Gujarat ATS Nabs Man For Fake Info Regarding Modi’s Assassination

Gujarat Anti-Terror Squad arrested a man from Uttar Pradesh’s Badaun for providing fake information on the Public Grievances Portal regarding a plot to kill Prime Minister Narendra Modi during his election rally in Jamnagar, an official said on Monday.

The arrested man was identified as Aman Saxena who was brought to Gujarat ATS for interrogation.
SL Chaudhary, Deputy SP, ATS said that the Gujarat ATS had got input on PG Portal that a girl named Tanya from Delhi is planning to kill PM Modi during the public rally in Jamnagar and is also planning a blast in Delhi Sachivalay.

“Tanya is a practising lawyer in Delhi and originally belongs from Patna. A man named Aman from Badayu is also involved and their Facebook profile was attached,” the official said.

Following the receipt of the information, a team from Gujarat ATS reached Delhi to check the input.

The team got to know that an unidentified person with a fake digital identity of Shubham Rajkumar Chhaleria had made this application on the PG portal. The team held Saxena in the process and brought him for further inspection, the Deputy SP said.

“On further enquiry, he disclosed that he had made 12 to 15 such applications with Shubham Rajkumar Chhaleria’s e-mail ID and mobile number from September 29, 2022, to 25 November 2022, regarding the killing of various national and international names, Central Sachivalay and blast during elections,” the police said.

Further investigation into the matter is underway. (ANI)

China Censors Reference To Protest Code Words, Demonstration Hotspots Like Xinjiang

Chinese censors are scrambling to scrub references to protest code words and demonstration hotspots like Xinjiang.

Chinese internet users and government censors are engaged in a cat-and-mouse game to control the narrative around the country’s anti- “zero COVID” protests, reported Al Jazeera.
By Monday, Chinese social media appeared to have scrubbed searches for protest hotspots like “Xinjiang” and “Beijing”, while posts with oblique phrases like “I saw it” – a reference to an internet user having seen a recently deleted post – were also censored.

“As the fissure widens between the lie and the truth, even what cannot be said or seen becomes immensely symbolic,” David Bandurski, co-director of the China Media Project, told Al Jazeera.

“It can punch right through the veneer. And this is what we’ve seen over the past few days. The words, ‘I saw it, marking the void in the wake of a deleted protest video, can become powerful. Or students protesting on campus can hold up blank sheets of paper and they speak volumes.”

Many posts documenting the protests have already jumped China’s Great Firewall with the help of virtual private networks (VPNs) and have been shared on popular Western platforms such as Twitter and Instagram, which are officially banned in China.

“Beijing appears to be using the same tactics of censoring Chinese social media based on keywords – however, the amount of information that is getting out past the Great Firewall is definitely noteworthy,” Stevie Zhang, the associate editor of First Draft News, a non-profit dedicated to combating online misinformation, told Al Jazeera.

Zhang said internet users were evading censors by taking screenshots of posts before they were deleted and then sharing them with each other or posting them on Western social media. In some cases, posts have made it full circle back to China via Twitter screenshots.

Other users have taken to using seemingly unrelated and uncensored phrases to express their feelings, Zhang said, using “repetitions of ‘good’, or ‘well done’, or ‘win’ as a sort of sarcastic or passive-aggressive way of highlighting the inability for Chinese people to voice any form of criticism.”

The use of euphemisms is a common tactic of Chinese netizens to evade government censors, with abbreviations and homonyms often standing in for banned words. During China’s “Me Too” movement in 2018, many internet users posted under the hashtag “rice bunny” – which when said aloud in Mandarin Chinese sounds like “me too” – after the original hashtag was banned, reported Al Jazeera.

This time, China’s censors have also taken note of how much information is circulating on Western platforms such as Twitter.

Protests began in Urumqi, the capital of the far-western Xinjiang region, on Friday following the deaths of 10 people in an apartment block fire before spreading over the weekend to major cities including Beijing, Shanghai, Nanjing, Wuhan, and Chengdu.

