Delhi Court Sends K Kavitha To Judicial Custody

The Rouse Avenue Court on Tuesday sent Bharat Rashtra Samithi (BRS) MLC K Kavitha to Judicial Custody till April 9, 2024. She was arrested recently in connection with Delhi excise policy-linked money laundering case.

The Special Judge Kaveri Baweja, while sending her to Tihar Jail for 14 days, also fixed hearing on Interim bail plea for April 1, 2024.

Kavitha appeared in court through Senior Advocate Vikram Chaudhari, along with Advocates Nitesh Rana, Mohit Rao and Deepak Nagar She had moved an interim bail application, citing that examinations of her 16-year-old son are about to begin.

Enforcement Directorate, while requesting that the court send her to Judicial custody, stated that the arrestee (Kavitha) is highly influential and there is every likelihood that the arrestee will influence the witnesses and tamper with the evidence if released, which may hamper the ongoing investigation.

The department is still further investigating the role of the arrestee in the instant matter and is unearthing the further proceeds of crime and identifying the other persons who are involved or connected with the process or activities related to proceeds of crime.

Investigation into economic crimes is more complex than ordinary crimes as economic offenders are resourceful and influential persons having deep roots in the society and commit the said crimes in a carefully planned and meticulous manner, thereby rendering the investigation process a complicated exercise.

Advocates Zoheb Hossain, Naveen Kumar Matta and Simon Benjamin appeared for Enforcement Directorate in the matter.

During the hearing today, the accused, K Kavitha was produced physically before the court. She was produced at the end of ED remand period.

Directorate of Enforcement (ED) arrested K Kavitha MLC, Telangana Legislative Council on March 15, 2024, in the case of Delhi Liquor Policy Scam. A search was also conducted at the residence of K Kavitha in Hyderabad on March 15, 2024. During the search proceedings, the ED officials were obstructed by the relatives and associates of K Kavitha, said ED through a statement.

ED has alleged that K Kavitha along with others conspired with the top leaders of AAP including Arvind Kejriwal and Manish Sisodia for getting favours in the Delhi Excise policy-formulation and implementation. In exchange of these favours, she was involved in paying Rs. 100 Crore to the leaders of AAP.

Through acts of corruption and conspiracy in the formulation and implementation of Delhi Excise Policy 2021-22, a continuous stream of illegal funds in the form of kickback, from the wholesalers was generated for the AAP. Further, K Kavitha and her associates were to recover the proceeds of crime paid in advance to AAP and to further generate profits/proceeds of crime from this entire conspiracy, stated ED.

Till date, the ED has conducted searches on 245 locations across the country, including Delhi, Hyderabad, Chennai, Mumbai and other places. 15 people, including Manish Sisodia, Sanjay Singh and Vijay Nair from AAP, have been arrested in the case so far.

ED has filed 1 prosecution complaint and 5 supplementary complaints in the case so far.

Further, out of the proceeds of crime generated, assets worth Rs. 128.79 crore have been traced so far and have been attached via provisional attachment orders dated 24.01.2023 and July 3, 2023. Both the attachment orders have been confirmed by the adjudicating authority in New Delhi.

ED has filed its first chargesheet in the case. The agency said it has so far undertaken nearly 200 search operations in this case after filing an FIR taking cognizance of a CBI case that was registered on the recommendation of the Delhi Lieutenant Governor.

The CBI inquiry was recommended based on the findings of the Delhi Chief Secretary’s report filed in July showing prima facie violations of the GNCTD Act 1991, Transaction of Business Rules (ToBR)-1993, Delhi Excise Act-2009, and Delhi Excise Rules-2010, officials said.

The ED and the CBI had alleged that irregularities were committed while modifying the Excise Policy, undue favours were extended to licence holders, the licence fee was waived or reduced and the L-1 licence was extended without the competent authority’s approval. The beneficiaries diverted “illegal” gains to the accused officials and made false entries in their books of account to evade detection, the probe agencies said.

As per the allegations, the Excise Department had decided to refund the Earnest Money Deposit of about Rs 30 crore to a successful tenderer against the set rules. Even though there was no enabling provision, a waiver on tendered licence fees was allowed from December 28, 2021, to January 27, 2022, due to COVID-19, the probe agency said and there was alleged loss of Rs 144.36 crore to the exchequer. No Guarantee If INDIA Alliance Will Exist Tomorrow: K Kavitha

Bharat Rashtra Samithi (BRS) MLC K Kavitha on Thursday asserted that there is no guarantee that today’s Indian National Developmental Inclusive Alliance (INDIA) alliance will exist tomorrow. 

