate “was undone” by the Supreme Court on October 16, 2015 by a majority of 4:1 finding the same as not being in consonance with the judicially evolved doctrine of ‘Basic Structure’ of the Constitution.

“There is no parallel to such a development in democratic history where a duly legitimized constitutional prescription has been judicially undone. A glaring instance of severe compromise of parliamentary sovereignty and disregard of the mandate of the people of which this house and the Lok Sabha are custodians,” he said.

“We need to bear in mind that in democratic governance basic of any ‘Basic Structure’ is the prevalence of primacy of the mandate of the people reflected in the Parliament. Parliament is the exclusive and ultimate determinative of the architecture of the Constitution,” he added.

Dhankar said it is disconcerting to note that on such a momentous issue, so vital to the democratic fabric, “there has been no focus in the Parliament, now for over seven years”.

“This House, in concert with the Lok Sabha, being the custodian of the ordainment of the people, is duty bound to address the issue, and I am sure it will do so,” he said.

The Vice President said the sublimity of the doctrine of separation of powers, is realized when the legislature, judiciary, and executive optimally function in tandem and togetherness, meticulously ensuring scrupulous adherence to the respective jurisdictional domain.

“Any incursion by one, howsoever subtle, in the domain of other, has the potential to upset the governance apple cart. We are indeed faced with this grim reality of frequent incursions. This house is eminently positioned to take affirmative steps to bring about congeniality amongst these wings of governance. I am sure you all will reflect and engage in a way forward stance,” he said.

Dhankar said parliamentary sovereignty is inviolable in any democracy and members have taken oaths to preserve it.

“Essence of democracy lies in the prevalence of the ordainment of the people reflected through the legitimized platform.”

He said the power of parliament of the day to act in exercise of its constituent power to “amend by way of addition, variation or repeal any provision of this Constitution in accordance with the procedure” is unqualified and supreme, not amenable to executive attention or judicial intervention except for the purpose of deciding any case involving a substantial question of law as to the interpretation of the Constitution envisaged in article 145(3) of the Constitution.

The Vice President said using this Constitutional power to amend, Parliament effected wholesome structural governance changes to further spinally strengthen democracy. This has been by way of incorporation of Part IX, IX A, and IX B in the Constitution providing a comprehensive mechanism for Panchayati Raj, Municipalities, and Co-operative Societies, he said.

Dhankar said authorities in constitutional positions in any institution are required to exemplify their conduct by high standards of propriety, dignity, and decorum.

“Time for all constitutional institutions to reflect and give quietus to public display of adversarially challenging stance, trading or exchange of advisories emanating from these platforms. I urge the Members of the House to proactively catalyze the evolution of wholesome cordial ecosystem ending this aberration,” he said.

“It is institutional seamless connection marked with mutual trust and respect that generates an ecosystem best suited for serving the nation. This House needs to catalyze this wholesome environment to promote synergic functioning of Constitutional Institutions, emphasizing the need to respect Laxman Rekha,” he added.

Dhankar said he looked forward to contributing to the growth trajectory of the largest vibrant democracy in the world and vindicating its trust and confidence.

He said the terms ‘Upper House’ or ‘House of Elders’ though not part of the official glossary, amply reflect the uniquely significant importance of this institution.

“Nation justifiably expects the House of Elders to take the decisive directional lead in reaffirming and enhancing the core values of the Republic and set up the traditions of parliamentary democracy exemplifying the highest deliberative emulative standards,” he said.

“Today, as we are in Amrit Kaal, we cherish one of the world’s finest constitutions as our own. Members of the Constituent Assembly were enormously talented with impeccable credentials and immense experience. The Constituent Assembly, given the scenario then, was as representative as was practicable,” he added.

Dhankar said with each election there has been progressively authentic enhancement in the representation gradient. “Presently the parliament reflects with authenticity the mandate and aspirations of the people as never before.”

He said the Constituent Assembly addressed sensitive, complex and critical issues, exemplifying sublimity engaging in dialogue, discussions, deliberations, and debate marked with a cooperative and consensual attitude.

“Diverse issues were traversed without there being any disruptions or rancor. Obstruction and Disruption of proceedings as parliamentary practice or option are antithetical to democratic values. The contemporaneous scenario on this count is concerning and makes it imperative for us to follow the high standards set in the Constituent Assembly. We need to be cognizant of severe public discomfort and disillusionment at lack of decorum in the temple of democracy,” he said.

Referring to his visit to Cambodia for India-ASEAN and East Asia Summits and FIFA World Cup Inaugural Ceremony in Qatar, Dhankar said he was sharing with members his “deep sense of pride and satisfaction of the level of respect India commands amongst world leaders and hope our growth trajectory generates for global peace and prosperity”. 8 Scribes Working For Srinagar Get Threats From Terrorist: MoS Rai

Eight journalists working for Srinagar-based local newspapers received threats through an online terror blog. Four of the media persons reportedly resigned, Minister of State for Home Nityanand Rai told the Rajya Sabha today.

MoS Home Nityanand Rai said that a case has been registered at Shergari Police Station in this regard.
“As reported, eight journalists working for Srinagar-based local newspapers received threats through the terror blog “Kashmir Fight”. Four media persons have reportedly resigned. The media persons who resigned belong to the media house “Rising Kashmir”. In this regard a case has been registered at Shergari Police Station, Srinagar,” told MoS Nityanand Rai to Rajya Sabha.

Rai further said that Jammu and Kashmir government has a policy of zero tolerance against terrorism and the security situation has improved significantly in the state.

