Tihar Jail Refutes AAP Charges, Says Sisodia Kept In Separate Cell

Refuting allegations made by Aam Aadmi Party that Manish Sisodia has been lodged with dreaded criminals and murderers, Tihar jail officials on Wednesday said that the former Delhi Deputy Chief Minister has been assigned a separate ward for his security where the inmates are not gangsters and have maintained “good conduct”.

The officials denied the “aspersions” on Sisodia’s lodgings as “unfounded”.

AAP leader Saurabh Bharadwaj earlier today claimed that Sisodia was lodged in Jail No.1 of Tihar, which he alleged is home to some of the most dreaded criminals and murderers. Bharadwaj alleged that the BJP was conspiring to kill his party leaders.

Responding to the allegations, the prison officials said, “Manish Sisodia has been assigned a segregated ward keeping his security in mind. The ward of CJ-1, where he is lodged has a minimum number of inmates who are not gangsters and are maintaining good conduct inside the jail.”

They further said that the allocation of a separate cell to the AAP leader makes it possible for him to meditate or do other activities without any disturbance.

“All arrangements, as per Jail Rules, are in place to ensure his safety and security. Any aspersions cast about his lodgings are unfounded,” the prison officials said.

Sisodia was arrested by the CBI on February 26 in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the National Capital Territory of Delhi (GNCTD).

The Special Judge MK Nagpal on March 6 remanded Sisodia to 14 days in judicial custody after noting that expiry of CBI custody in the case noting that the probe didn’t demand further custody of him at this time, but it may be sought later if required. (ANI)

Meanwhile, the court allowed Sisodia to have medicines prescribed in his MLC conducted by the CBI officials.

Sisodia’s lawyer sought the court’s permission for him to carry a pair of spectacles, a diary, a pen, and a copy of The Gita during the judicial custody period. The court had granted the permission.

As requested by Sisodia’s side, the court also directed the Jail superintendent to consider the request of keeping the accused in the vipassana cell/ Meditation cell. (ANI)

Delhi Chief Minister Arvind Kejriwal and Punjab Chief Minister Bhagwant Singh Mann on Sunday reached Raipur to campaign for Chhattisgarh assembly elections, 2023.

While talking to ANI, Kejriwal said, “The upcoming elections are very important for the people of Chhattisgarh. BJP ruled Chhattisgarh for 15 years and Congress ruled for about seven years.”
He added, “There is no significant difference in the governance of both the parties. Only the names of the parties and the names of the chief minister have changed. The life of the people did not change, the system did not change, and the system remained the same.”

Mann said, “Punjab has suffered exactly the same. For 25 years since 1997, there was the rule of two families. The Badal family and Captain created a mafia that looted Punjab fiercely, Sand mafia, land mafia, whatever.”

Bharatiya Janata Party leader Shehzad Poonawalla on Sunday alleged that the Aam Aadmi Party (AAP) is playing the victim card in connection with Manish Sisodia’s arrest and asked if the court is mentally “harassing” the former Delhi Deputy Chief Minister by not granting him relief.

Taking a potshot at the AAP, Poonawalla alleged that the party has transformed from a party which rose from the ‘India against corruption’ movement to a party protecting and celebrating corruption.
“This is the complete transformation of a political party that started its journey as India against corruption. Today they are doing celebration and protection of corruption they are looking at the action against corruption as mental harassment. Is the court also harassing mentally Sisodia by not giving Sisodia or Satyendar Jain relief? They are playing the victim card to safeguard themselves from the allegations of corruption. The AAP should answer the questions related to the Excise policy case,” the BJP leader said while speaking to ANI.

“Those who are responsible for the harassment of the people of Delhi by indulging in such corruption today instead of answering the questions on Sharab Ghotala, on telling us why the Sharab Ghotala was done and how such favours were given, they play the constant victimhood guide people of Delhi have rejected this card,” he added.

The remarks of the BJP leader came after Arvind Kejriwal and eight other leaders from different political parties wrote to Prime Minister Narendra Modi in connection with Sisodia’s arrest.

The leaders alleged that the timings of the lodging of cases or arrests of the Opposition leaders “coincided with elections” which makes it clear that the action taken was “politically motivated”.

