LS Passes Competition (Amendment) Bill, 2022

The Lok Sabha on Wednesday passed The Competition (Amendment) Bill, 2022 to amend the Competition Act of 2002.

Deals with a transaction value of more than Rs 2,000 crore, according to the Bill, will require the approval of the Competition Commission of India (CCI).
“…if the value of any transaction in connection with the acquisition of any control, shares, voting rights, etc., exceeds Rs 2,000 crore, it would require filing a notice of combination before the commission and to empower the Central Government to exempt certain transactions from the requirement to file combination notice under the Act,” the amendment Bill read.

It also proposed to reduce the timeline for the commission to pass an order on such transactions from 210 days to 150 days.

Also, it sought to broaden the scope of anti-competitive agreements.

Reportedly, the Bill was introduced in the Lok Sabha in August 2022, during the Monsoon Session of the Parliament, and subsequently it was referred to the Parliamentary Standing Committee on Finance for examination. (ANI)

Explosion in Bengaluru

Another Witness Turns Hostile In the 2008 Malegaon Case

Another witness in the 2008 Malegaon blast case was declared hostile after he did not support the prosecution’s case on Wednesday.

According to the prosecution, the witness is a relative of the absconding accused and has refused in court today that had given any statement to the police.
Earlier in the month, another witness was declared hostile after he did not support the prosecution’s case.

The hostile witness had initially given statements under CrPC 161 and 164 when ATS was initially investigating the case. According to the prosecution, this was the 30th witness to turn hostile in the case.

In November last year, the 29th witness had turned hostile in the case.

This person had given statements to the Anti-Terrorist Squad (ATS) in 2008 about accused Lt Col Prasad Purohit and Sudhakar Chaturvedi.

Previously, the 28th witness turned hostile on November 5 after he told the special National Investigation Agency (NIA) court that he does not remember the statement he had given to the earlier investigative agency- Maharashtra Anti-Terror Squad (ATS).

This witness had reportedly given a statement against the sitting Bhopal MP Sadhvi Pragya Singh Thakur and another accused, identified as Dayanand Pandey, of this case during the initial investigation done by Maharashtra ATS.

However, on November 5, he came before the special NIA court and was confronted with the facts of his statement. He said that he doesn’t remember what he had said in his statement to Maharashtra ATS earlier. He told the special NIA court that he is 75 years old and that is why it is difficult for him to remember what he had said in his statement.

Earlier in September and August, two other witnesses of the case had turned hostile during the special NIA court hearing. One of them, who worked at a hotel in Indore, refused to partially say in court what he had stated earlier to the investigating agency.

On September 29, 2008, six people were killed and over 100 others were injured after an explosive device placed on a motorcycle exploded in Maharashtra’s Malegaon city in Nashik town.

On October 23, 2008, the Maharashtra ATS made its first arrest in connection to the case by apprehending BJP MP Sadhvi Pragya Singh Thakur.

Later, other accused including Sameer Kulkarni, retired Major Ramesh Upadhyay, Sudhakar Chaturvedi, Ajay Rahilkar, and Sudhakar Chaturvedi were also caught.

On January 20, 2009, the ATS filed a charge sheet in the case after completing its investigation. In April 2011, the central government transferred the investigation into the case to the NIA. (ANI)

Tata Advanced Airbus Awards Systems Ltd (TASL)

Airbus Awards Aircraft Cargo Doors Contract To Tata Advanced Systems

Airbus on Wednesday awarded a contract to Tata Advanced Systems Ltd (TASL) to manufacture cargo and bulk cargo doors of the A320neo aircraft family.

The contract is a significant step towards increasing Airbus’ competitiveness in the single-aisle aircraft market and supporting the ramp-up of the A320 programme, said the company statement.
TASL will produce these doors at a new facility in Hyderabad using cutting-edge robotics and automation technology. Each shipset will include two cargo doors and one bulk cargo door. The contract was signed by Olivier Cauquil, SVP Aerostructure Procurement, Airbus and Masood Hussainy, VP and HO Aerostructure and Aero-Engines, Tata Advanced Systems Ltd, at Hyderabad on Wednesday.

“When it comes to supporting the development of India’s industrial capacities, Airbus is walking the talk. The latest contract underlines our continued commitment to ‘Make-in-India’ for an AatmaNirbhar Bharat (self-reliant India),” said Remi Maillard, president and managing director, Airbus India and South Asia.

“In TASL, we have a most trusted and able partner that will support the ramp-up of our A320neo family aircraft that has been the poster child of democratisation and transformation of India’s aviation sector. We will continue to grow our industrial footprint and the aviation and aerospace ecosystem at a fast pace in India,” he added.

Commenting on winning this contract, Sukaran Singh, managing director and chief executive officer, Tata Advanced Systems Ltd, said, “We have an ongoing relationship with Airbus based on trust and operational excellence, and this new contract win will further bolster our partnership in aerospace manufacturing in India.”

