The More They Try To Separate Us: Rahul To Wayanad People

Addressing a gathering in his parliamentary constituency for the first time after being reinstated as Lok Sabha MP, Congress leader Rahul Gandhi on Saturday hit out at the BJP saying that his relationship with people of Wayanad will become even stronger if they try to separate them.

“The BJP and the RSS do not understand what a family is. They don’t understand that the more they try to separate you and me, the closer we will become. They think that if we disqualify Rahul Gandhi, his relationship with Wayanad will break. If you disqualify Rahul Gandhi, his relationship with Wayanad will become even stronger ,” the reinstated MP said.

Rahul was reinstated as Wayanad MP last week, after the Supreme Court on August 4 stayed his conviction in the ‘Modi’ surname remark case.

Continuing his attack on Prime Minister Narendra Modi over violence-hit Manipur, the Congress leader said that rapes and murders are happening in the northeastern state but the former laughed and joked in Parliament.

The Congress MP has been launching attacks on Prime Minister Narendra Modi since the latter’s over two-hour-long speech in Parliament.

Rahul alleges that the Prime Minister spoke for 2 hours and 13 minutes in Parliament but he spoke about Manipur for only two minutes.

“There are thousands of people in Manipur who have suffered this. Someone’s house has been burnt down, someone’s sister has been raped, and someone’s brother and parents have been killed. It is as if somebody threw kerosene across Manipur and set it on fire…There is blood everywhere, there is murder everywhere, rape everywhere. That is the situation in Manipur and the Prime Minister spoke for 2 hours and 13 minutes in Parliament but he spoke on Manipur for 2 minutes. He laughed, joked. His cabinet laughed, joked…” Rahul Gandhi said.

Earlier on Friday, while addressing a press briefing in the national capital, Gandhi launched a similar attack on PM Modi.

“I heard PM Modi speaking in Parliament for about 2 hours and 13 minutes. He was cracking jokes, laughing with NDA MPs sloganeering. It does not behove a prime minister,” Rahul Gandhi said yesterday.

Emphasising that the Indian Army is capable enough to resolve the situation and bring normalcy to the state, he said, “Indian Army can stop this nonsense, drama in two days, but the PM wants Manipur to burn and does not want to extinguish the fire.”

Earlier on Thursday, PM Modi appealed to all Opposition parties to get involved in a collective effort to gain the trust of the people of Manipur and asked them not to exploit the situation in the northeastern state for political gains.

PM Modi further asked the opposition to ‘work together’ for restoring peace in Manipur and bringing normalcy there.

“I want to request the MPs of the Parliament to understand the value of this time. Come and proceed together. In this country, there have been more serious issues in the past, but we found a way to work together. Let’s come together. Take people of Manipur in confidence. Don’t take advantage of Manipur for doing politics. What has happened there in Manipur is unfortunate. Understand their pain and work for healing it. This should be our only way,” PM Modi said while replying to the debate on the no-confidence motion. (ANI)

Rahul Gandhi National Democratic Alliance (NDA) MP Smriti Irani

NDA Women MPs Demand Action Against Rahul For Making Inappropriate Gesture In House

Demanding strict action against Rahul Gandhi, National Democratic Alliance (NDA) women MPs wrote to Lok Sabha Speaker OM Birla alleging the Congress MP of making inappropriate gesture and displaying indecent behaviour in the House.

“I would like to drew your attention towards the incident in the House by Rahul Gandhi, MP from Wayanad, Kerala. The said member has behaved in an indecent manner and making inappropriate gesture towards Smriti Irani, Union Minister and Member of this House while she was addressing the House. We demand stringent action against such behaviour by the Manner, which has not only insulted the dignity women members in the House, it has also brought disrepute and lowered the dignity of this august House,” the letter read.

Bharatiya Janata Janata Party (BJP) MP Smriti Irani alleged Rahul Gandhi of ‘misbehaviour’ on the floor of the Lok Sabha.

Without naming Rahul Gandhi, Irani said, “I object to something. The one who was given the chance to speak before me displayed indecency before leaving. It is only a misogynistic man who can give a flying kiss to a Parliament which seats female members of Parliament. Such undignified conduct was never before seen in the Parliament of the country…”

“When the House of the People, where laws are made to protect the dignity of women, during the course of a session stands witness to a man’s misogyny, my question is should he be brought to task?” she added.

