Rahul Lands At Coimbatore Airport, Enroute To Wayanad

Congress leader Rahul Gandhi on Saturday morning arrived at Coimbatore airport on an IndiGo flight from Delhi.

During his two-day visit to Tamil Nadu and Kerala, starting today Gandhi will also visit Udhagamandalam (Ooty). 

Gandhi is then scheduled to travel by road to Wayanad, his parliamentary constituency in Kerala. This will be his first visit after he was reinstated as a Member of the Parliament in the Lok Sabha following the Supreme Court’s stay order on his conviction in the ‘Modi’ surname case.

In Kerala, Congress leader will participate in public meetings and a key handover ceremony of nine houses built under the Kaithangu Project in Kalpetta. 

Kerala Pradesh Congress Committee Working President VT Siddique said that Gandhi will attend a district Congress Committee meeting.

“There will be a very warm welcome ever hand in the history of Wayanad for Rahul Gandhi,” Siddique added.

According to sources, the Congress MP will embark on a Europe tour, covering three countries namely Belgium, Norway, and France from the second week of September where he will be meeting European Union Parliamentarians, the Indian diaspora, and university students.

Meanwhile, Gandhi spoke in the Lok Sabha during the no-confidence motion his party had moved against the PM Modi-led central government. The motion, moved by Congress MP Gaurav Gogoi and supported by the Opposition bloc I.N.D.I.A (Indian National Developmental Inclusive Alliance) was defeated on Thursday after an address by Prime Minister Narendra Modi.

Gandhi launched a scathing attack over PM Modi’s speech in the Lok Sabha during the no-confidence motion stating that it does not behove the PM to laugh and crack jokes in Parliament when Manipur has been “on fire” for over three months. (ANI)

India, China To Hold 19th Round Of Corps Commander Talks On Aug 14

India and China are likely to hold the 19th round of Corps Commander Level talks on Monday at the Chushul-Moldo meeting point in the Eastern Ladakh sector to resolve the ongoing military standoff between the two countries for over three years.

The two countries have been in a military standoff for the last three years since May 2020, when the Chinese tried to aggressively alter the status quo on the Line of Actual Control.

“The Indian side would be led by Fire and Fury Corps Commander Lt Gen Rashim Bali for the talks with representatives of the Chinese military on August 14. Officials from Ministry of External Affairs and ITBP are also expected to be part of the talks The two sides are likely to discuss the issues related to DBO and CNN junction along with other matters. India would also be pressing for disengagement from the Eastern Ladakh front,” defence sources told ANI.

This meeting is taking place after a gap of around four months. The last meeting between the two sides at the Corps Commander level was held in April earlier this year.

The meeting is taking place when both sides are engaged in rapid construction activities along the border areas to strengthen their respective positions.

The two countries started holding military talks on disengagement and de-escalation of the situation along the LAC in eastern Ladakh soon after the confrontation started between the two militaries.

The two sides have since then disengaged from multiple confrontation points and moved to new positions to avoid clashes and resolve the issues peacefully.

Sources said the Indian side is keen to resolve the dispute amicably securing all Indian interests in the region and has deployed over 50,000 troops to match the Chinese deployments in the areas opposite eastern Ladakh.

The two sides have been heavily deployed but have resisted direct conflicts even though the Indian side does not rule out the possibility of any misadventure by the adversary along the LAC.

India thwarted one such misadventure by the Chinese Army in December 2022 in Yang Tse near Tawang in Arunachal Pradesh. (ANI)

Issues Of South China Sea Need To Be Resolved Peacefully: MEA

Referring to the recent incident of water cannon being used at Philippines supply boat by Chinese coast guard ship, India on Friday said that issues in the South China Sea need to be resolved peacefully while urging China and the Philippines to adhere to international laws. 

“Let me emphasize where we are on the South China Sea developments. We’ve always felt that the issues need to be resolved, disputes peacefully, and the rules-based order, and we would certainly urge parties to follow that as well as ensure that no such incidents do not happen,” Ministry of External Affairs Spokesperson Arindam Bagchi said when asked whether the tension between China and Philippinesis concerning India. 

He further stated, “I mentioned specifically that I have already made a comment regarding the need to adhere to international law. I think I’d leave it at that.”

The “excessive and offensive” use of a water cannon by Chinese ship to block a Filipino supply boat occured at Second Thomas Shoal in the South China Sea. 