Airbus presently procures components and services worth USD 735 million every year from more than 100 Indian suppliers. Every Airbus commercial aircraft and every Airbus helicopter has critical technologies and systems designed, manufactured and maintained in India.

In addition, Airbus will build the C295 military aircraft Final Assembly Line (FAL) with TASL in Gujarat. Airbus said the programme will unlock the potential for cutting-edge design, component manufacturing, aircraft assembly and services capabilities across the value chain.

Together with the supply chain, Airbus said it supports nearly 10,000 jobs in India. By 2025, this number may rise to about 15,000. Further, the C295 military aircraft programme will lead to the creation of 25,000 direct and indirect jobs over 10 years, said the company in a statement. (ANI)

Project Akashteer: Def Min Inks Rs 2,400Cr Deal With BEL

In yet another boost to self-reliance in defence sector, the Ministry of Defence on Wednesday signed three contracts — two with Bharat Electronics Limited (BEL), Ghaziabad and one with New Space India Limited (NSIL) — at a total cost nearly Rs 5,400 crore, to bolster the defence capabilities of the country.

According to the Ministry of Defence, the first contract with BEL pertains to the procurement of the Automated Air Defence Control and Reporting System ‘Project Akashteer’ worth Rs 1,982 crore for the Indian Army.
The second contract with BEL relates to the acquisition of Sarang Electronic Support Measure (ESM) systems along with the associated Engineering Support Package from BEL, Hyderabad at an overall cost of Rs 412 crore for the Indian Navy.

The contract with NSIL, a Central Public Sector Enterprise under the Department of Space, Bengaluru pertains to the procurement of an advanced Communication Satellite, GSAT 7B, which will provide High Throughput Services to the Indian Army at an overall cost of Rs 2,963 crore, said the Defence Ministry statement.

The Automated Air Defence Control and Reporting System ‘Project Akashteer’ will empower the Air Defence units of the Indian Army with an indigenous, state-of-the-art capability, to effectively operate in an integrated manner. Akashteer will enable monitoring of low-level airspace over the battle areas of the Indian Army and effectively control the Ground-based Air.

Further, Sarang is an advanced Electronic Support Measure system for helicopters of the Indian Navy, designed and developed indigenously by the Defence Electronics Research Laboratory, Hyderabad under the programme Samudrika. The scheme will generate employment of approximately 2 lakh man-days over a period of three years.

Both projects will encourage the participation of Indian Electronics and associated industries, including MSMEs, who are sub-vendors of BEL.

Advanced Communication Satellite will considerably enhance the communication capability of the Indian Army by providing mission-critical beyond-the-line-of-sight communication to troops and formations as well as weapon and airborne platforms. The geostationary satellite, being a first-of-its-kind in the five-tonne category, will be developed indigenously by Indian Space Research Organisation (ISRO).

Many parts and sub-assemblies and systems will be sourced from indigenous manufacturers, including MSMEs and start-ups, thereby giving a fillip to the private Indian space industry, in line with the Prime Minister’s vision of ‘Aatmanirbhar Bharat’. The project will generate employment of approximately 3 lakh man-days over a period of three and half years. (ANI)

Setback For Mamata Predicted in Exit Polls

Can Sit On Dharna Near PM House: Mamata

West Bengal Chief Minister Mamata Banerjee, who on Wednesday sat on a dharna against the central government over alleged blocking of state money, said she would sit on a dharna near the Prime Minister’s residence in the national capital, if necessary.

She said the two-day dharna was staged to protest against the BJP-led central government’s alleged discriminatory attitude towards West Bengal. Mamata said she was sitting on dharna in her capacity as the TMC chief and not as the chief minister.
“I am working for people. I am fighting for the people whose money has been stopped for 100 days’ work. I am sitting for the rights of common people whose money has been blocked by the Centre. If required, Mamata can even sit on dharma near the PM’s house. I have the courage,” the Trinamool supremo said.

“You have blocked the money by invoking a so-called Section 27. But remember, people will vote you out with section 420 in 2024. You will not come to power,” she said.

Under BJP’s rule, she said the Opposition is harassed by the central agencies.

“A babu is saying that I will send CBI and ED to your house if you speak against me,” claimed the West Bengal Chief Minister.

Attacking the BJP further, Mamata said, “There were some good people in BJP. I used to respect Atal ji a lot. But nowadays the kind of material is there…A tubewell would not be made. You are taking money in the name of GST. I will ask all the opposition parties if there is no one who is tortured. They already have started calling women from home. I say why do you spare the small child. See in which level they have gone down…From Akhilesh, Uddhav, Arvind, Lalu and KCR all are thieves and only you are sadhu.”

She said all opposition parties should fight the BJP unitedly.

