Congress president Mallikarjun Kharge on Friday hailed the Supreme Court’s stay on Rahul Gandhi’s conviction in a 2019 defamation case and called it a victory of democracy and the Constitution, adding that it will be seen how long will it take to reinstate him after the Supreme Court relief.

“Satyameva Jayate….we all are happy and welcome the judgement of the Supreme Court. It is not only the victory of Rahul Gandhi but a victory of democracy and the Constitution…It’s a victory of people. Rahul Gandhi was disqualified within 24 hours. Let’s see in how many hours is he reinstated,” Kharge said while addressing a press conference in the national capital.

The Congress said the apex court judgment “is a strong vindication of truth and justice”.

Adhir Ranjan Chowdhury said he will write to the Lok Sabha Speaker Om Birla to revoke the disqualification of Rahul Gandhi from the House following the apex court order.

“It’s a happy day…I will write and speak to Lok Sabha Speaker today itself,” Adhir Ranjan Chowdhury told ANI.

“This is the victory of truth. This will prove costly for Prime Minister,” he said.

Chowdhury sought to raise the demand for revocation of Rahul Gandhi’s disqualification in Lok Sabha on Friday.

He said he will also make the demand on Monday.

“We were overjoyed when the SC pronounced its decision. Rahul Gandhi’s absence from the Parliament was felt. Through Point Of Information, I told the Chairman in the Parliament about the SC’s decision & said that his membership should be reinstated at the earliest…Truth won today…,” he added.

Congress general secretary Jairam Ramesh said Rahul Gandhi has “refused to bend” despite the relentless efforts of the BJP.

“The Supreme Court judgment is a strong vindication of truth and justice. Despite the relentless efforts of the BJPs machinery, @RahulGandhi has refused to bend, break or bow, choosing instead to place his faith in the judicial process,” Jairam Ramesh said in a tweet.

After his conviction in the case, Gandhi was declared disqualified as MP from Kerala’s Wayanad on March 24 following notification of the Lok Sabha Secretariat.

The apex court, while granting relief to Gandhi, said the ramifications of the trial court’s order are wide.

Not only was Gandhi’s right to continue in public life affected but also that of the electorate who elected him, the bench said.

Congress leader was sentenced to two years in jail on March 23 under sections 499 and 500 (defamation) of the Indian Penal Code (IPC) in a case filed by Purnesh Modi.

At a rally in Karnataka’s Kolar in April 2019, Rahul Gandhi, in a dig at Prime Minister Narendra Modi, said, “How come all the thieves have Modi as the common surname?”(ANI)

Anusandhan National Research Foundation Bill 2023 Introduced In LS

The Anusandhan National Research Foundation Bill, 2023 was introduced in the Lok Sabha on Friday by Union Minister of Science and Technology Dr Jitendra Singh.

The Bill, after being passed by both Houses of the Parliament, seeks to establish a research foundation that will seed, grow and promote Research and Development (R&D) and foster a culture of research and innovation throughout India’s universities, colleges, research institutions, and R&D laboratories.

The bill, after approval in the Parliament, will establish the National Research Foundation (NRF), an apex body to provide high-level strategic direction of scientific research in the country as per recommendations of the National Education Policy (NEP), at a total estimated cost of Rs. 50,000 crore during five years (2023-28), a release from the Ministry of Science and Technology stated.

The Department of Science and Technology (DST) will be the administrative Department of NRF which will be governed by a Governing Board consisting of eminent researchers and professionals across disciplines.

The Prime Minister will be the ex-officio President of the Board and the Union Minister of Science and Technology and Union Minister of Education will be the ex-officio Vice-Presidents. NRF’s functioning will be governed by an Executive Council chaired by the Principal Scientific Adviser to the Government of India, the press note stated.

NRF will forge collaborations among the industry, academia, and government departments and research institutions, and create an interface mechanism for participation and contribution of industries and State governments in addition to the scientific and line ministries.

It will focus on creating a policy framework and putting in place regulatory processes that can encourage collaboration and increased spending by the industry on R&D, the press release stated.

The bill will also repeal the Science and Engineering Research Board (SERB) established by an act of Parliament in 2008 and subsume it into NRF which has an expanded mandate and covers activities over and above the activities of SERB. (ANI)

SC Declines To Stay Scientific Survey By ASI Of Gyanvapi Premises

The Supreme Court on Friday declined to stay the scientific survey by Archaeological Survey of India (ASI) of the Gyanvapi mosque premises in Varanasi.

