RS Adjourned Till 12 Noon Amid Oppo Uproar Over Manipur Issue

Rajya Sabha was adjourned till 12 noon on Tuesday with the Opposition parties continuing to press for their demand for a discussion on ethnic violence in Manipur by suspending other business of the day and a statement by Prime Minister Narendra Modi.

Soon after the House assembled for the day Aam Aadmi Party (AAP) MP Raghav Chadha raised a point of order and sought division over the suspension of party leader Sanjay Singh from the Rajya Sabha for the remainder of the monsoon session on Monday.
Rajya Sabha Chairman Jagdeep Dhankhar declined the request and took up the listed agenda amid opposition protests.

He said that he had received 51 notices from Opposition members under Rule 267 for a discussion on Manipur situation.

He said some notices were also received for discussion under Rule 167.

Leader of the House Piyush Goyal said there the government is ready to discuss on each issue, and appealed that there should also be short duration discussion on crime against women in Rajasthan and Chhattisgarh.

Congress leader P Chidambaram said that Rule 267 must take precedence over Rule 267 and the House should commence the discussion on the Manipur situation.

As the Opposition leaders continued sloganeering from their seats, Rajya Sabha Chairman adjourned the House till 12 noon

The Rajya Sabha faced a washout for the third consecutive day on Monday and failed to transact significant business due to adjournments forced by the opposition over their demands.

The Monsoon session of Parliament began on July 20 and will continue till August 11. (ANI)

Karnataka: Kaveri Water Enters Low-Lying Areas Of Kodagu

As monsoon rains continue to wreak havoc in Karnataka, water from the Kaveri River reached sections of the area’s low-lying Kodagu district and caused alarm among the residents, officials said on Tuesday.

According to District Authority Officials, heavy rain battered the Kodagu district in Karnataka as a result of which the Kaveri River (Cauvery) swelled and entered some of the low-lying areas of the district and alarmed the locals.

The heavy rainfall led to a significant rise in water inflow in the Harangi Reservoir in Kodagu, consequently, the Reservoir gates were opened to release a substantial volume of about 30,000 cusecs of water.

After 30,000 cusecs of water from Harangi Reservoir were released into the river, the water entered the Kushalanagar City area.

As a precautionary measure, all residents living downstream and alongside the river were advised by the district administration to relocate to safer areas, said officials.

District authority Officials visited the place as water seeped into the local’s residences and said that they had advised people to move to safer places as there was fear of water entering the low-lying areas.

The Harangi Dam is located near Hudgur village, Kushalnagar taluk in the Kodagu district of Karnataka.

The masonry dam is built across the river Harangi, a tributary of the Kaveri. The dam is located about 9 km away from the heart of Kushalnagar town.

On Monday, Karnataka Deputy Chief Minister DK Shivkumar visited the war toom of Bruhat Bengaluru Mahanagara Palike (BBMP) to analyse the rain situation around Bengaluru.

Notably, all schools in five talukas of Chikkamagaluru district stood closed on Monday amid the prediction of heavy rains in the region.

District Collector Chikkamagaluru, Meena Nagaraj said on Sunday, “Holiday in schools announced by district authority in 5 talukas of Chikkamagaluru district (NR Pura, Mudigere, Sringeri, Chikmagalur, Koppa) in view of heavy rain in the region.”

Earlier, heavy rains lashed parts of coastal Karnataka on Saturday.

India Meteorological Department (IMD) issued an Orange alert on Saturday evening for coastal Karnataka and predicted heavy rainfall in the region.

The MeT department has also issued a warning to the people living in the Coastal Karnataka region to avoid areas that are prone to waterlogging and asked them to stay away from vulnerable structures which might collapse due to incessant rains. (ANI)

Gyanvapi: Caveat Filed In Allahabad HC Over Direction For ASI Survey

A caveat petition in the Gyanvapi case was filed by Rakhi Singh, a petitioner from the Hindu side, in the Allahabad High Court on Monday,  on the order of Varanasi Court directing a survey of the sealed area on the mosque complex by the Archaeological Survey of India (ASI).

The caveat petition was filed through advocate Saurabh Tiwari through the e-filing mode.
Also the main petitioner in the Shringar Gauri Sthal case, Rakhi Singh also came out in support of the ASI survey at the Gyanvapi mosque complex.

In her caveat, Rakhi urged the Allahabad High Court not to give its judgment without hearing the petitioner should the Anjuman Intezamia Masjid Committee approach it challenging the July 21 order of the Varanasi court.

“It is therefore, most respectfully prayed that this Hon’ble Court may graciously be pleased to allow the application and may provide the opportunity of hearing before passing any order in favour of proposed Petitioner(s)/revisionist(s) and/or pass such other and further order , which this Hon’ble Court may deem fit and proper,” the caveat read.

Earlier, on Saturday, Rakhi Singh had filed a similar caveat in the matter.

On Monday, the Supreme Court ordered that Varanasi district court order of the Archaeological Survey of India (ASI) survey of the Gyanvapi mosque complex, adjacent to Kashi Vishwanath temples, shall not be enforced till 5 pm of July 26.

