Slave Trade – A Stain That Refuses To Go

They are part of the past of many countries of origin, and of folklore that is fading into public memory as time moves. India is one of them. They are the unsung part of its diaspora, the world’s largest.

Those captured and shipped out as slaves are conveniently forgotten while India respects their successors, the indentured labour that left the shores with an official nod, never to return. Only, the past captors and the new consent-givers were the same.

Enslaving the weak and the vulnerable as part of the warfare caused by the thirst for territory and power is as old as mankind. But it became a lucrative business in the 17th century. The armed captors came stealthily, riding boats and ships, using the cover of darkness and local help, confident that the law was asleep.

Moving guns with goods for trade, also using religion when and where convenient, European powers colonized the world. They created national borders where none existed, to suit their geo-economic interests. The traders carved out empires where they impoverished the people and divided them into ethnic/faith/regional lines.

That colonial-era slavery is today surfacing across the world, Europe especially, as racism, apartheid and sectarian violence in countries that colonized and their erstwhile colonies alike. Note the shootouts, the terror attacks, the ethnic strife and much that is happening today.

The Empire is striking back as former colonizers struggle to co-exist with their former subjects. While this may be arguable, the recurring violence that is the consequence of colonization is not. And it is only going to escalate with time.

The provocation for writing this is the apology tendered last week by Dutch King Willem-Alexander. He laid a wreath at the slavery monument after apologising for the royal house’s role in slavery and asking forgiveness. Only, it has come on the 150th anniversary of the date when slavery was officially outlawed. And with the ban had come compensation, not for the slaves but for slave owners.

Old records say the Dutch pioneered slavery as “the world’s oldest trade”, soon to be joined by Spain, Portugal, France, Belgium and Britain. The last-named defeated them all in Europe and/or in the distant colonies and became the world’s largest colonizer-Empire builder where, as it was famously said, the sun never set.

To be fair, some European Union members are working to return the precious artefacts their ancestors stole from erstwhile colonies. But there is no such move in evidence in ‘Brexit’ Britain.

Unsurprisingly, sections of the Dutch opinion-makers last week said there is nothing to apologise for. They fear that this might open Pandora’s Box with former slaves and subjects asking for reparation. Didn’t the Britons bristle when India’s Shashi Tharoor held up a stained mirror to them at the 2015 Oxford debate?

India, the ‘jewel’ of the British Empire was perhaps the biggest ‘exporter’ of manpower. The context here is South Asia as, for nearly two centuries, its entire peninsula from Gujarat to the Arakans was the catchment area for slaves – 600,000 as per some estimates.

According to a study by Ruchi Singh for Migrationpolicy.org: “The 1833 abolition of slavery in most parts of the British Empire transformed the colonial system, replacing slavery with indentured servitude. In the eight decades that followed, the United Kingdom relocated millions of bonded Indian workers to colonies across Africa, Asia, and the Caribbean.”

A million ‘girmitiyas’ – those who signed an agreement – found work, but their poverty was replaced by another type with inclement weather and working conditions and what became their permanent separation from home. The story of the slaves and the indentured labour overlaps, with only shades of differences.

On the studied silence on slavery, Hubert Gerbeau has acutely observed, “The specialist in the slave trade is a historian of men and not of merchandise, and he cannot accept the silence of those transported.” While trans-Atlantic slavery from the western African shores to the Americas has been fairly well-documented, the Indian Ocean region is not.

Indeed, the study of how European traders set up ‘factories’ to trade, and forts for protection, took advantage of weak Indian Rajas and turned maritime powers. The competition in trade included the slave trade. It was huge, even though the records of the Dutch East India Company (VOC) cynically put the proportion of the slave trade as merely five per cent of the total.

The Portuguese imported Africans into their Indian colonies on the Konkan coast between about 1530 and 1740. Slavery in India continued through the 18th and 19th centuries. During the colonial era, Indians were taken into different parts of the world as slaves by various European merchant companies as part of the Indian Ocean slave trade. Slavery was prohibited in the possessions of the East India Company by the Indian Slavery Act, of 1843, in French India in 1848, in British India in 1861, and in Portuguese India in 1876.

