High Court Tells Delhi Govt To Fill Vacancies In Jails

The Delhi High Court has directed the Government of NCT Delhi to ensure that the appointments are made positively within a period of six months in relation to pending vacancies of Medical Officers, Paramedical Staff, Welfare Officers, Counsellors, Teachers for Education, Yoga Teachers, etc in the jails.

The Bench of Justice Satish Chander Sharma and Justice Subramonium Prasad in an order dated December 12 stated: “this Court is of the opinion that as the Respondents have already taken steps to depute persons on the post of Teachers and have taken steps for appointment of Counsellors, and they are certainly going to conclude the process of recruitment within a period of six months from today, no further orders are required to be passed in the present PIL.”

After going through the status report stated that 48 teachers and 23 Technical Teachers have been deputed by the Education Department, Government of NCT of Delhi (GNCTD) for training and imparting technical education to the inmates. It is stated that in respect of Counsellors, a notice has been issued inviting applications for 40 posts of Counsellors, however, appointments have not taken place.

The court direction came during the hearing of a PIL filed by Advocate Amit Sahni stating that a large number of vacancies of Medical Officers, Paramedical Staff, Welfare Officers, Counsellors, Teachers for Education, Yoga Teachers, etc, are lying vacant and the Government is not filling up the vacancies.

The Counsel for the Petitioner after going through the status report was fair enough in stating before this Court that once time has been granted by this Court to the GNCTD to fill up the vacancies/ back-logs within a period of six months, no further orders are required to be passed in the present PIL, said the Court.

Vaibhav Mishra, Sonali Tiwary, and Monica Chauhan, Advocates appeared for Petitioner Amit Sahni in the matter while Sanjana Nangia, Advocate, and Sameer Vashist, Additional Standing Counsel for Respondent (GNCTD).

“In respect of Medical and Para Medical staff, it is stated that steps have been taken to fill up the posts. The Counsel appearing for the GNCTD was fair enough in stating before this Court that a breathing period of six months is granted to the State to conclude the process of recruitment. The prayer is allowed,” the court said.

In the PIL, petitioner Amit Sahni had also sought directions to the Government of NCT Delhi and DG Prisons to constitute and notify the Board of Visitors, Service Board, State Advisory Board, Prison Development Board, and Forum for Prison Staff, as provided in Delhi Prison Act 2000 and Delhi Prison Rules 2018, in the larger interest of prisoners lodged in Delhi Jails as well as in the interest of Delhi Prison Administration.

There is an acute shortage of prison staff in general and particularly all posts of educational, correctional staff, psychiatric social workers, and psychologists have been lying vacant for a long. The respondents are duty-bound to take adequate steps not only for the welfare of the prisoners but for the well-being of the prison staff as well. The shortage of prison staff is a reason for the inadequate management of Delhi Jails and many-a-times the same leads to violence upon the errant inmates by the Jail Staff, said the plea. (ANI)

In a fresh wave of attacks, Russia has launched dozens of missiles and drones targetting Ukrainian energy systems, leading to a power emergency for millions of civilians leaving them in pitch dark amid cold winter nights, reported The New York Times.

Explosions shook cities and towns across Ukraine in the second-largest attack this week on Friday.
Vitalii Maletsky, the Mayor of Ukraine’s central city of Kremenchuk told the New York Times that heat was out for more than 200,000 customers as temperatures hovered around 14 degrees Fahrenheit (-10 degrees Celsius).

He implored people to “close all windows and take all possible measures to preserve heat.”

According to Klitschko, in Kyiv, even after hours of repairs, about two-thirds of the residents were left without heat and water and about 60 percent were left without electricity.

Kharkiv, Ukraine’s second-largest city, was left without power, heating, and water after the new wave of Russian missile strikes across the country. ‘Colossal’ damage said mayor, media reported.

The attack by Russia comes amid warnings from Ukraine’s military and political leaders that Russia is likely to make another attempt to seize Kyiv and was preparing for a new ground offensive this winter.

Ukrainian President Volodymyr Zelensky insisted that Russia is not serious about peace and that any pause in the war would only help Russia strengthen its hold on the seized territory and rebuild its forces to launch a fresh assault.

“See how we live. We are fed up! We need to hit back at Russia. Give us weapons. We have enough soldiers, give us weapons,” said Gennady Omelyan, a taxi driver in Kyiv in response to the recent attack on Ukraine, according to The New York Times.

Recently, blasts were heard in Kyiv’s Shevchenkivskyi district, city mayor Vitaly Klichko wrote on his Telegram channel on Wednesday, reported TASS.

“Explosions in the capital’s Shevchenkovsky district,” the mayor wrote.

