Telangana Govt Sets Up SIT To Probe Police Encounter

The Telangana government on Sunday constituted a Special Investigation Team (SIT) to investigate the police encounter against the four accused in the rape and murder of the 27-year old veterinarian.

The eight-member SIT team will be headed by Rachakonda Police Commissioner Mahesh M Bhagwat.

On the intervening night of November 27-28, the veterinarian was raped and murdered by four persons near the outer Ring Road at Shamshabad on the outskirts of Hyderabad.

All the four accused in the rape and murder case were killed in a police encounter in the early hours on Friday when Hyderabad police had taken the four accused at the crime spot to recreate the scene during which they allegedly attempted to flee.

The government took into consideration the Supreme Court’s judgement in the case of PUCL versus the state of Maharashtra and others to entrust the investigation into an independent probe agency or police team of another police station under the supervision of a senior police officer.

According to a government order the members of the SIT shall immediately take over the investigation under section 307, 394, 224, 332 r/w 34 IPC and section 174 r/w 176 CrPC and section 25 (1-B) (a), 27 of the Arms Act of Shadnagar PS under Cyberabad and all related cases registered in Telangana state as per guidelines of Supreme Court of India.

The terms of reference of SIT include: To recover and preserve the material evidence related to the death; To identify the witness and record the statements including the statements of police personnel involved in the death of four persons; The cause and circumstances leading to the death of four persons should be ascertained with reasons to establish truth.

The government order stated that all the government agencies including police in the state shall extend all possible assistance to the SIT keeping in view of the sensitivity of the case. After completion of the investigation, the SIT will file its report in the concerned court of law having jurisdiction.

‘Forget Mandir-Masjid, Focus On Issues That Matter’

I teach at a madarsa and conduct the namaz at a local masjid. As a mufti, I have read the Quran and Hadees in detail (a 9-year-long study is required) and have legal powers under Islam. Being a Mufti, I can tell you that the Quran says that Allah’s ibadat can be done anywhere. I also subscribe to the thought that God can be found in one’s heart and even though a place of worship is more ‘conducive’ and ‘helpful’ in finding peace, if any place of worship is causing non-peaceful situation, a Muslim should let it go. And therefore, I am okay with the Ayodhya verdict that came out on November 9.

A masjid is also known as Baitullah (the house of Allah). People were asked to come an offer the namaz together because it fostered a feeling of community-bonding and love among people. It is similar to kirtans and kathas in Hinduism. And the word masjid comes from sajda (which means bowing down), a place where you bow down in front of Allah, and let go of your ego, and surrender. I would say people should now leave the Babri Masjid / Ram Janmabhoomi temple issue into the hands of the very God who is at the centre of this issue.

The Quran talks about sabr (patience) and shukr (gratitude). One can be patient only when one has deep faith in God, otherwise it is difficult to be patient. So each moment in life is either an opportunity for sabr or shukr.

Islam focuses a lot on community building. About 1,400 years ago when Prophet Mohammed (PBUH) was blessed with being a messenger of Allah and when Islam started, masjids were meant to build communities. Not only people came together collectively to surrender their egos, masjids also functioned as community halls as well as places of justice where people could bring their problems and the elders and the knowledgeable could help solve them, much like how panchayats function. It was meant to be a place where everyone felt loved and accepted. However, some people who are what I call possessed ‘mazhabi shiddat’ or are under the influence of ego, and very passionately at that, cause problems in the name of mandir or masjid. Someone who has truly felt God becomes peaceful. 

Many people who consider themselves the thekedars of Islam (the protector of Islam) have only known ego, and not really known Allah, or even the Prophet. The word Islam (it contains the word salam or salamat) also means people who convey peace. And many people who wrongly interpret Islam to create non-peaceful situations haven’t truly read the Quran or interpreted it properly. 

In the end, I would just like to say that people, be they followers of any faith, should come together and figure out ways to make the present better rather than bickering about the past. There are so many important issues like pollution control, education, health etc. to be taken care of and we should behave like human beings first. At the end of the day we are all humans. 