He reiterated that India has a long-standing position on the disputes regarding South China Sea as parties need to adhere to international laws. 

“We have also underlined the need for peaceful settlement of disputes,” he added. 

On August 5, the Philippines accused Chinese Coast Guard ships of firing water cannons and making dangerous manoeuvres at its ships in the South China Sea.

“The Philippine Coast Guard (PCG) strongly condemns the China Coast Guard’s (CCG) dangerous manoeuvres and illegal use of water cannons against PCG vessels,” the PCG wrote in a statement shared on its official Facebook account Saturday.

PCG vessels were escorting ships carrying supplies to military troops stationed in Ayungin Shoal, also known as Second Thomas Shoal, in the Spratly Islands chain, known in China as the Nansha Islands.

China’s action received backlash from different countries. By Sunday, Washington, Manila’s principal ally, had denounced China’s actions and reaffirmed that it will uphold its end of the mutual defence pact with the Philippines. 

Australian, Japanese, and German officials referred to China’s moves as “dangerous” and “destabilising.”

Meanwhile, China also reacted on the incident and in a response accused the Philippines Coast Guard (PCG) of trespassing in its waters.

“Two Filipino supply vessels and two coast guard vessels illegally intruded into the waters adjacent to Renai Reef in China’s Nansha Islands,” Gan Yu, spokesman for the China Coast Guard, said according to the statement published on its website.

“China coast guard implemented the necessary controls in accordance with the law and prevented the Philippine vessels carrying the illegal construction materials. We urge the Philippine side to immediately stop its infringing activities in that maritime area,” Gan Yu said according to the statement.

Beijing has disregarded a 2016 decision from an international court finding that its claim to practically all of the South China Sea, through which trillions of dollars in trade flow every year, has legal standing.

On July 12, 2016, the arbitral tribunal ruled in favour of the Philippines on most of its submissions. the arbitral tribunal adjudicating the Philippines’ case against China in the South China Sea ruled overwhelmingly in favour of the Philippines, determining that major elements of China’s claim—including its nine-dash line, recent land reclamation activities, and other activities in Philippine waters—were unlawful, according to the  United States–China Economic and Security Review Commission.

However, China doesn’t accept the ruling, maintaining it was “null and void.” (ANI)

MEA Asks Indian Nationals In Niger To Leave Country

Ministry of External Affairs has issued an advisory asking Indian nationals whose presence is not essential in Niger to leave the country as soon as possible, following the coup in the African nation.

MEA spokesperson Arindam Bagchi said at a media briefing on Friday that the Indian government is closely monitoring the situation in Niger and also asked the people to reconsider their plans if they are travelling to Niamey.

“Government of India is closely monitoring ongoing developments in Niger. In light of the prevailing situation, Indian nationals whose presence is not essential are advised to leave the country as soon as possible. They may bear in mind that airspace is currently closed. When departing through a land border, utmost precautions may be taken to ensure safety and security. Those who may be planning travel to Niger in the coming days are also similarly advised to reconsider their travel plans until the situation normalizes,” said MEA.

“All those Indian nationals who have not registered with the Indian embassy in Niamey (Niger capital) are strongly advised to do so expeditiously. Indian nationals can reach emergency contact in the embassy of India in Niamey: +22799759975”, added MEA.

Responding to the question about the number of Indians stuck in Niger, Bagchi said, “About 250 Indians are there. MEA is requesting those who have not registered their names to the Indian embassy to register themselves. Indian Embassy in Niamey is in touch with the Indian communities and we have been told that they are safe.”

Niger has been engulfed in political chaos since late last month when the country’s President Mohamed Bazoum was ousted in a coup. Following the military coup Abdourahamane Tiani, the commander of Niger’s presidential guard has declared himself the country’s leader.

The uncertainty has rattled residents in Niamey, the capital. Some people flocked to supermarkets to purchase staples like rice and cooking oil in bulk, while others attempted to flee. Employees of local bus companies said most lines out of the capital were fully booked, CNN reported.

At the busy Wadata market, east of the capital’s centre, many shoppers buying food and necessities Monday voiced apprehension about what might come.