In a complaint, signed by more than 20 women parliamentarians, it was alleged that the Congress member made the “inappropriate gesture” towards Irani when was speaking in the House.

Meamwhile, Union Minister and Bharatiya Janata Party (BJP) leader Shobha Karandlaje also said that they have filed a complaint against Rahul Gandhi’s unparliamentary behaviour.

“This is inappropriate and indecent behaviour of a Member. Senior members are telling that this has never happened in the history of Parliament of India…What is this behaviour? What kind of a leader is he? That is why, we have complained to the Speaker to take CCTV footage of it and take action against him. This is what we have demanded,” she added. (ANI)

Rahul Gandhi Hit-And-Run Law

SC Stays Conviction Of Rahul; Says Person In Public Life Expected To Exercise Caution In Speeches

The Supreme Court on Friday stayed the conviction of Congress leader Rahul Gandhi in the criminal defamation case over the ‘Modi surname’ remark while saying that person in public life is expected to exercise caution while making public speeches.

Rahul Gandhi was sentenced to two years’ imprisonment which disqualified him as an MP under the rigours of the Representation of People Act.

After his conviction in the case, Gandhi was declared disqualified as MP from Kerala’s Wayanad on March 24 following notification of the Lok Sabha Secretariat.

A bench headed by Justice BR Gavai said no reason has been given by the trial court judge for imposing maximum sentence, and “order of conviction needs to be stayed pending final adjudication”.

The apex court while granting relief to Gandhi said the ramifications of the trial court’s order are wide.

Not only was Gandhi’s right to continue in public life affected but also that of the electorate who elected him, the bench said.

The bench also said there is no doubt that the utterances of Gandhi were “not in good taste” and “person in public life expected to exercise caution while making public speeches”.

The top court further said that Gandhi ought to have been more careful.

“Trial judge has awarded maximum sentence of two years. Except for the admonition by Supreme Court, no other reason has been granted for this by the trial judge forwarding a maximum of two years of the sentence. It is to be noted only on account of this maximum sentence, provisions of the Representation of People Act have come into play. Had the sentence been a day lesser, provisions would not have been attracted,” the bench stated in its order.

When the offence is non-cognisable, bailable, or compoundable, the trial judge is expected to give reasons for imposing maximum sentence, it added.

“Though the court has spent voluminous pages rejecting stay on conviction, these aspects are not considered in their orders,” the bench further said.

The apex court was hearing the appeal of Congress leader Rahul Gandhi against the Gujarat High Court order declining to stay Gandhi’s conviction in the case.

Appearing for Gandhi, senior advocate Abhishek Manu Singhvi told the bench that the case was non-cognisable, bailable, and compoundable offence and the offence was not against society, not kidnapping, rape, or murder. He asked how can this become an offence involving moral turpitude.

Gandhi is not a hardened criminal and there are many cases filed by BJP Karyakartas but was never any conviction, he said.

He further added that Gandhi has already missed two sessions of the Parliament.

Senior advocate Mahesh Jethmalani appearing for complainant Purnesh Modi argued Gandhi through his speech defamed the entire class, just because it matches that of the Prime Minister.

During the hearing, the bench said there is no whisper by the trial court judge about the need to grant a maximum sentence to Gandhi.

The bench asked whether the Constituency being unrepresented is a relevant factor. It observed that it’s not just one individual’s right being affected, but an entire electorate of a Constituency.

Earlier, filing an affidavit, Gandhi said that he was not guilty of in the ‘Modi surname’ remark case, and requested the Supreme Court to stay his conviction, to enable him to participate in the ongoing sittings of the Loksabha and the sessions thereafter.

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi, in his reply before the apex court, used slanderous terms such as ‘arrogant’ to describe him only because he has refused to apologise, stated Gandhi’s affidavit.

The complainant in Rahul Gandhi’s criminal defamation case in which he was convicted and sentenced to two years in jail by the Surat court over the ‘Modi surname’ remark, told the Supreme Court that the attitude of the Congress leader reveals arrogant entitlement and he doesn’t deserve any relief in form of stay on his conviction.