“We hope you would agree that India is still a democratic country. The blatant misuse of central agencies against the members of the opposition appears to suggest that we have transitioned from being a democracy to an autocracy,” the leaders wrote.

Calling the action against Sisodia, who was arrested on February 26 by the CBI, a “long witch-hunt”, the letter alleged that the allegations levelled in connection with the excise policy are a “smack of a political conspiracy”.

They claimed that Sisodia’s arrest has “enraged” people across the country and alleged that his arrest will “confirm what the world was only suspecting” that India’s democratic values were “threatened” under the BJP rule.

“The allegations against Sisodia are outrightly baseless and smack of a political conspiracy. His arrest has enraged people across the country. Manish Sisodia is recognised globally for transforming Delhi’s school education. His arrest will be cited worldwide as an example of a political witch-hunt and further confirm what the world was only suspecting – that India’s democratic values stand threatened under an authoritarian BJP regime,” the leaders wrote.

Among the Opposition leaders who were the signatories of the letter included BRS chief K Chandrashekhar Rao, JKNC chief Farooq Abdullah, AITC chief Mamata Banerjee, NCP chief Sharad Pawar, Uddhav Thackeray, Delhi Chief Minister Arvind Kejriwal, Punjab Chief Minister Bhagwant Mann, RJD leader Tejashwi Yadav, and Samajwadi Party chief Akhilesh Yadav.

However, there were no representations from Congress, JDS, JD (U), and CPI (M) in the letter. (ANI)

Sisodia Moves Bail Plea In Trial Court

Former Delhi Minister and Aam Aadmi Party (AAP) leader Manish Sisodia, who is presently in CBI remand, moved a regular bail petition in a trial court on Friday.

Sisodia was recently arrested by the Central Bureau of Investigation (CBI) for alleged irregularities in the framing and implementation of the excise policy of GNCTD.
According to the lawyer concerned, hearing on the bail plea will be held on Saturday. Sisodia is also scheduled to be produced on Saturday at the end of his remand period granted on February 27, 2023.

Rouse Avenue Court on Monday while sending Sisodia to CBI remand directed that the interrogation of the accused during the remand period shall be conducted at some place having CCTV coverage in accordance with guidelines laid down by the Supreme Court and the said footage shall be preserved by the CBI.

Special Judge MK Nagpal on February 27, 2023, decided to send Manish Sisodia to CBI remand till March 4, 2023. Sisodia was arrested on Sunday in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of GNCTD.

The court said, keeping in view the facts and circumstances, the accused is being remanded to CBI custody for a period of five days i.e. till March 4, 2023, for his further and extensive interrogation.

The court observed that the accused had joined the investigation of this case on two earlier occasions, but it has also been observed that he has failed to provide satisfactory answers to most of the questions put to him during his examination and interrogation conducted and has thus, failed to legitimately explain the incriminating evidence which has allegedly surfaced against him in the investigation conducted so far.

It is true that he cannot be expected to make self-incriminating statements, but the interests of justice and of a fair investigation require that he should come up with some legitimate answers to the questions which are being put to him by the Investigation officer.

Some of his subordinates are found to have disclosed certain facts which can be taken as incriminating against him and some documentary evidence against him has also already surfaced a proper and fair investigation requires that some genuine and legitimate answers to the questions being put to him about the same are to be found and hence, in considered opinion of this court, this can only be done during custodial interrogation of the accused, noted the court.

During arguments, CBI counsel told the court that the Delhi Deputy CM’s custodial interrogation is required for an effective investigation into the case. While seeking five days’ remand of Sisodia, CBI said, “Conspiracy was hatched in a very planned and secret manner.”

Meanwhile, senior Advocate Dayan Krishnan appeared for Sisodia and opposed the remand application of CBI.

“If someone is not willing to say something, that cannot be a ground for arrest,” argued Sisodia’s lawyer.

“What should I do with a phone that I changed? I am a minister, I cannot send it to a second-hand shop, it would have important data. CBI confronted me with the material but I did not confess. The remand application says I gave evasive replies. This cannot be a ground for remand. They search my residence on August 19, 2022. I hand over my phone. They called me to join the investigation and I joined. I cooperated,” Advocate Dayan Krishnan argued for Delhi Deputy CM.

