AAP Excise Policy Was To Exploit Money For Elections With Khalistanis Help: Gambhir

Bharatiya Janata Party (BJP) MP Gautam Gambhir on Tuesday described the Delhi Excise Policy Scam as an “open-and-shut case” and alleged that the policy was made to exploit money to “fight elections with Khalistani help”.

The BJP MP said that the AAP leaders should get “what they deserve”.
“It was an open-and-shut case. They should get what they deserve. This is the 1st time in India that an Education Min will go to Tihar jail that too in liquor scam case. This policy was made to exploit money so they can fight elections with Khalistani’s help,” Gambhir said while speaking to ANI.

He said that if Manish Sisodia, who is the Education Minister in the Arvind Kejriwal government besides heading the Delhi government’s excise department, has opened schools and colleges, he should show it to the BJP.

“If there was no discrepancy in liquor policy, it shouldn’t have been taken back. This is not the time to give emotional statements. If he (Sisodia) has opened schools, colleges and hospitals, show it to us. He can move to SC, but for me, Delhi CM and AAP has been exposed,” he said.

Delhi Bharatiya Janata Party leader Harish Khurana on Tuesday demanded the resignation of jailed Ministers of the Kejriwal government- Manish Sisodia and Satyender Jain – while recalling the Aam Aadmi Party supremo’s earlier stand of resignation.

This comes after Manish Sisodia moved Supreme Court challenging his arrest by the CBI in the excise policy scam case in Delhi. Sisodia was arrested on February 26 after 8-hour questioning.

BJP leader Harish Khurana said that Sisodia and Jain should step down on “moral grounds”.

“Manish Sisodia has moved the SC challenging yesterday’s decision of the court. He has the right to go but a question is raised on moral grounds. Arvind Kejriwal used to say in 2013 that there should be a resignation after any allegation is levelled against anyone. The allegation would be proven later. He had levelled allegations against leaders like Nitin Gadkari, Sheila Dikshit, and P Chidambaram. But today, their one minister is jailed for 8 months, the other is in the police remand,” he said.

“2 Ministers of Delhi are in jail today. You have not sacked Satyender Jain till today. Where is your morality? We demand you (Arvind Kejriwal) to seek his resignation on the basis of morality from both ministers. There are 22 ministries with Sisodia. Would they be run from jail? Isn’t there a Constitutional breakdown in Delhi?” the BJP leader asked.

Meanwhile, Supreme Court on Tuesday agreed to hear Delhi Deputy Chief Minister Manish Sisodia’s plea challenging his arrest after he was arrested by CBI on Monday in connection with the Excise policy scam case.

The plea was mentioned by Abhishek Manu Singhvi seeking an urgent hearing on Sisodia’s plea before the bench led by Chief Justice of India DY Chandrachud.

This comes a day after the special Central Bureau of Investigation (CBI) court on Monday granted 5 days remand of Sisodia to the CBI till March 4, to interrogate him in the excise policy case.

The senior AAP leader was produced before the court on Monday.

Sisodia was arrested by the CBI on Sunday.

Aam Aadmi Party leaders and workers staged protests in various states on Monday, crying vendetta behind Sisodia’s arrest and calling for his release at the earliest.

Meanwhile, the CBI on Sunday released a statement on Sisodia’s arrests, claiming he was giving evasive replies and wasn’t cooperating in the ongoing investigation in the liquor scam case.

The agency further said Sisodia had been summoned earlier on February 19 in connection with the ongoing probe, but had sought a week’s time citing the Delhi Budget.

“The Deputy CM was issued a notice under section 41A of CrPC for attending the investigation on February 19, 2023. However, he sought time of one week citing his preoccupation,” the CBI stated.

On his arrest, the CBI issued a statement saying, “He gave evasive replies and did not cooperate in the investigation despite being confronted with evidence to the contrary. Therefore, he has been arrested.” (ANI)

Delhi: Myanmar Woman Gang-Raped In Kalindi Kunj Area

A Myanmarese woman was allegedly gang-raped by four people in the national capital, informed Delhi Police on Tuesday.

The Myanmar woman alleged that she was made unconscious and abducted by an auto-rickshaw driver in the Kalindi Kunj area before being gang raped.
According to Delhi Police officials, the woman is a registered refugee.

“A case has been registered by the police following her complaint,” a police officer said.