A bench headed by Chief Justice of India DY Chandrachud said that ASI has clarified that the entire survey would be completed without any excavation and without causing any damage to the structure.

The entire process of scientific survey shall be concluded with non-invasive methodology, the bench ordered.

“We reiterate the direction of High Court that there shall be no excavation,” said the Supreme Court.

The bench noted that Chief Justice of Allahabad High Court took note of the affidavit of ASI that it is not carrying out any excavation during its survey and no part of wall etc. will be touched.

The Anjuman Intezamia Masjid Committee has challenged the Allahabad High Court order allowing ASI to conduct scientific survey by ASI of the Gyanvapi mosque premises.

During the hearing, senior advocate Huzefa Ahmad appearing for mosque committee objected to the survey saying if someone now comes and files a frivolous plea saying that there is a monument below this structure, will the court order ASI survey?

To this CJI DY Chandrachud replied, “What is frivolous to you is faith to other side.”

Solicitor General Tushar Mehta for Uttar Pradesh said ASI affidavit before the High Court says no drilling, cutting of stone will be done from the existing structure, no wall or structure will be damaged and it will be done by the non-destructive method.

Huzefa said when you conduct survey, it is like uncovering wounds of the past and that is what Places of Worship Act sought to injunct. “You are unravelling wounds of past here,” he said.

Justice Pardiwala told Huzefa that despite assuring that there will be no harm to the structure, you are opposed to the survey.

“This survey will be in form of a report. Tomorrow, if you succeed on maintainability, it will just be a piece of paper. Let the survey be undertaken by the ASI,” Justice Pardiwala said.

Ahmadi told the Supreme Court that something very unfortunate happened, when the matter was pending before the court, a statement was made by Chief Minister of Uttar Pradesh Yogi Adityanath on the issue. “You are the State. You are supposed to be non-partisan in the suit. The statement came while the appeal was being heard,” he added.

Senior advocate Madhvi Diwan appearing for some Hindu petitioners told the apex court that survey is not determinative or adversarial because it can go either way. It’s a chance we are also taking, we don’t know at this stage what the survey would show, she said.

Allahabad High Court dismissed the plea filed by Muslim party challenging the Varanasi court order allowing the ASI to conduct a scientific survey of the Gyanvapi mosque premises, except the ‘Wazukhana’ area where a “Shivling” was claimed to have been found last year.

Chief Justice of High Court Pritinker Diwaker passed the order, noting that scientific survey is important in the interest of justice.

On July 24, the top court put on hold till July 26 a detailed scientific survey by the ASI to determine if the mosque located next to the Kashi Vishwanath temple in Varanasi was built upon a temple.

On July 21, Varanasi district judge AK Vishvesha ordered the ASI survey of Gyanvapi complex on an application moved by four Hindu women on May 16, 2023.

The order of the district judge, however, excluded the ablution pond area of the complex, which has been sealed on the order of the top court.

On May 12 this year, the Allahabad High Court had allowed the scientific survey of this purported “Shivling” but the top court stayed this order on May 19.

During the survey, a structure — claimed to be a “Shivling” by the Hindu side and a “fountain” by the Muslim side — was found in the mosque premises on May 16 last year during a court-mandated survey of the mosque located next to the Kashi Vishwanath temple.

The High Court on May 12 set aside the Varanasi District judge order which had rejected the application for a scientific survey and carbon dating of the “Shivling” on October 14, 2022.

The High Court had directed the Varanasi District judge to proceed, in accordance with law, on the application by the Hindu worshippers for conducting a scientific probe of the “Shivling”.

Petitioners Laxmi Devi and three others had filed a plea in the High Court, challenging the order lower court order. (ANI)

LS Passes Bill That Seeks To Give Push To Theaterisation

Lok Sabha on Friday passed a bill to empower commanders of inter-services organisations to exercise disciplinary or administrative control over personnel of the army, air force and navy serving under their command with Defence Minister Rajnath Singh stating that the legislation is an important step in the direction of military reforms.  