The CBI on Sunday released a statement on Sisodia’s arrests, claiming he was giving evasive replies and wasn’t cooperating in the ongoing investigation of the liquor scam case. (ANI)

Aam Aadmi Party (AAP) leaders and Delhi ministers Manish Sisodia and Satyendar Jain resigned from their posts in the state cabinet on Tuesday.

Chief Minister Arvind Kejriwal accepted their resignation. Their resignations will now be sent to Delhi LG VK Saxena.
The development comes two days after Delhi Deputy Chief Minister Sisodia was arrested by the Central Bureau of Investigation (CBI) in connection with the Delhi excise policy case.

Sisodia was arrested on Sunday in an ongoing investigation of a case related to alleged irregularities in the framing and implementation of the excise policy of the Delhi government.

Supreme Court on Tuesday refused to entertain Delhi Deputy Chief Minister Manish Sisodia’s plea challenging his arrest in connection with the excise policy case.

The apex court suggested Sisodia to move to Delhi High Court. A bench headed by Chief Justice of India DY Chandrachud said that the court is not inclined to entertain the petition at this stage and suggested Sisodia to move to Delhi High Court.

“It can not interfere in the matter as it may open the gate of people approaching the top court in every such matter,” the court remarked.

Delhi’s Rouse Avenue Court on Monday sent him to CBI custody for 5 days.

The Central Bureau of Investigation (CBI) has quizzed Delhi’s Minister Satyendar Jain in Tihar Jail in connection with alleged corruption in the implementation of the Delhi Excise Policy.

Jain is presently lodged in Judicial Custody in connection with another case related to money laundering case registered by the Enforcement Directorate (ED).

His name surfaced in the matter along with another cabinet Minister of Delhi as well as Chief Minister Arvind Kejriwal.

According to the concerned lawyers, CBI has also quizzed Vijay Nair, who is also lodged in Tihar Jail in connection with the ED case related to the Excise policy. Nair was granted bail in a CBI case by the Trial court earlier.

Recently, CBI and ED have made several arrests for alleged corruption in the implementation of the Delhi Excise Policy. (ANI)

SC Agrees To Hear Sisodia’s Plea Challenging His Arrest Today

Supreme Court on Tuesday agreed to hear Delhi Deputy Chief Minister Manish Sisodia’s plea challenging his arrest after he was arrested by CBI on Monday in connection with the Excise policy scam case.

The plea was mentioned by Abhishek Manu Singhvi seeking an urgent hearing on Sisodia’s plea before the bench led by Chief Justice of India DY Chandrachud.
Supreme Court said that it will hear the matter after the end of board on Tuesday.

This comes a day after the special Central Bureau of Investigation (CBI) court on Monday granted 5 days remand of Sisodia to the CBI till March 4, to interrogate him in the excise policy case.

The senior AAP leader was produced before the court on Monday.

Sisodia was arrested by the CBI on Sunday.

Aam Aadmi Party leaders and workers staged protests in various states on Monday, crying vendetta behind Sisodia’s arrest and calling for his release at the earliest.

The workers were seen sitting on roads and chanting slogans while some staged a foot march wearing handcuffs against the BJP in the national capital. The workers were seen attempting to cross the barricades as the police tried to push them back. The police asked the party workers to step inside the office.

AAP workers protested outside the party office in the national capital, raising slogans such as “Jail ke taale tutenge, Manish Sisodia chutenge” (Jail locks will be broken, Manish Sisodia will be freed).

AAP leader Saurabh Bharadwaj said they have come to be arrested, as the agency has arrested Manish Sisodia in a false case.

“The Centre wants to arrest every leader, MLA and Minister of the AAP. So we, too, have come to PM Modi asking to be arrested. All of us have come to give our arrest. End our party and put us all in jail. The world should know that there is a dictatorship in India and the situation of Emergency is prevailing,” AAP leader Saurabh Bharadwaj told ANI earlier.

