SC: Stay On Demolition Of Shanties In Sarojini Nagar

The Supreme Court on Monday extended the stay on the demolition of ‘jhuggis’ in the Sarojini Nagar area of the national capital till the next date of hearing.

A bench of Justices KM Joseph and Justice Hrishikesh Roy listed the matter for further hearing in the third week of July and said that the undertaking given by the Centre regarding no coercive steps will be taken for removal of ‘jhuggis’ in the Sarojini Nagar will continue to next date of hearing.
Meanwhile, the Court agreed with the Centre’s suggestion for the appointment of a nodal officer

to carry out physical verification of all aspects including duration of stay by the dwellers, family details, income status and various others.

The Supreme Court has earlier directed authorities concerned not to take any coercive action relating to the removal of ‘jhuggis’ in the Sarojini Nagar area of the national capital.

The petitioner had challenged the Delhi High Court order which declined to provide rehabilitation/ relocation of the slum dwellers residing in ‘jhuggis’ of Sarojini Nagar.

The Court was hearing a petition filed by ‘jhuggi’ dwellers from Sarojini Nagar against the eviction orders without rehabilitation of slum dwellers.

Senior Advocate Vikash Singh, appearing for the petitioner, had raised the issue that thousands of people will lose their shelter and urged that there must some scheme for rehabilitation.

Senior Advocate Singh also mentioned that board exams are starting tomorrow.

The petition was filed by minor Vaishali, through next friend Sita Devi and others. The plea was filed by advocate Nitin Saluja. The petitioner has urged the Supreme Court to grant special leave to appeal the final order and judgment dated April 19, 2022, passed by the High Court of Delhi.

The present Special Leave Petition (SLP) has been filed by the petitioners against the final order and judgment dated April 19, 2022 (Impugned order) passed by the Division Bench of the High Court of Delhi, wherein the High Court had refused to interfere with the order dated April 11, 2022, passed by the Single Judge of Bench of Delhi High Court.

Delhi High Court has declined to provide rehabilitation/relocation of the slum dwellers residing in ‘jhuggis’ of Sarojini Nagar. The petitioner said that about 1,000 people and about 200 families have been residing in the said shanties for more than four decades ie since the 1980s.

“Hence, the Courts below have allowed the demolition of jhuggis/eviction of the slum dwellers as per the order dated April 4, 2022, issued by the respondent, and no alternative arrangements have been made for the said indigent and poor slum dwellers,” read the petition.

The petitioners said that they do not seek to hinder any of the development work/ public projects undertaken by the Government but are only seeking rehabilitation/relocation as per the policies of the State.

The petitioners submitted further that the forced eviction of jhuggi-residents in question, will permanently disrupt and destroy the lives of ‘jhuggi’ dwellers, as about 200 families, including children, elderly and women (including pregnant women) will be forcibly thrown on the streets, without any alternate accommodation. The residents of the said ‘jhuggis’ are extremely indigent persons such as dhobis, daily wage labourers, rag pickers, maids, street vendors etc. and they do not have any other source of residence, the petition read. Chinese Man Declared Dead At Hospital, Found Alive In Morgue

In a bizarre incident, an elderly person in a Shanghai nursing home was mistakenly taken to the morgue while still alive, local media reported, as the city’s prolonged lockdown continues to put a strain on city health facilities amid renewed COVID-19 outbreak.

The local government confirmed the incident which has triggered widespread anger and condemnation among Chinese people.
Soon after the report broke out, the Shanghai authorities established a joint team to investigate the nursing home where an elderly person who still has vital signs was reportedly being transferred to a mortuary.

The elderly person has been transferred to hospital and was stable, state media outlet Global Times reported.

As many as five officials in Shanghai’s Putuo district and the head of a local welfare house were held accountable and put under investigation after a local welfare house had wrongly transferred a living elderly person to the mortuary.

The incident comes as Shanghai’s lockdown enters have come under heavy criticism, with people unable to access essential medical care.