The Defence Minister moved the Inter-Services Organisations (Command, Control and Discipline) Bill, 2023 for passage in the House amid opposition protests over their demands related to Manipur debate.

Before the minister moved the bill for passage, he urged the Chair to allow him to speak from another seat. Rajendra Agrawal, who was in the Chair, said it is not a good situation in the House that the minister has to speak from another seat.

The bill is seen as a step towards theaterisation to optimize military resources.

Speaking on the bill, Rajnath Singh said it promotes jointness and provides better disciplinary and administrative powers to commander of inter-services organisations.

“I want to assure the House that this bill is an important step in the direction of military reforms. This bill does not include any additional financial implications,” he said.

Rajnath Singh said that at present the service personnel of Air Force, Army and Navy are governed by the provisions of the Air Force Act, 1950, the Army Act, 1950 and the Navy Act, 1957 and only officers of the respective services are empowered to exercise disciplinary powers over the service personnel under the respective Service Acts.

He said the Bill will essentially be an enabling legislation, which empowers the Heads of the Inter-services Organisations to exercise effective command, control and discipline on all personnel of regular Air Force, Army and Navy and to persons of other forces as notified by the Central Government, who are serving in or attached to an Inter-services Organisation, without amending the respective Acts. Actors Alia Bhatt and Ranveer Singh are overjoyed with the success of their film ‘Rocky aur Rani Kii Prem Kahaani’ and shared some interesting memories from the sets of the film.

Alia also spoke about the shooting of the wedding sequence in the film and the similarities and dissimilarities between real and reel marriage. 

Karan Johar and the entire cast talked about the movie and opened up about the shooting experience at the success party of the movie. A full video of the ‘Kudmayi’ song which brings out the grandeur of Rocky and Rani’s wedding was also released by the makers.

Ranbir Kapoor and Alia tied the knot in April 2022. During the shooting of the wedding sequence, Ranveer Singh went on his knees and in a similar way at the time of Varmala, Ranbir was lifted up and Alia was looking around so that someone picks her up, when Ranbir noticed this, he went down on his knees and bowed his so that she can put Varmaala on him.

Alia shared, “‘Kudmayi’ song was shot just four days after my marriage. But both were different as my home wedding was very simple, I was wearing a light sari and everything was so simple. I was roaming around very freely. However, in the reel wedding, I was wearing a heavy lehenga along with a heavy dupatta so I am very grateful that my real wedding was so simple as I cannot do those things twice.”

She added, “When Rocky and Rani were taking phere, someone said, ‘ladka aage jaata hai’, and I was like, ‘nahi ladki aage jaati hai, mai abhi abhi karke aayi hu. This was really an unforgettable moment.”

Alia continued, “In the scene where Ranveer goes down and bows his head so that I can put the Varmaala, that actually happened in my real marriage. When Ranbir was lifted up during the Varmala ceremony, I was looking around as no one was picking me up and then Ranbir went down his head and bowed his head so that I can put the Varmaala on him. So, everything happens very close to each other.”

Ranveer also added that the most fulfilling moment for him was watching the film with his wife Deepika Padukone.

Answering a question about Deepika’s reaction to his Kathak dance sequence in the film, he replied, “She loved it. I can say it was one of the most memorable and fulfilling movie-watching experiences of my life. I took her on a Saturday night to watch ‘Rocky Aur Rani Kii Prem Kahaani’. It was just the two of us. I had already watched the film and this time I wanted to see her reaction after watching the film. She was crying, laughing, clapping, whistling and sometimes turning around at me and saying, “aww..” She is proud of me and it was really a fulfilling moment for me.”

Filmmaker Karan Johar also informed the media that Alia got married twice in a week. “We shot the wedding sequence of Alia and Ranveer Singh in the movie just after four days of Alia and Ranbir’s marriage. Alia got married two times in the same week, one real and the other the reel one.”

‘Rocky Aur Rani Kii Prem Kahaani’ features Alia Bhatt, Ranveer Singh, Dharmendra, Shabana Azmi and Jaya Bachchan feature in the lead roles in the film. The film grabbed the eyeballs for many reasons and one of them was the kissing scene between Dharmendra and Shabana Azmi. (ANI)

Modi To Lay Foundation For Redevelopment Of 508 Railway Stations Sunday

Prime Minister Narendra Modi will lay the foundation stone for the redevelopment of 508 railway stations across the country Sunday morning via video conferencing, a release from Prime Minister’s Office said.

