Decision On 16 MLAs Of Shinde Camp Won’t Be Under Pressure: Narwekar

Maharashtra Assembly Speaker Rahul Narwekar on Tuesday said that he will decide on the disqualification of 16 Shiv Sena MLAs of Chief Minister Eknath Shinde’s camp on the basis of law and no decision will be taken under pressure.

“I welcome the decision of the Supreme Court, which has given special powers to the Assembly Speaker while giving its verdict in the case of disqualification of 16 MLAs of Maharashtra government,” Narwekar said.
He further said, “As far as decision-making is concerned, I will take this decision as soon as possible. But I will not be in a hurry to take this decision, if I take any decision in haste then it will not be correct.”

Narwekar said that he would not take a decision under anyone’s pressure

“I will take as much time as it takes to take a decision, I will not take a decision under anyone’s pressure. I will take a decision according to the law. It took more than 10 months for the court to take a decision,” he said.

Rahul Narwekar informed that he has not received any application from the Uddhav Thackeray group. He said that there will be no discrimination while taking the decision on the disqualification of the 16 MLAs.

Earlier on Tuesday, the Speaker held a meeting with the officials of Maharashtra Vidhan Bhavan.

Narwekar said that five petitions have been filed. “We will make 54 MLAs a party and get them heard. Which political party was there in July 2022…it has to be seen who was representing the authorized party,” he said.

Last week, the Supreme Court held that former Maharashtra Governor Bhagat Singh Koshyari was “not justified” to call for a floor test based on the request of Eknath Shinde faction since he did not have enough objective material before him to conclude that the then Chief Minister Uddhav Thackeray had lost the confidence of the House.

A five-judge Constitution bench of Chief Justice of India DY Chandrachud and Justices MR Shah, Justice Krishna Murari, Justice Hima Kohli and PS Narasimha said it could not disqualify the Eknath Shinde-led Maharashtra government and reinstate Uddhav Thackeray as Chief Minster because the latter had chosen to resign instead of facing a test of strength in the Assembly.

The court said the political imbroglio in Maharashtra arose as a result of party differences within the Shiv Sena.

The judgement of the apex court came on a batch of petitions filed by rival groups of the Shiv Sena in relation to the Maharashtra political crisis.

The Whip has to be appointed by a political party, the top court said. The apex court held that the Speaker’s decision to appoint Bharat Gogawale (Eknath Shinde) as the whip of the Shiv Sena party was illegal.

“The political party and not the legislature party appoints the Whip and the Leader of the party in the House. Further, the direction to vote in a particular manner or to abstain from voting is issued by the political party and not the legislature party. The decision of the Speaker as communicated by the Deputy Secretary to the Maharashtra Legislative Assembly dated July 3, 2022, is contrary to law.

The Speaker shall recognise the Whip and the Leader who are duly authorised by the Shiv Sena political party with reference to the provisions of the party constitution, after conducting an enquiry in this regard and in keeping with the principles discussed in this judgement,” it held.

The apex court further said that the Speaker must decide on disqualification petitions within a reasonable time.

It also said that MLA has the right to participate in the proceedings of the House regardless of the pendency of any petitions for their disqualification.

In August last year, the top court’s three-judge bench had referred to a five-judge Constitution bench the issues involved in the petition filed by rival groups of Shiv Sena in relation to the Maharashtra political crisis.

On June 29, 2022, the top court gave a go-ahead to the floor test in the Maharashtra Assembly on June 30. It had refused to stay the Maharashtra Governor’s direction to the then Chief Minister Uddhav Thackeray to prove his majority support on the floor of the House on June 30.

After the apex court’s order, Uddhav Thackeray announced his resignation as the Chief Minister and Eknath Shinde was later sworn in as the Chief Minister. (ANI)

Umesh Murder: Lookout Notice Issued Against Shaista, Guddu, Sabir

Prayagraj police have issued lookout notices against slain gangster Atiq Ahmed’s wife Shaista Parveen, and his close aides, Guddu Muslim and Sabir, officials said.