The country’s much-publicized “zero-covid” strategy that the government credited for bringing the country out of the pandemic till recently is falling apart as the rapidly mounting cases are again forcing mass lockdowns like those seen in 2020. (ANI)

IMD: Yellow Warning For NW India Over Western Disturbance

Indian Meteorological Department (IMD) on Monday issued a yellow warning for Northwest India due to a Western Disturbance, soon after the heatwave spell subsided across the country.

Senior scientist of IMD, RK Jenamani said that there are chances of the heatwave being over in most parts of India, including Delhi, Punjab, Haryana and Uttar Pradesh, as per the analysis of IMD today. However, there are chances of a heatwave in West Rajasthan and Vidarbha, but the major heatwave spell is over.
“The heatwave in Odisha and Bengal was over on April 30, as we predicted. Strong winds will be there in the next two to three days. We are also giving a Yellow warning to Northwest India as there is a Western disturbance. Delhi is likely to experience rain mainly on May 3. Rajasthan, Delhi, Haryana, and Punjab are on yellow alert and strong winds will be there tomorrow and rain may occur,” he said.

Jenamani further told that Western Disturbance is very active and the wind pattern can be seen in Delhi, Lucknow, and Jaipur. For teh next 6-7 days, east winds will also be very strong and the temperature will not rise.

“It is a big relief after such a big spell. A heatwave cannot be formed till May 7. We will be able to the exact situation after May 7 after analysing however the temperature goes. But right now the condition is good in May,” he added.

Speaking about the situation in Andaman, Jenamani said, “The system in Andaman is forming on May 4. Low pressure will be formed on May 6 and then it will be intensified. We are giving a warning to South Andaman and adjoining areas of the Bay of Bengal. We have asked people not to go there as there are indications that the system will intensify. We have mainly asked fishermen to not go there.”

The national weather forecasting agency predicted that the isolated parts of Himachal Pradesh, Punjab, Haryana-Chandigarh-Delhi, south Uttar Pradesh, Kutch and East Rajasthan will experience a decrease in the temperature from today, whereas Madhya Pradesh, Chhattisgarh, Telangana and West Rajasthan will experience heatwave conditions for another 24 hours. It will subside from May 3, the IMD said on Sunday.

It also predicted thunderstorm activity over Northwest and East India till May 4 and over Northeast India till May 3. Isolated places over Delhi, Himachal Pradesh, Punjab, Haryana-Chandigarh, east Rajasthan and parts of Uttar Pradesh will experience partly cloudy sky with the possibility of thunder development from Monday.

For the past few weeks, parts of the country have been reeling under intense heatwave with the mercury soaring high and average maximum temperature reaching 35.9 and 37.78 degrees Celsius in the northwest and central India respectively. (ANI)

CBI Files Fresh Case Of Cheating Against Mehul Choksi

The Central Bureau of Investigation (CBI) has registered a fresh case against fugitive diamantaire Mehul Choksi and his company Gitanjali Gems for allegedly defrauding the Industrial Finance Corporation of India (IFCI).

A senior CBI officer said that after the preliminary inquiry into the complaint received against Mehul Choksi and his company Gitanjali Gems from the Assistant General Manager (AGM) of IFCI, an FIR under IPC section 420 (cheating), 468 ( Forgery for purpose of cheating) and 471 (Whoever fraudulently or dishonestly uses as genuine) has been registered in Mumbai.

The officer informed that during the period 2014 to 2018, IFCI Ltd relying on the representation, assurances and undertaking of said private company as well as its Director and the value of the pledged jewels on the basis of valuation conducted by Valuers, had disbursed the entire loan amount of Rs 25 crore (approximately) on the basis of security cover of two times, pledge of shares, pledge of gold, diamond and gold CS studded jewellery.

It was further alleged that the accused had started committing defaults in the repayment of loan installments and in order to recover the defaulted amount of the installments, IFCI Ltd invoked the pledge and the fresh valuation obtained by IFCI dropped the valuation of the pledged jewels by 90 per cent.

The CBI also alleged that the Director colluded with the Valuers and got the valuation of the pledged jewels done with exorbitant and inflated value. The diamonds were allegedly of low quality and not real gemstones, the officer said.