Meanwhile, the CBI on Sunday released a statement on Sisodia’s arrests, claiming he was giving evasive replies and wasn’t cooperating in the ongoing investigation in the liquor scam case.

The agency further said Sisodia had been summoned earlier on February 19 in connection with the ongoing probe, but had sought a week’s time citing the Delhi Budget.

“The Deputy CM was issued a notice under section 41A of CrPC for attending the investigation on February 19, 2023. However, he sought time of one week citing his preoccupation,” the CBI stated.

On his arrest, the CBI issued a statement saying, “He gave evasive replies and did not cooperate in the investigation despite being confronted with evidence to the contrary. Therefore, he has been arrested.” (ANI)

With reference to the Ajnala incident, former Punjab Chief Minister Captain Amarinder Singh on Sunday said if the Aam Aadmi Party (AAP) government cannot handle law and order, the Centre should intervene to deal with the situation.

Speaking to ANI on Sunday, the former Punjab CM said, “He (CM Bhagwant Mann) is not interested on what is going on in Punjab. He is afraid of taking any step. Police officials may have got orders not to take any step during the Ajnala incident. The law and order has deteriorated in Punjab.”

“No government can run like this, the way this government is running. The day when Ajnala incident took place, Bhagwant Mann was sitting in Mumbai with Arvind Kejriwal,” he added.

Notably, Delhi Chief Minister Arvind Kejriwal and Punjab Chief Minister Bhagwant Mann on Friday called on former Maharashtra chief minister Uddhav Thackeray at his Mumbai residence.

Captain Amarinder Singh further raised concerns about the internal security of the country.

“The law and order situation in Punjab is horrible. The law and order is not the Centre’s subject. If they (Punjab government) are not able to handle it then the central government will have to take charge. There are drones getting caught every single day, I think the Centre must see it,” he said.

Thousands of supporters of Amritpal Singh, a Khalistan sympathizer, had on Thursday staged a massive demonstration in Amritsar to protest against the arrest of his aide Lovepreet Singh Toofan.

The supporters, who were holding swords and guns in their hands, broke through police barricades erected outside Ajnala police station.

The police later said “in the light of the evidence presented”, it has been decided that Lovepreet Singh Toofan will be discharged.

Lovepreet Singh was released from jail on Friday following orders of a court in Ajnala on an application by the police.

A day after Ajnala incident in which some policemen were injured, DGP Gaurav Yadav said that appropriate action will be taken against the people involved.

After the clash between supporters of the chief of suspected pro-Khalistan outfit ‘Waris Punjab De’, Amritpal Singh, and Punjab Police erupted in Ajnala, Chief Minister Bhagwant Mann on Friday said the law and order situation is under control.

‘Waris Punjab De’ chief Amritpal Singh said the incident concerning Ajnala police station in Amritsar on February 23 could have been avoided if police were alert and his aide Lovepreet Singh Toofan had not been arrested.

Amritpal Singh said in an interview with ANI that the incident and subsequent release of Lovepreet Singh will “change the course of the future”.

Amritpal’s supporters, some of them brandishing swords and other weapons, stormed Ajnala police station on Thursday over their demand for the release of Lovepreet Singh.

Asked about Punjab DGP Gaurav Yadav’s remarks that there will be action regarding the Ajnala incident, Amritpal Singh said that the senior police official cannot say he was not aware of the case.

“We are going through the cycle…They way it happened before, it could have been avoided if they were alert. The DGP could not say that he did not know about the case. It was not that he did not know about the case. The decision could have been made earlier. The guy should not have been arrested. We will not run away and hide somewhere. It’s not that I am going to hide somewhere. No, I will not. I will get killed. I will face everything, I will not hide anywhere,” he said.

Amritpal Singh said Punjab Police acted in a hurry based on wrong intelligence reports and authorities gave false information about him that he does not have support.

“When I am going to the public, this could happen any day if you have enough evidence to charge me. What they did was in hurry and based on wrong intelligence reports. I do not show everything on social media. They had some pressure and gave false information to the Central government that Amritpal Singh does not have any support in Punjab and he is isolated,” he said.

Invoking ‘Operation Blue Star’, Amritpal said it was a moment of “trauma” for Sikhs and continues to be.