According to TASS, an air raid alert was declared in the Ukrainian capital at 05.55 am (6:55 am Moscow time). Sirens also went off in the Kyiv, Vinnytsia, and Zhitomir regions.

The Shevchenkivskyi district is located in Kyiv’s central part. There are 71 enterprises in the district’s industrial complex. (ANI)

Delhi Air Quality Dips To ‘Very Poor’ Category

The air quality in the national capital reached the ‘very poor’ category on Saturday morning with an index of ‘310’ recorded on the Air Quality meter after some relative respite to Delhiites for a few days.

According to the System of Air Quality and Weather Forecasting And Research (SAFAR), Delhi’s air quality was recorded in the ‘very poor’ category on Saturday.

In the Delhi University area, the air quality was recorded as ‘very poor’ with the presence of PM 2.5 in the air at 318, whereas the Pusa area recorded it at 314.

Noida, also saw the air quality in the ‘very poor’ category with the AQI at 386 today.

Meanwhile, Lodhi Road and Mathura Road also experienced ‘very poor’ air quality with AQI at 306 and 303, respectively.

The AQI at the Delhi Airport Terminal 3 was recorded as ‘poor’ at 266.

The Air Quality Index from 0 to 100 is considered as good, while from 100 to 200 it is moderate, from 200 to 300 it is poor, and from 300 to 400 it is said to be very poor and from 400 to 500 or above it is considered as severe.

Earlier, the air quality in Delhi was in the ‘moderate’ category, it deteriorated and reached the ‘very poor’ category.

Kuldeep Kumar, a resident of Mandir Marg said, “If you still go out in the morning, then there is a burning sensation in the eyes. Right now the level of pollution has come down a bit, but not much.”

“The government should do something about these 4-wheelers plying in the city. Today if there are four members in a house, all four have a 4-wheeler,” he added.

Another resident of the city urged the Delhi government to bring back the Odd-Even policy. “Air pollution is slightly less as compared to last year. The cold has also increased and the odd-even should be brought as soon as possible to curb the remaining air pollution,” he said. (ANI)

Drawing parallels between Kashi and Tamil Nadu and sending out a message of unity irrespective of regional divides, the Uttar Pradesh CM further said, “Both UP and Tamil Nadu are promoting traditional enterprises and are working to strengthen local artisans and craftsmen to realize the goal of a self-reliant India.”

Beginning his address with the proclamation of ‘Vanakkam Kashi’ and ‘Har Har Mahadev’, the CM welcomed the guests from Tamil Nadu. “In the last month, 12 different groups from Tamil Nadu have visited Prayagraj and Ayodhya to get a sense of the religious significance of Uttar Pradesh,” he added.

He said the holy Jyotirlinga established by Lord Shri Ram at Shri Rameshwaram and Lord Adi Vishweshwar in Kashi are worshipped as holy Jyotirlingas. Both these Jyotirlingas are central to the relationship between Kashi and Tamil Nadu.

“Kashi remains the center of religion, culture, and spiritual consciousness of India. Similarly, Tamil Nadu has been the center of knowledge, art, and culture since ancient times. All elements of Indian culture are preserved in Kashi and Tamil Nadu,” he added. (ANI)

Madhya Pradesh Notifies Act Against Forced Religious Conversion

With an aim of curbing cases of forced religious conversions, the Madhya Pradesh government on Thursday notified the Freedom of Religion Act.

The 2022 Act prohibits religious conversions done with the intention of fear, greed and betrayal.
Under the Act, an accused as well as those supporting him could be sentenced to 10 years in jail and be slapped with a fine of Rs 1 lakh.

However, the Act provides for religious conversion by ‘self-interest’, as per provisions underlined in Section 10.

As per the notification, the person willing to convert and the cleric/person processing the conversion will have to submit a declaration in front of the district magistrate at least 60 days in advance. (ANI)

“It was a pleasure to meet and interact with Hon. PM @narendramodi ji at his esteemed office today. Lots to learn from his leadership and service to the nation,” PT Usha tweeted.

Earlier on Saturday, Usha was elected unopposed as the first woman president of the Indian Olympic Association (IOA).

The 58-year-old is also the first Olympian and the first international medallist to hold the top post in the 95-year-old history of IOA.

PT Usha’s election brings an end to a long-drawn crisis in the faction-ridden IOA which was warned of a possible suspension by the International Olympic Committee (IOC) if elections were not held this month.

The star sprinter Usha is one of the greatest athletes to have ever come out of India and brags four gold medals and seven silvers at the Asian Games. She missed out on a podium finish in the women’s 400m hurdles at the Los Angeles 1984 Olympics by 1/100th of a second. Her timing of 55.42s in LA still holds as a national record. (ANI)

India Slams Bilawal Bhutto’s ‘Uncivilised’ Remarks Against Modi

India on Friday slammed Pakistan Foreign Minister Bilawal Bhutto Zardari for his “uncivilized outburst” at Prime Minister Narendra Modi.