Searches were conducted at around eight premises of the accused Valuers in Mumbai and Kolkata which led to the recovery of incriminating documents. (ANI)

Pakistan, The Hand of The Establishment

Imran Khan’s misadventures in office and his attempts to cling to power have come against the reality of numbers as he tried to use every method in the book to outwit the establishment. Although he hasn’t given up, the levers of power have moved on from his grasp. The Supreme Court and High Court had to intervene to bring a rolling rail back 

Imran Khan, chairman of Pakistan Tehrik-e-Insaf, came to power in 2018 promising delightful dreams of prosperity, fair deal, national prestige, honour of Pakistani passport in the world, houses for poor, jobs for youth, lawmaking, best governance, no corruption, accountability of the corrupt politicians and officers, no protocol, quality education, no loan from IMF, return of all loans, respect of the state institutions etc. However during his tenure he proved an utter failure to metalize all these promises and hopes.

March 2022 proved catastrophic to Prime Minister Imran Khan when he was ousted from power through no-confidence move presented by the opposition parties including PPP, Muslim League (N), ANP, PTM and other members in the national assembly. This was the time when Imran Khan decided to go for political shenanigans in and outside the assemblies.

Imran Khan, quoting an ambassador’s cable from the US, declared the no-confidence move as an American conspiracy because Imran Khan had refused the USA to give airbases likely to be utilized for surveillance of Afghanistan.

On this stand, he organized his ministers, Speakers and social media to blame and embarrass the military establishment of Pakistan with the aim to cripple the confidence of the establishment, election commission and courts.

He warned the ‘establishment’ that he would be more dangerous (Khatare nak) if ousted. His own assembly members had deserted therefore he tried to threaten these members, the Courts, Election Commission and anyone else with Constitutional prerogatives as he interpreted it. Imran Khan is not a Constitutional legal luminary. Therefore, things went problematic and a constitutional crisis emerged.

At his alleged insistence, the Speaker did not allow the no-confidence move within due days as ordered in the Constitution of Pakistan. This was a violation. Being custodian of the constitution the Supreme Court of Pakistan handled the disorderly situation and ordered to act upon its orders. The Speaker once again used tactics to delay the assembly proceedings. However at midnight, the Islamabad High Court and Supreme Court opened and a prison van started moving along the Constitution Avenue.

This was entirely unexpected by the Prime Minster who had already requested the Army Chief General Qamar Javed Bajwa to interfere as he was ready to resign if the opposition consented to hold fresh elections. This option was declined by the opposition allies, the PDM. The Prime Minster had to leave the PM house with dejected heart and he moved to his home silently.

The Assembly passed no-confidence move against Imran Khan but the PTI (Imran Khan’s party) decided to create hurdles in the way of the new government. The political misadventure continued and as the Speaker resigned, the Deputy Speaker tried to sabotage further processes. He finally accepted the resignations of the PTI members and then resigned himself.

The legal process to confirm the resignations was not adopted so it is still pending and proved another political misadventure. Mian Shahbaz Sharif was elected new Prime Minster. However President Arif Alvi considered the new government imported, traitors and funded by USA and decided to refuse to administer the oath. Consequently the Chairman of the Senate of Pakistan took oath of the Prime Minister and his cabinet members. The new government was in place.

The Punjab Assembly was the next locus of the political games and intrigues. Ch. Pervaiz Elahi, the Speaker, first promised to side with the opposition but on the insistence of his son Moonas Elahi he chose to be the PTI candidate of Chief Minster against Mian Hamza Shahbaz. However the Speaker embarrassed the Deputy Speaker by issuing different statements and even issues orders though being CM candidate his powers were frozen.

Again, the Lahore High Court had to interfere. Yet again PTI and Muslim League (Q) tried to obstruct the process. They physically attacked the Deputy Speaker, Dost Mazari, to sabotage the voting process. After the skirmishes, the Police and the Assembly officials ensured voting for the CM office while PTI and Muslim League (Q) sensing clear defeat walked out of the assembly.

Mian Hamza Shahbaz won the CM office. Repeating the national farce again, the PTI Governor Umar Chattha refused to take oath from the newly elected CM and started correspondence with different offices including of the President.