According to the complaint, she was visiting somewhere in Southeast Delhi, along with her husband, for the treatment of their daughter, when the auto driver abducted her and took her to an isolated location.

“We registered a case on February 25 under IPC sections 365, 368, 376d,323, and 506,” said a police official.

An investigation is underway, police informed further.

Earlier, on February 3, a three-year-old was allegedly gang-raped by two persons in Delhi’s Fatehpur Beri area.

A woman reached Delhi’s Fatehpur Beri Police Station along with her daughter aged about three years, stating that her daughter had gone missing.

She said she was looking for her daughter when her neighbour, Rani, informed her that she had seen her daughter walking near the jungle area.

The neighbour claimed further that she had also seen two persons going in the same direction, towards the Jungle area.

According to the mother, they searched the area and found the child crying and bleeding from her private part. When the mother enquired about what had happened, the child kept crying.

The child was taken for her medical examination to a hospital. Following the complaint, the police swung into action and apprehended the accused.

The accused were identified as Ramniwas Panika (27) and Shaktiman Singh (22). Both belong to Sidhi district in Madhya Pradesh, officers said, adding that they were booked. (ANI)

Delhi HC Upholds Validity Of Centre’s Agnipath Scheme

The Delhi High Court on Monday dismissed a batch of petitions challenging the Agnipath scheme and seeking resumption and enrolment as per the previous recruitment scheme in Indian defence services.

“The scheme is made in the national interest and to ensure that armed forces are better equipped,” said a Bench headed by the Chief Justice of Delhi while passing the judgement.
A Division bench headed by Chief Justice Satish Chandra Sharma also comprising Justice Subramonium Prasad on Monday upheld the central government’s Agnipath Scheme and said that the court finds no reason to interfere in the said scheme.

On December 15, 2022, the bench kept the Judgement reserved after hearing arguments on behalf of different petitioners and the central government.

During the hearing, Additional Solicitor General (ASG) Aishwarya Bhati appeared for the central government and submitted before the court that more than 10 lakh aspirants have been given the benefit of age relaxation. The Agnipath scheme is a major paradigm shift in the recruitment process of defence personnel. We cannot put everything on the affidavit but we can say that we acted bona fide in the matter.

The central government has informed the Delhi High Court that no prejudice has been caused to any of the candidates who had participated in the earlier recruitment process.

It was further informed by the central government that recruitment in the ‘armed forces’ stands on a completely different footing viz-a-viz employment in public offices, as it constitutes an essential sovereign function, which directly relates to the maintenance of national security.

Therefore, the central government in exercise of its sovereign power and to effectively and efficiently safeguard the security and integrity of the country is duly empowered to change the policy providing the mode and methods/service conditions of the persons who are to be employed in the armed forces, stated the affidavit.

The decision of the central government to make recruitment through a new ‘Agnipath Scheme’, therefore, constitutes a policy decision taken by the government for national security reasons, it was further stated

Advocate Prashant Bhushan appeared for one of the petitioners challenging the scheme and argued that the decision made by the government is arbitrary and unfair. There is no real reason behind the decision.

He also argued that the candidates whose select list was out were made to keep on waiting for two and half years.

ASG Bhati responded to the contention and said, “There is a difference between the Navy and other defence forces. The Navy cannot afford to put on hold the process as it will impact its operational capabilities and war readiness. They had modified the recruitment plan.”

“Selection does not give a right to an appointment. The process got delayed because of Covid,” ASG argued.

The Chief Justice asked the ASG, “People who had cleared the examination were waiting. Why did you not complete the process? How you will answer this?”

ASG submitted that in June 2021, the decision was taken at the highest level. It was clear that the Agnipath scheme is a paradigm shift. After June 2021, we want to bring a big paradigm shift in the manner in which recruitment takes place.

It was clarified by the central government that the Agniveer is a separate cadre and ranks lower than sepoy.

During the argument advocate, Ankur Chibber who appeared for some of the petitioners argued that there can not of disparity in salary. The entry-level in force is sepoy. An Agniveer would get less salary than a sepoy. There should be an equal salary for equal work.

Another point he raised was that an Agniveer would have to join afresh if he is selected after a period of four years of service. His past four years of experience would not be counted. It will affect his seniority and other benefits.

Advocate Kumud Lata, the counsel for Harsh Jay Singh argued that the tenure of service is four years. Agniveer would not be entitled to a gratuity.

