Supreme Court

SC Gives Green Signal To RSS Route March In TN

The Supreme Court on Tuesday rejected the Stalin-led-Tamil Nadu’s appeal against the Madras high court order allowing Rashtriya Swayamsevak Sangh (RSS) route marches in the state.

A bench of justices V Ramasubramanian and Pankaj Mithal upheld the Madras High Court order which allowed the RSS route march in the state.
Dismissing the appeal filed by the Tamil Nadu government against the Madras HC order, the top court said, “Therefore, it is not possible for us to find fault with the order passed by the Judge either in the main writ petitions or in the review applications.”

“Hence all the special leave petitions are liable to be dismissed,” the top court said.

The top court has observed that the main objection raised by the State before the High Court was that after the imposition of a ban order on another organization, law and order problems cropped up in certain places and that the same led to several cases being registered.

The details of those cases are actually furnished in the memorandum of grounds of special leave petition.

“But the Chart provided by the State Government shows that the members of the respondent organization were the victims in many of those cases and that they were not the perpetrators,” the top court said.

Senior Advocate Mukul Rohatgi, appeared for the petitioners Tamil Nadu, in all the special leave petitions and Senior Advocates Mahesh Jethmalani and Menaka Guruswamy appeared for the respondent RSS.

Earlier, Tamil Nadu Government told the Supreme Court that they are not totally against the RSS route march but can’t permit it in sensitive locations.

The court was hearing the Tamil Nadu government’s appeal against the Madras High Court order permitting RSS for its route march in the state.

On February 10, Madras High Court directed Tamil Nadu police to grant permission to Rashtriya Swayamsevak Sangh (RSS) to take route marches in various districts across the State on public roads.

Recently the Tamil Nadu Government has challenged two orders of the Madras High Court dated September 22, 2022, and November 2, 2022.

Earlier, Tamil Nadu Government had also said that they will have a dialogue with the RSS on proposed routes for the march as they are not totally opposed to it.

The state government had apprised the court that the government denied holding route marches in the sensitive areas, which have faced PFI incidents and have border areas with disturbances.

The lawyer said, “The government had had some intelligence reports.”

The lawyer for Tamil Nadu Government had stressed that they are not fully opposed to the procession but to the manner in which it is proposed to be done.

“They are not able to control terrorist organizations and that is why they want to ban the route march,” the lawyer said.

Tamil Nadu Government has moved the top court against the Madras High Court order permitting the Rashtriya Swayamsevak Sangh (RSS) to take out its route march in Tamil Nadu on rescheduled dates. (ANI)

Balasaheb Thackera Uddhav

Will Call Uddhav To Clarify My Stand: Maharashtra Min

Days after stoking controversy in the State with his remarks that Balasaheb Thackeray and Shiv Sainiks had no role in Babri Masjid demolition on December 6 1992, Maharashtra minister and senior BJP leader Chandrakant Patil on Tuesday said that he will ring up Uddhav Thackeray to clarify his stand.

The remarks of Patil, minister of higher and technical education in the Eknath Shinde government, came hours after former Maharashtra Chief Minister and Shiv Sena (UBT) chief Uddhav Thackeray demanded the resignation of CM Shinde and sought the ouster of Patil, for making derogatory remarks against his father Balasaheb Thackeray.
“I will be calling Uddhav Thackeray to clarify my stand over this issue. I have full respect for Balasaheb Thackeray in my heart and I can not disrespect him. No one can forget his contribution to saving Hindus during the Mumbai riots (in 1993),” Patil said during a press briefing here on Tuesday.

“Maharashtra CM Eknath Shinde also called me up today morning and asked me to take a press conference to clarify my stand,” Patil said.

He said that those who were involved in the struggle were Hindus and they cannot be segregated as Shiv Sena workers or BJP men.

“The struggle for the Babri Masjid demolition was led by Vishwa Hindu Parishad (VHP), and everyone was working under their banner, so there was nothing like Shiv Sena, BJP or any other organisation. Everyone (present there while the mosque was being brought down) was a Hindu,” he said.

“My question was where was Sanjay Raut during demolition and that question still remains the same today,” he added.

The former Maharashtra BJP chief, while speaking to a regional news channel recently, said that Balasaheb Thackeray and Shiv Sena had no role in the Babri Masjid demolition on December 6 1992.

His remarks drew ire from the Shiv Sena (UBT) who demanded the minister’s resignation.

However, on Monday, after Patil was asked about his remarks, he reiterated that the world knows that VHP and its sub wings Durga Vahini, and Bajrang Dal were leading the fight against the disputed structure. (ANI)

Rahul Gandhi

Seize My House 50 Times, Will Continue To Raise Public Issues: Rahul

Congress leader Rahul Gandhi on Tuesday, lashed out at the Bharatiya Janata Party-led Centre and said that irrespective of the attacks the ruling party unleashes at him, the former MP is not going to stop from raising the issues of the public, and nobody can stop him from representing his erstwhile Lok Sabha constituency Wayanad.