The Muslim League(N) again had to knock at the High Court and Justice Ameer Ali Bhatti asked Dr. Arif Alvi to depute anyone else to ensure oath of the CM Punjab. This oath taking issue is still pending and the politicians are more concerned with their party line than the constitution and the state.

The current political situation of Pakistan has exposed the inability and incapability of the politicians to permit smooth running of processes. They are unable to cope with this sort of political crisis. Woefully, this ensures that Pakistan will have to suffer more in the coming years because of the leadership crisis. This further confirms that the political parties only can only function in office if the establishment supports them in the day-to-day affairs.

Unfortunately, Pakistan’s political parties generally condemn the establishment’s role when they are in opposition but expect full support and behind the scene maneuverings when they are in the government. Imran khan was very happy when he was enjoying this support but as the establishment withdrew its political role, the government collapsed and Imran Khan started staging mass protest.

Imran Khan believes that use of religion and cursing the military Chief, USA, Courts and election commission would force them to rethink and give him support again. The foreign funding case, Tosha Khana scandal and his signatures on some other documents relating to medicine, flour, sugar subsidy etc. however could be very dangerous for his political career. Therefore, he has adopted the going-public policy to seek the establishment’s favour in the current and coming political happenings but it is likely to be another political misadventure bearing no positive results.

On the other hand, it is expected that the PTI will get something from the institutions because past history reveals that nuisance value does work and the leaders kicked out of the corridors of power are granted relief through deals reached with the levers of real power in Pakistan. Therefore, we can conclude that Imran Khan will survive in the political arena but he has damaged his party and relations with most countries due to his ill thought out statements, speeches and actions. As the song goes, ‘another one bites the dust’. In Pakistan as in most countries, the sunrise and sunset of a politician depends on those who hold real power behind the office.

UP: FIR Against Police Personnel After Death Of Gangster’s Daughter

The Uttar Pradesh Police have registered an FIR against more than seven police personnel in connection with the case of the gangster Kanhaiya Yadav’s daughter, who was found dead inside the house in mysterious conditions on Monday.

Complainant Vijay Yadav, son of gangster Kanhaiya Yadav, lodged the FIR under section 154 of the Criminal Procedure Code (CrPC) in Sayyidraja police station.
It stated that at around 5.00 pm on the evening of May 1, the Station House Officer of Sayyidraja police station, Uday Pratap Singh, and Sanjay Singh along with four women constables and other police personnel forcibly entered the house of the complainant in his absence, and thrashed his sisters Nisha and Gunjan. The elder sister Nisha was thrashed to death by police officers, he has alleged.

The younger sister of the deceased said, “We both were alone when police personnel entered our home and started beating us. Two women police constables and 8-10 male personnel took my sister to a room and beat her, and they left after half an hour. I entered the room and saw my sister hanging from a ceiling fan.”

The daughter of gangster Kanhaiya Yadav was found dead in her house in the early morning of Monday. The family of the victim claimed that the deceased was thrashed by the SHO of Saiyyedraja police station after which she died.

The incident led to protests against police officials by the local villagers near the residence of Kanhaiya Yadav. Gangster Kanhaiya Yadav also reached the crime spot soon after he received the information about his daughter’s death.

Locals blocked the roads and vandalised the police vehicles that had reached the crime spot. Two policemen were injured while the protestors chased them away.

Inspector-general of police of Varanasi zone, K Satyanarayan, said that information was received that a 22-year-old woman, the elder daughter of gangster Kanhaiya Yadav, died under suspicious circumstances in the house and her younger daughter was injured.

“Two policemen of Dial 112 reached the spot immediately. The locals had blocked the road and attacked the policemen and they were seriously injured. The agitated villagers damaged the police bike as well,” he said.

The injured were admitted to a hospital for treatment, IG said.

Samajwadi Party MLA Prabhu Narayan Singh Yadav, who joined the protest, said, “It is a very sad incident that happened due to the irresponsible action of the SHO and under complete negligence of the police. DM and IG have visited here, and they have assured required actions against the accused. If we find any delay in justice, we will not sit silently and raise our voices.”

IG also said that at around 4.00 pm on Sunday, the police went to the house of gangster, Kanhaiya Yadav, in the Manrajpur village of Sayedaraja police station area against whom the court had issued an NBW warrant in a riot case. Kanhaiya was not present at home, after which the police returned.