She also raised a point that there is no provision for pension for Agniveers. She also referred to other countries including USA, Russia, and Israel during her arguments.

Justice Prasad said, “It is a new scheme which gives an option to a young man to get training. After that, he can go and do any job. Moreover, it is not compulsory.”

Another advocate, who has served in the army for 21 years, submitted that the period of training is short. The tenure of service is also short. What quality the force will get if training is too short.

He submitted that there is physical and arms training which requires at least one year. He also submitted that the sense of belonging develops over a period of time. The soldiers give respect and get respect over the period of time they spend in the force.

He submitted that the government did not take feedback from the unit level which operates at the ground. The government should reconsider it.

Earlier, the bench refused to put a stay on the Agnipath Scheme and said. “If petitioners get success in the case, they will get it.”

“We will not pass any stay or interim order and will hear the case finally,” added the bench.

On July 19, 2022, the Supreme Court transferred various pleas related to Agnipath Scheme to Delhi High Court.

The Supreme Court also clarified that as regards to other similar petitions challenging Agnipath Scheme pending in other various High Courts, the concerned HCs should either give an option to the petitioners to either have their petitions transferred to the Delhi HC or to keep their petitions pending with liberty to petitioners to intervene in Delhi High Court.

The top court had also requested the Delhi HC to take up the matter and dispose of it expeditiously.

“High Courts of Delhi, Kerala, Punjab and Haryana, Patna and Uttarakhand are hearing matters connected to these schemes,” noted SC.

The SC directions come after hearing advocates Kumud Lata Das and M L Sharma for petitioners and SG Tushar Mehta for Respondents.

A petition challenging the scheme stated that the announcement of the scheme has caused nationwide protests in Bihar, Uttar Pradesh, Telangana, Haryana, Uttarakhand, West Bengal and various other states due to the short-term duration of the scheme in the Indian Army for four years coupled with future uncertainties of the trained ‘Agniveers’.

A PIL in this regard also sought quashing of the Centre’s notification for the Agnipath scheme saying the scheme is “illegal and unconstitutional”.

The Union Cabinet on June 14, 2022, approved a recruitment scheme for Indian youth to serve in the three services of the Armed Forces called Agnipath and the youth selected under this scheme will be known as Agniveers. Agnipath allows patriotic and motivated youth to serve in the Armed Forces for a period of four years. The Agnipath Scheme has been designed to enable a youthful profile of the Armed Forces. (ANI)

Election Of MCD Standing Committee Members On Feb 27: Mayor Shelly

Election Of MCD Standing Committee Members On Feb 27: Mayor Shelly

After the Delhi Municipal Corporation Standing Committee election witnessed chaos on the third day, MCD Mayor Shelly Oberoi announced February 27 as the new date for the election on Friday.

“Election of members of the MCD Standing Committee will be held on February 27,” announced Oberoi amid sloganeering at the Civic Centre.
The House has been adjourned till Monday, February 27.

Meanwhile, Oberoi alleged, “Standing committee elections were held as per BJP demands. Still, they created a ruckus & came up on stage to attack me. I thank female Civil Defence personnel for saving me.

“BJP members physically assaulted AAP female members. BJP accept your defeat, she further alleged.

On Friday, Aam Aadmi Party leader Atishi alleged that the newly elected mayor Oberoi was physically assaulted by a BJP male member in the Civic Centre.

She urged the BJP to stop the “goondaism” in the Civic centre and said that BJP should accept its defeat.

While talking to ANI, Atishi said, “Today BJP showed goondaism in the Civic centre. A standing committee election was going on. When counting started BJP realised they were losing & they created a ruckus. The mayor was attacked & physically assaulted by a BJP male member.”

She further stated, “What behaviour is this? This is shameful and condemnable. The country is seeing this. BJP should accept their defeat. I request BJP to stop their goondaism. Those who have attacked the Mayor will be sent behind bars.”

Meanwhile, Aam Admi Party (AAP) Councillor Ashok Kumar Maanu collapsed at Delhi Civic Centre minutes back and alleged that the ruckus had been caused by the BJP goons.

While talking to ANI, Maanu said, “They are so shameless that they attacked even women and the Mayor. BJP goons did this.”

On the other hand, BJP leader Harish Khurana blamed Aam Admi Party for the ruckus. He said, “Election officers declare the election and say that votes declared invalid by Mayor are valid and three candidates each of AAP and BJP have won. But AAP does hooliganism here as instructed by Kejriwal. We won’t tolerate this goondaism and will approach the Court.”