He was addressing a public meeting at Wayanad, after holding a road show in the constituency along with his sister and party leader Priyanka Gandhi.
“Now when I am not an MP, I thought about what it means to be an MP. It means to be a people representative. For that, you have to understand the emotions, sufferings, and difficulties of the people. You should have the ability to touch and treat people like equals, and at times as your superiors. So, a true representative of people develops by giving things that you desire, by fighting for what the people desire, by becoming less arrogant and more humble,” he said while addressing the people at Wayanad.

This is his first visit to his erstwhile Lok Sabha constituency Wayanad after his disqualification from Lok Sabha as a court in Surat convicted him in a defamation case on the ‘Modi surname’ remark.

Spelling out the job of an MP, he said, the main task of the member of Parliament is to raise the issues of the people without fear.

Terming the position of MP as just a “Tag”, he said, “MP is just a tag, a position, a post. BJP can take away my tag, my position, my house, or put me in jail, but they cannot stop me from representing the people of Wayanad. To represent the people of Wayanad, means to represent their issues. There are practical things, buffer zone, night roads, and medical colleges. And I will keep on working on these issues. Don’t think that if I am not an MP, they have disqualified me, and our relationship has ended. Not for 3-4 years, not for my entire life, my relationship won’t be changed,” he said.

The former MP said that he finds it surprising that BJP has not been able to “understand” their opponent even after so many years.

“I have been fighting out the BJP for quite some years. And it surprises me, that in so many years they have been unable to understand their opponent. They do not understand that their opponent will not be intimidated. They think that sending police to my house will make me scared, taking away my house will make me disturbed. I was actually happy, that they took away my house. It was not interesting for me to live in that house. I saw hundreds of hundreds of people losing their house in Wayanad during the floods,” Rahul Gandhi said.

He further added, “Seize my house 50 times, but I will continue to raise the issues of the people of Wayanad and the people of India. You make people fight, and you abuse and threaten people, I will keep fighting for the people and respecting every single community, religion and idea. You continue to be as nasty and evil as you want, and I will continue to be as kind as I can. Because this is a fight between two visions of India. So, we are not scared of your intimidation, in fact, we find it quite amusing”.

He further alleged that he was not asked to speak in parliament, and accused the BJP leaders of “lying” about him.

“I went to Parliament and asked the Prime minister some questions about a businessman. I asked Mr Modi please explain your relationship with Mr Adani. I showed how the defence relationship between India and Israel was transformed, and the rules of the airports were changed, to help Mr Adani. The Prime Minister did not answer. The first time you saw, the government himself not allowing the Parliament to function,” Rahul Gandhi said.

The former Congress President added that the more BJP attacks him, the more he will continue to walk on the right path.

“The rule is that if anyone says anything about an MP, he has the right to reply. I went to Speaker with that rule, also but still, I was not allowed to speak. And because the government was uncomfortable with the type of issues I raise, I was removed from the Parliament. Doesn’t matter, it is the biggest gift that you can give me. Because now, I know that if BJP is attacking me, taking my house, and removing me from Parliament, I am doing the right thing. I am not going to stop,” he added. (ANI)

Don’t Mess Around With My Authority: SC To Lawyer

“Don’t mess around with my authority,” said Chief Justice of India DY Chandrachud on Tuesday to a lawyer who was trying to mention a matter to get an early date of hearing.

The counsel mentioned the matter for an early listing of his case, but the CJI said, “The matter is already listed for hearing on April 17.”
The counsel then sought to mention the case before another bench. To which the CJI asked the counsel, “Your date is 17th, you want to mention it before another bench to get a date of 14th?”

The counsel then told the bench that a similar matter was taken up on Monday by the court and some fresh matters were also mentioned.

“If it is listed for 17th it will come on 17th. Don’t mess around with my authority,” said the CJI.

The CJI further told him, “Do not play these tricks with me. You can’t mention it here and then elsewhere for an earlier date.”

Earlier in March, there was a heated exchange of words as the Chief Justice of India (CJI) DY Chandrachud lost his calm at the Supreme Court Bar Association president Vikas Singh while hearing a land allotment matter relating to lawyers’ chambers.

An exchange of words was witnessed when the SCBA President stressed for listing a matter before a bench led by CJI DY Chandrachud.

SCBA President Vikas Singh apprised the court that they are struggling to get the matter listed for the last six months.

When the SCBA President urged for listing the matter, he also said that they have to take it to the judge’s residence if the matter did not get listed.

CJI Chandrachud lost his temper and asked the senior lawyer, “Is this the way to behave?”

“I will not be cowered down by you,” CJI DY Chandrachud said adding that he has been in this profession for 22 years and never allowed himself to be browbeaten by a member of the Bar, litigant or anyone else and will not let that happen in the last two years of his profession.

SCBA President also refused to maintain silence. Thereafter, the court said that it will list the matter on March 17 but not as item 1 in the cause list.

During the mention of cases, the SCBA president urged the court to list the matter early as the matter is not listed for six months. Senior Advocate said that the Appu Ghar land came under the Apex court premise on the petition by the SCBA but the Bar got only one block (ANI)
