SC Rejects Bail Plea Of Jain In Money Laundering Case

The Supreme Court on Monday rejected the bail plea of former Delhi Minister Satyendar Jain in the money laundering case, asking him to surrender forthwith.

A bench of Justice Bela M Trivedi and Justice Pankaj Mithal dismissed the appeal filed by Jain.

The court also rejected the bail plea of the other two co-accused Ankush and Vaibhav Jain.

On May 26, Satyendar Jain was granted interim bail for six weeks on medical grounds and later it was extended from time to time.

Additional Solicitor General SV Raju, appearing for the Enforcement Directorate (ED), had taken court through concurrent findings of the trial court and high court and other details related to the case.

Countering the ED submission, Senior Advocate Abhishek Manu Singhvi, appearing for Jain, had said that his client had been incarcerated for a year. He also remarked that probe agencies are trying to convert an income tax case into a money laundering matter.

The Senior Advocate urged the top court to grant bail to Jain saying that he is not a flight risk and threat to witness. The senior advocate also said that this is a matter of life and liberty for Jain.

The Enforcement Directorate has opposed the bail plea of former Delhi Minister Satyendar Jain and had submitted before the top court that whenever he wants to be out of jail he moves bail on medical grounds and, stays in hospital. Whenever there is an argument on the bail in the court, he falls down, which is a strange coincidence. However, Jain’s counsel called the submission baseless.

Meanwhile, the hearing on Jain’s bail witnessed many twists and turns in December 2023, as Chief Justice of India DY Chandrachud explained why the matter was listed before a different combination of bench as there was a matter relating to the extension of bail.

CJI also mentioned the communication received from Justice AS Bopanna to take up part heard matter from him because he would not be able to hear the matter due to medical reasons.

Earlier, Jain’s bail plea was partly heard by a bench of Justices AS Bopanna and Bela M. Trivedi. Later, the matter was listed before a bench of Justice Trivedi and Justice Satish Chandra Sharma.

Jain underwent surgery on July 21 last year. The interim bail given to Jain on medical grounds was extended from time to time.

On May 26, the top court granted interim bail to Satyendar Jain for six weeks in the money laundering case but imposed various conditions, including refusing to talk with the media or leaving Delhi without permission.

Satyendar Jain has moved to the top court seeking bail in money laundering cases. He has challenged the Delhi High Court order dismissing his bail plea in the money laundering case against him.

On April 6, the Delhi High Court dismissed the bail plea of Satyendar Jain. The HC while dismissing the Satyendar Jain bail plea, stated that the applicant is an influential person and has the potential to tamper with evidence.

On November 17, 2022, the trial court dismissed the bail petition of Satyendar Jain. He was arrested on May 30, 2022, under sections of the Prevention of Money Laundering Act (PMLA) by the Enforcement Directorate and is presently in Judicial Custody in the case.

The ED case is based on a Central Bureau of Investigation (CBI) complaint registered on the allegation that Satyendar Jain had acquired movable properties in the name of various persons from February 14, 2015, to May 31, 2017, which he could not satisfactorily account for. (ANI)

After the alleged detention of Aam Aadmi Party (AAP) workers, who were on their way to protest against the disputed Chandigarh mayoral polls, Delhi minister and AAP leader Saurabh Bharadwaj said the BJP committed ‘fraud’ in the elections.

The AAP erupted in protest after the presiding officer declared the BJP nominee the winner after 8 votes were ruled invalid.

Speaking to ANI on Friday, the AAP leader said, “The nation saw how the BJP committed fraud in the Chandigarh mayoral polls. Arvind Kejriwal and Bhagwant Mann are leading a peaceful protest at the BJP office today. However, ahead of this protest, our MLAs, councillors and party workers were detained at various places across Delhi. Is the BJP so scared of Arvind Kejriwal that they are not even letting this protest take place?”

Also, hitting out at the BJP-led Centre for the alleged detention of an AAP MLA from Gandhinagar, Bharadwaj said, “He is our elected representative from Gandhinagar. Is there an undeclared emergency in the country now? Can’t we even hold a peaceful protest?”

Earlier. fellow party leader and minister Atishi, too, launched a blistering attack on the BJP over the alleged detention of AAP workers ahead of the scheduled protest in the national capital.

“There was brazen fraud in the Chandigarh mayoral elections. Delhi CM Arvind Kejriwal and Punjab CM Bhagwant Mann are holding a peaceful protest over this issue in Delhi today. However, before the workers could even reach the protest site, police barricades were put up all over the city. Our MLAs were placed under house arrest and party workers were detained. Why is the BJP so scared?” the AAP leader asked.

She claimed that busloads of AAP volunteers were detained outside the party office.