Pro-junta demonstrators, meanwhile, gathered Sunday at a 30,000-seat stadium in Niamey to voice their support for the military government and their opposition to ECOWAS sanctions, CNN reported. (ANI)

Chadha Suspended From RS Over ‘Breach Of Privilege’

Aam Aadmi Party (AAP) MP Raghav Chadha was suspended on Friday from the Rajya Sabha for “breach of privilege” after complaints of ‘fraud’.

The move came after a complaint from four MPs alleging he named them in a house panel without their consent.

Rajya Sabha Chairman Jagdeep Dhankhar, while announcing Chadha’s suspension, said, “…I suspend Raghav Chadha from the service of the Council till the Council has the benefit of the report by the Committee of Privileges.”

His suspension followed a motion moved by the Leader of the House Piyush Goyal who sought action against the AAP leader for including names of some members of the Upper House without their consent in a proposed select committee for the Government of National Capital Territory of Delhi (Amendment) Bill, 2023.

However, according to the AAP, the suspension has been done due to Raghav’s press conference yesterday defending himself in the alleged breach matter.

“Nowhere has Piyush Goyal’s motion for suspension or notice served by Privilege Committee mentioned the words – forgery or fake, signatures, farziwada etc. It doesn’t even remotely allege anything to this effect. The Leader of the House has also quoted excerpts from the Press Conference on 10th August 2023 and quoted the example of using birthday invitation to explain the process of consent,” the party said.

Earlier on August 8, Union Home Minister Amit Shah in the Rajya Sabha alleged fraud after five MPs of the Upper House — S Phangnon Konyak, Narhari Amin and Sudhanshu Trivedi of BJP, M Thambidurai of AIADMK and Sasmit Patra of BJD — said that their name was included without their consent in a motion moved by Chadha in the House.

“Two members (BJD MP Sasmit Patra and BJP MP Dr Sudhanshu Trivedi) are saying that they have not signed the motion (to be part of select committee) moved by AAP MP Raghav Chadha. Now it is a matter of investigation how the motion was signed,” said Union Home Minister Amit Shah in Rajya Sabha on Delhi Services Bill.

While addressing a press conference on Thursday, the AAP leader hit out at the Bharatiya Janata Party (BJP) over “forged signatures” allegations by five Rajya Sabha MPs and challenged the BJP to show him the piece of paper where they are claiming the forged signatures.

“I challenge the BJP leaders to bring the paper on which forged signatures were done,” he said.

Rajya Sabha Chairman Jagdeep Dhankhar, on Wednesday, sent the complaints of the MPs to the privileges committee to look into the matter. (ANI)

Shah Introduces Three Bills In LS For Revamping Criminal Laws, Replace IPC, CrPC, Indian Evidence Act

Three bills of momentous significance aimed at replacing British-era laws with a thrust on “justice instead of punishment” were introduced in Lok Sabha by Union Home Minister Amit Shah on the last day of the monsoon session of Parliament.

The Bharatiya Nagarik Suraksha Sanhita 2023, the Bharatiya Nyaya Sanhita 2023 and The Bharatiya Sakshya Bill 2023 were introduced in the Lower House of Parliament.  Amit Shah said that the bills are being referred to the Standing Committee for scrutiny.

While the Bharatiya Nyaya Sanhita 2023 seeks to replace IPC 1860, Bhartiya Nagrik Suraksha Sanhita 2023 seeks to replace Criminal Procedure Code and Bharatiya Sakshya Bill 2023 will replace the Indian Evidence Act, 1872.

Home Minister said that the bills are not aimed at giving punishment but rendering justice.  He said the bills have been introduced after extensive consultations.

The key provisions of the legislation include repealing sedition, a new penal code against mob lynching, death for rape of minors and first-time community service as one of the punishments for petty offences.

The offences against women and children, murder and offences against the State have been given precedence. New offences of terrorist acts and organised crime have been added to the Bill with deterrent punishments.

New offences added on acts of secession, armed rebellion, subversive activities, separatist activities, or endangering sovereignty and unity of India and there is one-year imprisonment for bribing voters during elections.

The Bharatiya Sakshya Bill 2023 provides that ‘evidence’ includes any information given electronically, which would permit the appearance of witnesses, accused, experts and victims through electronic means.

It provides for admissibility of an electronic or digital record as evidence and it shall have the same legal effect, validity and enforceability as paper records. The bill seeks to expand the scope of secondary evidence to include copies made from the original by mechanical processes, copies made from or compared with the original, counterparts of documents as against the parties who did not execute them and oral accounts of the contents of a document given by some person who has himself seen it and giving the matching hash value of original record will be admissible as proof of evidence in the form of secondary evidence.