PM Modi has often laid stress on the provision of state-of-the-art public transport.

Noting that railways are the preferred mode of transport of people across the country, he has emphasised the importance of providing world-class amenities at railway stations.

The Amrit Bharat Station Scheme was launched to redevelop 1309 stations across the country.

As part of this scheme, the foundation stone for the redevelopment of 508 stations is being laid by the Prime Minister. These stations will be redeveloped at a cost of more than Rs 24,470 crores.

Master Plans are being prepared for the development of these stations as ‘City Centres’, with proper integration of both sides of the city. This integrated approach is driven by the holistic vision of the overall urban development of the city, centred around the railway station.

These 508 stations are spread across 27 states and union territories, including 55 each in Uttar Pradesh and Rajasthan, 49 in Bihar, 44 in Maharashtra, 37 in West Bengal, 34 in Madhya Pradesh, 32 in Assam, 25 in Odisha, 22 in Punjab, 21 each in Gujarat and Telangana, 20 in Jharkhand, 18 each in Andhra Pradesh and Tamil Nadu, 15 in Haryana, 13 in Karnataka among others.

The redevelopment will provide modern passenger amenities along with ensuring well-designed traffic circulation, inter-modal integration and well-designed signage for the guidance of passengers. The design of the station buildings will be inspired by local culture, heritage and architecture. (ANI)

SC Stays Conviction Of Rahul; Says Person In Public Life Expected To Exercise Caution In Speeches

The Supreme Court on Friday stayed the conviction of Congress leader Rahul Gandhi in the criminal defamation case over the ‘Modi surname’ remark while saying that person in public life is expected to exercise caution while making public speeches. 

Rahul Gandhi was sentenced to two years’ imprisonment which disqualified him as an MP under the rigours of the Representation of People Act. 

After his conviction in the case, Gandhi was declared disqualified as MP from Kerala’s Wayanad on March 24 following notification of the Lok Sabha Secretariat. 

A bench headed by Justice BR Gavai said no reason has been given by the trial court judge for imposing maximum sentence, and “order of conviction needs to be stayed pending final adjudication”. 

The apex court while granting relief to Gandhi said the ramifications of the trial court’s order are wide. 

Not only was Gandhi’s right to continue in public life affected but also that of the electorate who elected him, the bench said. 

The bench also said there is no doubt that the utterances of Gandhi were “not in good taste” and “person in public life expected to exercise caution while making public speeches”. 

The top court further said that Gandhi ought to have been more careful. 

“Trial judge has awarded maximum sentence of two years. Except for the admonition by Supreme Court, no other reason has been granted for this by the trial judge forwarding a maximum of two years of the sentence. It is to be noted only on account of this maximum sentence, provisions of the Representation of People Act have come into play. Had the sentence been a day lesser, provisions would not have been attracted,” the bench stated in its order. 

When the offence is non-cognisable, bailable, or compoundable, the trial judge is expected to give reasons for imposing maximum sentence, it added. 

“Though the court has spent voluminous pages rejecting stay on conviction, these aspects are not considered in their orders,” the bench further said. 

The apex court was hearing the appeal of Congress leader Rahul Gandhi against the Gujarat High Court order declining to stay Gandhi’s conviction in the case. 

Appearing for Gandhi, senior advocate Abhishek Manu Singhvi told the bench that the case was non-cognisable, bailable, and compoundable offence and the offence was not against society, not kidnapping, rape, or murder. He asked how can this become an offence involving moral turpitude.

Gandhi is not a hardened criminal and there are many cases filed by BJP Karyakartas but was never any conviction, he said. 

He further added that Gandhi has already missed two sessions of the Parliament. 

Senior advocate Mahesh Jethmalani appearing for complainant Purnesh Modi argued Gandhi through his speech defamed the entire class, just because it matches that of the Prime Minister. 

During the hearing, the bench said there is no whisper by the trial court judge about the need to grant a maximum sentence to Gandhi.

The bench asked whether the Constituency being unrepresented is a relevant factor. It observed that it’s not just one individual’s right being affected, but an entire electorate of a Constituency. 