Meanwhile, China’s western Xinjiang region eased some COVID-19 restrictions in its capital Urumqi on Monday, after a deadly fire in the city blamed on virus controls sparked protests across the country.

People in the city of four million, some of whom have been confined to their homes for weeks on end, can travel around on buses to run errands within their home districts starting Tuesday, officials said at a press conference Monday, reported Arab News.

The protests in Urumqi erupted after footage posted on social media showed fire trucks spraying water from too far away to reach the apartment building, with internet users claiming authorities could not get closer due to pandemic barricades and cars that had been abandoned by people who had been quarantined.

Videos and photographs of the protests quickly circulated on Chinese social media platforms such as WeChat and Weibo, where they received tens of thousands of views before being deleted by government censors, reported Al Jazeera.

The acts of defiance shared online included scenes of people tearing down barricades, calling for the resignation of Chinese President Xi Jinping, and holding up blank white pieces of paper as a symbol of protest.

China’s COVID protests come as the country is grappling with its most cases yet, promoting a new wave of lockdowns and restrictions on freedom of movement in big cities, including Beijing, Shanghai, Chongqing, and Guangzhou. Health authorities reported 40,347 new infections for Sunday, a fifth straight daily record.

Residents of Urumqi, where the recent protests began, have lived under harsh restrictions since August 10, in what is believed to be China’s longest continuous lockdown.

In late March and early April, a five-day “circuit breaker” lockdown in Shanghai was extended to two months, prompting food shortages and rare displays of public discontent.

China is the last country in the world sticking to a “zero-COVID” policy aimed at stamping out flare-ups of the virus at almost any cost. The strategy, which relies on lockdowns, border controls, and mass testing, has kept cases and deaths low compared with elsewhere but inflicted serious economic and social costs. (ANI)

Irish Regulator Fines Meta 265 MN Euros Over Data Breach

Ireland’s data regulator on Monday slapped Facebook owner Meta with a 265-million-euro (USD 275 million) fine after details of more than half a billion users were leaked on a hacking website.

The penalty resulted from an investigation, started in April 2021, related to the discovery of a collated dataset of Facebook personal data that had been made available online. Facebook was also ordered to take a range of corrective measures, reported Euronews.
Meta said it had cooperated fully with the investigation by Ireland’s Data Privacy Commissioner (DPC) and made changes to its systems during the time in question, including removing the ability to scrape its features in this way using phone numbers.

Monday’s fine is the fourth that Ireland’s Data Privacy Commissioner (DPC) has levied against one of Meta’s companies. It is Meta’s lead privacy regulator within the European Union and has 13 more inquiries into the social media group outstanding.

The DPC regulates Apple, Google, Tiktok, and other technology giants due to the location of their EU headquarters in Ireland. It currently has 40 inquiries open into such firms, including the 13 involving Meta, reported Euronews.

The regulator has the power to impose fines of up to 4 percent of a company’s global revenue under the EU’s General Data Protection Regulation’s (GDPR) “One Stop Shop” regime introduced in 2018.

The DPC said mitigating factors in Monday’s decision – which had been approved by all other relevant EU regulators – included Facebook’s actions.

In September the watchdog hit its Instagram subsidiary with a record fine of 405 million euros, which Meta plans to appeal.

The Irish regulator said in a statement that other relevant EU regulators agreed with the decision issued on Monday after it shared a draft ruling with them last month under the bloc’s “one-stop shop” system of regulating large multinationals. (ANI)

Shraddha Case: Two Men With Swords Attack Police Van Carrying Aaftab

Two men with swords were detained for attacking the police van carrying Aaftab Amin Poonawalla, the accused in the Shraddha Walkar murder case, outside the Forensic Science Laboratory (FSL) office in Delhi.

The two men who attacked the police van were carrying swords and claimed to be from ‘Hindu Sena’.
Aaftab was being taken by the police after his polygraph tests were done for the day.