However, on the demand of the family of the deceased, SHO Singh has been suspended, and we have ensured a fair investigation into the case, to maintain law and order in the area, a police force has been deployed, said the IG. (ANI)

Diminishing Dominance of Bollywood Cinema

‘Ajay Devgan’s View On Hindi Is Not Just ignorant, It Is Downright Stupid’

Moinak Guho, an alumnus of the Satyajit Ray Film and Television Institute in Kolkata, shares his views on the diminishing dominance of Bollywood cinema

Clearly, Ajay Devgan has made a rather stupid statement. In the first instance, it shows the desire of the Bollywood celebrity to prove his loyalty to the current regime in New Delhi. This kind of blatant alignment with the corridors of power is not new; Devgan, obviously, is one among the many who wants to rub shoulders with the powers that be.

But, on a second look, the bigger issue is of his ignorance. Hindi was never an indigenous language anyway. That it has been awarded the status of ‘national language’ by Devgan is downright foolish.

He also questions a fellow star from South India about dubbing “your mother tongue movies” in Hindi. Is Mr Devgan not aware of the fact that copying from cinema in South India, including from the block-busters, has been going on rampantly in Bollywood for decades?

It is well-known that Hindi cinema in Mumbai is doing bad business these days. There is no originality left in the cinematic work being mass produced by the Mumbai production houses. While there seems to be a certain ideological bankruptcy prevailing in big bucks Hindi cinema, a section of the industry players is falling over one another to get into the good books of the government in Delhi. One shining example of this phenomenon is The Kashmir Files. Surely, in terms of aesthetics, originality and content, this seems to be a bit problematic and will obviously impact both the script and the cinema of the years to come.

With the OTT phenomena having taken over India, people are willfully choosing meaningful cinema in other languages: Malayalam, Tamil, Bengali. These industries, though without the powerful financial structures that prevails in Bollywood, is overwhelmed with talent in all branches of film-making. That Hindi should be dominating across the nation just does not work anymore – consider it history.

Indeed, it is difficult to remember one good film made in the Hindi language and dished out from the cash-rich box office apparatus in Mumbai, though there have been fabulous and meaningful low-budget films which have been widely appreciated across the country. A good film is, finally, a good film, and language is of no significance.

I remember watching two great films recently: Pebbles in Tamil and Nayattu in Malayalam. Both are fabulous works and language has been no barrier in their superb aesthetic rendition.

Unfortunately, when it comes to big business cinema, and the industry which revolves around grandiose commercial movies, I will cite one example. It also reflects that the days of Hindi box office movies are passé. I personally would not really like to watch Pushpa or RRR. However, two days ago, we tried to go for a movie in Kolkata. Of the 20 shows in one day in a multiplex, 10 were showing RRR, there were five shows for KGF II, four for Jersey, and, only one, yes, only one show of a Bangla movie. Thereby, hangs a tale.

Raj Thackeray Warns For Removal Of Loudspeakers Atop Mosques

Amid the ongoing political row over the use of loudspeakers at mosques, Maharashtra Navnirman Sena (MNS) chief Raj Thackeray warned and said that if loudspeakers are not taken down then the Hanuman Chalisa would be played with double volume compared to Azan from May 4.

Addressing a gathering at Sanskrutik Mandal Maidan in Aurangabad, where a huge crowd was gathered, the MNS chief said, “Today is the first day of Maharashtra (Maharashtra Day). I won’t listen from the 4th day from now. Wherever we will see a loudspeaker, we will also chant Hanuman Chalisa in front of the loudspeaker in double volume.”
Thackeray further said that loudspeaker is not a religious issue but it is a national issue and warned that if they don’t stop, then we will also take a stand.

“This is not a religious issue. It is a national issue but if you stop us, we will also take a stand. All the loudspeaker speaker is not under the law and it is illegal. The Supreme Court already said it was illegal, it was not a matter of Sambhajinagar (Aurangabad) it was a country issue. When we take sabha they say it was an education zone, a temple zone you can’t take sabha, but for them, there is an objection. Who gave you rights?” asked the MNS chief.