Earlier, filing an affidavit, Gandhi said that he was not guilty of in the ‘Modi surname’ remark case, and requested the Supreme Court to stay his conviction, to enable him to participate in the ongoing sittings of the Loksabha and the sessions thereafter. 

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi, in his reply before the apex court, used slanderous terms such as ‘arrogant’ to describe him only because he has refused to apologise, stated Gandhi’s affidavit.

The complainant in Rahul Gandhi’s criminal defamation case in which he was convicted and sentenced to two years in jail by the Surat court over the ‘Modi surname’ remark, told the Supreme Court that the attitude of the Congress leader reveals arrogant entitlement and he doesn’t deserve any relief in form of stay on his conviction. 

Gandhi has shown arrogance rather than being apologetic over his remarks and his attitude rank as insensitivity to an offended community and contempt for the law, he told the apex court.

Approaching the top court, Gandhi also sought a stay of the Gujarat High Court verdict which upheld his conviction. He said the High Court verdict “has no parallel or precedent in the jurisprudence of the law of defamation”. 

He contended that it was “not only curious but extremely significant, indeed sinister, that all earlier cases, including the one regarding the present speech, were filed by members and office bearers of the ruling party”. 

It was submitted that the surname ‘Modi’, in different parts of the country, encompassed different communities and sub-communities, which usually have no commonality or uniformity at all. The Modi surname belonged to various castes. 

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi who simply has a ‘Modi’ surname, did not prove that he was prejudiced or damaged in any specific or personal sense, the plea filed in the apex court added. 

Gandhi’s plea said, “Unprecedentedly, in a case of criminal defamation, a maximum sentence of two years has been imposed. This itself is a rarest of rare occurrence.” 

The High Court on July 7 affirmed the decision of a Gujarat Sessions court, which had refused to put on hold a magisterial court order on March 23 convicting Gandhi and handing out the maximum punishment provided for criminal defamation under the Indian Penal Code. 

Rejecting Gandhi’s plea, the High Court has said that he has been seeking a stay on his conviction on “absolutely non-existent grounds” and a stay on conviction is not a rule but an exception. 

In March, the magisterial court convicted Gandhi for his remarks ahead of the 2019 national polls about the ‘Modi’ surname. 

After the magisterial court convicted Gandhi, he approached the Sessions court, which rejected his plea for a stay on his conviction on April 20. Thereafter, he approached the High Court.

Chandrayaan-3: Spacecraft Covers Two-Thirds Of Distance To Moon

The Chandrayaan-3 spacecraft, which was launched on GSLV Mark 3 (LVM 3) heavy-lift launch vehicle successfully from the Satish Dhawan Space Centre in Andhra Pradesh’s Sriharikota on July 14, has covered about two-thirds of the distance to the Moon.

“The spacecraft has covered about two-thirds of the distance to the moon. Lunar Orbit Injection (LOI) set for Aug 5, 2023, around 19:00 Hrs. IST,” Indian Space Research Organisation (ISRO) tweeted Friday.

Chandrayaan-3, India’s third lunar exploration mission, will make India the fourth country after US, China, and Russia, to land its spacecraft on the surface of the moon and demonstrate the country’s abilities for safe and soft landing on the lunar surface.

The spacecraft was successfully launched onboard LVM-3 on July 14, 2023, at 14:35 IST. The spacecraft is currently undergoing a series of orbit manoeuvres with the objective of reaching the moon’s orbit.

Chandrayaan-3 will take nearly 33 days from the launch date to reach the orbit of the moon. Upon landing, it will operate for one lunar day, which is approximately 14 Earth days. One day on the Moon is equal to 14 days on Earth.

Chandrayaan-3 components include various electronic and mechanical subsystems intended to ensure a safe and soft landing such as Navigation sensors, propulsion systems, guidance & control among others. Additionally, there are mechanisms for the release of Rover, two-way communication-related antennas and other onboard electronics.

The stated objectives of Chandrayaan-3 are safe and soft landing, rover roving on the moon’s surface, and in-situ scientific experiments.

The approved cost of Chandrayaan-3 is Rs. 250 crores (Excluding Launch Vehicle Cost).

Chandrayaan-3’s development phase commenced in January 2020 with the launch planned sometime in 2021. However, the Covid-19 pandemic brought an unforeseen delay to the mission’s progress.