Earlier, the FSL Director Sanjeev Gupta told ANI that the polygraph test of Aaftab may continue tomorrow as well.

“The Expert team is conducting polygraph tests. Today’s session will be completed soon. We may need to continue the test tomorrow as well. Once our tests are completed, the Narco test will be conducted,” he said.

The polygraph test held on Sunday could not be completed, despite Aaftab being taken to the FSL office for three days.

The first session of the polygraph test on Aaftab was deferred after his “ill health”. The second session of the test, which was to be held on November 23, was also deferred after Poonawala reportedly “fell ill”. The second and third sessions were conducted on November 25 and 26 respectively.

Aaftab is accused of strangling to death his live-in partner Shraddha and chopping her body into 35 pieces. He is also alleged to have preserved the chopped body parts in a refrigerator before dumping them in forested areas in Delhi and Gurugram.

Police had earlier said Aaftab, who confessed to killing Shraddha and chopping her body into 35 pieces, was giving misleading answers to questions.

Delhi Police had submitted in court that Aaftab was giving wrong information and was misleading the investigation. (ANI)

Freedom Of Religion Doesn’t Include Fundamental Right To Convert Others To A Particular Religion: Centre To SC

The Central government on Monday told the Supreme Court that the right to freedom of religion does not include a fundamental right to convert other people to a particular religion.

It is “cognizant of the gravity and the seriousness” of the issue, said the Centre in its affidavit filed on a PIL claiming that fraudulent and deceitful religious conversion is rampant across the country.
Such issue of conversion shall be “taken up in all seriousness by the Union of India and appropriate steps shall be taken as the Central government is cognizant of the menace”, the Centre said in its affidavit.

“The right to freedom of religion certainly does not include the right to convert an individual through fraud, deception, coercion, allurement or other such means,” it said.

The central government further said that nine States over the course of the years passed enactments seeking to curb this practice. Odisha, Madhya Pradesh, Gujarat, Chhattisgarh, Jharkhand, Uttarakhand, Uttar Pradesh, Karnataka, and Haryana are the States which already have legislation in place on conversion, the affidavit added.

The affidavit stated that “such enactments are necessary for protecting cherished rights of vulnerable sections of the society including women and economically and socially backward classes.”

The right to freedom of religion, and more importantly, the right to the consciousness of all citizens of the country is an extremely cherished and valuable right that ought to be protected by the executive and the legislature, it said.

As the matter came up for hearing, a bench headed by Justice MR Shah said the issue of forced religious conversion is “very serious” and asked the Centre to file a detailed affidavit to make its stand clear.

It asked the Centre to file an affidavit with instructions from the State governments.

The bench has now posted the matter for hearing on December 5.

Earlier, the top court had remarked that forced religious conversion is a “very serious issue” and may affect the “security of the country” along with the freedom of conscience of citizens as far as religion is concerned.

It had said, “It is a very dangerous thing. Everyone has freedom of religion. What is this forceful conversion?”

The apex court was hearing a plea filed by advocate Ashwini Kumar Upadhyay claiming that fraudulent and deceitful religious conversion is rampant across the country, and that the Central government has failed to control its menace.

The plea sought directions to the Law Commission of India to prepare a report and a Bill to control “deceitful religious conversion”.

It further sought a declaration from the Court that fraudulent religious conversion and conversion by intimidation, threatening and through gifts and monetary benefits offends Articles 14, 21 and 25 of the Indian Constitution.

The PIL said, “There is not even one district which is free of religious conversion by hook and cook and the carrot and the stick.”

“If such conversions were not checked, Hindus would soon become a minority in India. Thus, the Centre was obligated to enact a country-wide law for the same,” it added.

Actor Arjun Kapoor, who has commenced shooting for his untitled film’s Delhi schedule, recently revealed how the national capital has always been tremendously lucky for his film career.

As per reports, Arjun Kapoor, Rakul Preet Singh, and Bhumi Pednekar are coming together for a romantic comedy film directed by Mudassar Aziz for which the trio has completed the London schedule.