“When Golden temple was attacked and Jarnail Singh Bhindranwale was killed, it might have been a happy moment for many people, but it was a trauma for Sikhs. It is still a trauma. You don’t care about the judgment of law and society because you are the society. Not a single Hindu was attacked in Punjab…….When (former Prime Minister) Indira Gandhi was killed, Sikhs…were attacked,” he said.

Amritpal , a suspected Khalistan sympathiser, said allegations were made against Jarnail Singh Bhindranwale, and huge money was spent “to destroy his image”.

“When someone is in the power, they have the power to make anything evil. Jarnail Singh Bhindranwale is evil in the eyes of the Indian people, and Indira Gandhi might be a hero. But that does not change our idea of us. We will love him. India has control over all the resources to make him evil and it did it. Billions of dollars were spent to destroy his image and to put allegations against him. But what happened? There is no village here that will not have his pictures. Youth is inspired, they did not see him. But what happens? The suppression finds its way come out of slavery,” Amritpal said.

The head of the Sikh religious sect Damdami Taksal, Bhindranwale, was killed along with his armed followers during Operation Blue Star launched by the Indian Army at the Golden Temple complex.

Amritpal also said steps should be taken to make policing system better.

“The Indian people should reconsider the policing system in the country. It is still pre-1947. The way they interrogate people, the way they pick them up, the way they work. Courts are filled with such cases because the policing system is not right. It’s not the problem of the police, but of the law. They have to change the law to make policing system better and make things more transparent,” he said.

Aam Aadmi Party leader Atishi on Friday alleged that the newly elected mayor Shelly Oberoi was physically assaulted by a BJP male member in the Civic Centre.

She urged the BJP to stop the “goondaism” in the Civic centre and said that BJP should accept its defeat.
While talking to ANI, Atishi said, “Today BJP showed goondaism in the Civic centre. A standing committee election was going on. When counting started BJP realised they were losing & they created a ruckus. The mayor was attacked & physically assaulted by a BJP male member.”

She further stated, “What behaviour is this? This is shameful and condemnable. The country is seeing this. BJP should accept their defeat. I request BJP to stop their goondaism. Those who have attacked the Mayor will be sent behind bars.”

Meanwhile, Aam Admi Party (AAP) Councillor Ashok Kumar Maanu collapsed at Delhi Civic Centre minutes back and alleged that the ruckus had been caused by the BJP goons.

While talking to ANI, Maanu said, “They are so shameless that they attacked even women and the Mayor. BJP goons did this.”

On the other hand, BJP leader Harish Khurana blamed Aam Admi Party behind the ruckus. He said, “Election officers declare the election and say that votes declared invalid by Mayor are valid and three candidates each of AAP and BJP have won. But AAP does hooliganism here as instructed by Kejriwal. We won’t tolerate this goondaism & approach the Court.”

On Friday, Maanu collapsed at Delhi Civic Centre as clashes broke out here between AAP and BJP councillors.

Ruckus broke out at Delhi Civic Centre once again as AAP and BJP Councillors jostled, manhandled and rained blows on each other.

This is the third day of commotion in the House.

On Friday, amid political slugfest, the voting process to elect six members of the Standing Committee of the Municipal Corporation of Delhi (MCD) took place at the Civic Center in the national capital

Ahead of the election of six members of the MCD Standing Committee, Delhi MCD House witnessed sloganeering by Bharatiya Janata Party (BJP) councillors.

In a jolt to the Aam Aadmi Party two days after it won the polls for the mayor and deputy mayor in the MCD, Bawana councillor Pawan Sehrawat joined the BJP on Friday.

The switchover happened shortly before the polling to elect members of the MCD’s Standing Committee on Friday.

Earlier, on Thursday, the House was adjourned for the 13th time since it convened post the MCD polls in December 4, last year, after councillors of the ruling AAP and the Opposition Bharatiya Janata Party came to blows over polling to elect members of the Standing Committee. (ANI)

Punjab Vigilance Arrests AAP MLA Rattan In Bribery Case

Aam Aadmi Party (AAP) Bathinda Rural MLA Amit Rattan has been arrested in connection to a bribery case, Punjab Vigilance Bureau (VB) officials said on Thursday.