“Heavy barricades all across Delhi, buses full of AAP volunteers being detained, hundreds of paramilitary forces outside the AAP party office–why is the BJP so scared of a protest on the Chandigarh mayor elections?” Atishi posted from her official X handle.

Delhi Chief Minister Arvind Kejriwal, too, weighed in on the events, claiming that cadre arriving at the protest site were stopped at various places across the national capital.

“All across Delhi, they are detaining elected MLAs, councillors and volunteers who were coming to the party office. What is this going on?” CM Kejriwal posted from his X handle.

“Stolen votes in the first Chandigarh Mayor election. Now the people coming to protest peacefully against this are being stopped at various places across Delhi,” Kejriwal added in his post.

Also wading into the alleged police crackdown on the party supporters and the fresh ED summons to CM Kejriwal in connection with the Delhi liquor policy case, AAP spokesperson Priyanka Kakkar said, “The Constitution gives us the right to protest. Today, our party leaders are being stopped illegally. Where does BJP get the permission for this? The fresh ED summons (to Kejriwal) came at the BJP’s behest. We will decide our course of action once the summons is sent properly.”

The AAP and the Congress, which put up a joint candidate, moved the Supreme Court challenging the outcome of the mayoral polls.

CM Mann, too, called the polls “a murder of democracy.”

Earlier, there was a rift between the protestors and the police at the spot.

Youth Congress workers were heard chanting the slogan ‘Bhrastachar band karo’ (Stop the corruption).

However, the police detained the protestors after a while.

A hearing was also held on January 31 in the Punjab Haryana High Court on a plea claiming foul play during the mayoral elections.

During the hearing in the Punjab and Haryana High Court, Kuldeep Kumar, the mayoral candidate of the AAP and Congress, was represented by the Advocate General of Punjab, Gurminder Gary.

Advocate Anil Mehta represented the Chandigarh Municipal Corporation in the matter.

BJP nominee Manoj Sonkar was declared the Chandigarh Mayor on Tuesday after he won the mayoral polls with 16 votes against the 12 votes bagged by Congress-AAP candidate Kuldeep Tita.

Video Of Jain Enjoying Meal In Tihar Goes Viral

A new purported video of jailed Delhi minister Satyendar Jain having an elaborate meal inside Tihar has emerged, just a day after footage of the minister receiving an oil massage inside his jail cell trigged an uproar.

The latest CCTV footage sourced from Tihar jail sources shows Jain getting an elaborate meal in jail.
Tihar Jail sources also said that the Delhi minister gained 8 kg weight during his time in jail, contrary to his lawyer’s claims of him having lost 28 kgs.

The new footage surfaced a day after Jain on Tuesday submitted before the trial court that he has not been getting privileges like proper food and medical check-up in Tihar Jail. He had also claimed that he lost 28 kg while being locked up in jail.

Sharing the video on his twitter handle BJP spokesperson Shehzad Poonawalla said “One more video from media! After taking maalish from rapist & calling him PHYSIO therapist, Satyendra Jain can be seen enjoying sumptuous meal! Attendants serve him food as if he is in a resort on vacation!”

“Kejriwal ji ensured that hawalabaaz gets VVIP maza not saza!,” Poonawalla said

In an accompanying video on his Twitter account, Poonawalla said after,” He is being served outside food by two attendants as if he is in a resort or a restaurant and there is a variety of delicacies and dishes in front him, as if he is not there for the saza (punishment) of corruption, but maza (fun) of maalish (massage)and restaurant food.”

“Arvind Kejriwal must answer why the person who has been in jail for the last five months is being given this facility by keeping him in the minister post — to take ‘vasooli’ from Sukesh, maalish from a rapist and now food from outside jail,” Shehzad said.

In the latest purported footage from Tihar jail, Jain is seen having food including fruits and dry fruits.

On Tuesday, the minister’s counsel Senior Advocate Rahul Mehra had alleged that Enforcement Directorate was leaking sensitive information to the media despite the order of the Court and undertaking given in this court.

Rahul Mehra also denied ED allegations of getting privileged treatment in Tihar Jail. He asked, “What privilege are they talking about?”

“I have lost 28 kg in jail. Is this what a privileged person in jail gets? I’m not even getting proper food. What privilege are they talking about? No prison rules are violated if an undertrial is pressing his hand or feet,” Jain said.

However, appearing for ED, advocate Zohaib Hossain denied the allegations made by Satyendar Jain’s lawyer and said that there is not a single leak from the Enforcement Directorate.

The latest episode comes days after purported videos of the minister getting a massage inside his cell in Tihar went viral on social media. The Aam Aadmi Party however asserted that Jain was receiving physiotherapy.

Sources reported on Tuesday that the person administering massage to Jain was not a physiotherapist, furthermore, he has been identified as a rape accused too.