Chandrayaan-3 is the ISRO’s follow-up attempt after the Chandrayaan-2 mission faced challenges during its soft landing on the lunar surface in 2019 and was eventually deemed to have failed its core mission objectives.

The key scientific outcomes from Chandrayaan-2 include the first-ever global map for lunar sodium, enhancing knowledge on crater size distribution, unambiguous detection of lunar surface water ice with IIRS instrument and more. The mission has been featured in almost 50 publications.

Moon serves as a repository of the Earth’s past and a successful lunar mission by India will help enhance life on Earth while also enabling it to explore the rest of the solar system and beyond. (ANI)

By any yardstick, the coming together of 26 political parties earlier to form a united Opposition front against the ruling BJP-led NDA is a significant development. The move has literally rewritten the political script for the 2024 general elections. It will no longer be a fragmented or loosely held clutch of political parties which will challenge the BJP, but a closely knit alliance committed to “safeguarding democracy and the guiding principles of social justice and equality spelt out in the Constitution”.

While such proclamations can be dismissed as meaningless rhetoric by critics, the coming together of the Opposition and the imminent threat it poses has not been lost on the BJP. So, what was until recently billed as a one-sided ‘Modi vs the Rest’ contest, suddenly had to be rephrased as a ‘War between Alliances’. The saffron party, which had not paid much heed to its allies till then, went into an overdrive to rally them together. More importantly, it set off on a desperate hunt for new friends.

Even non-descript regional parties were persuaded to jump on the NDA bandwagon. The wooing exercise, replete with promises, did not stop till the BJP could parade 39 allies before the nation. That was 13 more than the 26 in the Opposition camp and was promptly projected in sections of the media as a moral victory. But, was it?

The NDA looked more like a hurriedly cobbled ragtag army — an expression which BJP supporters often use to deride the Congress and its allies.

The BJP’s troubles did not end with securing more allies. The challenge posed by the Opposition alliance also came from an unexpected quarter — its name. The Indian National Developmental Inclusive Alliance, admittedly, is a mouthful to say or remember. In its abbreviated form it becomes I.N.D.I.A, or, simply, INDIA. Certainly, whoever came up with the name and acronym had packed a punch.

The BJP immediately smelt danger because several Opposition leaders were quick to dub 2024 as an INDIA Vs Modi contest and a battle for democracy. That was the last thing that the ruling dispensation wanted since it sent out an implicit message that Modi was fighting India. Even pitching the fight as one which pitted the NDA against I.N.D.I.A did not have a positive ring to it.

Hence, it was decided to rubbish I.N.D.I.A. It soon dithered into a ludicrous effort trying to claim that India is not India but Bharat. In a clear case of cutting the nose to spite the face, the BJP’s troll army and establishment-friendly members of the commentariat tried to run down India as a name given by foreigners. Later, the argument was recalibrated by none other than the prime minister who stated that by calling itself India, the Opposition has not earned any glory or deceived anyone. Even the much-reviled East India Company or the Indian Mujahideen has India in its name!

The very fact that Modi entered the argument reveals that he is deeply concerned. Surely, there are other signals that are equally worrying for the BJP.

Communal violence nationwide, including in Manipur, unemployment and rising prices are issues that the Opposition will surely focus on. It knows that despite the rosy data dished out by government agencies and the IMF, the rising prices of essentials is a reality that the ordinary citizen faces with no relief. It is also beginning to sink in that corporate sops and loan write-offs (Rs 15.31 lakh crores in the last ten years), deplete the national exchequer and is recovered through higher GST and other indirect levies. These inflate prices and keeps fuel costs high even when crude prices have crashed. Remember, the poor contribute more to indirect taxes than the minority rich. ‘We the taxpayers’ are not the suited-booted gentry portrayed on prime-time, but the humble citizen.

Till now, the BJP has banked on promoting religious and cultural insecurity among Hindus to hide its inequitable economic policies which robs the poor and subsidises the rich. It also masked rising unemployment through the clever use of data and by keeping the communal cauldron boiling. Hindus are in danger, Bharatiya culture is being extinguished — this has been the ritualistic war cry. It remains to be seen if this formula will succeed again.

As for the Opposition alliance, it must hold together, forget past differences, and ignore the provocations from a powerful section of the media which has sold its soul to the establishment.
