Mahua Moitra

Delhi HC Rejecting Mahua’s Plea Seeking Media Gag

The Delhi High Court on Friday dismissed the plea moved by Trinamool Congress (TMC) leader Mahua Moitra seeking to restrain the Enforcement Directorate (ED) from leaking any “confidential or unverified information” to the media concerning the investigation against her under the Foreign Exchange Management Act, 1999 (FEMA).

The Delhi HC stated, “This Court has carefully perused the various news articles which have been annexed with the writ petition. The newspaper cuttings do not deal with the private life of the Petitioner but are only reportings regarding the investigation that is being conducted against the Petitioner who is a public figure and same is unrelated to her private life.”

The bench of Justice Subramonium Prasad also said, “There is nothing in the news articles that would have the effect of invading into the privacy of the Petitioner (Mahua Moitra) or tend to impair the impartiality of the investigation or that it can have the effect of prejudicing the trial of the Petitioner in the event it is initiated.”

Court noted that the statement made by the Counsel for ED that the Advisory on Media Policy issued by the Government of India vide Office Memorandum dated 01.04.2010 has been and is being followed, and after perusing the news articles, this Court believes that the reliefs as sought for by the Petitioner by way of the present writ petition need not be granted at this stage and the writ petition is dismissed.

The Delhi High Court on Friday dismissed Trinamool Congress leader Mahua Moitra’s plea to restrain the Enforcement Directorate from allegedly leaking any confidential, unverified information to media related to the ongoing FEMA probe against her.

Advocate Siddhant Kumar, who appeared for ANI, contended before the High Court that the reporting concerning a public figure regarding acts committed as a public official. It is the right of the press to report on the conduct of public officials such as Mahua Moitra who is also seeking to contest the next general election.

During the hearing, ED told the court it had not leaked any information to the media. How the information about her being summoned came to the press, we are not aware, said the ED counsel.

Mahua Moitra had moved Delhi High Court sought direction to restrain ED and 19 media houses from leaking, broadcasting and disseminating any “confidential or unverified information” concerning ED’s investigation against her regarding proceedings under FEMA.

The plea alleged that ED has wilfully and maliciously leaked the details of the FEMA summons, as well as the response submitted by the Petitioner to the 14 February Summons and sensitive details of allegations being investigated against the Petitioner.

It appears that ED intends to subject the Petitioner to a media trial by leaking sensitive particulars, including salacious allegations, allegedly stemming from their ongoing investigation and thereby, not only prejudice the investigation into the matter but also tarnish the Petitioner’s reputation in the public eye.

Instead of undertaking a fair, transparent and ethical investigation into the alleged violations of the FEMA by the Petitioner, it appears that ED is pursuing efforts to vilify the Petitioner in the public eye by deliberately and consistently drip-feeding members of the media with every single detail of the investigation being conducted by ED against the Petitioner, plea read. Trinamool Congress (TMC)

Cong Yuvraj Says Youth Of Kashi, UP Are Nashedi: Modi Slams Rahul

Prime Minister Narendra Modi on Friday slammed Congress leader Rahul Gandhi over his ‘drunken youth’ remark and said that he was “shocked” upon hearing the term ‘nashedi’ used to describe the youth of Uttar Pradesh.

Addressing the inauguration event of several projects in Varanasi, PM Modi without mentioning Rahul Gandhi’s name, noted that the prince of the Congress family referred to UP’s youth as ‘nashedi’.

“The ‘yuvraj’ of Congress ‘shahi-parivar’ has called the youth of Kashi and UP ‘nashedi’. What kind of language is this? They have spent two decades abusing Modi, and now they (Congress) are venting out their frustration on the youth of Uttar Pradesh. Jinke aapne hosh thhikane nahi hai, wo UP ke, mere kashi ke bachcho ko nashedi keh rahe hai (those who are not in their senses are calling UP’s youth addicts),” the Prime Minister said.

He further said that the youth of Uttar Pradesh are busy building a developed state.

“Now that Uttar Pradesh is progressing, the ‘yuvraj’ of the Congress family said that the youth of Uttar Pradesh are addicts. The youth of UP are busy in building a developed state,” PM Modi said.

PM Modi said adding that no one will forget this insult of the youth by the INDI alliance.

“A person who belongs to a dynasty is always threatened by the common youth force. They only like those who always praise them. And now they have another reason to not like Uttar Pradesh after Ram Mandir’s inauguration. I did not know Congress had so much hatred towards Lord Ram. They can’t see or think beyond their family and vote bank,” he added.

Earlier on February 20, in a veiled swipe at PM Modi, who represents Varanasi in the Lok Sabha, Rahul Gandhi claimed that during his visit to the temple town as a part of the ongoing Bharat Jodo Nyay yatra, he saw people lying drunk on roads.

Addressing the public in Amethi, Wayanad MP said the youths of Uttar Pradesh were on a ‘trip’ after boozing by night.