The Trinamool chief said the BJP’s “double engine government” has now become “Bhajpa washing machine”.

“The so-called double-engine government has failed. BJP has turned into a washing machine. Those who do not know how to respect women, are now giving lectures about the Constitution,” she said.

“One of the BJP’s goons was saying that they would come out armed on the streets during the Ram Navami procession. We would not stop any Ram Navami procession. But remember, Ramzan is going on…The law will take its own course if you try to incite violence in Muslim-dominated areas. There is every right to carry out processions and public meetings. But no one has the right to instigate riots,” the West Bengal CM added.

Mamata alleged further that the Centre has not released funds for the Mahatma Gandhi National Rural Employment Guarantee (MGNREGA) project and other schemes for the state.

The protest was held ahead of the panchayat elections in the state. (ANI)

Adani Group Hindenburg

SEBI Never Comments On Entity-Specific Matters: Chief On Adani-Hindenburg

Securities and Exchange Board of India chairperson Madhabi Puri Buch, in her first press appearance since the Adani-Hindenburg issue rocked the country, categorically said the regulator will not comment on it as the matter is sub-judice.

On March 2, the Supreme Court set up an expert committee amid the controversy arising out of a report by US short-seller Hindenburg Research on the Adani Group. It directed SEBI to investigate whether there has been a violation of Section 19 of SEBI rules and any manipulation of stock prices.
“We never comment on entity-specific matters and on top of that, the matter is before the Supreme Court. We never comment on sub-judice matters,” Buch said at a press conference after its board meeting.

“We will follow the advice of the Supreme Court. We are duty-bound to follow whatever the Supreme Court has said,” she said, adding, “We will follow the Supreme Court order in letter and spirit.”

Further, she informed that the apex court has instructed the regulator to precisely give the update to the committee and it will be inappropriate to comment on the matter.

The January 24 Hindenburg report alleged stock manipulation and accounting fraud by the conglomerate. Over the past few weeks since the Hindenburg report, share prices of most companies in the Adani Group have dropped significantly, though in varying degrees.

In response to the US short seller’s report, the Adani Group had hit back, calling Hindenburg Research “an unethical short seller” and stating that the report was “nothing but a lie”. The continued sell-offs in the group’s stocks led its flagship firm, Adani Enterprises Limited, to cancel a fully subscribed Rs 20,000 crore follow-on public offer.

Adani Group on January 29, in a long 413-page report, said the report by Hindenburg Research was not an attack on any specific company but a “calculated attack” on India and its growth story. (ANI)

L-G Appointment Of Aldermen In MCD

SC Notice To L-G Against Appointment Of Aldermen In MCD

The Supreme Court on Wednesday issued a notice to Lieutenant Governor VK Saxena on a plea of the Delhi government challenging the appointment of ‘aldermen’ by the L-G in the Municipal Corporation of Delhi (MCD) house.

A bench of Chief Justice of India DY Chandrachud and Justices Justices PS Narasimha and JB Pardiwala posted the matter for hearing on April 10.
After Aam Aadmi Party (AAP) won the municipal elections, the Lt Governor appointed 10 aldermen that were opposed by the Delhi government.

The petition of the Delhi government sought the quashing of the orders dated January 3 and 4 whereby the Lieutenant Governor nominated 10 persons to the MCD.

The plea stated that the Lieutenant Governor has “illegally” appointed 10 nominated members to the Municipal Corporation of Delhi on his own initiative, not on the aid and advice of the Council of Ministers.

This is the first time since Article 239AA came into effect in 1991 that such a nomination has been made by the Lieutenant Governor completely by-passing the elected government, thereby arrogating to an unelected office a power that belongs to the duly elected government, the Arvind Kejriwal-led Delhi government stated.

It sought a direction “to nominate members to the Municipal Corporation of Delhi under Section 3(3)(b)(i) of the Delhi Municipal Corporation Act, 1957, in accordance with the aid and advice of the Council of Ministers.”

Neither the section nor any other provision of law says anywhere that such nomination is to be made by the Administrator in his discretion. As such, under Article 239AA of the Constitution, the word “Administrator” must necessarily be read as Administrator/Lieutenant Governor, acting on the aid and advice of the Council of Ministers, and the Lieutenant Governor was bound to make the nominations on the aid and advice of the Council of Ministers, the plea added.

In the present case, Delhi L-G was not been vested with any discretionary authority to make nominations to the MCD under either a constitutional provision or any statutory provision, the plea said.

“Accordingly, the only two courses of action open to him were to either accept the proposed names duly recommended to him for nomination to MCD by the elected government, or to differ with the proposal, and refer the same to the President. It was not open to him to make nominations on his own initiative, completely circumventing the elected government. As such, the nominations made by the Lieutenant Governor are ultra vires and illegal, and are consequently liable to be quashed,” the plea added. (ANI)
