EC Should Spell Out Factors For Not Holding Elections in J-K: Abdullah

The National Conference (NC) Vice President Omar Abdullah on Monday raised questions regarding the delay in conducting elections in Jammu and Kashmir and called on the Election Commission of India to clarify the reasons behind this delay.

He emphasized that the ECI owes an explanation to the people of J-K as to why they are being deprived of their democratic rights.

“They (ECI) are not being given the permission to hold elections in Jammu-Kashmir. If asked about the elections, you (ECI) said that you are considering the factors. Tell us what are the factors (for not holding elections in J-K) for it. Is the situation so bad that elections can’t be conducted? But the Government of India across the world is telling the story that J&K is peaceful and thousands of tourists are coming. ECI has to answer to the people of J-K why are they keeping them away from democracy,” Omar Abdullah said.

He further said that the ECI has no plausible reasons not to hold elections in J-K.

He further said that the results of the Kargil Hill Council results are “a verdict against the Centre’s move made on August 5, 2019, to bifurcate J-K”.

With the results of all 26 seats declared in the counting for Ladakh Autonomous Hill Development Council (Kargil) polls, the National Conference and Congress alliance on Sunday won 22 seats, comfortably crossing the halfway mark.

The Congress-National Conference alliance bagged 22 seats out of 26 seats (10 Congress and 12 National Conference) while the BJP just won 2 seats and 2 seats were won by independent candidates. This was the first election in the Union Territory Ladakh after Article 370 was scrapped from the Indian constitution.

There are a total of 30 seats in the council, of which 26 are elected members and the remaining four are nominated. (ANI)

JKDFP Declared As Unlawful Association For 5 Yrs

The Central government on Thursday declared the Jammu and Kashmir Democratic Freedom Party (JKDFP) as an unlawful association for a period of five years.

Ministry of Home Affairs (MHA) made the declaration through a notification announcing the JKDFP as an ‘Unlawful Association’ under Section 3(1) of the Unlawful Activities (Prevention) Act (UAPA) 1967.

The notification mentions that the action is based on inputs that the organization has been involved in “anti-national activities since 1998 and its members have always promoted separatism and terrorist acts in India.”

“The members of this organization, by inciting the people, want to make Kashmir a separate Islamic state, which is prejudicial to the sovereignty, security and integrity of India. Many criminal cases have been registered against this organization under various sections of UAPA 1967, IPC 1860, The Arms Act 1959 and Ranbir Penal Code 1932.”

The JKDFP was formed in 1998 by Shabir Ahmad Shah, a prominent separatist known for his anti-India and pro-Pakistan propaganda.

As per the MHA notification, Shabir Ahmad Shah had called Kashmir as a ‘dispute’ and ruled out any settlement within the framework of the Constitution of India and the members of the JKDFP have been at the forefront of secessionist activities in the Jammu and Kashmir and want to create a separate Islamic State.

“The leader or members of the JKDFP have been involved in raising funds through various sources including Pakistan and its proxy organizations for perpetrating unlawful activities, including supporting terrorist activities, sustained stone-pelting on Security forces in Jammu and Kashmir,” reads the notification.

The notification further states that the JKDFP and its members by their activities show sheer disrespect towards the constitutional authority and constitutional set-up of the country.

“The JKDFP and its leaders or members, particularly its founder Shabir Ahmad Shah, have

been indulging in unlawful activities, which are prejudicial to the integrity, sovereignty, security and communal harmony of the country. There have been a number of inputs showing linkages of the JKDFP with banned terrorist organizations,” reads the notification.

The JKDFP and its members have been involved in violent terrorist activities with an intent to create a reign of terror in the country, thereby endangering the security and public order of the State, and its anti-national activities also show disrespect and disregard for the constitutional authority and sovereignty of the State, hence an immediate and prompt action was required against the organisation, clarified the notification.

As per the notification, if there is no immediate curb or control of unlawful activities of the JKDFP, it will use this opportunity to continue with the anti-national activities that are detrimental to the territorial integrity, security and sovereignty of the country; continue advocating the secession of the Jammu and Kashmir from the Union of India while disputing

its accession to the Union of India; escalate its insurrectionary activities including an attempt to carve out an Islamic State out of the territory of the Union of India by destabilizing the Government established by law; and continuing to propagate anti-national sentiments of the people of Jammu and Kashmir with the intention to cause disaffection against India and disrupt public order.

“The Central Government, having regard to circumstances, is of firm opinion that it is necessary to declare the Jammu and Kashmir Democratic Freedom Party (JKDFP) as an unlawful association with immediate effect, and accordingly, in the exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect for a period of five years from the date of its publication in the Official Gazette,” added the notification. Pakistan Caretaker PM Kakar

Pak PM Kakar Raises Kashmir At UNGA, India To Reply On Saturday

Pakistan caretaker Prime Minister Anwarul Haq Kakar on Friday predictably raised the Kashmir bogey in his speech at the UN General Assembly. Kakar claimed that the Jammu and Kashmir issue is among the longest-standing items on the UN agenda.

Kakar’s remarks came during his address to the 78th session of the United Nations General Assembly in New York today. He said, “Pakistan desires peaceful and productive relations with all our neighbours including India,” and added that “Kashmir is the key to peace between Pakistan and India.”

India has repeatedly raised its concern over Pakistan’s support of cross-border terrorism and has asserted that terror and talks cannot go together.