I shot 2 States, Ki & Ka, Sandeep Aur Pinky Faraar in the national capital and all these films turned out to be some of the most special films in my filmography and gave me tremendous recognition that I’m grateful for.”

He added, “So, I’m excited to be back in Delhi to shoot my next and I hope that Delhi will add its magical touch and make this film again a stand-out one for my career in cinema.”

Arjun, who is on a strict diet as he continues his physical transformation, is looking forward to his cheat day when he can gorge on the Delhi delicacies.

Arjun said, “Since I’m very fitness-forward these days and want to achieve a certain body type soon, I won’t be able to gorge on the Delhi delicacies but I have convinced my trainer to allow me a day of cheat meals in Delhi.”

He also shared, “I am waiting for the day when I can have my Bua’s Ghar ka khana and the local chaat. I’m looking forward to this outdoor schedule in Delhi where I can relive my childhood summer holidays and enjoy my cheat and treat meal and spend time with my family here.”

Arjun and Bhumi will also be seen in director Ajay Bahl’s upcoming film ‘The Ladykiller’.

Gujarat Polls: Himanta Slams Kharge’s Tea Remarks

Assam Chief Minister Himanta Biswa Sarma on Monday said that dogs have a higher value in the Congress party in comparison to humans.

Sarma’s comment came as a reaction to Congress President Mallikarjun Kharge’s tea remark. Earlier on Sunday, Kharge stoked a controversy with his remark on Prime Minister Narendra Modi.
Kharge, while addressing a public rally at Dediapada in the tribal-dominated Narmada district of poll-bound Gujarat, said, “A person like you (PM Modi) claims to be poor. I am also poor, I am one of the untouchables. People drank your tea, nobody would’ve had my tea.”

“Then you say that you are poor and somebody abuses you. If you say it for sympathy, then people have become smarter now. If you lie once or twice, people will hear but how many times will you lie? He’s the leader of lies..,” Kharge added.

Earlier on Monday, Sarma told ANI, “Mallikarjun Kharge said, no one has tea with me. So maybe Rahul Gandhi doesn’t have tea with Kharge Ji and Congress follows such practices. Congress MP Rahul Gandhi should tweet a backdated picture in which he could be seen having tea with Mallikarjun Kharge.”

“What I feel is that dogs have a higher value in the Congress party in comparison to humans. So Mallikarjun Kharge’s comment that no one has tea with me may be partially correct,” Sarma added. Sarma addressed a press conference in Ahmedabad, the capital of the poll-bound state.

Gujarat has been a BJP stronghold for a long and the party has set its sights on returning to power for the seventh term.

In the 2017 Assembly polls, the BJP won 99 of the total 182 seats. The party has been in power in the state for the last 27 years.

However, it faces a stiff electoral challenge from the AAP, which is eyeing a big electoral footprint in the state after storming to power in Punjab.

Congress also hopes to put its best electoral foot forward to unseat the BJP.

Election Commissioners Must Be Chosen With A Broad-Based Consensus

Raghvendra Kumar, an advocate in the Supreme Court, says for a democracy to thrive, its top constitutional posts must remain immune from influence and favouritism

The recent hearings in the Supreme Court in the matter of appointments to the Election Commission have triggered a discussion about whether more caution is required in the selection of its members. Or in plain words, doubt has been cast on whether Central Election Commission is prone to favouring the political executive of the day.

In the General elections held on the last few occasions, mostly on account of the long election schedule, the ostensible leniency in not chastising the ruling party during the election campaign, and doubtful conclusions of the election results in some cases have led some political observers and the opposition to believe that the Central Election Commission is likely to get compromised if the current process of appointment by the central government continues.

The unnecessary hurry in appointing a member of the Central Election Commission has also been taken note of by the Supreme Court Bench. Therefore, bringing reforms to the Central Election Commission has become pertinent.