There is hardly a mention of slavery – from India and by Indians. For, India was also a large slave trade hub in which all communities participated and benefitted. In historical terms, it was the latter-day business enterprise succeeding what each invader to India did and by those who built kingdoms through internecine warfare. Each battle – and they were numerous, history says – meant enslavement by the victor of the vanquished – men, women and children – who were killed or converted and many shipped out.

Scholars of the slave trade say that the practice continued, stealthily, with an unofficial nod, long after slavery and trade were banned by the Europeans. Keeping slaves was as common as keeping concubines wherever feudalism married business enterprises. The former helped with abundant manpower that the latter needed for indigo, cotton and tea cultivation, or to build roads and railways.

One may not call it slavery. But labour under duress is rampant in most of the former colonies. Is it surprising to see today under-aged boys at wayside restaurants and factories (despite the Factories Act) and little girls minding babies while ‘memsahib’ is at a kitty party or simply surfing on a cellphone or watching the latest film?

Digital personal data protection bill

Draft of Digital Personal Data Protection Bill Approved

Union Cabinet has approved the draft of Digital Personal Data Protection (DPDP) Bill 2023.

According to official sources, the bill is likely to be tabled during the upcoming monsoon session of Parliament.
The Centre introduced the Personal Data Protection Bill 2019 in Parliament in December 2019. The Bill was sent for consideration to the Joint Committee of Parliament. The Joint Committee, after consultations, submitted a report to the Speaker. In view of the feedback by stakeholders and various agencies, the Bill was withdrawn in August 2022.

On November 18, 2022, the government published a new draft Bill, titled the Digital Personal Data Protection Bill 2022, and initiated a public consultation on this draft. A comprehensive and detailed consultation was held on this subject.

21,666 comments were received from the public and a series of consultations were held with 46 sector organisations, associations and industry bodies. Comments were also received from 38 ministries/ departments of the Government of India.

The reintroduced draft Digital Personal Data Protection Bill 2022 proposed six types of penalties on non-companies to companies. To prevent a personal data breach, a penalty of up to Rs 250 core is being proposed in the draft bill which was put out for public comments.

Besides, failure to notify the Board and affected Data Principals in the event of a personal data breach and non-fulfilment of additional obligations in relation to Children may attract a penalty of up to Rs 200 crore.

Non-fulfilment of additional obligations of Significant Data Fiduciary under sections 11 and 16 of the Act may attract Rs 150 crore and Rs 10 crore fines, respectively.

Lastly, non-compliance with provisions of this Act other than those listed in (1) to (5) and any rule made thereunder will attract penalties up to Rs 50 crore.

Points that emerged in the course of consultations and comments were thoroughly studied and the draft Digital Personal Data Protection Bill 2023 was finalised.

The purpose of this Act, the draft said, is to provide for the processing of digital personal data in a manner that recognizes both the right of individuals to protect their personal data and the need to process personal data for lawful purposes.

During the drafting of the Personal Data Protection Bill in 2019, the government said that the entire gamut of principles was widely debated and discussed. These include the rights of individuals, duties of entities processing personal data and regulatory framework, among others.

The first principle of the proposed Bill is that usage of personal data by organisations must be done in a manner that is lawful, fair to the individuals concerned and transparent.

The second principle of purpose limitation is that the personal data is used for the purposes for which it was collected. The third principle of data minimisation is that only those items of personal data required for attaining a specific purpose must be collected.

Among others, personal data should be limited to such duration as is necessary for the stated purpose for which personal data was collected and reasonable safeguards to ensure that there is no unauthorised collection or processing of personal data are some features. (ANI)

Pilot congres key meeting

Rajasthan: Gehlot, Pilot To Attend Key Cong Meet Today

Congress leader Sachin Pilot will be part of a key meeting of the state party leadership, which will also feature Chief Minister Ashok Gehlot, indicating that the two feuding heavyweights of the ruling party may finally be burying the hatchet ahead of the crucial Assembly polls at the end of this year.

The meeting of the Pradesh Congress Committee (PCC), which is scheduled to be held virtually at 11 am on Thursday, will also feature PCC Chief Govind Singh Dotasara, cabinet ministers, and the All India Congress Committee (AICC) in-charge of Rajasthan, Sukhjinder Singh Randhawa.
The meeting will be held via Zoom.