A bench headed by Chief Justice of India DY Chandrachud says that in the meantime mosque committee shall move the Allahabad High Court with its plea against the district court’s order.

The bench said the order was passed to give some breathing time to the Muslim side to approach the Allahabad High Court.

Gyanvapi mosque management committee, Anjuman Intezamia Masajid, mentioned the matter before the CJI seeking a stay on the July 21 order of the district court.

Senior advocate Huzefa Ahmadi sought a stay on the ASI survey of the mosque complex saying the top court had earlier stayed the carbon dating of the structure, claimed as “shivling” by the Hindi side, found in the ablution pond of the mosque during a court-mandated survey in May 2022.

“What is the tearing hurry, this place has been a mosque since the 1500s? there must be status quo order,” Ahmadi asked the bench.

During the hearing the apex court recorded the submissions of Solicitor General Tushar Mehta, appearing for Uttar Pradesh government, saying it appears ASI is not carrying out any excavation as ordered by the district court and no excavation is contemplated for a week.

Senior advocate Shyam Divan, appearing for the Hindi side, opposed a stay request of Muslim side saying let there should be exercise of caution on the issue and it must go to the High Court.

The Solicitor General has already said no excavations will be carried out, he said, adding that court is seized of the matter and when status quo order is made by Supreme Court it continues indefinitely.

On Friday, Varanasi district judge AK Vishvesha ordered the ASI survey of Gyanvapi complex on an application moved by four Hindu women on May 16, 2023.

The order of the district judge, however, excluded the ablution pond area of the complex, which has been sealed on the order of the top court.

On May 12 this year, the Allahabad High Court had allowed the scientific survey of this purported “shivling” but the top court stayed this order on May 19.

During the survey, a structure — claimed to be a “Shivling” by the Hindu side and a “fountain” by the Muslim side — was found in the mosque premises on May 16 last year during a court-mandated survey of the mosque located next to the Kashi Vishwanath temple.

The High Court on May 12 set aside the Varanasi District judge order which had rejected the application for a scientific survey and carbon dating of the “Shivling” on October 14, 2022.

The High Court had directed the Varanasi District judge to proceed, in accordance with law, on the application by the Hindu worshippers for conducting a scientific probe of the “Shivling”.

Petitioners Laxmi Devi and three others had filed a plea in the High Court, challenging the order lower court order. (ANI)

Mahabharata Set To Make Its UK Premiere At London’s Barbican Theatre

A new stage adaptation of the ancient Indian epic ‘Mahabharata’ is in the works. As per Variety, the stage adaptation of Mahabharata is all set to make its UK premiere at London’s Barbican Theatre this fall.

The retelling of the revered text, which follows a devastating family feud and explores profound philosophical and spiritual ideas, is from Canada’s Why Not Theatre and had its world premiere at The Shaw Festival Theatre in Niagara-on-the-Lake, Canada in March.
The production is presented in two parts and narrated by a storyteller (Miriam Fernandes). “Karma” (part 1), is the origin story of the rival Pandava and Kaurava clans. In “Dharma” (part 2), a great battle destroys the planet and the survivors are left behind to rebuild.

“Mahabharata” is performed by a company from across four continents, all from the South Asian diaspora. The cast includes UK-based performers Ajay Chhabra (“Rough Diamonds,” Netflix), Neil D’Souza (“How To Hold Your Breath,” Royal Court), Darren Kuppan (“Let The Right One In,” Manchester Royal Exchange), Goldy Notay (“Life of Pi,” U.K. tour) and Sakuntala Ramanee (“Life of Pi,” West End), who are joined by Canadian and other international performers Shawn Ahmed, Jay Emmanuel, Fernandes, Navtej Sandhu, Anaka Maharaj-Sandhu, Ellora Patnaik, Meher Pavri, Munish Sharma and Sukania Venugopal, and understudies Varun Guru, Karthik Kadam, Suma Nair, Ronica Sajnani and Ishan Sandhu.

The adaption is by Why Not Theatre’s founding artistic director Ravi Jain, who also directs, and co-artistic director Fernandes, using poetry from Carole Satyamurti’s “Mahabharata: A Modern Retelling.”

The original concept was developed with Jenny Koons. Set design is by Lorenzo Savoini, costume design by Gillian Gallow, lighting design by Kevin Lamotte, projections by Hana S Kim, sound design by John Gzowski and Suba Sankaran, original music by John Gzowski and Sankaran, with contributions from Dylan Bell, Gurtej Singh Hunjan, Zaheer-Abbas Janmohamed and Hasheel Lodhia, and choreography by Brandy Leary with contributions by Jay Emmanuel and Ellora Patnaik. SC Refuses To Stay delimitation Exercise Underway In Assam

The Supreme Court on Monday refused to stay the ongoing delimitation exercise underway in Assam but agreed to hear a challenge made to it by opposition leaders of the state.