We might remember that the political executive also did appoint TN Seshan, JM Lyngdoh, and SY Qureshi and they earned respect for the work done during their terms. Even prior to the Seshan era, it cannot be said with certainty that the CEC was tainted and worked in the favour of political masters of the day. In fact, the Indian election system, the process of election and the function of its Election Commission both at the Central and State level has been praised and adopted by many Asian and African democracies.

Democracy survives in the minds of the people. The more transparent its functioning is the more trust it generates among its subscribers. A healthy democracy must evolve its systems, time and again to make it more transparent, accountable and robust. That alone will rid it from the dangers of opaqueness and favouritism.

What must be done is to make the Constitutional appointments immune from influence and bias of the constituents by making it broad-based consensual process. There should be openness in selection process so the appointees are insulated from influences with fixed terms of appointments without extensions and their functioning. While their financial and functional independence is important, they must be made accountable to a multi-party parliamentary disciplinary committee with appropriate penal provisions only.

The Supreme Court did suggest inclusion of the Chief Justice of India in the process of appointment of the members of the Commission. For a long-term measure a “National Commission for Appointment to Constitutional Posts” including the Judiciary as well could be a beginning in right direction. The appointment process can of course be initiated by the elected government of the day.

Let it be based in parliamentary system of ratification but the appointments must be made by a process that includes multiple political parties and prior consultation with the Chief Justice of India. Till this actually happens, it would be prudent that the functioning of all constitutional bodies including the Central Election Commission be examined by the judicial system, All possible loopholes must be plugged so that the process of governance should be free from any doubt of unfairness towards any of its stakeholders.

WB: BJP Protests Outside Assembly Over Extra Teachers’ Recruitment

The Bharatiya Janata Party (BJP) on Monday staged a protest outside the State Assembly over the extra teachers’ recruitment drive passed by the state cabinet.

West Bengal’s Leader of Opposition (LoP) Suvendu Adhikari said that the current cabinet led by Mamata Banerjee should tender their apology.

He said, “It’s a big scam. This cabinet, sworn in under the Constitution, recommended in Calcutta High Court through a cabinet note that non-qualified persons should be accommodated in recruitment. Mamata Banerjee and her cabinet should go behind the bars.”

Adhikari further said that the party had moved a motion for discussion over extra teachers’ allotment, but it was rejected.

BJP MLA Agnimitra Paul too accused the ruling party TMC and said that State Government planned that a non-qualified person who will be sacked, would be appointed to these posts.

“Excess posts were created in Education Department. State Government planned that non-qualified persons who will be sacked, will be appointed to these posts. Education Secretary revealed this before the Court. We demand that the cabinet be arrested as they’re doing corruption,” Agnimitra Paul said.

Notably, in an interim order, the Supreme Court on Friday stayed the Calcutta High Court order, directing the CBI to start an inquiry into the source of an application in connection with alleged irregularities in the appointment of teachers through the West Bengal Central School Service Commission.

A bench of Chief Justice of India DY Chandrachud and Justice Hima Kohli issued a notice to the respondent in the plea.

On November 23, a single judge of the Calcutta High Court held that prima facie, the application filed by the Commission is a ‘benami application’. The Single Judge proceeded to enquire of the counsel as to whether or not he had drafted the application.

Though a request appears to have been made before the high court to withdraw the application, it declined to allow the withdrawal on the ground that it would enquire into “who are pulling the strings from behind such application”.

The proceedings were listed thereafter at 3 pm on the same day.

At 3 pm on the same day, the files were produced before the high court in pursuance of its earlier directions. The single judge directed the CBI to commence an inquiry with regard to the source from which the application originated.

The proceedings were thereafter listed at 10.30 am November 24, on which date the principal secretary to the West Bengal government was directed to appear personally to answer some of the questions that the single judge intended to address since “the filing of such an application is clearly not the brainchild of the Commission”.

The orders of the single judge were challenged before the division bench of Calcutta HC, which dismissed the appeals.

West Bengal then moved the Supreme Court against the order of the Calcutta High Court. (ANI)