Gandhi has shown arrogance rather than being apologetic over his remarks and his attitude rank as insensitivity to an offended community and contempt for the law, he told the apex court.

Approaching the top court, Gandhi also sought a stay of the Gujarat High Court verdict which upheld his conviction. He said the High Court verdict “has no parallel or precedent in the jurisprudence of the law of defamation”.

He contended that it was “not only curious but extremely significant, indeed sinister, that all earlier cases, including the one regarding the present speech, were filed by members and office bearers of the ruling party”.

It was submitted that the surname ‘Modi’, in different parts of the country, encompassed different communities and sub-communities, which usually have no commonality or uniformity at all. The Modi surname belonged to various castes.

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi who simply has a ‘Modi’ surname, did not prove that he was prejudiced or damaged in any specific or personal sense, the plea filed in the apex court added.

Gandhi’s plea said, “Unprecedentedly, in a case of criminal defamation, a maximum sentence of two years has been imposed. This itself is a rarest of rare occurrence.”

The High Court on July 7 affirmed the decision of a Gujarat Sessions court, which had refused to put on hold a magisterial court order on March 23 convicting Gandhi and handing out the maximum punishment provided for criminal defamation under the Indian Penal Code.

Rejecting Gandhi’s plea, the High Court has said that he has been seeking a stay on his conviction on “absolutely non-existent grounds” and a stay on conviction is not a rule but an exception.

In March, the magisterial court convicted Gandhi for his remarks ahead of the 2019 national polls about the ‘Modi’ surname.

After the magisterial court convicted Gandhi, he approached the Sessions court, which rejected his plea for a stay on his conviction on April 20. Thereafter, he approached the High Court.

Congress leader was sentenced to two years in jail on March 23 under sections 499 and 500 (defamation) of the Indian Penal Code (IPC) in a case filed by Purnesh Modi.

Allow Me To Participate In Ongoing LS Sessions, Rahul Tells SC

Congress leader Rahul Gandhi while maintaining that he was not guilty in the ‘Modi surname’ remark case, on Wednesday requested the Supreme Court to stay his two-year conviction, enabling him to participate in the ongoing sittings of the Lok Sabha and the sessions thereafter.

At a rally in Karnataka’s Kolar in April 2019, Rahul Gandhi, in a dig at Prime Minister Narendra Modi, said, “How come all the thieves have Modi as the common surname?”.
Gandhi, filing an affidavit before the top court said that he has always maintained that he is not guilty of the offence and that the “conviction is unsustainable” and if he had to apologise and compound the offence, “he would have done it much earlier”.

The complainant, Gujarat BJP MLA Purnesh Ishwarbhai Modi, in his reply before the apex court, used slanderous terms such as ‘arrogant’ to describe him only because he has refused to apologise, stated Gandhi’s affidavit.

Using the criminal process and the consequences under the Representation of Peoples Act to “arm twist” Gandhi into apologising for no fault, is a gross abuse of the judicial process and ought not to be countenanced by this court, he added.

The affidavit further stated that Gandhi has an ‘exceptional’ case considering the offence being a trivial offence, and the irreparable harm that accrues to him as an elected MP.

“On the other hand, there is no prejudice caused at all to the complainant. It is therefore prayed for that the conviction of Gandhi be stayed, enabling him to participate in the ongoing sittings of the Lok Sabha and the sessions thereafter,” Gandhi said.

The complainant in the Rahul Gandhi’s criminal defamation case in which he was convicted and sentenced to two years in jail by the Surat court over the ‘Modi surname’ remark, on Monday told the Supreme Court that the attitude of the Congress leader reveals arrogant entitlement and he doesn’t deserve any relief in form of stay on his conviction.

Gandhi has shown arrogance rather than being apologetic over his remarks and his attitude shows insensitivity to an offended community and contempt for the law, according to the complainant.

“At the time of sentencing before the Trial Court, the Petitioner far from being repentant or contrite, displayed arrogance. He said he did not seek any mercy from the court and would not apologise for any harm to the reputation of the persons he had defamed. Subsequent to the order of conviction and sentence, in a press conference, the petitioner said that he would never apologise in this case as he was not a Savarkar, but a Gandhi,” stated the affidavit filed by complaint Purnesh Ishwarbhai Modi.