Just like the Hindu philosophy of ‘VasudhaivKutumbakam’ (the whole world is one family), Islam also believes in equality and brotherhood. When people offer namaz together or go to perform the Hajj, all differences are removed and people are treated as one. Everyone who goes to Mecca to perform Hajj has to wear similar kind of clothing and has to stand in the same line. So people should behave like humans first with each other, in a humane manner. Islam also says that the best way to set the world right is to set oneself right, and if anyone else is doing wrong as per a person’s perspective, let God handle it.

43 Killed In Delhi Factory Fire, Owner Arrested

As many as 43 people died after a fire broke out in a factory in Anaj Mandi at Rani Jhansi Road on Sunday morning, police said.

Around 62 people were taken out from the building that caught fire in the wee hours on Sunday of which 43 have been declared dead.

Delhi Police arrested the owner of the building and his manager in which the fire broke out. “Rehan and his manager Furkan have been arrested. The police are also interrogating brothers of Rehan — Shan and Imran. We are also looking for those who were running the factory. We are investigating the matter. From the information we have, more or less there is no possibility of more bodies being recovered,” DCP, North, Monika Bhardwaj told reporters.

According to police, there was some part of the building, which Rehan had not given on rent.

A case has been registered under Section 304 (punishment for culpable homicide not amounting to murder) of the Indian Penal Code against building owner Rehan, who had absconded after the fire broke out.

Delhi Chief Minister Arvind Kejriwal expressed grief over the death of 43 people, who lost their lives in a major fire that broke out in Anaj Mandi at Rani Jhansi Road.

Taking to Twitter, Kejriwal called the incident “a very very tragic news” and said that firemen were doing their best.”V v tragic news. Rescue operations going on. Firemen doing their best. Injured are being taken to hospitals,” he tweeted.Around 15 people were initially rushed to the hospital after a fire broke out at a factory in Anaj Mandi.

Soon after receiving the report, 15 fire tenders were rushed to the spot to douse the fire and to carry out rescue operations. Given the intensity of the fire, 10-12 more fire tenders had to be sent at the spot.

Speaking to media, Deputy Fire Chief Officer Sunil Choudhary said: “A fire broke out in a 600 sq feet plot. It was very dark inside. It is a factory where school bags, bottles and other materials were kept.”

“We have so far sent 15 people to the LNJP hospital for medical aid. While some of them were injured, others had fainted. The owner said that around 20-25 labourers were sleeping inside when the incident happened,” he had added.

The officer further said the fire was of “medium category” and had been completely doused.

Kishore Kumar, Medical Superintendent of Lok Nayak Hospital, had told ANI: “We got 14 casualties, of which 10 were brought dead. The causalities have been brought from basti area near filmistan. Our team of doctors is attending to those who are alive.”

Mohammad Asim, a local said, “The flat was given on rent. It was a short circuit. Fire brigade team and police teams did a great job.”

The fire has been completely doused and rescue operations are currently underway.

Unnao Rape Victim Succumbs To Burn Injuries

A 23-year-old rape victim, who was set ablaze by five men in Unnao district yesterday, succumbed to her injuries late night at Delhi’s Safdurjung hospital on Friday.

“She died at 11.40 pm. She suffered a cardiac arrest and doctor tried to resuscitate, but she could not survive,” Dr Shalab Kumar, Head of Burns and Plastic Department, told ANI.

The post-mortem of the Unnao rape victim revealed that she died of extensive burn injuries.

Also, no indication of poisoning and suffocation was found in the body.

“No indication of poisoning and suffocation was found on the body during post-mortem. Autopsy reveals that the victim died to extensive burn injuries. The autopsy was conducted in the morning,” said Dr Sunil Gupta, Medical Superintendent, Safdarjung Hospital.

After the post-mortem, the mortal remains are being taken to her village in Unnao.

After battling for life at Delhi’s Safdarjung Hospital, the Unnao rape victim who was set ablaze while on her way to a court hearing on Thursday morning, died at 11:40 pm on Friday.