This will be the first meeting where the two leaders, who have been locked in a bitter and protracted power tussle, will come face to face since their differences came to the surface.

While they have been making public statements against each other, with the party high command seemingly at pains to broker a truce, Pilot, in the recent past, escalated his attack against the Gehlot government, demanding that it makes good on its promise to order a probe against the alleged corruption under former chief minister Vasundhara Raje Scindia.

He also took out a ‘Jan Sangharsh Yatra’ to raise public awareness on his demand and step up pressure on the Ghelot government to live up to its promise to the people.

Earlier, on May 29, in view of the persisting war of words between the two leaders, Congress national president Mallikarjun Kharge had summoned CM Gehlot and his former deputy for separate meetings in the national capital.

Congress leader Rahul Gandhi also attended the meeting at the party’s headquarters in the national capital.

Earlier, on May 15, Pilot issued an ultimatum to the Congress government to probe the alleged paper leak scam during the previous Bharatiya Janata Party (BJP) rule in the state.

He warned the Gehlot government of agitations if his demand wasn’t met in a month.

He raised three key demands, threatening the government with protests if they were not acted upon in a month’s time. These were disbanding and reorganising the Rajasthan Public Service Commission (RPSC), which hit the headlines in the wake of the alleged paper leak case, compensation to the affected candidates, and a high-level inquiry into the alleged scam under the Vasundhara Raje government.

He alleged that there was loot and corruption under Raje’s rule.

“Ashok Gehlot saheb also levelled allegations (against the BJP government) while in the Opposition. Today four and a half years (of the government) have been completed but the promises made have not been fulfilled,” Pilot said earlier, adding that he wrote several letters to CM Gehlot.

“I went on a fast in Jaipur, but when nothing happened. Now, I will go to the people through the Jan Sangharsh Yatra,” he had said. (ANI)

Manipur: Schools From Classes 1-8 Resume After Two Months

The schools under the Department of Education (Schools) of the Manipur government on Wednesday reopened and resumed their normal classes for Class 1-8 after more than two months of closure due to ethnic violence that erupted in the hilly state on May 3.

The move was taken keeping in mind the welfare of the students, said sources privy to the positive development, adding the parents and guardians of the students are happy with the opening of schools after prolonged summer vacation.

During an inspection of schools on the first day of resumption of classes, a source said the “students expressed their happiness”.

The schools had extended summer vacation from May 4 till July 4 due to the prevailing law and order situation in Manipur.

Even as normal classes resumed for standards 1-8, 96 of the 4,617 schools could not be opened as the premises are being utilised for relief operations, said sources.

“The students displaced by the recent violence in the state are allowed to get admission free of cost to nearby schools,” the source informed further.

“Further, the requirement of prior permission of Board of Secondary Education Manipur/Council of Higher Secondary Education Manipur (BoSEM/CoHSEM) for Class 9 to Class 12 has been relaxed for violence-affected students opting for a change of school and no fees shall be charged for updation of registration with BoSEM/CoHSEM in such cases,” the source said.

The Department of Education(S) and Samagra Shiksha, Manipur have distributed textbooks, exercise books, pens, pencils, Sports items and School uniforms for the displaced children staying at Relief Camp in both Hill and Valley districts.

“Till now 27,629 textbooks; 20,375 notebooks; 4,955 pencils; 3,483 sharpeners and erasers and 5,171 pens have been distributed to relief camps through concerned ZEOs. Further, 1,536 sports items such as football, carrom board sets, chess and ludo sets have been distributed to the relief camps,” the source added.

It was observed during an inspection on Wednesday that the maximum attendance at schools on Wednesday were recorded by students, who were displaced in the wake of the violence and were shifted to relief camps, the source informed further.

The conflict in Manipur led to many shifting to relief camps while leaving more than 130 people dead.

The ethnic violence and clashes also saw many houses, shops, business establishments and vehicles destroyed. (ANI)

UCC objection to law commission

AIMPLB Opposes UCC, Sends Objections Draft To Law Commission

The All India Muslim Personal Law Board on Wednesday handed over a draft of the Uniform Civil Code (UCC) to the Law Commission, listing its objections to the proposed legislation and highlighting the rights that the enshrined for the community in the Constitution.

