Azam Khan, Wife, Son Given Seven-Year Jail

A court in Uttar Pradesh’s Rampur on Wednesday convicted Samajwadi Party leader Mohammed Abdullah Azam Khan, his wife Tanzeem Fatima, and son Abdullah Azam Khan in a fake birth certificate case.

The court awarded a seven-year jail term and a fine of Rs 15,000 to all three of them.

Speaking of the court’s judgement, former DGS (Crime) Arun Saxena said, “Abdullah Azam Khan had two birth certificates. Akash Saxena filed a FIR. After the probe, the charge sheet was filed. The court has given its judgement today and all three people were found guilty. On the conviction point, the court sentenced all three to a maximum of seven years’ imprisonment. Approximately a fine of Rs 15,000 has also been imposed.”

The former DGC further said that Azad Khan’s first birth certificate is of January 1, 1993, while the other birth certificate was made from Lucknow in which his birth date is September 30, 1990

The Supreme Court on September 26 referred to the District Judge, Muradabad for addressing the question relating to the correct date of birth of the petitioner Khan and send a finding to this Court for further consideration in the matter.

The court had noted that the correct date of birth relating to the petitioner is relevant for the ultimate consideration of the issues raised and to decide the juvenility.

Abdullah Azam Khan had moved the Supreme Court against a recent Allahabad HC order that refused to stay his in connection with a 2008 protest case, which led to his disqualification as an MLA from the Uttar Pradesh assembly.

Khan claiming that he was a juvenile as of the date of the incident, has challenged the Allahabad High Court order dated March 17.

Mohammed Abdullah Azam Khan was disqualified from the UP Legislative Assembly after he was convicted and sentenced to two years’ imprisonment in a 15-year-old case. Abdulla Azam Khan was representing Suar in Rampur district in the Assembly.

Abdullah Azam Khan, and his father, were convicted by a local court in Uttar Pradesh of allegedly using criminal force to deter a public servant from discharge of his duty and other provisions of the Indian Penal Code (IPC) in a matter pertaining to a dharna on a state highway in January 2008. SC Gives No Interim Relief To Azam Khan

The Supreme Court on Wednesday refused to give any interim relief to Samajwadi Party leader Mohammad Abdullah Azam Khan in a matter related to the protest case.

A bench of justices MM Sundresh and PK Mishra posted the matter for further hearing after the report on juvenility is filed.

The top court on September 26 has referred to the District Judge, Muradabad for addressing the question relating to the correct date of birth of the petitioner Khan and send a finding to this Court for further consideration in the matter.

The court had noted that the correct date of birth relating to the petitioner is relevant for ultimate consideration of the issues raised and to decide the juvenility.

The court was hearing SP leader Mohammad Abdullah Azam Khan plea challenging Allahabad High Court order which rejected his plea seeking stay on his conviction in a matter related to protest case.

Recently, Allahabad High Court has refused to stay the conviction of Mohammad Abdullah Azam Khan in connection with a 2008 protest case, which led to his disqualification as an MLA from the Uttar Pradesh assembly.

The Supreme Court had earlier requested the Allahabad High Court to decide at earliest Mohammad Abdullah Azam Khan plea seeking stay of his conviction in a matter related to protest.

Abdullah Azam Khan moved Allahabad High Court against trial court order seeking suspension of his sentence.

In the plea, Abdullah Khan apprised the court that on March 17, High Court of Allahabad after perusing the Application preferred by the Petitioner granted the Respondent State a time period of 3 weeks to file counter affidavit, however, failed to appreciate the fact that if the Application is not decided expeditiously then the same would be rendered infructuous and the Petitioner would suffer irreparable harm.

On February 13, Trial Court convicted Abdullah Azam Khan for offences punishable under Section 353, 341 IPC and 7 Criminal Law Amendment Act, 1932, and sentenced him to undergo two years of simple imprisonment.

Subsequent to the order of the Trial Court on February 13, 2023 convicting Khan, the Assembly Secretariat, Uttar Pradesh Legislative Assembly on February 15 notified that the Constituency Seat of Suar, District Rampur of the Uttar Pradesh Legislative Assembly has become vacant.

The Petitioner appealed to the Court of Additional Sessions Judge, Rampur against the order of the Trial Court and also filed an application for stay of conviction and sentence. However, the Sessions Court dismissed the said application on February 28. Thereafter, the Petitioner approached the High Court against the order.