Dr Shalab Kumar, HOD of burns and plastic department at the hospital told ANI: “It is very sad that the Unnao rape victim could not survive despite our best efforts. She suffered cardiac arrest at 11:10 pm and we tried to resuscitate her, but she could not survive.”

On Thursday, the 23-year-old Unnao rape victim was airlifted from Lucknow’s SMC government hospital to Safdarjung Hospital.

According to the police, five miscreants allegedly threw kerosene on the woman and set her ablaze when she was on her way to a local court for the hearing of a rape case she had filed.

Notably, the woman had filed a rape case in March this year, which is under trial at a local court in Uttar Pradesh’s Unnao. (ANI)

Vet Rape: All Accused Killed In Police Encounter

All the four accused in the rape and murder of a woman veterinarian were killed in an encounter with Telangana police early on Friday.

According to the police, all the four were being taken to the scene of the crime, where the charred body of the doctor was found, when they allegedly attempted to escape and were shot at.

Senior police officials arrived at the site of the encounter.

“The accused Mohammed Arif, Naveen, Shiva and Chennakeshavulu were killed in a police encounter at Chatanpally, Shadnagar on Friday in the wee hours, between 3 am and 6 am. I have reached the spot and further details will be revealed,” Cyberabad Police Commissioner V C Sajjanar said.

The four accused were arrested and were in judicial custody and lodged in high-security cells at Cherlapally Central Jail in Hyderabad.

Police said that the veterinarian was brutally raped and killed by the accused who burned her body in Shamshabad area on November 27. Her charred body was recovered on November 28. The killing has drawn mixed response from across the nation.

According to the police, all the four men were being taken to the crime spot to reconstruct the sequence of events after which the charred body of the doctor was found near Hyderabad last week.

“The accused snatched weapon and fired on Police. In self defence the police fired back, in which the accused were killed,” DCP Shamshabad Prakash Reddy said.

After the news of the shoot-out poured in, locals started gathering near the spot and raised slogans hailing police, like ‘DCP Zindabad, ACP Zindabad’. They even showered rose petals on police personnel at the encounter site.

Meanwhile, neigbours of the woman veterinarian also celebrated by bursting firecrackers, offering sweets to cops and tying Rakhis to them.

Security has been tightened at the site of encounter.

Speaking to ANI, the victim’s father said, “It has been 10 days since my daughter died. I express my gratitude towards the police and government for this. My daughter’s soul must be at peace now.”

Asha Devi, whose daughter Nirbhaya was gangraped and left to die on road in December 2012, said Telangana police “did a great job”.

“I am extremely happy with this punishment. Police have done a great job and I demand that no action should be taken against the police personnel,” Asha Devi said.

Chairperson of Delhi Commission for Women, Swati Maliwal, who has been on a hunger strike since Monday against rape incidents in the country, said laws need to be made more stringent.

“What will the police do if rapists try to escape? That is exactly why we are requesting the Centre to create a strong system in the country so that rapists who are committing such heinous crimes need to be given death penalty after all kinds of court procedures,” Maliwal said.

BJP lawmaker Locket Chatterjee lauded Telangana Police and said that such operations should be made ‘legal’.

“This is a very good step taken for our country, I felt really good when I read this news in the morning. The soul of the rape victim must be at peace now. Her family must be at peace. Such encounters should be made legal,” Chatterjee told ANI.

“If something of this sort happens then the culprits should be hanged to death or killed in an encounter within seven to fifteen days. I thank Hyderabad Police for the encounter carried today,” she added.

BSP chief and former Uttar Pradesh chief minister Mayawati also commended Telangana Police and said police in Uttar Pradesh and Delhi can take inspiration from them.

“Police in Uttar Pradesh and also in Delhi should take inspiration from Hyderabad Police, but unfortunately here criminals are treated like state guests, there is jungle raj in Uttar Pradesh right now. Hope the attitude changes for the better.

Crimes against women are on the rise in Uttar Pradesh, but the state government is sleeping,” she said.

BJP leader Uma Bharti called this the “biggest incident in the 19th year of this century that will guarantee women’s safety.”