Jailed Delhi Minister Satyendar Jain, who was criticized over the viral CCTV video inside the Tihar, was being given a massage by an accused in a rape case, the official sources claimed on Tuesday.

The Tihar Jail official sources claimed that the prisoner, identified as Rinku, was “not a physiotherapist” and has been charged under the Protection of Children from Sexual Offences (POCSO) Act, 2012.

“The masseur providing massage to jailed Delhi min Satyendar Jain is a prisoner Rinku. He’s a prisoner in a rape case, charged u/s 6 of the POCSO Act and 376, 506 & 509 of IPC. He’s not a physiotherapist,” the sources claimed.

Deputy Chief Minister Manish Sisodia on Saturday claimed that the CCTV footage that went viral showing Jain being given a full-body massage was a “treatment for injury”.

“Only BJP can make cruel jokes by leaking CCTV footage of an injured person’s treatment… His (Satyendar Jain’s) spine was damaged, it’s on record,” Sisodia had said on Saturday.

However, the Deputy Chief Minister’s claim was refuted by the Indian Association of Physiotherapists.

The body also demanded an apology for “degrading physiotherapy”.

Calling out the Minister, the Indian Association of Physiotherapists tweeted on Saturday, “IAP strongly condemns the statement of the minister degrading physiotherapy by comparing it with massage given to another minister. Shows the level of education and knowledge they have about our noble profession.”

In a video, the president of the association condemned the minister while also demanding an apology from him.

“There is news going on on social media and we have received many complaints from our members. Many physiotherapists all across India that in jail, and one physiotherapy session was given to a patient. And as a professor of physiotherapy and as president of the Indian

Association of Physiotherapists, we can say that the session going on was not physiotherapy. It is a way of degrading physiotherapy. We strongly condemn this act. We want that the Minister or whosoever should apologize for that,” he said.

“I request all physiotherapists in India to write down to the news channels that please don’t degrade physiotherapy. This is not physiotherapy. Let’s condemn this act and let’s move in a direction where we can correct things,” the president added.

Earlier on Saturday, the former PRO of the Tihar jail said that it cannot be physiotherapy as the video clearly showed that co-inmates were giving him a massage.

Sunil Gupta, former PRO of the Tihar jail told ANI that the video makes it clear that other prisoners of the prison were giving the minister a massage.

“Massage is different from physiotherapy. Physiotherapy is given in physiotherapy wards in the hospital,” he said.

The purported CCTV footage dated September 13 shows the minister lying on his bed while a man seated next to him is seen massaging his foot.

In another video shared by BJP national spokesperson Shehzad Poonawalla on his official Twitter handle, a man is seen massaging the Delhi minister’s legs and back before proceeding to give him a full head massage.

The videos surfaced on social media on Saturday, 10 days after the ED accused the Delhi minister, who was arrested in a money laundering case, of getting special treatment inside the Tihar jail.

Jain has been in jail since June. A Delhi court denied his bail application on November 16. (ANI)

Delhi Court Defers Satyender’s Bail Plea Till Tomorrow

The CBI Court at Rouse Avenue on Wednesday deferred for tomorrow the pronouncement of the order on bail petitions of Delhi Minister Satyender Jain, and two others in the Money Laundering case.

Enforcement Directorate (ED) arrested Satyender Jain on May 30.
Special CBI Judge Vikas Dhull on Wednesday said the order copy is not ready for all three accused. It will take some time. Will pass the order tomorrow at 2 pm.

The Court on November 11, had kept the order reserved after the conclusion of arguments from all sides.

During arguments, it was submitted on behalf of Jain that the investigation related to the applicant has been completed and a charge sheet has been filed. No case of money laundering is made out against the applicant.

Senior advocates N. Hariharan and Rahul Mehra submitted that it is alleged that a conspiracy for money laundering was hatched in 2010. At the time neither Jain was an MLA nor a Minister. So how could he hatch a conspiracy for money laundering?

It was also submitted that as per the charge sheet the other accused have admitted that the money allegedly laundered belongs to them. Jain has nothing to do with the companies in question.

On the other hand, the bail plea was opposed by the ASG for ED. The ASG S V Raju submitted that there are witnesses and materials sufficient to make out a case of money laundering against the accused.

ASG submitted that the accused was involved in money laundering with other accused. He sent money to Kolkata-based companies and that money belong to Jain. He is the conspirator and kingpin.

ED also raised the issue of special treatment given to Satyender Jain in the Tihar Jail. Special food is being provided to him and getting massages from unknown people. Most of the time he is either in the hospital or in jail enjoying these facilities, said the ED.

The enforcement agency has alleged that the companies which were “beneficially owned and controlled” by Jain had received accommodation entries amounting to Rs 4.81 crore from the shell companies against cash transferred to Kolkata-based entry operators through a hawala route.