India has also provided evidence at various international forums of Pakistan’s support for Terrorist groups.

Pakistan’s caretaker PM however harped on what he called the illegal occupation of Jammu and Kashmir.

“India has evaded implementation of the security council’s resolutions which call for the final disposition of Jammu and Kashmir to be decided by its people through UN-supervised plebiscite. Since August 2019, India has deployed 900,000 troops in illegally occupied Jammu and Kashmir to impose the final solution for Kashmir,” Kakar claimed.

Following the Indian government’s decision in August 2019 to abolish Jammu and Kashmir’s special status and bifurcating it into two Union territories- Jammu and Kashmir and Ladakh, the Pakistan government, then led by Imran Khan, expelled India’s ambassador to Islamabad and halted bilateral trade.

India has already made it clear after the Pulwama attack in 2019 that it wants normal bilateral ties with Pakistan, adding that it is incumbent upon them to create a conducive environment free from terrorism and hostilities.

Earlier in August, former Pakistan PM Shehbaz Sharif had shown his willingness to talk to India.

“With our neighbours, we are prepared to talk to them, provided that the neighbour is serious to talk on serious matters on the table because war is no more an option. Pakistan is a nuclear power, not as an aggressor but for our defence purposes. We had three wars fought in the last 75 years. And what happened is it generates more poverty, unemployment, and lack of resources” PM Sharif had stated.

Following this, the Ministry of External Affairs (MEA) said that India wanted neighbourly ties with Pakistan but there should be an atmosphere free from terror and violence for such a relationship.

During a weekly briefing, the MEA spokesperson had said “We have seen reports regarding the comments by the Pakistan PM on this issue. India’s clear and consistent position is well known that we desire normal relations with all our neighbouring countries including Pakistan. For this environment free of terror and hostility is imperative.”

India will now have the right to reply to Pakistan’s speech at the UNGA on Saturday morning and a sharp rejoinder is expected. (ANI)

Article 370

SC Reserves Judgement On Pleas Challenging Abrogation Of Article 370

The Constitution bench of the Supreme Court has reserved its verdict on a batch of petitions challenging the abrogation of Article 370 and bifurcation of the erstwhile state of Jammu and Kashmir into two Union territories.

Five-judge Constitution bench comprising Chief Justice of India DY Chandrachud, Justices Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, and Surya Kant reserves the judgement after hearing the arguments for 16 days.

The bench granted three days time to parties to file written notes on their submissions in the case.

The Central government has defended its decision of abrogation of Article 370 saying there was no “constitutional fraud” in repealing the provision that accorded special status to the erstwhile state of Jammu and Kashmir.

Attorney General R Venkataramani and Solicitor General Tushar Mehta appeared for Centre.

Centre told the bench that Jammu and Kashmir was not the only State whose accession to India was through instruments of accession but many other princely States that too had joined India, post-independence in 1947, with conditionalities and after their merger their sovereignty was subsumed in the sovereignty of India.

Of the 565 princely States at the time of independence in 1947, the majority of them were in Gujarat and many had conditions relating to taxes, land acquisition and other issues, the Central government told the bench.

Centre also submitted that the status of Jammu and Kashmir as a Union Territory is only temporary and it will be restored to Statehood, however, Ladakh would remain a Union Territory.

Senior advocate Kapil Sibal, appearing on behalf of the petitioners, opened the arguments by saying Article 370 was no longer a “temporary provision” and it had assumed permanence post the dissolution of the Constituent Assembly of Jammu and Kashmir.

He contended that the Parliament could not have declared itself to be the legislature of J-K in order to facilitate the abrogation of Article 370 as Article 354 of the Constitution does not authorise such an exercise of power.

Highlighting that the express terms of clause 3 of Article 370 show that a recommendation from the Constituent Assembly was essential to remove Article 370, Sibal argued that in the wake of the dissolution of the Constituent Assembly whose recommendation was required to abrogate Article 370, the provision could not be revoked.

Jammu and Kashmir High Court Bar Association has told the Supreme Court that while acceding to India, the Maharaja of Jammu and Kashmir acceded his sovereignty over the territory of the State but not his sovereign power to rule and govern the State.

Accession of Jammu and Kashmir to India was territorial and except for defence, external affairs and communication, rest all the powers were retained with the State to make laws and govern, said senior advocate ZA Zafar appearing for J-K High Court Bar association.

The Central government has defended its decision to abrogate Article 370 from Jammu and Kashmir saying post the changes, street violence, which was engineered and orchestrated by terrorists and secessionist networks has now become a thing of the past.

Since 2019, when Article 370 was abrogated, the entire region has witnessed an “unprecedented era of peace, progress and prosperity”, Centre said.

After the abrogation of Article 370 from Jammu and Kashmir life has returned to normalcy there after three decades of turmoil, the Centre in its affidavit told the Supreme Court.

It has been said that schools, colleges and universities have been functioning without any strikes during the last three years.

The Constitution bench was hearing a batch of petitions challenging the abrogation of Article 370 of the Constitution and bifurcating the state into two Union Territories.

A number of petitions were filed in the top court including those of private individuals, lawyers, activists politicians and political parties challenging the Jammu and Kashmir Reorganisation Act, 2019, which splits Jammu and Kashmir into two Union Territories — Jammu and Kashmir, and Ladakh.

On August 5, 2019, the Central government announced the revocation of the special status of Jammu and Kashmir granted under Article 370 and split the region into two Union territories. (ANI)