Shuttler Saina Nehwal and wrestler Babita Phogat have also lauded the Telangana Police over the encounter.

On the other hand, National Commission for Women (NCW) chairperson Rekha Sharma said the NCW always wanted speedy justice and death penalty through a legal system for the four accused in the rape and murder of a woman veterinarian in Telangana.

“As a common citizen, I am feeling happy that this was the end we all wanted for them. But this end was supposed to be through the legal system. It should have happened through proper channels,” said Sharma.

“We always demanded the death penalty for the accused and speedy justice as well, but the accused people were killed in an encounter. So, police are the best judge to know in what circumstances was the encounter carried out,” she added.

Samajwadi Party MP Jaya Bachchan, who had earlier advocated public lynching of rapists, commented, “der aaye durust aaye (better late than never)”.

NHRC To Probe Encounter After Suo Moto Cognisance

The National Human Rights Commission (NHRC) on Friday took suo motu cognisance of the killing of the four accused in Telangana vet’s rape and murder case in a police encounter.

The Commission said that this matter is required to be probed very carefully.

The accused – Mohammed Arif, Naveen, Shiva and Chennakeshavulu – were killed in a police encounter at Chatanpally, Shadnagar on Friday in the wee hours, between 3 am and 6 am, Cyberabad Police Commissioner V C Sajjanar said.

The NHRC has asked its Director General (Investigation) to immediately send a team for fact-finding on the spot investigation into the matter. The team of the Investigation Division of the Commission headed by an SSP is expected to leave immediately and submit their report at the earliest.

It said the encounter indicates that the “police personnel were not properly alert and prepared for any untoward activity” by the accused on the spot, which resulted in the death of all four.

“If the arrested persons were actually guilty, they were to be punished as per law pursuant to the directions of the competent court,” the Commission said.

It added that the death of four persons in an alleged encounter with the police personnel when they were in their custody, is a matter of concern for the Commission.

Stating that the Commission is aware that growing incidents of sexual assault and violence against the women, it said, “loss of human lives even of a person arrested by the police under law, in such circumstances, would definitely give a wrong message to the society.”

“The Commission has already expressed its view that there is lack of “Standard Operating Procedure” to immediately respond to the panic situations by the police authorities. We have been insisting upon all law enforcing agencies to keep human rights angle in their view while dealing with the persons arrested by them or being kept in their custody,” it said.

The Commission asserted that the right to life and equality before the law are the basic human rights recognised and granted by the Constitution.

The four accused were under arrest and in judicial custody. They were lodged in high-security cells at Cherlapally Central Jail in Hyderabad.

Police said that the veterinarian was brutally raped and killed by the accused who later burned her body in the Shamshabad area on November 27. Her charred body was recovered on November 28.

Unnao Rape Survivor Critical, Say Safdarjung Docs

The condition of the rape survivor from Unnao, who was airlifted from Lucknow to the national capital on Thursday and put on a ventilator is critical and there are minimal chances of her survival, doctors attending to her at Safdarjung Hospital said.

“The Unnao rape victim is in very serious condition. There are minimal chances of survival. Now, we have put her on a ventilator,” Sunil Gupta, Medical Superintendent of Safdarjung Hospital said.

“She has suffered 90 per cent of burn injuries. We are putting all our efforts to improve her condition,” he added.

The 23-year-old survivor was airlifted from Lucknow’s SMC government hospital to Safdarjung Hospital last night.

The woman had filed a rape case in March this year, which is under trial at a local court in Uttar Pradesh’s Unnao.

According to the police, five men identified as Shubham, Shivam, Harishankar, Umesh and Ram Kishore, had allegedly thrown kerosene on the woman and set her ablaze when she was on her way to a local court for the hearing of a rape case she had filed.

On Thursday, Chief Minister Yogi Adityanath had taken cognizance of the incident and said that the treatment of the victim will be carried out on government expenses and strict action will be taken against the accused.

Toxic Air Keeps Delhi-NCR Citizens Choking

The air quality of the national capital remained very poor for the second consecutive way with the overall Air Quality Index docking at 388 with PM2.5 at 234 and PM10 359.