On Friday, Maanu collapsed at Delhi Civic Centre as clashes broke out here between AAP and BJP councillors.

Ruckus broke out at Delhi Civic Centre once again as AAP and BJP Councillors jostled, manhandled and rained blows on each other.

This is the third day of commotion in the House.

On Friday, amid political slugfest, the voting process to elect six members of the Standing Committee of the Municipal Corporation of Delhi (MCD) took place at the Civic Center in the national capital.

Ahead of the election of six members of the MCD Standing Committee, Delhi MCD House witnessed sloganeering by Bharatiya Janata Party (BJP) councillors.

In a jolt to the Aam Aadmi Party two days after it won the polls for the mayor and deputy mayor in the MCD, Bawana councillor Pawan Sehrawat joined the BJP on Friday.

The switchover happened shortly before the polling to elect members of the MCD’s Standing Committee on Friday.

Earlier, on Thursday, the House was adjourned for the 13th time since it convened post the MCD polls in December 4, last year, after councillors of the ruling AAP and the Opposition Bharatiya Janata Party came to blows over polling to elect members of the Standing Committee. (ANI)

AAP’s Shelly Oberoi Elected Delhi Mayor

AAP’s Shelly Oberoi Elected Delhi Mayor

Aam Aadmi Party candidate Shelly Oberoi has been elected as the new mayor of Delhi after having secured 150 votes on Wednesday.

“I assure you all that I will run this House in a constitutional manner. I expect you all will maintain the dignity of the House and cooperate in its smooth functioning,” Delhi Mayor Shelly Oberoi said as soon as she was elected as the mayor.
The BJP received 116 votes in the Municipal Corporation of Delhi (MCD) polls to elect Delhi’s mayor as the previous three attempts – on January 6, January 24 and February 6, failed to elect the mayor.

“Goondaism has lost, the public has won. BJP wanted to make its own mayor by cheating. I congratulate Shelly Oberoi on her election as Delhi mayor. Next, Ale Iqbal will become the deputy mayor,” AAP MLA Saurabh Bharadwaj said.

The voting which started at around 11.30 am went on for more than 2 hours.

A total of 10 nominated MPs, 14 nominated MLAs and 241 elected councillors out of 250 voted in the mayoral election.

“The goons lost, the public won. Many congratulations to all the workers on becoming the Mayor of Aam Aadmi Party in Municipal Corporation of Delhi and once again whole hearted gratitude to the people of Delhi. Many many congratulations to the first Mayor @OberoiShelly of AAP,” Deputy Chief Minister Manish Sisodia tweeted.

The polling began with the MPs and MLAs casting their votes, followed by voting by the elected Councillors. The nominated MLAs of both parties also cast their votes, among whom 13 were from the AAP and 1 from BJP.

AAP MLA Akhilesh Pati Tripathi also cast his vote. In the last election, the presiding officer had barred Akhilesh Pati Tripathi and Sanjeev Jha from voting on the grounds that both of them were accused of corruption.

There was a need for 274 valid votes for the mayoral election. Congress has 9 Councillors who boycotted the election. In this situation, a total of 265 votes had to be cast in today’s election.

Either of the two mayoral candidates needed 134 votes to win.

The voting began at 11.30 am after the Supreme Court ruled that the Delhi Mayor election be conducted. The court also ruled that the aldermen (nominated councillors) would have no right to vote.

The election was due after Aam Aadmi Party won the MCD elections in December last year.

The last three attempts to elect the Mayor failed due to the political bickering between the Aam Aadmi Party and Bharatiya Janata Party. The civic centre met for the first time on January 6, second on January 24 and last on February 6.

In the last meeting, Presiding officer Satya Sharma of the BJP administered oath to the aldermen, the members nominated by Lt Governor Vinai Saxena before administering the oath to the elected councillors.

A plea was thereafter filed in the Supreme Court challenging the Delhi LG’s decision to permit the nominated members to vote, after which the top court on February 8 issued a notice to the LG.

Chief Minister Arvind Kejriwal also had sent a proposal to the LG to conduct elections on February 22 which was approved on February 18.

As per the order issued by the Lieutenant Governor, elections for the mayor, deputy mayor and six members of the standing committee will be held on February 22.