It seeks to put limits on the facts which are admissible and its certification as such in the courts. The proposed Bill introduces more precise and uniform rules of practice of courts in dealing with facts and circumstances of the case by means of evidence.

The Evidence Act was enacted in the year 1872 with a view to consolidating the law relating to evidence on which the court could come to a conclusion about the fact of the case and then pronounce judgment.

It came into force on September 1, 1872.

The Bharatiya Nagarik Suraksha Sanhita 2023  proposes to repeal the Code of Criminal Procedure, 1973.

It provides for the use of technology and forensic sciences in the investigation of crime and furnishing and lodging of information, and service of summons, through electronic communication.

Specific timelines have been prescribed for time-bound investigation, trial and pronouncement of judgements.

The bill states that a citizen-centric approach has been adopted for the supply of copies of the first information report to the victim and to inform them about the progress of the investigation, including by digital means.

In cases where the punishment is seven years or more, the victim shall be given an opportunity of being heard before the withdrawal of the case by the Government. The summary trial has been made mandatory for petty and less serious cases.

The accused persons may be examined through electronic means, like video conferencing. The magisterial system has also been streamlined.

The Code of Criminal Procedure, 1973 regulates the procedure for arrest, investigation, inquiry and trial of offences under the Indian Penal Code and under any other law governing criminal offences. The Code provides a mechanism for conducting trials in a criminal case. It gives the procedure for registering a complaint, conducting a trial and passing an order, and filing an appeal against any order.

The bill states that delays in the delivery of justice due to complex legal procedures, large pendency of cases in the courts, low conviction rates, low level of uses of technology in the legal system, delays in the investigation system, complex procedures, inadequate use of forensics are the biggest hurdles in speedy delivery of justice, which impacts poor man adversely.

It also notes that the experience of seven decades of Indian democracy calls for a comprehensive review of our criminal laws, including the Code of Criminal Procedure and adopt them in accordance with the contemporary needs and aspirations of the people and that the government is committed to making a comprehensive review of the framework of criminal laws to provide accessible and speedy justice to all.

The Bharatiya Nyaya Sanhita 2023 seeks to repeal the Indian Penal Code to streamline provisions relating to offences and penalties. It is proposed to provide first-time community service as one of the punishments for petty offences.

The statement of objects and reasons of the bill says that offences against women and children, murder and offences against the State have been given precedence. “The various offences have been made gender neutral. In order to deal effectively with the problem of organised crimes and terrorist activities, new offences of terrorist acts and organised crime have been added to the Bill with deterrent punishments. A new offence on acts of secession, armed rebellion, subversive activities, separatist activities or endangering the sovereignty or unity and integrity of India has also been added.

The fines and punishment for various offences have also been suitably enhanced. (ANI)

SC Grants Bail To Nawab Malik On Medical Grounds

The Supreme Court on Friday granted bail to former Maharashtra minister and NCP leader Nawab Malik for two months on medical condition in a money laundering case.

A bench of Justices Aniruddha Bose and Bela M Trivedi said that bail is being granted to Nawab only on medical grounds and not on merits.

Solicitor General Tushar Mehta appearing for the probe agency said he has no objection to the bail on medical grounds.

The bench in its order said, “The petitioner is at present in hospital, Mumbai, being treated for ailments related to the kidney and other ailments. Let him be released on medical bail for two months. Let a counter affidavit be filed to the main petition within five weeks and a rejoinder thereafter in three weeks. List after 10 weeks. Bail granted. We are passing the order strictly on medical conditions and have not entered merits.”

The order of the top court came on a plea filed by Malik against a Bombay High Court order which rejected the temporary medical bail plea.

The High Court had declined the petition of the jailed leader seeking bail on medical grounds.

Malik, while seeking bail on health grounds had claimed he was suffering from a chronic kidney disease apart from various other ailments.

The Directorate of Enforcement (ED) arrested Malik in February 2022 alleging that he usurped a property in Kurla with the help of Dawood Ibrahim’s late sister Haseena Parkar between 1999-2006.

ED alleged that since Parkar handled Dawood’s illegal businesses, the money was ultimately used for terror funding. (ANI)