According to SAFAR, the rise in air pollution is because of the prevalence of calm surface winds and a decrease in ventilation coefficient which creates a conducive environment for pollutant accumulation.

An AQI between 0-50 is considered good, 51-100 is satisfactory, 101-200 moderate, 201-300 poor, 301-400 very poor and 401-500 is marked as severe/hazardous.

The AQI was 399 in Dhirpur at 9 am and it dipped to ‘severe’ category at 415 in Mathura Road area. The AQI near Pusa, Airport Terminal 3 and Delhi University stood at 354, 391 and 389 respectively.

However, in Pune, Mumbai, and Ahmedabad, the air quality remained in the moderate category with the AQI at 115, 131 and 105 respectively.

Today, the minimum and maximum temperature of Delhi will hover around 7 degrees Celsius and 23 degrees Celsius with the humidity at 46 per cent. A shallow fog will envelop the region throughout the day.

The Center-run SAFAR has advised people residing in the national capital to reduce prolonged or heavy exertion.

“Take more breaks and do less intense activities. Asthmatics, keep medicine ready if symptoms of coughing or shortness of breath occur. Heart patients, see a doctor if you get palpitations, shortness of breath, or unusual fatigue,” it said in an advisory.

When Economics Nibbles At Politics

Two of India’s most credible voices spoke as if in unison on November 29 and 30 at events organized by major media houses. Their well-meant, well-timed warnings are that the economy is in bad shape, something the government of the day is doggedly denying.

The oft-repeated phrase, “it’s the economy, stupid!” comes to mind, but it will not suffice. Bad economic management has combined with widespread perceptions of fear in political and social arenas.

The TINA (there is no alternative) factor that had emerged only six months ago after Prime Minister Narendra Modi and the alliance he leads won a bigger mandate than 2014 is sliding.  

Both, former premier Manmohan Singh and veteran industrialist Rahul Bajaj linked economic governance to a vitiated social climate. Fear, they said, was generated, not by those in power alone, but also by those who draw inspiration and support from them and act with impunity.

Singh’s warning was confirmed the very next day, doubly more than he had expressed last year. India’s gross domestic product (GDP) has fallen to 4.5 percent, the lowest in over six years, when Singh and his government, accused of policy paralysis, were in office. The GDP growth then was 8.5 percent. It had crossed ten at one time during his tenure.   

When Singh had last year darkly predicted a two percent GDP fall, then Finance Minister, late Arun Jaitley, had hinted at Singh’s going senile. Lawmakers and leaders of the ruling Bharatiya Janata Party (BJP) had been more direct in using harsh words.

Singh has been spared abuses this time – not that anybody in the government is taking his words kindly. The counter-response is only more resolute since the government apparently sees Singh straying into political arena by alleging that a “toxic combination of deep distrust, pervasive fear” is “stifling economic activity and hence economic growth”.  

More ire has been reserved for Bajaj, who has pierced through the bubble of India Inc.’s silence. To be fair, he was in the past critical of Singh’s economic management as well. And Singh, braving doubting Thomas all around in those early years, had been dismissive of that criticism. India’s entrepreneurial class is grateful to Singh, the reforms’ pioneer, whether or not they would admit it.

With formidable ministers Amit Shah (who is also the BJP chief), Nirmala Sitharaman and Piyush Goyal on stage, Bajaj spoke of corporates afraid to criticize government, of an environment of impunity for phenomena like lynching and of terror-accused Pragya Thakur’s political journey to Parliament with the BJP’s full backing and support.

The ministers, particularly Shah, denied or defended it all. He compared his government’s record with that of the Singh Government, of all things, on cases of lynching of Muslims and Dalits by vigilantes belonging to his party or its affiliates. Official figures prove his claim hollow. Shah has got to deny this since RSS Chief Mohan Bhagwat who guides his party has decried the very term ‘lynching’ as something alien to Indian culture.  