“I went to Varanasi and I saw people lying on roads drunk. The youths of Uttar Pradesh are on a trip after consuming liquor by night. On the other hand, there is the Ram Mandir which is only visited by the likes of PM Modi, Ambani and Adani. You will see all our billionaires there but not a single person from a backward class or the Dalit community,” Rahul said.

“Your place is only limited to roads for begging while they (Centre’s alleged corporate cronies) keep minting money,” he added.

The Varanasi constituency has seen a huge influx of funds from the Centre and state government and is also a part of the Smart City mission, which was launched by Prime Minister Narendra Modi on June 25, 2015. (ANI)

Prime Minister Narendra Modi targetted the opposition coalition, INDIA bloc while addressing a gathering in Uttar Pradesh’s Varanasi on Friday.

He said that the INDI alliance works for their ‘parivar’ (family) not the welfare of the poor.

“Today every Dalit and every backward person of the country has to keep one more thing in mind. In our country, the people of the INDI alliance, who believe in instigating and fighting in the name of caste, oppose the schemes for the benefit of Dalits and the deprived. In the name of the welfare of the poor, these people do politics for their family,” the Prime Minister said.

While addressing the 647th birth anniversary event of Sant Ravidas, PM Modi said, “Today our government is taking forward the ideas of Sant Ravidas ji. BJP government is for everyone, BJP government’s schemes are for everyone.”

“Today, this mantra of ‘Sabka Saath, Sabka Vikas, Sabka Vishwas and Sabka Effort’ has also become the mantra to connect with 140 crore countrymen,” he said.

The Prime Minister state that equality comes only by giving priority to the deprived society and that his government has been committed to serving every section of society and their development.

“In the last 10 years, work has been done keeping in mind those people who remained away from the stream of class development. Earlier, the poor were considered last, today the biggest schemes have been made for them,” he said.

PM Modi said that Sant Ravidas presented society with the importance of freedom and also worked to bridge the social divide.

“High caste, untouchability, discrimination. He raised his voice against all this. India has a history that whenever the country is in need, some saint, sage or great personality is born in India. Saint Ravidas ji was a great saint of the Bhakti movement, who gave new energy to the weak and divided India,” PM Modi said.

PM Modi offered a floral tribute to Sant Guru Ravidas during the event.

During the occasion, the Prime Minister unveiled a statue of Sant Ravidas at Varanasi today. Uttar Pradesh CM Yogi Adityanath was also present.

“Today I also have the privilege of inaugurating the new statue of Saint Ravidas ji. The foundation stone of Sant Ravidas Museum was also laid today,” the Prime Minister said.

Earlier in the day, PM Modi distributed prizes to winners of Sansad Sanskrit Pratiyogita at BHU in Varanasi.

Haryana Govt Revokes NSA Against Farmer Leaders

The Haryana Police on Friday revoked the imposition of the National Security Act (NSA), 1980 against some union leaders of the Ambala district after announcing it late on Thursday night, officials said.

Sibash Kabiraj, IGP Ambala Range said that the NSA will not be invoked against the farm leaders.

“This is to clarify to all concerned that the matter of invoking provisions of the National Security Act on a few farm union leaders of district Ambala has been reconsidered and it has been decided that the same will not be invoked,” he said.

The Police also appealed to farmers to cooperate with the authorities in maintaining law and order.

“Haryana Police appeals to the protestors and their leaders to maintain peace and cooperate with the authorities in maintaining law and order,” Kabiraj added.

Earlier, the Haryana government had invoked the National Security Act against farmer leaders with police officials seeking details of property loss in Ambala district.

In an official statement, Ambala Police wrote, “From February 13, 2024, continuous efforts are being made by the farmer organizations to break the barricade imposed on Shambhu Border by the farmers regarding their march to Delhi, and daily attempts are being made to spoil the law and order by pelting stones at the police administration and creating ruckus.”

“During this period, a lot of damage has been caused to the government and private property by encroachment, the police said, adding the administration had already that if the agitators caused damage to government and private property then this loss would be compensated by seizing their property and bank accounts.”

“If public property is damaged by the agitators during the movement, there is an amendment in the Prevention of Damage to Public Property Act 1984 (PDPP Act) under the provisions of the Supreme Court in which, the people who caused damage to public property during the movement or called for the movement and the officials of that organization are held responsible for any damage caused,” the statement read.

According to the Haryana Public Administration’s Property Recovery Act 2021, in case of damage to government property, there is a provision to compensate for the loss of public property by attaching property and confiscating bank accounts of the person causing the loss.

“Proceedings to compensate for the loss of government property during the farmers’ protest, attachment of property and seizure of bank accounts of the protestors have been initiated,” the Police statement added.

The National Security Act (NSA) of 1980 is a law in India that allows the government to detain people to maintain public order and national security.

The act allows the central or state government to detain a person if there is reason to believe that they may be engaging in an act threatening national security.

The NSA is a preventive detention law, which involves the detainment of a person to keep them from committing future crimes and/or from escaping future prosecution. (ANI)