In response to media queries on Bilawal’s ‘uncivilized’ remarks, the official spokesperson for the MEA, Arindam Bagchi, said, “These comments are a new low, even for Pakistan. Pakistan’s foreign minister’s frustration would be better directed towards the masterminds of terrorist enterprises in his own country, who have made terrorism a part of their state policy. Pakistan needs to change its own mindset or remain a pariah.”

Earlier, External Affairs Minister S Jaishankar on Thursday ripped into Pakistan over its role in sponsoring and spreading terrorism and advised Islamabad to clean up its act and try to be a good neighbor.

In reply to a question from a Pakistani journalist, who accused India of spreading terror, Jaishankar replied,” You are asking the wrong minister when you say how long will we do this. It is the ministers of Pakistan who will tell how long Pakistan intends to practice terrorism.”

Responding to the EAM’s remark, Bilawal unleashed a personal attack on PM Modi and also hit out at the Rashtriya Swayamsevak Sangh (RSS).

“We wish that Pak FM would have listened more sincerely yesterday at the UNSC to the testimony of Anjali Kulthe, a Mumbai nurse who saved the lives of 20 pregnant women from the bullets of the Pak terrorist Ajmal Kasab. Clearly, their FM was more interested in whitewashing Pakistan’s role,” said Bagchi.

He further said that the foreign minister of Pakistan has “obviously forgotten this day in 1971, which was a direct result of the genocide unleashed by Pakistani rulers against ethnic Bengalis and Hindus”.

“Unfortunately, Pakistan does not seem to have changed much in the treatment of its minorities. It certainly lacks credentials to cast aspersions at the Mother of Democracy,” added the MEA spokesperson.

As recent conferences and events have demonstrated, counter-terrorism remains high on Pakistan’s global agenda, he said, adding that its indisputable role in sponsoring, harboring, and actively financing terrorist and terrorist organizations remains under the scanner.

“Pakistan FM’s uncivilized outburst seems to be a result of Pakistan’s increasing inability to use terrorists and their proxies,” Bagchi said.

“Cities like New York, Mumbai, Pulwama, Pathankot and London are among the many that bear the scars of Pakistan-sponsored, supported and instigated terrorism. This violence has emanated from their Special Terrorist Zones and exported to all parts of the world. ‘Make in Pakistan’ terrorism has to stop,” he added.

He also stated that Pakistan is a country that glorifies Osama bin Laden as a martyr and shelters terrorists like Lakhvi, Hafiz Saeed, Masood Azhar, Sajid Mir and Dawood Ibrahim.

“No other country can boast having 126 UN-designated terrorists and 27 UN-designated terrorist entities!” Bagchi added.

A flurry of other politicians, too, objected to Bilawal’s uncivilised bursts on PM Modi. “As far as the leadership of PM Modi is concerned, the world has recognised that leadership,” said Minister of State for External Affairs Meenakashi Lekhi.

“PM Modi has helped not only India but also other countries, including Pakistan, during Covid. If a foreign minister of a country is making such statement, it doesn’t hold him well,” added Lekhi.

Incidentally, Pakistan was included in the grey list of FATF several times for incubating terrorism.

“The statement of the foreign minister of Pakistan is very shameful and it is an attempt to replicate the way in which the Pakistan Army was defeated by the Indian Army on this day in 1971. Maybe he is still in pain. The world has seen Pakistan’s actions and intentions. They have been giving shelter to terrorists for a long time. PM Modi has taken strict actions against terrorism. The US killed Osama Bin Laden in Pakistan and India did a surgical strike in Pakistan,” said Union Minister Anurag Thakur. (ANI)

China Is Preparing For War, Govt Hiding It: Rahul Gandhi

Flagging a “clear threat from China” amid the ongoing border row, Congress leader Rahul Gandhi on Friday claimed that the neighbouring country is “preparing for war” and alleged that the Centre is “hiding and not accepting it”.

In an apparent reference to the recent faceoff between the Indian and Chinese soldiers in Arunachal Pradesh’s Tawang sector on December 9, Gandhi said that China is making an “offensive preparation on the side of Ladakh and Arunachal” while the Indian government “is in slumber”.

“There is a clear threat from China. The government is trying to hide it and ignore it. But that threat cannot be ignored or hidden. China is making offensive preparation on the side of Ladakh and Arunachal Pradesh. The Indian government is in slumber. It doesn’t want to hear it. China is preparing for war, not for an incursion,” he said while addressing a press conference here.