According to the Delhi Municipal Corporation Act, the Municipal House has to meet within a month after the conclusion of the civic polls and elect the mayor. However, the election has been stalled thrice over the dispute over the voting rights of nominated members.

The municipal elections in Delhi were held on December 4 and the results were announced on December 7. Aam Aadmi Party won 134 seats out of 250. (ANI)

Income Tax Surveys At BBC India Offices Enter Day 2

Income Tax Surveys At BBC India Offices Enter Day 2

The income tax (I-T) department on Wednesday continued its survey at the offices of the BBC in Delhi and Mumbai for the second day, sources say.

On Tuesday, the I-T department conducted a survey at BBC’s offices in Delhi and Mumbai in view of the British public broadcaster’s “deliberate non-compliance” with the Transfer Pricing Rules and its vast diversion of profits. Yesterday, the sleuths arrived at the BBC offices located at the national capital’s KG Marg and Mumbai’s Kalina Santacruz for the survey.
In the case of the BBC, sources said there has been persistent non-compliance with the above mentioned rules for years. As a result of the same, several notices have been issued to the BBC. However, the BBC has been continuously defiant and non-compliant and has significantly diverted its profits, sources said.

Sources said the above exercise, conducted by the tax authorities, is called “survey”, not search or raid as per the provisions of the Income Tax Act. Such surveys are routinely conducted and are not to be confused to be in the nature of a search/raid, said sources.

The key focus of these surveys is to look into the manipulation of prices for unauthorised benefits, including tax advantages. These surveys have been undertaken due to BBC’s persistent non-compliance of the norms, making it a repeat offender.

In this case, sources said BBC has been, “non-compliant under transfer pricing rules; persistent and deliberately violative of transfer pricing norms; and deliberately diverted a significant amount of the profits and have not followed the arm’s length arrangement in the case of allocation of profit.”

Accordingly, the surveys have been conducted with a view to investigating BBC’s violation of the Transfer Pricing Rules and its diversion of profits.

After the I-T department survey, sources in the United Kingdom government said they are monitoring the developments closely.

“We are closely monitoring reports of tax surveys conducted at the offices of the BBC in India,” UK government sources said.

Meanwhile, BBC has said it is cooperating with the income tax department, which is conducting a survey at its offices in New Delhi and Mumbai.

“The Income Tax Authorities are currently at the BBC offices in New Delhi and Mumbai and we are fully cooperating,” the BBC News Press Team said in a statement.

The development comes weeks after the BBC released a documentary on Prime Minister Narendra Modi – ‘India: The Modi Question,” which caused controversy.

The Centre had issued directions for blocking multiple YouTube videos and Twitter posts sharing links to the controversial BBC documentary on PM Modi.

The Supreme Court had on February 3 directed the central government to produce original records relating to its decision to block the BBC documentary. (ANI)

No Scope For Religion Hate Crimes In A Secular Country: SC

The Supreme Court on Monday asserted that there is no scope for hate crime on basis of religion in a secular country such as India and stressed that it has to be rooted out.

A bench of justices KM Joseph and BV Nagarathna said that there is a growing consensus around hate speech.
“There cannot be any compromise on hate speech at all,” said the bench, adding that it is only if the State acknowledges the problem of hate speech that a solution can be found.

It is the primary duty of the State to protect its citizens from any such hate crimes, the bench stressed while hearing a plea against hate crimes.

“When action is not taken against hate crimes then an atmosphere is fostered which is very dangerous and it has to be rooted out from our lives. There cannot be any compromise on hate speech at all,” it observed.

The observation of the apex court came while hearing a plea of a Muslim man who has alleged that he was assaulted and abused in the name of religion on July 4, 2021, by a “screwdriver gang” of criminals as he had boarded a car to go to Aligarh from Noida.

The petitioner Kazeem Ahmad Sherwani alleged that the police has not bothered to register any complaint of hate crime.

“If a person comes to the police and says that I was wearing a cap and my beard was pulled and abused in the name of religion and still no complaint is registered, then it is a problem,” the bench proclaimed.

Justice Joseph said that be in a minority or majority, certain rights are inherent in human beings.

“You are born into a family and raised in one. We have no choice in our religion, but we stand out as a nation. That’s the beauty, the greatness of our nation. We have to understand this,” said Justice Joseph.

The apex court asked the Uttar Pradesh government to file a detailed affidavit and posted the matter for further hearing on March 3. (ANI)