A bench of Chief Justice of India DY Chandrachud and Justices JB Pardiwala and Manoj Misra issued notice to the Centre on the plea and asked Centre to file affidavit within three weeks.
Refusing to stay the delimitation process of Election Commission initiated in Assam, the bench said it wouldn’t issue any order restraining poll panel to take any further steps regarding delimitation exercise in the state.

“At this stage when delimitation has commended having due regard to issuance of the draft proposal on June 20, 2023, it would not be proper to interdict the process at this stage. Hence, while reserving the constitutional challenge, we are not issuing any orders restraining the Election Commission to take any further steps”, the apex court stated in its order.

The apex court was hearing a plea filed by ten opposition leaders from Assam challenging the recent draft proposal of the Election Commission of India (ECI) for the delimitation of Assam’s 126 Assembly constituencies and 14 Lok Sabha constituencies.

The petition also challenged Section 8A of the Representation of People Act, 1950 as per which the Election Commission is exercising its power in conducting the delimitation process.

The petitioners filing the petition through advocate advocate Fuzail Ahmad Ayyubi challenged the provision on the grounds of the same being arbitrary and opaque apart from also being discriminatory to the State of Assam.

The petitioners who have filed the petition are Lurinjyoti Gogoi (Assam Jatiya Parishad), Debabrata Saikia (INC), Rokibul Hussain (INC), Akhil Gogoi (Raijor Dal), Manoranjan Talukdar (CPI(M)), Ghanakanta Chutia (Trinamool Congress), Munin Mahanta (CPI), Diganta Konwar (Anchalik Gana Morcha), Mahendra Bhuyan (Nationalist Congress Party), and Swarna Hazarika (Rashtriya Janata Dal).

The petitioners have challenged recent proposals of the ECI readjusting the extent of 126 Assembly and 14 Lok Sabha Constituencies in Assam by a draft order issued on June 20.

The petition challenged the methodology adopted by the ECI by taking different Average Assembly Size for different districts and argues that population density or populous-ness has no role to play in the process of delimitation.

“While the Constitution of India envisages an exercise whereby Constituencies are to be readjusted so as to ensure that all constituencies are comprised of an almost equal population, by relying on 2001 census figures, the Election Commission has created three categories of districts and has taken different yardstick for the three categories resulting in possible deviation of up to 33 per cent between the population of largest and smallest constituency,” the petition stated.

Petition contended that delimitation for the rest of the country has been conducted by a high powered body headed by a retired Supreme Court Judge and the same Commission was formed for Jammu and Kashmir as well.

“However, the provision of Section 8A discriminates against Assam and three North-Eastern States, for which the Election Commission has been prescribed as the authority to conduct delimitation,” it further stated.

The petition has also highlighted certain statements of the Chief Minister of Assam who has publicly stated that the present exercise will be beneficial to one party i.e., BJP while being damaging to other opposition parties.

Such statements, the petition submitted, while do not inspire any confidence in the exercise, also give rise to apprehensions that the ECI exercise has not been independent and has been heavily dictated by the State government, it added.

The apex court is also seized of two PILs regarding the delimitation of four North-Eastern States including Assam.

In December of last year, the Election Commission began the delimitation of Assembly and Parliamentary Constituencies in Assam by using 2001 Census as per Section 8A of the Representation of the People Act, 1950. (ANI)

No Headway In Identification of source in hoax threats calls to Indian airlines

Parliamentary Panel Recommends Special Airline Wing For Unruly Passengers

A Parliamentary Committee on Monday recommended a special airline wing to deal with cases related to onboard unruly passengers.

The Department related to the Standing Committee for Transport, Tourism and Culture has tabled its report on the development of greenfield and brownfield airports and issues pertaining to the civil enclave in defence airports in parliament on Monday.
According to the reports, a special airline wing should be formed for dealing with police and courts in cases of unruly passengers since at present, the pilot and crew members have to attend the court and visit police stations for prosecuting the unruly passenger.

The Ministry may also coordinate with the concerned departments to ensure that any victims of unruly passengers are not required to physically visit distant police stations and courts in pursuance of legal remedy in such cases.

Members of the committee, in its meeting held on January 30 this year, highlighted the issue of victim passenger and cabin crew having to make several visits to a non-local police station.

The committee appreciated that the Directorate General of Civil Aviation (DGCA) has issued CAR, Section 3- Air Transport, Series M, and Part VI titled “Handling of unruly /disruptive passengers”, specifying detailed procedures for the airlines to follow in case of incidents of unruly behaviour by passengers during flights.

The Committee recommended that the DGCA may enforce a zero-tolerance policy for incidents of unruly behaviour by passengers and strict implementation of the ‘No-Fly List’ may be ensured. DGCA may periodically review the SOPs and emergency procedures manuals framed by the airline companies in this regard, to ensure the compliance of DGCA norms.

In the past few months, there have been numerous untoward incidents involving verbal and physical altercations either among passengers or between passengers and the flight crew.

These incidents have brought to light the importance of ensuring a mechanism to prevent and deter such fights, especially mid-flight, which impact the overall safety of passengers and flight crew, the report reads. (ANI)