The working committee of the Board had approved the draft response on the UCC, and, on Wednesday, it was presented for discussion at a virtual general meeting of the Board that began at 10 am.
Earlier, the Secretary of the Law Commission of India had asked AIMPLB to submit a proper response, after soliciting views and ideas from the public, regarding the UCC. Responding to the same, the secretary general of AIMPLB said the issue was examined earlier and the commission’s predecessor reached a conclusion that the UCC was “neither necessary nor desirable”.

The panel also sought six months’ time to prepare an appropriate response by religious organisations, individuals, and public-spirited persons. Previously, the AIMPLB had passed a resolution at its executive meeting saying that the implementation of a Uniform Civil Code (UCC) was not possible as it would be an ‘unnecessary’ Act.

It added that the Places of Worship Act 1991, should be “maintained and well-implemented” and religious conversion was a matter of “Freedom of religion”.

Earlier, a meeting of the Parliament’s Standing Committee on Personnel, Public Grievances, Law and Justice, convened on Monday, sought the views of the Department of Legal Affairs, the Legislative Department, and the Law Commission of India on the June 14 notice issued by the Law Commission, inviting views of stakeholders on the Uniform Civil Code.

Opposition MPs said at the meeting it was necessary to keep in mind that the UCC is not just about one family law, but about the matters related to every religion, caste, and community of the society, which is why all sections of the society must be kept in mind.

The Uniform Civil Code (UCC), which had been a hot topic that had polarised opinions over the last 4 years, hit the forefront yet again after Prime Minister Narendra Modi made a strong case for the implementation of uniform legislation at a recent address.

PM Modi said the country cannot run on two laws and that Uniform Civil Code (UCC) was in keeping with the founding principles and ideals of the Constitution.

“Today people are being instigated in the name of UCC. How can the country run on two (laws)? The Constitution also talks of equal rights…Supreme Court has also asked to implement the UCC. These (Opposition) people are playing vote bank politics,” PM Modi said while addressing booth-level workers in Bhopal. (ANI)

MP Urination Case: Accused Home Razed, Kin Claims Old Video Circulated

The residence of Pravesh Shukla, the accused in the Sidhi urination case, was razed on the order of the state government.

The accused was apprehended after a video went viral on Tuesday where he was seen relieving himself on a man.
As the authorities arrived at the accused’s house with a bulldozer, his family members the video over which he was arrested was an old one, which has been brought to the forefront as the elections are close.

“It’s an old video being circulated for political and electoral reasons,” the accused’s sister told ANI.

Shukla was booked under the National Security Act (NSA) and is currently lodged in Rewa Central Jail.

Earlier, his father had said, “There is no way my son could have done this. This is a conspiracy to frame him. We were also very distressed after we saw the video.”

Reacting to the viral video on Tuesday, state Home Minister Narottam Mishra condemned the incident saying Chief Minister Shivraj Singh Chouhan ordered immediate action against the accused.

“Strict action will be taken against the accused,” Mishra said on Tuesday.

Earlier, on the order of CM Chouhan, a case was registered against the accused youth under the National Security Act after the video of his lewd act was widely circulated online.

The incident took place at Kubri village in the Sidhi district of Madhya Pradesh.

In the viral, the accused was purportedly seen urinating on the face of a man in an inebriated state.

The accused, Pravesh Shukla, was identified as a resident of Kubri village.

As soon as the video went viral on social media, CM Chouhan, on Tuesday, took cognizance of the matter and ordered strict action against the accused. He also asked the accused to be booked under the NSA.

“A viral video of Sidhi district has come to my notice. I have instructed the administration to arrest the accused and take strict action against him and also impose NSA,” CM Chouhan tweeted on his official handle.

Further, according to the police, following the CM’s instruction, a case was registered against the accused at Bahari police station under IPC sections 294, 504, sections 3(1) (r)(s) of SC/ST Act and the NSA. (ANI)

Nationalist Congress Party chief Sharad Pawar, who is battling a crisis in the party triggered by his nephew Ajit Pawar joining the Shinde-Shiv Sena government in Maharashtra, said at a crucial party meeting here that the NCP symbol is “not going anywhere” and that they were not hungry for power and will keep working for people.