While building its industrial base, the Bajaj family has a history of speaking up against the government of the day, especially that of the Congress. Rahul B. dared fellow-captains of trade and industry at the conclave to speak up, but none responded. Only leading woman entrepreneur Kiran Shaw Majumdar has taken the cue from Bajaj.

Come to think of it, India Inc. hails most Budgets and praises most finance ministers, as long as its purpose is swerved. It has always moved cautiously, sensing the political climate before speaking out on economic issues. In recent memory, the year 2013 was one such time when the Singh Government was besieged with political protests.

Behind this new churning, unmistakably, there is the Maharashtra factor. Sharad Pawar has sewn together government of an unlikely alliance of known ideological adversaries united to keep the BJP out of the richest state. His emergence, like Bajaj (incidentally, both have their respective bases in Pune) has confounded many calculations and put some life into a beleaguered Opposition.

New Maharashtra Chief Minister Uddhav Thackeray has taken some decisions responding to public concerns like environmentalists’ pleas against felling trees in Mumbai’s wooded area and has announced withdrawal of cases against the Maoists imprisoned under stringent anti-terror laws. The controversial Indo-Japanese Bullet train project, half-way through, is slated to slow down, if not ended. The latter two issues are bound to cause friction with New Delhi.

But he has compulsions. By reinforcing continued adherence to Hindutva that he shares with the BJP, Thackeray has had to keep future political options open. He cannot afford to shed his ideological moorings strengthened along with the BJP over the last three decades. Friction with secular allies is in store.             

Significantly, the BJP slide in recent elections is not because of, but despite, a weak Opposition. It remains divided and has nothing to offer to the people. The recent months have witnessed the rise of regional forces, Pawar being the best and the most promising of the lot. 

The Congress remains in deep slumber, as if running on autopilot. It merely reacts to events, unsure at times about its stand, only to be bashed back by the BJP and its voluble social media supporters. The Gandhis are seen as doing a holding operation, ineffective in office and indecisive about their own role, even as the party gets reduced to third or fourth position.

There are other fears surrounding enforcement of law to detect ‘outsiders’ or ‘infiltrators’. Everyone but the die-hard BJP supporters (read Shah supporters) think this would open the Pandora’s Box. Potentially, just about anyone among the millions who migrate for work or due to a natural calamity can come under suspicion for lack of documents that prove his/her domicile status.

The Modi Government faces long-term decline in economic growth. The latest GDP numbers merely certify what has been experienced on the ground for a long time now. What is striking about the slowdown this time is that it hits the most vulnerable sections of the population. Agricultural distress combined with the disastrous demonetization experiment, has hurt those that serve as the real economic engine.

How far the Singh-Bajaj-Majumdar observations reflect and impact the public mood remains uncertain. It would be premature, if not naïve, to expect anything radical. It is a long grind.

Truth be told, Modi remains popular among large sections and his government/party wield greater money and muscle power than all opponents combined.    

But message is clear: National pride and religion certainly have their own place. But people want jobs and basic necessities first, over everything else. To revive the economy, Modi will have to review the social and political ethos and philosophy. Nothing less will help him and the country.

Rape Survivor Set Ablaze On Way To Court In U.P.

A rape survivor was set ablaze in Bihar area of Uttar Pradesh’s Unnao on Thursday morning.

The victim was earlier referred to Lucknow but was later brought to Safdarjung Hospital in New Delhi for medical treatment.

The ambulance carrying Unnao rape survivor covered a distance of 13 km from the Indira Gandhi International airport to Safdarjung Hospital in 18 minutes.

“We have set up a dedicated ICU under the observation of Dr Shalab Kumar – Head of Burn and Plastic Surgery at Safdarjung hospital,” hospital medical superintendent Dr Sunil Gupta had said adding that all the preparations for her treatments have been made.

The woman, who has suffered about 90 per cent of extensive burn injuries, was first referred to a Lucknow hospital from Unnao and then was shifted to Safdarjung Hospital for proper medical treatment.

The Chief Minister, in a statement, said that the treatment of the victim will be carried out on government expenses and strict action will be taken against the accused.