Justifying his point that the loudspeaker is topic is not a religious issue it was a national issue, he said, “One journalist asked me why do you take a stand on loudspeakers today. I said that we chant Hanuman Chalisa and Muslims should listen. A Nashik journalist told me that he is a Muslim and that he also has a problem with loudspeakers. His children can’t sleep.”

He further requested the state police to stop the use of loudspeakers otherwise and if loudspeakers are not removed, “we won’t keep quiet”.

He also announced that he will do more rallies in Marathwada, Vidarbha and other cities as well.

“I will do rally in all cities Vidarbha, Kokan, west Maharashtra, east Maharashtra,” he said.

The MNS chief further said that further slammed Nationalist Congress Party (NCP) chief Sharad Pawar for spreading poison-like caste politics.

“Sharad Pawar says that we are against the country. Pawar, you divided this state in caste politics. Now, Pawar has suddenly started speaking about Shivaji Maharaj. Has Pawar ever taken the name of Shivaji? When I said Pawar is an atheist, they got disturbed and click photos with gods. Your daughter said that my father is an atheist. Pawar, you read only what is comfortable for you. My grandfather (Balasaheb Thackeray) believed in Hinduism and you should read his books. My grandfather was a believer in dharma. I have brought here a few references for Sharad Pawar. These are references from my grandfather’s writings. My grandfather had started Hindu Missionary Movement. My grandfather started public Navratri Utsav.”

“Pawar poisoned Maharashtra. Pawar played hate politics. Sharad Pawar ji, I won’t take one stand I won’t speak on any particular caste,” he added.

The loudspeakers row started when the MNS chief on April 12, when gave an ultimatum to the Maharashtra government seeking the removal of loudspeakers from mosques within May 3, failing which, he warned, MNS workers will play Hanuman Chalisa on loudspeakers. (ANI)

Modi Gets Rousing Welcome From Indian Diaspora In Berlin

Prime Minister Narendra Modi, who arrived in Germany on the first leg of his three-day Europe visit, got a rousing welcome from the Indian diaspora in Berlin on Monday.

PM Modi greeted members of the Indian community, who were awaiting his arrival at Hotel Adlon Kempinski in Berlin. Many children along with their parents were present at the hotel, waving their hands at the Prime Minister’s arrival.

The people chanted “Vande Mataram” and “Bharat Mata ki Jai” on seeing the Prime Minister.

The Prime Minister also interacted with a little girl who presented him with a portrait of his picture. He took a picture with the girl who called him her icon and also signed the portrait for her.

Earlier this morning, the Prime Minister arrived at Berlin-Brandenburg airport in Germany on the first leg of his visit to three European nations. Upon his arrival, PM Modi expressed confidence that the visit will boost the friendship between India and Germany.

“Landed in Berlin. Today, I will be holding talks with Chancellor @OlafScholz, interacting with business leaders and addressing a community programme. I am confident this visit will boost the friendship between India and Germany,” he tweeted.

During his visit to Germany, PM Modi will hold his first in-person meeting with the newly appointed Chancellor Olaf Scholz. PM Modi and Olaf Scholz will also co-chair the 6th India-Germany Inter-Governmental Consultations (IGC).

The 6th IGC will be followed by a high-level roundtable where PM and Chancellor Scholz will interact with the top CEOs of both countries. PM Modi will also interact and address the Indian diaspora in Germany.

India and Germany have had a ‘Strategic Partnership’ since 2001, which has been further strengthened with three rounds of Intergovernmental Consultations (IGC). The last IGC was co-chaired by PM Modi and German Federal Chancellor Angela Merkel who visited India. The fifth round of IGC was held from October 31-November 1, 2019. The consultations were delayed due to the COVID-19 pandemic.

PM Modi’s three-nation visit will have a substantial and comprehensive agenda during his bilateral and multilateral meetings.

PM Modi is also scheduled to visit Denmark on Tuesday to hold talks with leaders from Nordic countries, along with other high-level interactions, the visit will conclude with a stopover in Paris on Wednesday where the Prime Minister will meet the newly re-elected French President Emmanuel Macron.