The petitioner said that he believes that during the pendency of the Application before the High Court, by-election to the Rampur constituency would be announced.

The petitioner said he is concerned that if such an announcement is made and thereafter, the High Court passes a stay order the same would be rendered moot due to the announcement of the by-elections. (ANI)

IT Raids On Locations Linked To SP Leader Azam Khan

The Income Tax department on Wednesday morning conducted searches at multiple premises linked to Samajwadi Party (SP) leader Azam Khan in Uttar Pradesh, sources said.

Teams of IT personnel reached cities including Rampur, Meerut, Lucknow, Ghaziabad, Saharanpur and Sitapur to raid multiple premises linked to the Samajwadi Party leader.

Azam Khan was elected MLA from the Rampur Sadar constituency.

The state Assembly Secretariat, earlier in October, announced Khan’s disqualification from the House after a court sentenced him to three years in jail in a hate speech case.

The case was registered against Khan in April 2019 for levelling serious allegations against administrative officials posted in Rampur, Prime Minister Narendra Modi and Uttar Pradesh Chief Minister Yogi Adityanath during an election meeting.

During the 2019 Lok Sabha elections, Khan was booked for making inflammatory speeches while addressing a public meeting in Khatanagaria village of the Milak Kotwali area.

Earlier Allahabad High Court in May 2022 had granted interim bail to Azam Khan in a matter which was related to a wrongful possession of Waqf board property land. 

Azam Khan began his political career by winning the 1980 assembly election on Janata Party (Secular) ticket from Rampur. He has served as a minister in both Akhilesh Yadav and Mulayam Singh Yadav governments. (ANI)

SC Declines Azam Khan’s Plea Seeking To Transfer Cases Out Of UP

Supreme Court on Wednesday declined to entertain Samajwadi Party leader Azam Khan’s plea seeking to transfer certain cases against him from Uttar Pradesh to another state.

The Supreme Court asked Azam Khan to approach the concerned High Court and directed that his petition may be taken up on an expeditious basis.
The SP leader is currently facing nearly 90 cases including a case of hate speech, corruption, and theft.

The Uttar Pradesh Legislative Assembly Secretariat earlier in October announced the disqualification of Khan from the House after a court sentenced him to three years in jail in a hate speech case.

The case of hate speech was registered against Azam Khan in April 2019 for levelling serious allegations against administrative officials posted in Rampur, Prime Minister Narendra Modi, and Uttar Pradesh Chief Minister Yogi Adityanath during an election meeting.

During the 2019 Lok Sabha elections, Khan was booked for making inflammatory speeches while addressing a public meeting in Khatanagaria village of the Milak Kotwali area.

A video of Khan’s statement also surfaced on social media. Khan was released from jail earlier this year after the Supreme Court granted him an interim bail in a cheating case. He spent nearly two years in jail.

He had won the Rampur Sadar Assembly seat in the last UP Assembly polls for a record 10th time.

After becoming an MLA, he resigned from the Lok Sabha. In June this year, BJP’s Ghanshyam Lodhi wrested the Rampur parliamentary seat from the Samajwadi Party, defeating his nearest rival by over 42,000 votes in a bypoll. (ANI)

Azam Khan Disqualified From UP Assembly Membership

SP leader and Rampur MLA Azam Khan were on Friday disqualified from the membership of the Uttar Pradesh Legislative Assembly, as per the Office of UP Assembly Speaker, a day after he was sentenced to 3 years in prison along with a fine of Rs 2,000 in a hate speech case of 2019.

Khan has been sentenced to three years in prison in a 2019 hate speech case by the Rampur District court, and he lost his Assembly membership as his eventual imprisonment term is longer than two years.
The SP leader lost his MLA post because as per the 2013 Supreme Court judgment if an MLA, MLC, or MP is convicted in a criminal case and gets jailed for a minimum of two years then he/she loses membership of the house with immediately effect.

Azam Khan won the 2019 Lok Sabha election from Rampur (UP) but he vacated this seat after being elected to the UP state assembly in March 2022. The SP leader had won the 2022 assembly election from Rampur while being lodged in Sitapur jail.

Earlier on Thursday, the Samajwadi Party leader and two other accused were sentenced to three years in prison along with a fine of Rs 2,000 in a hate speech case filed against him over his speech against UP Chief Minister Yogi Adityanath. However, he has been granted bail and given a week’s time to appeal against the sentence.