According to officials, Uttar Pradesh police have already declared a bounty of Rs 50,000 in the name of Shaista Parveen.
Despite efforts, the police are not able to trace Parveen and the other two. In such a situation, officials are of the view that they may run out of the country.

This, in turn, has prompted authorities to issue lookout notices against all three of them. Officials said that Prayagraj Police had earlier sent its report in this regard to the Uttar Pradesh government.

And on the basis of this, a lookout notice has been issued against them to prevent them from leaving the country. The notice period will be for 1 year.

The lookout notice has been sent to all immigration checkpoints, and if they are caught while trying to flee out of the country, Prayagraj police will receive an alert from the agencies concerned.

On April 9, the UP police doubled the reward on Shaista Parveen, slain gangster Atiq Ahmed’s wife. She carries a Rs 50,000 reward on her. UP police on April 19 conducted raids in Uttar Pradesh’s Kaushambi in search of Shaista.

According to the police, search operations are still underway in Uttar Pradesh’s Prayagraj and nearby localities. With the killing of Atiq Ahmed and his brother Ashraf and also the death of Atiq’s son Azad Ahmed in an encounter with the STF on April 13, Shaista has been on the run ever since.

Earlier on April 25, Atiq’s brother-in-law, Akhlaq Ahmed, a health department doctor allegedly involved in unethical activities, was suspended by the Uttar Pradesh government.

Dr Akhlaq Ahmed is currently lodged in Prayagraj’s Naini Jail. He was posted at Bhavanpur Community Health Center in Meerut. Dr Akhlaq Ahmed is accused of providing explosives to absconding shooters and sheltering Guddu Muslim after the murder of Umesh Pal in Prayagraj.

Karnataka Deputy CM DK Shivakumar

K’taka CM: Siddaramaiah, Shivakumar In Delhi Today, Cong To Decide

Despite Congress’ clear mandate in the Karnataka assembly polls, suspense over chief minster continues with Karnataka Congress president D K Shivakumar, one of the two contenders to the post, scheduled to arrive in Delhi later on Tuesday ahead of an announcement by the party.

Congress leader Siddaramaiah, the other frontrunner for the chief minister’s post, had arrived in the national capital on Monday.
Shivakumar, who celebrated his birthday yesterday had stayed behind in Bengaluru citing a stomach infection. Both he and Siddaramaiah had been called to Delhi by the top leadership of the AICC for a discussion. The Congress won 135 seats in the 224-member Karnataka assembly.

The party’s central observers for Karnataka had yesterday briefed Congress president Mallikarjun Kharge on the views of the newly elected MLAs. According to party sources, Kharge will consult Sonia Gandhi, Rahul Gandhi and Priyanka Gandhi Vadra before announcing a final decision.

“The name of the next Karnataka CM will be announced in the coming 24 hours,” they said.

The Congress legislative party had met late evening on Sunday in Bengaluru and passed a one-line resolution empowering Congress chief Mallikarjun Kharge to pick the head of the legislative party.

On Monday, Shivakumar said that all the MLAs are together and the call on the chief minister will be taken by the party’s high command.

Speaking to ANI, Shivakumar said, “The party high command will take a call. I don’t want to comment or speak anything more. Whatever I had to speak, I have spoken already. I do not want MLAs (support)…that is not important to me. Ours is a Congress block. 135 is the number and one more ally member. We all are one and will work together”.

Meanwhile, Congress veteran Siddaramaiah met with the top leadership of the All India Congress Committee (AICC) at Delhi’s Lodhi Hotel late on Monday night.

Siddaramaiah, who served as chief minister of Karnataka from 2013-2018, however, remained tight-lipped on the meeting and did not interact with the reporters.

DK Shivakumar’s brother DK Suresh arrived in Delhi on Monday evening and met with AICC President Mallikarjun Kharge at the latter’s residence.

“I have met the AICC chief. I meet him whenever I come to Delhi. The same way I met him today. Our AICC general secretaries will let you know about other issues,” Suresh told reporters. (ANI)