“The party symbol is with us, it is not going anywhere. The people and party workers who brought us to power are with us,” Pawar said at a meeting convened by him at YB Chavan Auditorium even as the rival group held a simultaneous meeting at Mumbai Education Trust (MET) Bandra.
Sharad Pawar’s daughter Supriya Sule, MP and party leaders Anil Deshmukh, Balasaheb Patil, Ashok Pawar, Jayant Patil and Rohit Pawar were among those present.

The crisis in Nationalist Congress Party has been triggered by Ajit Pawar switching sides on Sunday and joining the Eknath Shinde-BJP government as Deputy Chief Minister. Eight other NCP MLAs took oath on Sunday with Pawar as ministers.

Sharad Pawar termed the meeting as “historic” and slammed the group led by Ajit Pawar saying they had not followed any procedure.

“We weren’t taken into confidence by the MLAs who decided to split. Ajit Pawar faction has not followed any procedure. Ajit Pawar should have spoken to me if he had any problems. If he had something on his mind he could have approached me,” the NCP chief said.

He also attacked the BJP for joining hands with those it had called “corrupt”.

“You (BJP) called the NCP corrupt. So, why have you allied with the NCP now?…Whatever happened to Uddhav Thackeray has been repeated,” he said.

Eknath Shinde, who is Maharashtra Chief Minister now, had split the Shiv Sena which was led by Uddhav Thackeray.

Sharad Pawar told his supporters and NCP workers that they have to keep marching ahead despite the hurdles.

“We don’t have hunger for power; we will keep working for the people. Today, the entire country is watching us…This meeting is historic for NCP. We have to keep marching ahead despite the hurdles in our way,” he said.

Pawar’s remarks on NCP election symbol ‘clock’ came amid the feud between the two factions reaching the Election Commission.

The Election Commission has received a petition from Ajit Pawar staking claim to Nationalist Congress Party (NCP) and the party symbol, sources said.

The sources said the Election Commission has also received a caveat from Jayant Patil, who is with the Sharad Pawar group. He also informed the panel that they have initiated a disqualification process against nine MLAs who joined the Eknath Shinde-BJP government in the state on Sunday.

The sources said action will be taken by the poll panel as per the extant legal framework.

They said ECI had received a petition under Para 15 of the Symbols Order, 1968 from Ajit Pawar on June 30, 2023 followed by 40 odd affidavits of MPs/MLAs/MLCs dated June 30 (received in Commission on July 5).

The sources said the poll panel also received a resolution unanimously electing Ajit Pawar as NCP president.

The parallel meetings came after the two factions announced crucial appointments to assert their control over the party.

The NCP faction led by Ajit Pawar has taken affidavits from party workers to show their allegiance at MET Bandra.

Addressing the gathering in Bandra meeting, Ajit Pawar took a swipe at his uncle urging him to step down and give a chance to the new generation.

“You (Sharad Pawar) give us your blessings…The other day, he went to the YB Chavan Memorial…I have also been there…but you are 83, aren’t you going to stop?… Give us your blessings and we will pray that you live a long life,” Ajit Pawar said.

Sharad Pawar group has moved a disqualification petition against the nine MLAs to Maharashtra Assembly Speaker Rahul Narwekar.

Apart from Ajit Pawar, Chhagan Bhujbal, Dilip Patil, Hasan Mushrif, Dhananjay Mundo, Dharmaraobaba Atram, Aditi Tatkare, Sanjay Bansode and Anil Patil joined Eknath Shinde-Devendra Fadnavis Maharashtra government as ministers on Sunday.

Sharad Pawar has also removed Praful Patel and Sunil Tatkare from the party for “anti-party activities”.

“Your actions of supporting Ajit Pawar and the eight other MLAs, who have sworn oath as Ministers in violation of the party’s direction and mandate, ex-facie amount to anti-party activities and that you deemed to have voluntarily left the membership of Nationalist Congress Party,” Pawar said in a communication which was also sent to the two party MPs.