Earlier on August 2, BRS chief and Telangana Chief Minister K Chandrasekhar Rao (KCR) made it clear that his party is not siding with either the INDIA alliance or NDA.

“There is no guarantee if today’s INDIA Alliance will exist tomorrow. There will be state elections and seat-sharing issues for the Parliament election before that. The situation would be different after that,” K Kavitha told ANI. 

She further said that when the results of the Parliament elections come, the situation would change after that too.

“Historically, pre-poll alliances have not been very successful in this country. So, we will definitely wait. But BRS is a national party with a national agenda and a universal agenda. It is not like the Congress party with one agenda in Karnataka and another agenda in Telangana,” she added. 

Kavitha further attacked the BJP saying that the party has done nothing for Telangana for the last 10 years so they will get negative results in Telangana just like Karnataka

“In the South, people always look at which party is raising the issues of their region the most so the result here will be different. BJP has done nothing for Telangana for the last 10 years so they will get negative results in Telangana just like Karnataka,” she said. 

Earlier, the opposition parties, united under the banner of the INDIA on August 31-September 1, concluded their third meeting in Maharashtra and adopted resolutions to collectively contest the upcoming 2024 Lok Sabha elections while announcing that seat-sharing arrangements would be finalized as soon as possible through a spirit of give-and-take.

After a two-day meeting of the opposition Indian National Developmental Inclusive Alliance coalition four main committees were formed in which members of all the political parties were included.

The first meeting of the joint opposition was held in Patna on June 23 and the second meeting was held in Bengaluru on July 17-18.

INDIA alliance is a group of opposition parties, including the Congress and the parties have come together to take on the National Democratic Alliance (NDA), which is led by PM Narendra Modi’s Bharatiya Janata Party (BJP), and prevent it from winning a third straight term at the Centre in the 2024 Lok Sabha elections. 18 Parties To Participate In Hunger Strike In Delhi Tomorrow: K Kavitha

Bharat Rashtra Samithi (BRS) MLC and Telangana chief minister K Chandrashekar Rao’s daughter K Kavitha on Thursday said that a hunger strike will be held in the national capital on March 10 and that 18 political parties have said that they will participate in the protest launched to seek introduction of the Women’s Reservation Bill in the current session of Parliament.

The BRS leader also said that she will face Enforcement Directorate as she has not done anything wrong.
Addressing a press conference here Kavitha, who received summons from the Enforcement Directorate for questioning in the Delhi excise police case said that if a woman has to be interrogated by a central agency, then as per law, she has a “fundamental right” to be questioned at her home.

“We released a poster on March 2 about the hunger strike in Delhi over the Women’s Reservation Bill. 18 parties confirmed their participation…ED summoned me on March 9. I requested for March 16 but don’t know what haste they’re in, so I agreed for March 11.”

“When an agency wants to interrogate a woman, she has a fundamental right that it be done at her home,” she stated.

“So, I requested ED that they can come to my house on 11th March to investigate but they said that I will have to come to them,” the BRS leader said.

Kavitha arrived in Delhi today and said that she will be appearing before the Enforcement Directorate on March 11.

In a series of tweets, BRS MLS had hit out, alleging that certain political motives have been masquerading in the name of investigation.

“As a law-abiding citizen, I’ll fully cooperate with investigating agencies. I will appear at your good offices on March 11,” she had said in a statement.

“…I have been summoned by ED to appear on March 9th in Delhi. However, due to the Dharna and prefixed appointments, I’ll see legal opinions on the date of attending it,” BRS MLC K Kavitha had stated.

“I fail to understand as to why I have been summoned at such short notice. It seems that certain political motives have been masquerading in the name of investigation. I categorically say that I have nothing to do with the present investigation,” she had said in a subsequent tweet.

“Being a social worker and having prior commitments, I had already planned my schedule for the upcoming week & the abrupt rejection of my request seems to be motivated by reasons best known to you, which demonstrates that it is nothing but political victimisation,” she had tweeted.

On March 8, the BRS came down heavily on the Centre after the ED summoned Kavitha in connection with its ongoing probe of the Delhi excise policy case, saying that the central probe agencies have become an extended arm of the BJP.

Referring to the summons as “politically motivated”, BRS leader Ravula Sridhar Reddy had said that except ED and BJP, nobody really understands the case registered in connection with the new-withdrawn new Delhi excise policy. (ANI)