A case was registered against Khan in Rampur in April 2019 for allegedly making provocative remarks against the Uttar Pradesh CM and the then District Magistrate of Rampur, Aunjaneya Kumar Singh.

During the 2019 Lok Sabha election campaign, Khan had used provocative remarks against the then Rampur district magistrate Aunjaneya Kumar Singh, chief minister Yogi Adityanath, Prime Minister Narendra Modi, and Congress candidate Sanjay Kapoor.

Earlier this year, Azam Khan was released from Sitapur district jail, a day after the Supreme Court granted him interim bail in an alleged case of cheating.

The SP leader was also granted bail in a cheating case lodged at the police station in Rampur.

Khan has been lodged in Sitapur jail since February 2020 as many cases are registered against him.

Earlier, in a big relief to the SP leader, the Allahabad High Court on October 1, 2022, had put his arrest on hold. The matter pertains to the disappearance of machines used for construction in 2017 for which a case was registered on September 19, this year.

A person named Baqur Khan brought the case to the fore. The missing machinery including bulldozers, carriers, and other materials was later found on the premises of Muhammad Ali Jauhar University. The Allahabad HC also sought a reply from the Uttar Pradesh government on this matter.

On May 10, 2022, the Allahabad HC granted interim bail to Khan in a case related to wrongful possession of Waqf Board property.

Azam Khan Convicted For Hate Speech Against Yogi

Samajwadi Party leader Azam Khan was on Thursday convicted by a court in Uttar Pradesh in a hate speech case filed against him over his comments against state Chief Minister Yogi Adityanath.

The Rampur court today convicted the Samajwadi Party’s senior leader and is expected to pronounce the quantum of the sentence at 3 pm today.
A case was registered against Khan in Rampur in April 2019, for allegedly making provocative remarks against the Uttar Pradesh CM and the then District Magistrate of Rampur, Anjaneya Kumar Singh.

‘Rampur, Azamgarh By-polls Prove Voter’s Trust In CM Yogi’

Ashok Vishnoi, BJP’s district general secretary of Rampur, UP, says days of dynastic politics in Uttar Pradesh are over. Here, in his own words:

The BJP is overwhelmed with the results of recent by-polls in Uttar Pradesh. We have wrested the two Lok Sabha seats of Rampur and Azamgarh which were once considered the pocket borough of Samajwadi Party leader Azam Khan.

The victory has sent a message – by and large – that nothing is permanent in politics. And any political change can only be brought by tireless working for janata, the people, the electorate. Prime Minister Narendra Modi gave us a mantra: Thakna nahi hai, rukna nahi hai (Forget the fatigue, work without a break). And following his advice, the BJP cadre in Rampur has rolled the dice in our favour.

While Azam Khan was not at his venomous best, having drawn lessons from Election Commission action earlier, Samajwadi Party chief Akhilesh thought it would be a cakewalk. Little did they realise that things have changed under Yogi Adityanath’s rule. The BJP has given them a rude shock for their complacency and laidback attitude.

Chief Minister Adityanathji, along with a team of 16 ministers, made it a point to reach out to every nook and corner of the constituency, and made the electorate aware about his work and future plans, coupled with the near absence of the so-called ‘entitled rulers’ of Rampur, turned the tide in BJP favour.

The by-poll results have once again proved that the people have faith in Yogi Adityanathji and Narendra Modiji. It is not only the victory of our candidates but the victory of BJP’s ethics and work culture.

Another thing which the results have thrown up is that caste politics and appeasement policies are fading away. The voter has woken up. The victory (both in Rampur and Azamgarh) has sent a message loud and clear: blocks of Muslim-Yadav, Pandits, OBCs, SCs, and STs are a passé. If you want to win, you need to first win their hearts and address to their concerns. It was not a fight of Lodhis, Jatavs, Yadavs, Muslims and others this time. It was about the people and their basic needs.

The voter knew who would come to respond to their concerns. They would not vote for the dynasts and their representative who have done little to address their issues for years. The results are all about ridding the constituency of one-family business. After all, if their elected ‘leader’ is a serial offender and a frequent visitor to jail, who will stand by them in the times of a crisis?

At the same time, it has brought a huge responsibility on our shoulders. If the BJP leaders fail to deliver on their promises, or do not live up to the expectations of the voter, we too shall lose the plot sooner than later. We must not be complacent; we have to sustain the voters’ trust in us and that is our challenge