Seeking dismissal of Gandhi’s appeal, the complainant said, the Congress leader maligned a totally blameless class of persons by his reckless and malicious words.

Earlier, the apex court sought a response from the Gujarat Government and the complainant on an appeal of Gandhi challenging the Gujarat High Court order which declined to stay his conviction in the criminal defamation case.

After his conviction in the case, Gandhi was declared disqualified as MP from Kerala’s Wayanad on March 24 following notification of the Lok Sabha Secretariat.

Gandhi was sentenced to two years’ imprisonment which disqualified him as an MP under the rigours of the Representation of People Act.

Rahul Gandhi

Call Us Whatever You Want…We Are INDIA: Rahul

Congress leader Rahul Gandhi on Tuesday responded to Prime Minister Narendra Modi’s jibe at the newly-formed INDIA alliance of opposition parties and said he can call them by any name but they will “help heal Manipur” and “rebuild the idea of India” in the state which has seen ethnic violence.

Rahul Gandhi said in a tweet that parties of INDIA will bring back “love and peace” to the people of Manipur.
“Call us whatever you want, Mr. Modi. We are INDIA. We will help heal Manipur and wipe the tears of every woman and child. We will bring back love and peace for all her people. We will rebuild the idea of India in Manipur,” Gandhi said.

The Congress leaders’ remarks came after Prime Minister Narendra Modi took a jibe at  the emerging alliance of opposition parties in his remarks at the meeting of BJP Parliamentary Party on Tuesday.

Twenty-six opposition parties including Congress, which met in Bengaluru earlier this month, decided to name their alliance – INDIA (Indian National Developmental Inclusive Alliance).

BJP leader Ravi Shankar told the media after the BJP Parliamentary Party meeting that PM Modi had said in his remarks that “something on face value could be different from something that is really true”.

“PM Modi has said that Indian National Congress, East India Company was founded by a foreign national. Today people are using names like Indian Mujahideen and Indian People’s Front. Something on face value could be different from something that is really true,” Prasad said.

“We are proud of our PM. We are coming back to power in 2024,” he added.

Congress President Mallikarjun Kharge also reacted in the Rajya Sabha to PM Modi’s remarks.

“So many representatives are giving notices under 267 in Parliament. We are talking about Manipur. Manipur is burning but the Prime Minister is talking about East India Company,” Kharge said.

Sources said parties of INDIA are planning to move no-confidence motion against the BJP-led government in the Lok Sabha.

They said that the floor leaders of Congress and other like-minded parties discussed the proposal to bring a no-confidence motion in their meeting held on Tuesday morning. (ANI)

SC Issues Notice On Rahul’s Plea, Next Hearing On August 4

The Supreme Court on Friday sought a response from the Gujarat government and complainant on an appeal of Congress leader Rahul Gandhi challenging the Gujarat High Court order which declined to stay his conviction in the criminal defamation case in which he was sentenced to two years in jail by Surat court over ‘Modi surname’ remark.

A bench of Justices BR Gavai and PK Mishra, issuing notice to the government and complainant Purnesh Ishwarbhai Modi, granted ten days time to them to file their responses through affidavit. It has posted the matter on the stay of his conviction for hearing on August 4.
At the outset of the hearing, the lead judge of the bench Justice BR Gavai said his father was a politician and had been an MLA and MP with the support of the Congress party and had a close association for more than 40 years.

Justice Gavai offered to recuse from the case saying his father and brother have association with the Congress party.

“It is my duty to disclose. everyone should know. My father had been a politician and had been closely associated with Congress for more than four decades. Though he was not a Congress member, he was elected with the help of Congress. My brother is in active politics. If any party had an objection, then I would recuse,” Justice Gavai said.

However, both parties said they don’t have any objection to Justice Gavai hearing the matter.

During the brief hearing, Singhvi argued that Gandhi has already lost 111 days as an MP from the Wayanad constituency and apprehended that Election Commission may announce a bypoll soon in the constituency.

“He could not attend the last Parliament session and now stands to be out of ongoing session. Please consider granting an interim stay on conviction,” Singhvi told the bench.

“Even when we were in the Opposition, we always preached and practised positive politics. We unearthed scams of previous governments but never questioned or insulted the mandate of the people.