According to officials, MLA Amit Rattan is being questioned at Bathinda Civil Line Police Station and will be soon taken to Bathinda Civil Hospital for medical examination.
The MLA’s arrest comes four after he was called for questioning by the vigilance officials, sources pointed out.

On February 17, a vigilance team arrested MLA Rattan’s personal assistant, Rashim Garg, from Bathinda Circuit House in Punjab for allegedly taking a bribe of Rs 4 lakhs from a sarpanch.

According to the officials, the sarpanch’s husband accused the MLA’s PA of demanding a bribe of Rs 5 lakh by taking the name of Amit Rattan, after which the complainant reached the circuit house with the Vigilance team.

The PA was caught red-handed while accepting the bribe at the circuit house. Further investigation into the matter is underway, officials added. (ANI)

Aam Aadmi Party candidate Shelly Oberoi has been elected as the new mayor of Delhi after having secured 150 votes on Wednesday.

“I assure you all that I will run this House in a constitutional manner. I expect you all will maintain the dignity of the House and cooperate in its smooth functioning,” Delhi Mayor Shelly Oberoi said as soon as she was elected as the mayor.
The BJP received 116 votes in the Municipal Corporation of Delhi (MCD) polls to elect Delhi’s mayor as the previous three attempts – on January 6, January 24 and February 6, failed to elect the mayor.

“Goondaism has lost, the public has won. BJP wanted to make its own mayor by cheating. I congratulate Shelly Oberoi on her election as Delhi mayor. Next, Ale Iqbal will become the deputy mayor,” AAP MLA Saurabh Bharadwaj said.

The voting which started at around 11.30 am went on for more than 2 hours.

A total of 10 nominated MPs, 14 nominated MLAs and 241 elected councillors out of 250 voted in the mayoral election.

“The goons lost, the public won. Many congratulations to all the workers on becoming the Mayor of Aam Aadmi Party in Municipal Corporation of Delhi and once again whole hearted gratitude to the people of Delhi. Many many congratulations to the first Mayor @OberoiShelly of AAP,” Deputy Chief Minister Manish Sisodia tweeted.

The polling began with the MPs and MLAs casting their votes, followed by voting by the elected Councillors. The nominated MLAs of both parties also cast their votes, among whom 13 were from the AAP and 1 from BJP.

AAP MLA Akhilesh Pati Tripathi also cast his vote. In the last election, the presiding officer had barred Akhilesh Pati Tripathi and Sanjeev Jha from voting on the grounds that both of them were accused of corruption.

There was a need for 274 valid votes for the mayoral election. Congress has 9 Councillors who boycotted the election. In this situation, a total of 265 votes had to be cast in today’s election.

Either of the two mayoral candidates needed 134 votes to win.

The voting began at 11.30 am after the Supreme Court ruled that the Delhi Mayor election be conducted. The court also ruled that the aldermen (nominated councillors) would have no right to vote.

The election was due after Aam Aadmi Party won the MCD elections in December last year.

The last three attempts to elect the Mayor failed due to the political bickering between the Aam Aadmi Party and Bharatiya Janata Party. The civic centre met for the first time on January 6, second on January 24 and last on February 6.

In the last meeting, Presiding officer Satya Sharma of the BJP administered oath to the aldermen, the members nominated by Lt Governor Vinai Saxena before administering the oath to the elected councillors.

A plea was thereafter filed in the Supreme Court challenging the Delhi LG’s decision to permit the nominated members to vote, after which the top court on February 8 issued a notice to the LG.

Chief Minister Arvind Kejriwal also had sent a proposal to the LG to conduct elections on February 22 which was approved on February 18.

As per the order issued by the Lieutenant Governor, elections for the mayor, deputy mayor and six members of the standing committee will be held on February 22.

According to the Delhi Municipal Corporation Act, the Municipal House has to meet within a month after the conclusion of the civic polls and elect the mayor. However, the election has been stalled thrice over the dispute over the voting rights of nominated members.

The municipal elections in Delhi were held on December 4 and the results were announced on December 7. Aam Aadmi Party won 134 seats out of 250. (ANI)