Kejriwal Is Guru Of Thugs: BJP On Chandrasekhar’s Letter

Amid the row over conman Sukesh Chandrasekhar’s letter mentioning Delhi Chief Minister Arvind Kejriwal of receiving money, Bharatiya Janata Party (BJP) national spokesperson Gaurav Bhatia on Saturday launched a scathing attack on the Aam Aadmi Party (AAP) chief attributing him as the “guru of all thugs”.

Addressing a press conference, Bhatia said, “Arvind Kejriwal is the guru of all the thugs. There is no friend whom Arvind Kejriwal has not cheated. The sins and misdeeds of Arvind Kejriwal were exposed by the letter of misdeeds by the letter from Sukesh Chandrasekhar.”
“The letter says the way Arvind Kejriwal takes Rs 50 crore from the great thugs and discusses sending such persons against whom there are many criminal cases to Rajya Sabha. Today, the role of three people becomes clear in this, the first is the biggest thug and kingpin Arvind Kejriwal, the second is Satyendra Jain, third is Kailash Gehlot,” he added.

Bhatia said according to the letter, Kejriwal told Sukesh Chandrashekhar that he had given Rs 50 crores and asked him to bring 20-30 more businessmen like him and gave a target of Rs 500-600 crore.

The BJP leader said that Kejriwal’s promise of clean Delhi has failed and people in the national capital are suffering from severe air quality.

Attacking Kejriwal, BJP MP Gautam Gambhir said, “The biggest thug is not the one who is sitting in jail but the one who is sitting on the chair of Delhi and cheating the entire Delhi and the people of the country. He has already made Delhi dirty. Now he wants to make Rajya Sabha dirty. Delhi has neither clean water to drink nor clean air to breathe.”

In a letter that has been confirmed by his lawyer, Sukesh, who is currently lodged in Delhi’s Tihar Jail and facing several cases of corruption under the Prevention of Corruption Act and Money Laundering Act, alleged, “Delhi Minister Satyendar Jain and ex-Tihar DG are threatening me after my complaint to Delhi’s LG went public”.

Launching a scathing attack on Chief Minister Arvind Kejriwal, Sukesh fired questions at him.

“Kejriwal Ji why you forced me to bring 20-30 individuals to contribute Rs 500 crore to the party in return for seats,” he claimed.

Sukesh further asked why did the Delhi Chief Minister receive Rs 50 crore from him and offered him a Rajya Sabha seat.

“Kejriwal Ji, I am the country’s biggest thus according to you, then why on what basis you received Rs 50 crore from me and offered Rajya Sabha seat to me? So what does that make you?” the letter alleged.

He further asked the Delhi Chief Minister and jailed Minister Satyendar Jain to “stop threatening and intimidating” him through the jail administration and said that nothing will stop him from seeking a detailed CBI probe.

“Kejriwal ji and Satyendar Jain ji, stop threatening and intimidating me through the jail administration. Nothing will stop me from moving ahead and seeking a detailed CBI probe,” the letter stated.

“After my arrest in the year 2017, I was imprisoned in Tihar Jail and Satyendra Jain visited me several times. The secretary had asked me to give Rs 2 crore per month as protection money,” Chandrashekhar stated in his letter. (ANI)

Sachin Pilot Targets Modi-Gehlot Chemistry, Draws Parallels With GN Azad

A day after Prime Minister Narendra Modi heaped praise on Rajasthan Chief Minister Ashok Gehlot, Congress leader and former deputy chief minister Sachin Pilot termed it as a “very interesting” development that “should not be taken lightly.”

“The PM had similarly praised Ghulam Nabi Azad in Parliament. We saw what happened after that,” Pilot said.
Talking to reporters here, Pilot said, “We all witnessed Prime Minister Narendra Modi’s praises during his visit to the Mangarh Dham, We all have seen similar things, earlier in the Rajya Sabha as well when the PM heaped praises on former Rajya Sabha MP Ghulam Nabi Azad on his farewell day. Everybody knows what happened after that. It is an interesting development yesterday and should not be taken lightly.”

Prime Minister Narendra Modi on Tuesday visited Mangarh Dham in Rajasthan and shared the dias with Gehlot at the event “…When PM Modi goes abroad, he receives great honor. Because he is PM of the nation of Gandhi, where democracy is deep-rooted. When the world realizes this, they feel proud that the PM of that country is coming to them…,” Gehlot said.

Addressing the event, PM Modi recalled his days as the Chief Minister of Gujarat. “Ashok ji (Gehlot) and I had worked together as CMs. He was the most senior in our lot of CMs. Ashok ji is still one of the senior-most CMs among those who are sitting on the stage right now,” he said.

Meanwhile talking to reporters here today, Pilot also said that the time has now arrived “to take action against indiscipline” and sought action against errant MLAs of Rajasthan.

The pilot said MLAs who have been served notices should be told to file their replies. “Congress is an old party… I request the new president to take action against indiscipline,” he said.

“As far as Rajasthan is concerned, a CLP meeting called on September 25 couldn’t be held. AICC considered it a matter of indiscipline…Rules same for all. So, if indiscipline occurred and replies were given, action should be taken. I believe party chief Mallikarjun Kharge will take a decision soon,” Pilot said.

In the run-up to the nomination for Congress president election, Gehlot was forced to bow out of the process after Congress MLAs supporting Gehlot did not attend a Congress Legislature Party meeting on September 25. (ANI)