“If you see the pattern of their weapons, they are preparing for war. Our government is hiding it and is not accepting it,” he added.

Gandhi also lashed out at External Affairs Minister S Jaishankar and said that he should “deepen his understanding”.

“This is happening because the Indian government is working event-based and is not working strategically. When there is a matter of international relations, no event works there. Power works there. I have said it multiple times that we should be careful. The EAM should deepen his understanding,” he said.

The Congress leader also questioned the media and said that it would not ask questions to him over the ongoing border row with China.

“The ones who captured 2,000 sq km of India and killed 20 Indian soldiers, and are thrashing our soldiers in Arunachal Pradesh. I said to my friend that the Indian media would not ask me questions about it,” he said.

Earlier on Tuesday, Defence Minister Rajnath Singh told Parliament that Chinese troops had attempted to transgress the LAC at Yangtse in the Tawang sector of Arunachal Pradesh in a bid to “unilaterally change the status quo”, but were given a firm and resolute response forcing the Chinese side to retreat.

In his statement in both the Lok Sabha and Rajya Sabha, Singh said the face-off led to a physical scuffle that led to injuries to a few personnel on both sides but “there were no fatalities or serious casualties” to Indian soldiers.

Giving statements in both House, the Defence Minister also assured that “our forces are committed to protecting our territorial integrity and will continue to thwart any attempt made on it”. (ANI)

RJD Elder Manoj Jha Too Calls For Change In Collegium System

Disagreeing with the current collegium system, RJD member of parliament from Rajya Sabha Manoj Jha said that with the new changes, the government needs to bring the Judicial Appointments Commission (NJAC) bill.

Manoj Jha said that the Judicial Appointments Commission (NJAC) bill needs to be made in line with the Constitution so that the participation of all sections of society is ensured in judicial appointments.

Jha also questioned the NJAC bill brought by the central government in 2014, rejecting the existing collegium system and said that there was no provision for reservation for Scheduled Castes, Scheduled Tribes and Backward Classes in NJAC.

There is a tussle between the central government and the judiciary since 2014 regarding the collegium system.

On December 8, Minister of Law Kiren Rijiju said that there is no such proposal to reintroduce the NJAC with suitable modifications.

While responding to the several questions raised by politicians Mallikarjun Kharge and Dr John Bittas in Parliament, Law and Justice Minister said, the appointment of the Judges of the Constitutional Courts is a continuous, integrated and collaborative process between the Executive and the Judiciary.

Rijiju also said that the appointments of judges require consultation and approval from various constitutional authorities both at the state and central levels. Government appoints only those persons as Judges of High Courts who are recommended by the Supreme Court Collegium.

Giving the details, Rijiju said, “As on December 5, 2022, there is one proposal for the appointment of a Supreme Court Judge and eight proposals for the appointment of the High Court’s Judges recommended by the Supreme Court Collegium are pending with the Government.”

“Further, there are eleven proposals for the transfer of High Court Judges, one proposal for the transfer of a Chief Justice and one proposal for the appointment of the Chief Justice of a High Court recommended by the Supreme Court under consideration of the Government,” he said.

Rijiju also said that a total of 256 proposals have been remitted by the Government to the High Courts.

“During the last five years, a total of 256 proposals have been remitted by the Government to the High Courts. The proposals are remitted to the concerned High Courts on the advice of the Supreme Court Collegium,” he added.

On the question of the number of vacancies as of the date in the Supreme Court and High Court, the Law minister stated that as on December 5 against the sanctioned strength of 34 Judges, 27 Judges are working in the Supreme Court leaving seven vacancies.

“In the High Courts, against the sanctioned strength of 1108, 778 Judges are working leaving 330 vacancies,” he added.

In 2014, the National Democratic Alliance government brought the National Judicial Appointments Commission (NJAC) Act in an attempt to change the system of appointment of judges.

Vice President Jagdeep Dhankhar recently passed a certain remark on the 99th Constitutional Amendment Bill paving way for the National Judicial Appointment Commission (NJAC) which was undone by the Supreme Court in 2015. (ANI)

A school teacher in Delhi’s Karol Bagh flung a class 5 girl from the first floor of the school building on Friday, according to Delhi police.

The injured girl identified as Vandana was immediately rushed to Bara Hindu Rao hospital.

The beat officer of Desh Bandhu Gupta Road police station immediately reached the spot after receiving complaints.

According to the police reports, the teacher first hit the girl student with small paper-cutting scissors and then threw the child from the first-floor classroom.

The injured girl is now out of danger (stated by a doctor).

The teacher, Geeta Deshwal has been detained and a case is being prepared on the eyewitness’s statement. (ANI)
